Complaint: On Friday XX/XX/XXXX I called Bayview Loan Servicing to make a payment. There was money in a suspense account. The original payment amount is {$580.00}. In the suspense account there was {$290.00}. Bayview told me I could make {$280.00} which is the difference between the original payment amount and the suspense fund. Twice on Saturday I received a call from Bayview wanting payment and my ex husband said they called him 3 times. On Sunday I received a phone call and so did my ex husband. This has got to stop and I will call them on Monday and complain.

Complaint: I filed for a modification of my loan last year, completed the trial paymentsakeing them all, and in XX/XX/XXXX Bayview Loan Services came up with a collection on a title search that was never found before of me owing back child support. I gave them the judgement by a iowa judge stating I dont owe, they didnt accept the court order, I filed for a new modification, and requested a reconsideration of the first, I submitted all docs that they requested and they have dragged there feet at every turn, not returning calls, request for information at all, I filled a complaint with CFPB just over a week ago, after this I got a call from my old account manager that a new one was assigned, and the same thing as happens with ththe new account manager, not returning calls, calling at times that when I have told them I was working and so on. Yesterday I have receive the first corespondents since I have filed, only after the CFPB complaint, and the letter contradicts each other, asking for information that I have already given them, and they still intend on selling the house on the XX/XX/XXXX without giving me due process under the modification law.

Complaint: Received 90 Demand letter dated XX/XX/XXXX while in active bankruptcy # XXXX. Contacted BayView Loan Servicing regarding mortgage loan # XXXX status. BayView Loan servicing did confirm status of account and could not explain why i am receiving phone calls and active attempts to collect debt. I sent in a formal dispute but to this date activity continues.
Next, mortgage transferred from XXXX to Bayview on or about XX/XX/XXXX. There are at least 2 missing payments and escrows have been overprojected over 1/6 above escrow pad. total Escrow balance they claim i owe is {$4900.00}.
Finally, i contacted BayView Loan Servicing and was informed that BayView, in fact, does not have an escrow account set up for my mortgage when, in fact, i signed loan paperwork authorizing escrows with XXXX years ago. Until now, i've always had an active escrow account for XXXX XXXX XXXX XXXX, MA XXXX, my primary residence.

Complaint: I have been trying to get a loan modification for a year. Two separate and incorrect appraisals were performed which indicated my home was worth much more than it actually is worth. After disputing this over the course of several months, a correct appraisal was performed. I resent all the paperwork necessary for a loan modification and was told my application was being considered. That information was given to me on XX/XX/XXXX.by my assigned asset manager. I continued to try to make contact with the bank, leaving messages each time but never got a phone call back. Finally on XX/XX/XXXX I received a message that my primary contact was no longer with the company and I was given another contact. Again I had reached out but we kept playing " phone tag '' On XX/XX/XXXX I finally spoke to yet another representative assigned to my file. From the conversation, it sounded as though my file was lost or somehow unattended. but now the file would be " escalated ''. I received a letter from the bank requesting items that don't exist and have been trying to reach the new representative to try to clarify exactly what they need to move my application along. I have left 4 voicemails over the last couple of days. I left specific information on when I could be reached since we are in different time zones. As I am on the West Coast, I said I could not be available until XXXX PST./ XXXX EST. Instead he left a message at XXXX PST. I am really concerned this is their " strategy '' to avoid working on my file. They have made themselves almost completely unavailable to me. As I have a deadline of when I need to submit the remaining paperwork and documents I am very concerned that I can not reach anyone at the bank. From the outset, this bank has made mistakes on my file or have been obstructionist.

Complaint: I started my loan modification process with XXXX XXXX XXXX in XX/XX/XXXX. I thought I was nearing the end of the process and near a decision on my request when my loan was sold to Bayview Loan Servicing. Ultimately the process had to be restarted and I've been working on that for more than a year. Through this reapplication and review period I've been trying to establish how many payments I've missed. After much back and forth, I finally got something from Bayview. While I agree with the payments missed with Bayview, they show I've missed payments when my loan was with XXXX XXXX XXXX. I am still disputing the validity of debt that Bayview says I have with the previous servicer of my loan ( XXXX XXXX XXXX ) It does not agree with my records at all.. Meanwhile I've been trying to make regular payments and have been in regular contact with the asset manager at Bayview. In this past week I have been trying to get in contact with him to make another payment. I have been attempting to reach him by phone and by email. Finally after days of trying I got a message the phone number was no longer in service and my email was returned as undeliverable. Finally I was able to get through to someone at Bayview only to find out my file as assigned to another asset manager so I could successfully make a payment on time. I have not gotten any correspondence letting me know about this change of personel. I am frustrated by their lack of attention and customer service.

I have tried to correct challenge directly with tax accessor office multiple times. The tax roll confirms payments are coming from Bayview however credit is going to wrong person and address. Complaint: Bayview Loan Servicing is consistently sending me letters that I am default in my mortgage payments and sending me statements that do not show accurate payments to my loan account. I am continually getting letters indicating that they have representatives available to get me appropriate counseling for my financial troubles, which I've never had with my mortgage companies. Recently, I received two certified notices, one addressed to my beloved deceased mother titled " NOTICE OF DEFAULT AND INTENT TO ACCELERATE '' dated XX/XX/XXXX. The second notice was sent to me, see attached copies. Since XXXX, I have never defaulted on any payment for my mortgage and always paid on a timely basis. I have had to resort to sending my monthly payment by certified mail with the USPS so that these payments may be traceable. I have all the documentation necessary to bring a formal complaint against Bayview Loan Servicing.
The unprofessional tactics have caused me much distress. I have on many occasions called their offices to resolve this ongoing harassment. I have even advised them that I would retain legal counsel if this unfair treatment did not stop. Therefore, I am appealing to your agency to investigate Bayview Loan Servicing for the complaint herewith formally submitted.

Complaint: I had a modification with Bayview Loan Servicing, I completed the trial payment period making all payments on time. As I was waiting on them to convert the mortgage to a conventional loan they did a title search were they found a lean for child support. This Lean is not valid and was not found by other title searches done on this property, or other mortgages that I have had. I even have a court order stating that I didn't owe child support, which they said did not prove anything. Bayview also will not return phone calls, or even make contacts with me about my modification. I have also received a letter stating that they are reconsidering my old modification based on the court document, and a decision was to be made by XX/XX/XXXX. As of today XX/XX/2018 there has been no decision. I believe that they are using stall tactics to take my house, and violating the modification law. I have also filed a complaint with XXXX XXXX pertaining to Bayview.

Complaint: XXXX XXXX XXXX and Bayview Loan Servicing is attempting to foreclose on my home with a fraudulent assignment transfer. Section 201 of the pooling and servings agreement states that all assignments and transfers had to be conveyed before the cut off date of the trust filed with the United States Securities Exchange. I contacted Bayview loan, I stressed my concerns and disputes they stopped the foreclosure sale, and told me that they would be sending a workout package, and I have not received. We made a phone to the case manager, but my calls have not been returned. I filed an affidavit of Fraud by an Expert XXXX XXXX XXXX in XXXX Superior Court XX/XX/XXXX on this fraudulent assignment that being used to conduct this foreclosure. I also revoked the power of attorney that i signed XX/XX/XXXX. I removed XXXX XXXX XXXX XXXX from having the right to signs attorney in fact for me, and everything is recorded in XXXX Co Superior Court.

Complaint: On XX/XX/XXXX, I provided a cashiers check in the full amount of endebtedness outstanding of {$62000.00} payable to Bayview Loan Servicing LLC to XXXX XXXX XXXX XXXX to stop a trustee sale of the property at XXXX XXXX XXXX XXXX XXXX, Idaho XXXX that I received by deed from the prior bankrupt owner as part of a Bankruptcy Court ordered settlement of my judgments against the prior bankrupt owner.
Because I paid off the entire loan, Bayview should have recorded a release of their deed of trust.
In XX/XX/XXXX, I am attempting to refinance my property, and title shows that the deed of trust has never been released.
My title company has been contacting Bayview for months with no results.
Can CFPB get Bayview to release the paid off deed of trust?

Complaint: I submitted a complaint earlier and after waiting over a month I got a response and talked with a XXXX XXXX XXXX and he informed me that Bayview screwed up the repayment plan. I was then told on the XX/XX/XXXX that they had put a response on the Vice Presidents desk who was out of the Country probably conducting more illegal business for Bayview and that a decision to waive a payment and bring the account current was going to be done. Then two days later I get a Notice of Default and Intent to Accelerate notice in the mail after XXXX told me that since Bayview screwed up the figures and breached the contract. Bayview is nothing more than a fraud and illegal business practice and maybe somebody at this company should advise the Government to overtake this loan company and get people in prison and correct the problems.
