Complaint: First complaint XXXX Now complaining again! Called XX/XX/XXXX talked to a loss mitigation representative, said loan was under ASSUMPTION since not dead can not assume, was told this last XX/XX/XXXX, have letters stating that and want loan modification, have askind also for copies of loan documents since XX/XX/XXXX then rep said email to a different department! received a letter dated XX/XX/XXXX that was in process! but nothing! RESPA stats have right to receive all signed copies of loan documents and in california modification has to be reviewed have sent more than one time, inclosed are just some of the proof and yet know one can get the modification under review when all paperwork was faxed in a timely manner! DONT LIKE COMPLAINING but nothing gets done with this company! XXXX XXXX on LOAN -- I XXXX XXXX have POWER OF ATTORNEY AND ON TITLE! ( had to refax more than 10 times )

Complaint: My mortgage have been transferred from chase to bayviewloan LLC last XX/XX/XXXX. My monthly payment with XXXX was {$420.00}, in XX/XX/XXXX i paid bayview {$420.00}, by XX/XX/XXXX bayview decided to increase the monthly payment to {$480.00}. For XX/XX/XXXX, they sent a statement {$500.00}. I call them no one seemed to have an answer on why the mortgage keeps charging. My original loan was modified on XX/XX/XXXX at 3 % for the first 5 years, 4 % XX/XX/XXXX and 4.5 % that will start XX/XX/XXXX and the woll will remain the same until the loan is paid off. The mortgage was recast last XX/XX/XXXX, XXXX canceled the pmi. Even though XXXX forwarded all the doctor to the new lender. They decided to violate the contract. I need help please.

Complaint: There were two major errors in servicing my loan. First error occured when my loan was modified about three years ago. I was left behind when the loan was not properly reconciled after the modification became complete. Then my loan was transferred to Bayview. They billed me incorrectly and then admitted they made a mistake. I have been fighting them now for a full three years trying to get them to correct their errors. They several times sent me back letters claiming they did not make an error. I hired an attorney to help me audit my loan and they found errors. After paying an attorney for over a year now, Bayview admits they made an error and they have now corrected their errors. They however, have not corrected the bad credit rating they gave me over the past 3 years. They stopped accepting payments from me many times due to these errors. They also took monies from Keep Your Home California in XX/XX/2001 and did not apply those funds until about two years later. Now my attorney has asked them for assistance in bringing my loan current and they will not call my attorney back. This game they play is not only unfair and is forcing me into foreclosure, but according to my attorney is illegal. RESPA Regulation X requires my servicer NOT to evade my requests for assistance. Bayview has evaded now for almost three years.

Complaint: My original loan was with XXXX XXXX XXXX, who transferred it to XXXX. I became very ill and underwent three XXXX last year and had missed several payments but XXXX encouraged me to apply for a loan modification. I was in the midst of completing the necessary paper work when XXXX returned my most recent two mortgage payments and notified me that my loan was transferred to Bayview Loan Servicing. This is when the real nightmare began! Bayview would not any accept payments from me. They immediately served me with a notice of default. I completed their loan modification paperwork and submitted it, only to have them time and time again send me notifications that they needed additional information. This process began in XX/XX/XXXX. The loan modification is still " in progress. '' The request I received in the mail today asks for " a copy of Estate Documents i.e. executed Last Will and Testament '' and " Copy of Trust Agreement. Must be irrevocable trust with borrower reflected as beneficiary ''! I have complete records of their correspondence along with all my responses that I sent registered mail with tracking numbers. I also have a phone log of my numerous attempts to contact them by phone. I have been shut down from accessing my account via their website. Foreclosure is scheduled for XX/XX/XXXX. I have the funds available but they will not tell me the reinstatement amount. I have made four requests via email beginning XX/XX/XXXX. I was notified ( with the foreclosure documents ) to contact their partner, XXXX XXXX XXXX XXXX of WA. Neither Bayview or XXXX XXXX XXXX will provide me with the information I need to make payment to keep my home. Bayview is the most corrupt company I have every done business with. Can you help?

Complaint: We were in the process working with XXXX on getting a loan modification. Uniform Borrower Assistance Form was sent to XXXX on XX/XX/XXXX. On XX/XX/XXXX We received a Here to Help letter from Bayview Loan Servicing, saying they understand financial circumstances may change affecting our ability to pay our mortgage and they want to offer assistance in case we are unable to catch up on missed mortgage payments. Options provided to keep our home include modify our mortgage, a Uniform Borrower Assistance Form was sent along with this letter. We did not send in any documents at all at this time. On XX/XX/XXXX we received and " official '' letter saying our mortgage loan was transferred from XXXX to Bayview. Also on XX/XX/XXXX we received a letter saying " Thank you for sending your application for Loss mitigation> " This letter confirms ore receipt of documents requested in your Initial Package Request '' ( We did not send anything ) and instructions to Submit documents. On XX/XX/XXXX Letter noting our dedicated point of contact and instructions for how to apply UBAF. And HAMP info. On XX/XX/XXXX, Letter saying they are using the UBAF documents from XX/XX/XXXX sent to XXXX and are being reviewed. On XX/XX/XXXX Letter saying Loss Mit. app is incomplete and needs form XXXX and must be submitted by XX/XX/XXXX. On XX/XX/XXXX ( before missing form was sent or received ) Letter received saying we were APPROVED FOR TRIAL MORTGAGE, the new monthly cost is XXXX ( which is lower by only XXXX ) I did call our point of contact to discuss the amount and see if we could re-file our UBAF because there was a significant change in our financial circumstances, His response was " Bayview is UNABLE to consider this request because The XXXX XXXX Flex Modification Trial Period Plan we have been approved for and currently making payments on ( we are not making any payments at this time ) offers the best available terms to us. Because the new Investor who owns this loan uses " The Waterfall Ranking Method '' and will deny any Foreclosure Prevention Options. Because our Loan has been approved for a Trial Period Plan this results in a denial for any other Foreclosure prevention Options Ranked below the option we are eligible. On XX/XX/XXXX Letter received again saying we have been approved for a Trial Plan. I called point of contact again expressing our concerns and he basically said if we do not make the first Trial Payment on or before XX/XX/XXXX Bayview will begin to FORECLOSE. On XX/XX/XXXX Letter saying Bayview " NOTICE OF DEFAULT AND INTENT TO ACCELERATE '' So it seems t us we Have No Recourse, No Options to Discuss and No Opportunity to Prevent FORECLOSURE from Bayview. IS THERE ANYTHING WE CAN DO?????

Complaint: I originally entered into a 30 year fixed mortgage with XXXX in XXXX. In XX/XX/XXXX when the mortgage meltdown was starting I was talked into a XXXX Loan that I was told I could get out by XXXX XXXX. It was a negative-am loan supposedly designed to help keep your home by just paying interest for awhile. When I realized this was a predatory loan and have not been able to get out of it I have decided to get some help. We all know what happened in XXXX and XXXX XXXXXXXX XXXX took over all the old XXXX loans and I thought they were supposed to help the people that were harmed by their loans to make it them right. In the past years they have changed servicers at least three times along with the interest rate which has been changed 5 times since I started my Chapter XXXX. I am almost ( 6 months left ) in a Chapter XXXX to be able to keep my home. In XX/XX/XXXX the newest servicer ... .Bayview Loan Servicing LLC XXXX XXXX XXXX XXXX XXXX XXXX , XXXX XXXXXXXX , Fl . XXXX ... .files a Motion for Relief of Automatic Stay and I entered into a signed stipulation between their attorney, my attorney and the bankruptcy judge in which I could pay back the arrearages, work on getting a loan modification to avoid foreclosure and be able to keep my home. I was working with XXXX XXXX, Asset Manger for Bayview Loan Servicing ( XXXX XXXX ) ) XXXX instructed me that Bayview needed me to request an appraisal for my home and that the appraisal needed to be XXXX to XXXX XXXX dollars less that the projected {$530000.00}. He said the reason was that XXXX XXXXXXXX XXXX did not want me to be able to sell it and make money on it. I personally thought that was ridiculous. Then on XX/XX/XXXX I received a couple of threatening phone messages from Bayview ( XXXX XXXX ) telling me that I have a ton of money I need to come up with or they were going to start foreclosure proceedings. I tried calling him back and he again said I need to send him a large amount of money ( didn't give me an amount ) also that he had talked with my attorney and that my attorney said he couldn't do anything then he said he would call me back and hung up. It was very weird and scary to say the least. Harassment. I notified XXXX XXXX who has never returned my call and I notified my attorney who said he has never spoken with anyone from Bayview Loan Serving. I have a partner, XXXX XXXX that can verify all of the above. His contact number is XXXX. In closing I would like to say is that all I have ever wanted was to get out of this predatory negative-am loan and into a regular fixed loan. Complaint: I have submitted several or more applications with Bay view Loan Serving LLC., a servicing loan co for my mortgage, and each time they have classified my application as incomplete, not on time, and missing. I have compiled with their request to complete the applications each time, and return to them within their time frame requested. I am still receiving replies from Bay view Loan serving that the applications are still incomplete. This has been repeated process from XX/XX/XXXX and continues to, ( XX/XX/XXXX). My mortgage balance is XXXX and I am paying a mortgage note of {$1100.00} monthly, with an interest rate of 8.3 %. I am retired, XXXX and a XXXX patented. I have borrowed from relatives in helping to complete the mortgage payment, but still behind a payment every month. I have submitted hardship letters in my behalf, to support my application for modification to Bay view Loan Servicing LLC ... Customer is assign to asset manager who state in their letters that they are available if and when needed, but the asset manager are never available. The caller is put on hold for hours and never gets to speak with the person whom he or she assigned or is asked to leave a message that is never answered.
