Complaint: I have had my mortgage with Bayview Loan Servicing , LLC, for approximately six years with good credit history, however this company was not of my own chosen, this company brought my mortgage from XXXX mortgage and with them my payment went up very high, and also doing this time i developed and continue to have health issues with XXXX for one, high bills, and paying back taxes that put me in a hardship with my finances. The first four of the six years Bayview Loan Servicing , LLC, didn't report my credit history to any of the credit bureaus with very good credit., and lately after several years they have been reporting my credit history., also during these same times I have applied for a modification loan five or more time, and have been denied five or more time, however the last modification application was fill out with the assistance from a state counselor to make sure the application was in proper order, and i still was denied the modification loan.from Bayview Loan Servicing , LLC. I am asking please, that Bayview Loan Servicing , LLC please have this inquiry, and credit history removed from my credit file because it is making it very difficult for me to acquire credit.

Complaint: Good afternoon, my name is XXXX XXXX, I'm taking this opportunity to file this complaint against Bayview loan Sevicing, LLC. I had a mortgage with XXXX XXXX, which without my consent transferred it to Bayview. Since then we are facing many problems with that Bank. From 1000 plus, we are paying more than 2000 dollars, and whomever we spoke, nothing has been done to lower our rate to the current one on the market. On XX/XX/2018, we have received a letter, which was a notice of default, for XXXX, that amount was paid in order to update the account. Even though, the bank has received all my payments, nothing has been done to update my account. I have a policy number XXXX, I purchased my own insurance and without my consent, Bayview loan went a paid my insurance in full. for those violations, I want my mortgage to be transferred back to XXXX XXXX. Complaint: I think that my home loan servicer Bayview Loan Servicing has not acted in good faith to try and assist me with neither a home loan modification, nor a hardship loan modification. Please take note that I initially requested a loan modification in XX/XX/XXXX. Bayview seemed to draw out the process, and requested more documentation at a snails pace. This initial attempt cumulated with me receiving a negative response from Bayview on XX/XX/XXXX. This was due to a my receiving a negative NPV score. On XX/XX/XXXX, I responded to the negative NPV letters, and stated that the information utilized to score my income was inaccurate, and did not correctly utilize my gross monthly income, nor did it utilize my wife 's income. I also requested an explanation of the NPV score. I attached updated and correct information to reflect our true income. I received a response letter from Bayview on XX/XX/XXXX stating that they had received my loss mitigation application. On XX/XX/XXXX, I received a credit report from Bayview showing that my credit score was XXXX, as of XX/XX/XXXX. On XX/XX/XXXX, I received a Letter from Bayview stating that my loss mitigation application was incomplete, and it requested additional documentation be provided by XX/XX/XXXX. On XX/XX/XXXX, both my wife an I received Notice of Trustee Sale letters, which stated that my home would go up for public auction on XX/XX/XXXX. The letter also contained a Notice to Property Owner about the sale. On XX/XX/XXXX I engaged a Homeowner representative to assist me with dealing with the situation. On XX/XX/XXXX-XX/XX/XXXX, I submitted an updated Uniform Applicant Assistance Form/Form 710, along with the documentation that the application called for. On XX/XX/XXXX, I received a notice of payoff demand from the XXXX XXXX. The latter gave me until XX/XX/XXXX to re-instate my loan. In the amount of {$280000.00}. I also received a mortgage statement from Bayview, with a reinstatement amount of {$47000.00} to re-instate the loan, and an accelerated amount of {$280000.00}. There are three separate amounts, and it was highly confusing. On XX/XX/XXXX, I received another letter from the XXXX XXXX, which showed a new re-instate amount of {$46000.00}. This was a fourth different amount, and added to my confusion. On XX/XX/XXXX, my home was valued at {$490000.00}. The starting auction bid was {$230000.00}. My representative, at my request was able to negotiate additional month, before my home was to be auctioned off. The new auction date was set on XX/XX/XXXX. Do to my situation, I was able to secure a loan from my 401 K, and on XX/XX/XXXX, I submitted an electronic payment directly from my bank to Bayview, in the amount of {$47000.00}. Per my mortgage statement, dated XX/XX/XXXX, my re-instatement amount due was {$47000.00}. The payment arrived prior to my receiving my XX/XX/XXXX mortgage statement. Although my payment was submitted electronically to Bayview on the XX/XX/XXXX, it does not appear to have been applied to my account until XX/XX/XXXX. I received my next statement which was due on XX/XX/XXXX. The re-instatement amount had grown to {$50000.00}. Please keep in mind that the previous reinstatement amount of {$47000.00} had already been received by Bayview, and had not been applied to my account. On XX/XX/XXXX, I electronically transmitted a payment in the amount of {$3000.00}. It appears that this payment was not applied to my account on XX/XX/XXXX. This was fully four ( 4 ) days later. this payment brought my total payments to the reinstatement amount of {$50.00}, XXXX. My account is now reinstated. In preparation for the payment that I made online, on XX/XX/XXXX, I checked my Bayview online account. As I had not gotten a response from my hardship application, I went to the hardship application page, and found that my hardship application had been denied on XX/XX/XXXX/XX/XX/XXXX. I had never received a response on the hardship application that I submitted on XX/XX/XXXX-XX/XX/XXXX. As I checked my hardship application page, it appeared that all of my documentation had been submitted, and that there was nothing amiss. Why was I denied the hardship request? I eventually found out. I had attempted to make contact with my asset manager XXXX XXXX, during the week of XX/XX/XXXX-XX/XX/XXXX, but she was out of the office and unavailable for the entire week. This was very troubling, as my payments had not been applied to my account, and I wanted to verify that my account was in fact re-instated. I was finally able to schedule a call the next week, an I eventually spoke to here on XX/XX/XXXX. I was ensured that all was up to date, my account was back in good standing. Coincidentally, I received a letter on XX/XX/XXXX, overnight XXXX. The letter was dated the day before, XX/XX/XXXX. This letter is pure fabrication, as it stated that my application request was denied because my application was incomplete, and that I did not submit all of the documents that Bayview requested. This was totally false an inaccurate. Bayview clearly was not making a good faith effort to assist me in the hardship process. They did not respond to hardship application, and they knew they had to cover their tracks. As of today, I can no longer see the hardship application tab on my online account, it shows that all of my documentation was submitted properly and that I did not receive any communication from Bayview until XX/XX/XXXX. This was obviously a clumsy attempt to cover up wrong doing on the part of Bayview. Bayview 's handling of my mortgage modification and hardship applications, were either incompetent at best, or fraudulent at worst. I have had two ( 2 ) different asset managers ( XXXX XXXX XXXX and XXXX XXXX ) working on my applications sent I initiated the process. Neither are very engaged, nor are the very communicative with me. They are difficult to make contact with. In fact, both Customer Service and Customer Relations lines, will only let you make a payment, or speak with your asset manager. This is definitely convenient for the home owner, as XXXX XXXX is rarely in the office. The home owner must leave a message or schedule a call back time. if you are on a time line to lose your home, I would think the servicer should have some additional back up for the asset managers. There handling my attempt to modify my loan appears corrupt and unlawful, and I would like it to be investigated. Fortunately for me, I had the means to recover, but lot of home owners do not. Complaint: Whom This may Concern : All three of these complaint 's are tied in together. Our home we feel was unfairly foreclosed on XX/XX/XXXX at XXXXXXXX XXXX at the XXXX County Courthouse. 1. XXXX XXXX XXXX was the cause of all this. Had they worked with us none of this would have taken place. I would have been able to keep working as a Broker paarttime and kept our payments made on our first mortgage instead of trying to move me and everyone and everything our of a home we built, loved and wanted to keep. I put the home on the market for sale in case I could not save our home fast enough, then XXXX and XXXX XXXX XXXX would get their money and we would hopefully get some of the well over {$100000.00} equity we had tied up in the house. We built in XXXX. XXXX XXXX XXXX appraisal came in at {$430000.00}. In XXXX we put a extra {$20000.00} plus my husbands labor and another builders labor into the house. In XXXX I had a local appraiser appraise the house as they once work with XXXX XXXX XXXX. They brought the house in low at {$420000.00}. XXXX at XXXX was helping us second week of XXXX to get a loan modification with XXXX XXXXXXXX since the foreclosure was stopped on XX/XX/XXXX. XXXX said she subnitted the 185 plus page documentation to XXXX in the portal on XX/XX/XXXX. The next day XXXX calls me and said they had sent the loan to Bay View Loan Servicing. I was told to work through them for a loan modification. All the while XXXX had reset the auction foreclosure date for XX/XX/XXXX. There again tying up our hands from getting a loan modification through Bay View Loan Servicing or giving us a chance to sell at market value. They killed us by advertising our home up for a starting bid of {$200000.00}. XXXX lies when they said I said there were no changes in there letter. I told them there were no changes, except I had another few closings and I still was waiting on my XXXX taxes to be completed by my bookkeeper and CPA. XXXX XXXX XXXX XXXX denied us a loan modification. They said because it was within a 37 day period of XXXX foreclosing. I DO NOT UNDERSTAND WHAT BAY VIEW SERVICING WAS DOING WITH OUR LOAN WHILE XXXX WAS FORECLOSING. XXXX XXXX XXXX IS BEHIND THIS. our family is devastated. the buyer broke into our home the next day and changed the locks. My bookkeeper was there getting my washer and dryer when they broke in the kitchen door. We have been abused. Both banks could have worked with us. i proved by keeping in contact with them monthly and sometimes weekly that we were good creditors. we paid them, fell on our luck a few months and they stole our home. We are noe out of our {$100000.00} dolaars only retirement money we had. Bay View called on the XX/XX/XXXX to say they will be in touch. i told them they foreclosed on us. Complaint: Bayview loan servicing took over my mortgage i had with XXXX since XXXX. It has been nothing but misery since they took over. I was behind 4 payments but I have paid all of them and I have my bank statement to prove bayview took the money out of my checking account. They are saying i am {$3700.00} past due, my recent payment they told me to pay to get my loan current was {$1700.00} and I paid this on XX/XX/XXXX. Bayview is saying none of the payments have been paid even though I talked to them over the phone. And I don't appreciate them charging me to ( inspect ) my for {$11.00}. They left two notes on my door telling me to contact them after I made the first two payments. Which they are lying just to come to my home. I don't appreciate them saying I haven't made any payments when my checking account will show they took out all the payments that they required for me to get the loan current. They are not going to foreclose on my own by being deceitful and dishonest about not applying my payments to my mortgage account. The employees at bayview are very rude and unprofessional well this is how people who are trying to steal from you act like. From all the complaints I read about them on their better business bureau record. Bayview isn't going to get away with being deceitful trying to take away from my home. And they are falsely reporting on my credit files that I am 60-89 days past due and my last payment was back on XX/XX/XXXX. A bayview employee got an attitude with me when i told them i made the payments. Yes i am very angry and I have a right to be angry with bayview trying to steal from me and being down right deceitful. And sending someone to my home twice after I have paid payments and lying saying they have been trying to reach me even though I have talked with them.

There have been no issues inasmuch as we have never missed or been late with a payment. But suddenly, in true form, theyve decided that our loan mod is no longer viable! No reason! If you check your database, youll see that I started reporting my findings about XXXX many years ago, and my findings were accurate inasmuch as the CFPB fined them. ( For which Ive received no restitution from their fine. ) Now Im dealing with Bayview, and here we go with their shenanigans. HELP!

Complaint: CFPP/OCC CFPB To Whom this may concern, I, XXXX XXXX had filed a complaint with the CFPB against XXXX XXXX XXXX in XXXX XXXXXXXX, XXXX. Our complaint is we were not treated fairly. We were forced to sell and then not given the time to sell our home, since if they were not going to work with us by renewing our HELOC or let us make intersest only payments through at least XX/XX/XXXX. XXXX XXXX XXXX was the one to first forced the foreclosure and XXXX XXXX ( Asset Manager ) contacted XXXX XXXXXXXX. She told me she did. I have no way to prove. XXXX XXXX XXXX from XXXX Federal Reserve office reply to my email ( from last week ) this morning. She said that I would need to contact the CFPB/OCC to get help with stopping the Auction on our home during this investigation. Our home at XXXX XXXX XXXX XXXX, XXXX, XXXX that was scheduled for foreclosure on XX/XX/XXXX is now scheduled for Auction on the XXXX County Court House Steps this Thursday on XX/XX/XXXX. PLEASE STOP OUR HOME FROM FORECLOSURE AUCTION NOW! We do not deserve this treatment, The Federal Reserve in XXXX has begun a investigation into our claim against XXXX XXXX XXXX. The attached documents have the contact information. XXXX XXXX XXXXXXXX our first lender knew I have been working very hard to sell our home because they too have refused to put even one payment on the end or restructure and refuse to refinance twice in XXXX. I was devasated as XXXX XXXX XXXXXXXX knew just like XXXX XXXX XXXX that I was working diligently to sell our home while also fighting for a chance to keep it. I told both Banks I would sell to get them there money but we needed to be treated equally as fair. We have over a {$100000.00} of equity in our home. Our only retirement money. We are XXXX and XXXX. We are fighting for our rights as a consumer to keep or home or at least be able to sell for market value in this Seller 's market. The banks are refusing to allow us through this year to sell. Both banks are guilty now of not treating us fairly as homeowners. XX/XX/XXXX. I received a letter from Bay View Loan Servicing a package to fill out for a loan modification. I contacted Bay View Loan Service Asset Management Department to tell them that I wanted the loan modification and that I had just applied through XXXX for a loan modification with XXXX. I was informed by a agent in this department that they will not grant us a loan modification because we are scheduled for foreclosure by XXXX XXXX XXXX/ ingiated by XXXX XXXX ( Asset Manager at XXXX XXXX XXXX in XXXX XXXXXXXX, XXXX . We would never have had to experience the trauma of losing our home we built and our family suffer such igonizing pain over these last two years. We are good homeowners who take pride in our home and land. We have worked extremely hard to get where we are and to keep what is rightfully ours to keep. Both banks should have been willing to work with us and made a effort to make our home affordable on a smaller income. We paid our payments. Many folks walked away through the market crash. We did not through the market crash, my XXXXXXXX XXXX and treatments and my husband XXXX all this happen, the market crash XXXX, my XXXXXXXX XXXX XX/XX/XXXX, XXXX XXXX XX/XX/XXXX, my XXXX six month treatments in the new XXXX XXXX. We just need our banks to work with us, we feel our rights have been violated as a consumer. To the banks we mean nothing as human beings and homeowners. Bayview Loan Servicing stating that the company has decided to make XXXX XXXX XXXX XXXX, ( who is primary on this loan ) to make myself XXXX XXXX XXXX ( second position ) co-equal on this loan as of XX/XX/2018. Bayview has put a {$19000.00} arrears on my credit report although I have been making consistent payments on this property for over 10 years, but there is not foreclosure on property. I hav n't received a payment coupon book in 10 years for this loan. The interest is 10 % on this loan. My loan was at 2 %, what happened? Complaint: I lost my job so my mortgage was transferred to Bayview Loan Servicing. I was working on getting back on track with a three-month trial plan that would avoid foreclosure and allow a modification. I made my first payment XX/XX/XXXX. When I called to make my second payment XX/XX/XXXX, I was told that I'd never made the first. It came out of my bank, so I had my bank look to see where it went, and it showed that Bayview put it in the wrong account. ( attached ) I also found out that because I'd " missed '' that payment, they had sent my mortgage to foreclosure. At that time, I called several times to get it fixed. An escalation " expert '' told me the only way to get anything to her was fax ( no email, which I later found was untrue. I could have emailed ). I purchased an online fax app to be able to get them what they needed. Still nothing. I did call their attorney to find that, at least, the foreclosure was frozen and nothing had moved on it. Finally, after nearly a month of calls they fixed it. Still there were issues on amounts. They supposedly now have paperwork backdating the first payment. I have since completed the three required payments, but the modification would have added 12 years to my mortgage, so I said I would rather just pay the back amount owed in increments. It's listed as about {$7000.00} but that's an issue as well. In that is about {$1800.00} or more in legal fees they paid to start the foreclosure process. A process that only happened because of their mistake. There is paperwork in their computer, I was told, that shows they backdated my " found '' payment to XX/XX/XXXX and that the foreclosure proceedings began XX/XX/XXXX. The woman I was working with agreed that this should be looked at. Two weeks later, still nothing. And now my mortgage is due again but when I called yesterday to check in and pay at least this month, I was told I need to do it through the person assigned to me. She failed to call on the appointment they gave me with her. And, I have a letter from the company saying that, since I didn't take the modification, I can either sell my house, have a pre-foreclosure sale or give them the deed to my property. Really? Because those aren't my only options. But from what I've seen in my brief online research, this company is good at forcing people into foreclosure and taking their property. So, I need this looked into. Not just for me but for the other people they may be doing this to.

Prior to Bayview 's decision regarding the loan modification I was contacted by a law firm that my home was scheduled for foreclosure sale on XX/XX/2018. Bayview through deception processed my loan modification with no formal decision and proceeded to push my home through foreclosure proceedings.
