Debt is not mine
Complaint: For several years now I have been getting collection calls for XXXX XXXX. I have repeatedly told the collection firms that I am not XXXX XXXX and to stop calling. The calls stop for awhile and then start up again. I have had calls for XXXX XXXX as well.
The current firm has called me and now sent me a letter which I have attached. I am tired of playing this game with these folks.

Trouble with how payments are handled
Complaint: I started being garnished from allied for my student loans I was never notified by them nor my employer that this was happening until I recived my check stub and noticed this, I have spent countless hours on the phone with them due to I should have been exempt from this happening, my employer stated they needed something from them, they stated they needed something from my employer, in an attempt to call once again the lady I spoke with at allied stated my account was closed with them on XXXX XXXX and refused to give me any information on when the last papyment was recived or how much they collected, my checks are still being garnished from this company, they refered me to XXXX, and tbey refered me to another company ... So this company did not notify me of any garnishment to begin with so I did not have the appropriate time to fill out the paperwork I needed to to avoid garnishment but is also still collecting money for an account they dont have? I just want more information and tge money ive paid to be reimbursed or something, I dont know how a company can request money with oit notification let alone still vollect it from my payroll if they dont have an account for me!

Debt is not mine
Complaint: On XXXX XXXX, 2016, I received a letter from Allied Interstate LLC a debt collection company attempted to collect an debt unknown to me in the amount of {$48000.00}, plus {$140000.00} in interest. The alleged debt total was stated to be {$63000.00}.
This is an outrage as I do not owe anyone this debt. The letter says that the " debt due is a charge-off '' of {$48000.00}.
The original Creditor is stated to be XXXX. The Creditor is stated to be XXXX. The Account Number for Allied Interstate is listed as # XXXX. I have not had any business dealings with any of the above referenced entities.
In my letter to Allied Interstate LLC, dated XXXX XXXX, 2016, I disputed all aspects of the alleged debt and the authority of Allied Interstate to pursue any action of any sort against me.
I submit that this activity on the part of Allied Interstate is a violation of the Fair Debt Collection Practices Act, 15 USC 1692, and other consumer protection laws as well. They are attempting to collect a debt that is not mine. They are trying to collect some kind of non-existent debt from a securities " Trust '' of some kind - it appears.
I also believe that they are threatening some kind of legal action, i.e., " If a creditor or debt collector receives a money judgment against you in court, state and federal laws may prevent the following types of income from being taken to pay the debt : ''. It is my understanding that these types of companies try to initiate lawsuits without properly serving people with the required notices.
Allied Interstate LLC also states that, " Your creditor or debt collector believes that the legal time limit ( statute of limitations ) for suing you to collect this debt may have expired. It is a violation of the Fair Debt Collection Practices Act, 15 USC 1692 XXXX to sue to collect on a debt for which the statute of limitations has expired. '' EXPIRED!!!

Debt resulted from identity theft
Complaint: Allied Interstate made debt collection calls to me after verifying they received a faxed cease and desist by e-mail. Additionally, iQor, a company not licensed to collect debts in Florida, contacted me to recover money. They blatantly violate the TCPA, FDCPA, and FCCPA. Additionally, XXXX recalled the debt because it never existed to begin with.

Right to dispute notice not received
Complaint: Allied Interstate , Inc. has repeatedly attempted to collect on a debt which they have no proof of validity. First judgement was vacated court file number XXXX. Now comes back with no proof of debt and wants money again. Allied Interstate, Inc. was fined in XXXX XXXX for using these same tactics. Complaint was in XXXX and CFPB sent letter that Allied Interstate never did respond. Company is a scam. Illegal judgement needs to be removed or I will file a federal complaint with the FTC.

Can't get flexible payment options
Complaint: I am still somewhat confused as to why I would have to pay so much considering I am currently a XXXX in " XXXX '' status ( XXXX ). I have not received any documentation stating whether or not I will be hired for the XX/XX/XXXX-XX/XX/XXXX school year.
SO WHAT HAPPENS IF I AM WITHOUT A JOB?
I have barely worked between XX/XX/XXXX and XX/XX/XXXX and I am currently homeless staying with a relative 's home. So I can be kicked out on the grounds of " at will '' laws at any moment.
Are there any amnesty options/periods afforded to people such as myself that are in dire straits financially?
I am also confused about why when interviewed I am asked about what I am supposed to make annually when I have not yet made this amount nor is my job promised for the following year.
According to my XXXX for XX/XX/XXXX, I barely made XXXX.
So should n't this paperwork be drawn up on the bases of my true financial reality, not the guidelines that are coerced upon me by Allied Interstate?
I raise these issues because I have to finish courses in order to keep my employment with XXXX XXXX XXXX XXXX and this program places me in jeopardy because the money you are requesting impedes upon available funding to pay for the courses needed to retain the job and start paying you in the coming months.
I am intent on loan rehabilitation but what is the point of starting this program if the money you take from me each month will destroy my efforts to secure my job for the long-term. This big picture detail needs to be factored into the loan rehabilitation process as usually people in my position will have student loan people and IRS coming for money if they have been unemployed for many years.
What 's worse is that the interest in all of these organization continue to rise while the job opportunities among employers offering a salaries sufficient enough to meet such demands are sparse.
So while I start my complaint with your organization, I will also like this to be shared with the proper people within the house and senate so that they get a more realistic idea of how bad the student loan crisis continues to be. It 's not like I am a criminal. The education and XXXX XXXX I hold is not living up to the steady and gainful employment pretext under which it was sold to me. So I also believe that the student loan crisis is part of a larger fraud against people like myself born into poverty. At this point I would rather give the XXXX XXXX back than to pay XXXX + while the job market shrinks after the big crash in XXXX.
I would like : Allied Interstate to postpone this until I have an actual job Re-do my monthly loan amount based on what I actually earned in XXXX, about XXXX, not the projected cost of XXXX-XXXX.
I would like payments to start after I pay for the schooling necessary to keep the job. If I ca n't keep the job because they are draining me financially, no one wins because I go back into default status and look for a job all over again.
The reason I am certain of this is because this is what happened in XX/XX/XXXX-XX/XX/XXXX when I worked in another district and as a result I did n't get re-hired. So i am complaining so that hopefully you can rescue me from this loop of greed that the creditor keep inflicting upon me.
Thank you.
I have provided you with all of the documentation that I could find. If I need to order any other documents, let me know and I will do so.
Thank you for your patience and understanding while I try and finish a busy year teaching while attempting to recover from default and transition into loan forgiveness, if at all possible.
