Complaint: After questioning the validity of the mortgage debt since they were not shown as active on my MIN number recorded by MERS ( Mortgage Electronic Recording Services ), XXXX could not explain why they were inactive on my NOTE and sold the claimed debt to Bayview Loan Servicing LLC on XX/XX/XXXX. Current MERS search reveals that XXXX was inactive on my NOTE MIN number since XX/XX/XXXX ( See attached document ).
Bayview Loan Servicing LLC has been trying to get personal information from me but I have insisted that they validate this debt. They sent me a packet filled with old statements, photocopy of the NOTE ( which they do not show up as servicer of the claimed debt when I searched the MIN number on the NOTE on MERS ). Bayview has sent me letter of intent to accelerate foreclosure when they are not able to validate this claimed debt. I need them to validate this debt by providing a NOTE that shows them as a servicer of my MIN number and a Bill to the said account so as to confirm the default.

Complaint: I have a complaint against XXXX XXXX, XXXX XXXX XXXX XXXX my original loan was with XXXX until they were indicted been sold off to XXXX XXXX XXXX who promised me a modification made me go into default and then while I was in XXXX they foreclosed on my property this unaccredited service or XXXX XXXX based out of XXXX what is going on here. I am in litigation and I need assistance Does this agency really protect the consumer. I tried to modify my loan in XXXX What does property in XXXX and put a ton of money into it. They purposely did not want to modify my loan. To collect fees from the Fed. There is a case of XXXX County court the property is XXXX XXXX XXXX XXXX XXXX XXXX mass I have been obliterated by these banks please assist as I may have to go to the press for this entire event, this is ruining our socioeconomics in the country running our children and our economics with unfair play. Please assist XXXX XXXX XXXX. A law firm called XXXX XXXX XXXX XXXX based out of XXXX illegally foreclosed on my property on XXXX XXXX put it on auction and illegally sold it off without proper notice and jurisdiction of the Commonwealth of Massachusetts. Supposedly the new owner never closed he came to my door and told me he bought my house online. I have no Trust passing signs on my property and yet he still knocked on my door looking in my windows I filed a complaint with the police department. I am suing the servicer the bank and the attorney that represented the bank or an accredited service are based out of XXXX Florida XXXX XXXX who I never heard of Ive been paying my mortgage since XXXX taxes insurance maintenance this is got to stop please assist

Complaint: Dear Bayview I appreciate you assisting me with tax accessor office. Unfortunately the tax information is not corrected in tax accessor records therefore updating mailing address is impossible.
It appears to be an attempt to steal my home. There is no record in XXXX XXXX XXXX ( called today ) file that anyone filed a claim or followed procedure regarding my Condominium Rider.
I was in bankruptcy in 2009 when my address was added to a lawsuit I was not a party of. The court corrected/void documents which no longer affect title.
As soon as another agency/third party completes investigation and confirm my ownership a new story or letters do starts all over again.

Complaint: My home is up for a foreclosure sale the XXXX Tuesday in XX/XX/2018. The assignment that being used to foreclose was created after the cut off date of the alleged trust that claiming to have Power of Attorney. I revoked the power of attorney that was given to the XXXX XXXX with the Borrowers Waiver of Rights in the XXXX County Courts. The assignment is robo signed and fraudulent.

Complaint: So in XX/XX/2018 I received Loan Modification by XXXX XXXX XXXX to sign the modification, and to bring the account current. So I accepted the modification and made the first three trial payments on time. In beginning of this month, they sent me another modification document to sign which increased the interest rate from 4 % to 5.62 %. And, also increasing my monthly payments from $ XXXX to $ XXXX, and when they tried to send me the loan modification document they tried to backdate the dates which mentioned the loan modification was taken place in XXXX of 2018. XXXX is claiming that it was a clerical error on their part but it is clearly evident it was not through out the document.
Furthermore, they are trying to increase my interest rate so I owe them money from they months I originally signed the paperwork. They have to honor the modification which was originally signed in XXXX.

Complaint: Bayview took over the servicing on our mortgage that we are behind on. We had an attorney that we hired to help us obtain a loan modification since our payments had increased. We were in a hardship situation due to the death of the primary supporter of the residence who was on the mortgage. Our attorney told us in XX/XX/2018, that we needed to file for bankruptcy to help get the mortgage modified. However, the attorney was incorrect and the bankruptcy court reprimanded him and dismissed the bankruptcy. On XX/XX/2018, we received NOTICE OF TRUSTEES FORECLOSURE SALE set for XX/XX/2018. We contacted Bayview to explain the situation with the attorney and that we would like to have a modification and keep our home. They instructed us to submit a Hardship Application. They said that they needed the copy of the death certificate and will so they could speak to us. I submitted those items immediately and received a notice on XX/XX/2018 from Bayview thanking us for submitting the application for loss mitigation. On XX/XX/2018, we submitted a Hardship application with all financial information that Bayview had requested. On XX/XX/2018, Bayview sent a letter thanking us again for sending the application for loss mitigation saying that within 30 days of their receipt of documentation, they will provide us with a written decision regarding our eligibility for an assistance program. On XX/XX/2018, Bayview sent another letter stating they had received the request for assistance from us, but were unable to consider this request because the submission date was too close to the proximity to the scheduled foreclosure date. I then contacted our loss mitigation representative, XXXX XXXX XXXX who told me that there was nothing we could do and that Bayview will not consider our application because we were within 37 days to the sale date. I pleaded with him for any help, including a short sale, deed in lieu of foreclosure, anything except the actual foreclosure. He said absolutely there were no options for us. On XX/XX/2018, we were informed by a private third party company, that our home WAS NOT LISTED FOR FORECLOSED ON XX/XX/2018. Subsequently, we have now learned that the actual posting date for foreclosure is XX/XX/2018, which is more than 37 days since the Hardship Application was submitted to Bayview. We have never heard back from Bayview again nor any attorney representing them. Our application should be reviewed and considered since we did submit it within the time frame Bayview requires. We were never given any rights to appeal their decision. We were given NO options or advice on how to proceed. We are upside down on our home due to structural foundation problem and hail damaged roof. We would like to keep our home and want to bring our account current, but need Bayview to help us.

Complaint: I started this loan with XXXX XXXX in 2003 was having problems with payments so I did some deferments with the thought that they were put on the back of the loan is was then sold to XXXX now I'm with babies and it's at the end of mortgage in XXXX and I still have a XXXX balance what can I do and does XXXX XXXX owe me any money with that law suite.My understanding wasXXXX a month for 161 months which I think was enough please help! Complaint: In XX/XX/2018, I applied for a loan modification with my servicer Bayview Loan Servicing. I was advised after the paperwork was submitted that the " single point of contact '' or " relationship manager '' had changed and therefore I had to resubmit all of the paperwork. By the time I was advised of this, and the paperwork was resent ( XX/XX/2018 ) I was advised that my request for a loan modification could not be reviewed as they ( Bayview ) had set a foreclosure sale date for XX/XX/2018. Although the documents were resubmitted again last week ( XX/XX/2018 ), I fear that no one will acknowledge receipt of the documents nor review my request.
I feel I have stable enough income to pursue a loan modification, and I am even willing to sell the property should a loan modification not work out. I am, however, upset that Bayview will not work with me to try to keep my home or work out a solution when I have been very transparent with them about my hardship and have complied with any/all requests for documents.
