Complaint: American Express XXXX The basis for my dispute is American Express was required to notify me prior to XX/XX/XXXX, or no later than 30 days after American Express failed to notify me about reporting derogatory info. to XXXX, XXXX, and XXXX In section 603 ( p ) 15 U.S.C. ss 168s-2 ( a ) ( 7 ) ( A ) ( I ) ; The notice required under subparagraph ( A ) shall be provided to the customer prior to, or no later than 30 days after XX/XX/XXXX, furnishing the negative derogatory 30, 60,90,120, information to a consumer reporting agency described in section 603 ( p ), 15 U.S.C. ss 1681s-2 ( a ) ( 7 ) ( B ) ( I ) .Plus broke commercial law under UCC 9.501 that all notices were timely and properly given bydated certified mail receipt. They were not met. I asked for documentation & received no response.
Also, American Express " failed to give me my " Mini-Miranda '' five days prior to placing this derogatory item on all of my credit reports, per Section 807 ( 11 ) & FDCPA 809, which is {$1000.00} per violation and the state of TX allows treble damages.
Under 809. Validations of date and Mini-Mirandi under Section 807 ( 1 ) American Express failed to send me my initial communication before placing this alleged derogatory 30, 60,90,120 status on my credit reports further violating the FCRA, I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to {$2500.00} and can be enforced by the FTC, and that my state attorney general can also enforce this with a {$1000.00} penalty as well.

Complaint: American Express Blue Bird is unlawfully holding a cancelled cruise ticket as a " merchant review ''. XXXX XXXX XXXX has physically sent XXXX the proper amount of money to return to my card account. In the card holder agreement it reads as this under " merchandise returning merchandise '' : " If you wish to return any merchandise purchased with a Bluebird Account, Bluebird Card, Family Account or Family Account Card, you will be subject to the merchant 's return policies. If the merchant agrees to issue a credit, such credit may take as long as seven ( 7 ) days or longer to post and be reflected as Available Funds. In the event credit is issued on a return of merchandise not originally purchased with your Bluebird Account, Bluebird Card, Family Account or Family Account Card, such credit ( s ) may be treated as an invalid transaction and can result in suspension and/or closure of your Bluebird Account, Bluebird Card, Family Account or Family Account Card, as well as such credit ( s ) being deducted from your Bluebird Account, Bluebird Card, Family Account or Family Account Card and sent back to the merchant of record. If you return merchandise that, when originally purchased, was subject to an offer or other promotion that resulted in a credit to your Bluebird Account or Family Account, any return of such merchandise will result in the credits being deducted from your Account or Family Account. '' On XXXX I cancelled a cruise ticket through XXXX XXXX line. The refund was {$120.00}. On XXXX I made the same payment amount to XXXX. In the card holder agreement listed above, it references " merchandise ''. XXXX XXXX line sent me no " merchandise '' on XXXX or any time there after previous to the cancellation. XXXX claims in the XXXX plus calls I have made to their customer service line since XXXX, that the policy is strictly enforced as stated in the agreement. XXXX has failed to provide me with a list of " merchandise '' that was purchased on XXXX from XXXX XXXX Lines. Further more the card holder agreement states : " The XXXX Card ( and each Family Account Card ) is a prepaid payment device which, among other uses, may be used to pay for goods and services at bricks-and-mortar and online retailers and other merchants that accept American Express Cards, both within and outside the XXXX, and to obtain cash from ATMs that permit American Express transactions within the United States and XXXX XXXX, in each case subject to the terms and conditions of this Agreement. Transactions conducted using a Bluebird Card will be funded from and to the extent of Available Funds in your Bluebird Account, and transactions conducted using a Family Account Card will be funded from and to the extent of Available Funds in the relevant Family Account or as otherwise provided in this Agreement. Where applicable, present the Card to the merchant at the time of payment and sign the merchant 's receipt with the same signature you used when you signed the back of the Card. The Card can also be used to make purchases over the internet, by mail order, or by telephone. If you experience any difficulty making a purchase with the Card, please call Customer Service for assistance. You agree to use the Card only at merchants that accept American Express Cards in accordance with the terms and conditions of this Agreement and only for lawful purposes. The Card may be used to make a final payment in respect of a car or other rental, but may not be able to be used to make a car rental reservation, a hotel reservation, or other reservation or deposit. Merchant categories are determined by merchants and other parties, and you agree to hold us harmless for any transactions that occur as a result of inaccuracies in merchant classification. Cards may not be used for any type of illegal activity or prohibited sale or gambling or as otherwise prohibited by this Agreement, and you agree not to engage in any such illegal or prohibited activity when you use ( or allow others to use XXXX your Account or XXXX Account with a Card. See Section 19 for a list of activities which are prohibited under this Agreement. '' Note where it states : '' The Card may be used to make a final payment in respect of a car or " other rental '', but may not be able to be used to make a car rental reservation, a hotel reservation, or other reservation or deposit. " ( the words " other reservation '' do not specify that a dinner reservation, airline reservation, or cruise reservation can not be made. " Other '' has no clear definition, but car and hotel are " specified ''. ) On XXXX the CS rep stated that a cruise is considered a " commodity '' ( Paying for services ) The agreement allows for a card holder to pay on " other rentals ''. On a cruise a room is paid for or " rented '' as a service. Cancellation on this type of transaction is not considered a " merchandise return ''. The card holder agreement does not reflect the word " commodity '' anywhere within it. Conclusion : American Express stated that ALL refund transactions are subject to a 7 day hold no matter what via the phone conversations. In XXXX XXXX I had 4 actual " merchandise '' returns ranging from {$1.00} up to {$89.00} that were NOT held for 7 days or longer for review. In reviewing the card holder agreement it is not expressly written that it " will '' take 7 days to make funds available. It clearly states on " merchandise returns '' only that it " MAY '' take up to 7 days or longer. In this case " merchandise '' was NOT returned. A cancellation of a service occurred which XXXX allows under its agreement. No reference is made in conjunction with this type of return anywhere in the card holder agreement. XXXX does not list any " reasonable '' reason that any " merchandise return XXXX XXXX ) '' are subject to " holding ''. XXXX has illegally withheld monies from my access against its own cardholder agreement. I have requested that the funds be made at the conclusion of the business day XXXX. American Express has failed to release the {$120.00} as of the date of this complaint.

Complaint: On XXXX/XXXX/XXXX at approximately XXXX pm I went to XXXX XXXX XXXX ATM. I requested XXXX dollars from my American express sever account. The ATM started processing my request. The machine made sounds of counting the money. And the screen stated " please take your cash '' but no cash was there to take it continue to make the same noises of counting cash and after a minute the machine stated this transaction has been cancelled and no money was given. No receipt was given and the machine went back to the original setting. So I accessed my account via my mobile app to check my balance and it shown the XXXX withdraw. I tried to access my balance using the ATM and it would not give me a balance. I tried accessing another transaction and was not successful. As I was at the machine I called American express and spoke to a representative they filed a dispute of the transaction and told me I would get a second email in approximately 24 to 48 hours requesting additional information. On Monday XXXX/XXXX/XXXX I called the Branch spoke to XXXX the XXXX XXXX who informed me that he could not give me any information concerning the ATM. And I need to file my dispute with my bank ( American Express ). On XXXX/XXXX/XXXX at XXXX pm I received an 2nd email from American express with the dispute form and instruction on responding through an encrypted email. I followed the instructions and responded back to them. On XXXX/XXXX/XXXX at XXXX I received a Email from American express that the completed the review and determined no credit was due. And the ATM provider confirmed the funds were dispensed and if I wanted a copy of the documents that was used I need to contact them ( American express ) I called them on XXXX/XXXX/XXXX at approximately XXXX am. I requested the documents and also requested to reopen my dispute. I never received those documents but they did reopen my dispute. I received the open dispute email on XXXX/XXXX/XXXX at XXXX am. I received an email on XXXX/XXXX/XXXX atXXXX am stating that they are in the process of reviewing my claim and if they need additional information the will contact me. On XXXX/XXXX/XXXX at XXXX stating they completed there investigation of our dispute. But in the email it states that they sent me an email on XXXX/XXXX/XXXX and we requested additional information within a specified time frame and you did not submit it and they need additional time to complete their investigation which can take up to an additional 30 days. I called American Express spoke to a representative and he explained nothing just that he was documenting all of this and would be sending this to the dispute team via email. I requested once again for the documents showing I got the money. He stated he would make the request also. He also stated that my dispute was still open.

Complaint: I have contacted American Express on numerous occasions to informed American Express representatives that Im a victim of identity theft and I never applied for an American Express credit card account. Yet, lAmerican Express continues to hold me liable for fraudulent transactions of {$12000.00} on American Express account ending in # : XXXX. I contacted my 2 U.S. Senators of Arizona. I got in contact with U.S. Senator XXXX XXXX and XXXX XXXX, and Senator XXXX and Senator XXXX called me back and informed me they will look into the matter for me, contact American Express and have American Express delete the fraudulent account, charges and my personal information from their database and possibly call senate hearings, because they have received similar complaints about American Express from other constituents in their district.

Complaint: A few months ago, I called American Express regarding my XXXX XXXX credit card. I asked if there was any way they could process a goodwill removal of a delinquent payment reported for this account from XXXX. The customer service representative asked me what my reasoning was, and I explained that I had been in a long process of moving from XXXX to XXXX at the time and my mail kept getting lost. I also explained that if she looked at my other card with XXXX, she would see that I never paid late on it. She agreed and said that because I never received my statements, she simply had to order it again and the late payment report should fall off my credit report in about 8 days. It has been quite a while past 8 days and it is still showing on my credit report. I received the reprinted statement in the mail shortly after the call so I know that she truly did order the statement.
Additionally, I received an offer from XXXX to open a Platinum card. I honestly believed it was another upgrade to my XXXX XXXX card ( also called " Platinum '' ) because both cards ended in XXXX at the time. That was so confusing, but I called customer service a few times to clarify and they were so helpful. Ultimately, I closed the account after being assured by the Platinum customer service representative that the account will not appear on my credit report since I never activated it and never paid the annual fee. Lo and behold, it is showing as a closed account on my credit report as of this date.
So my request is basically to please clarify both of these situations. I am 100 % confident that if you listen to all of these calls, you would agree with me that I have the right to believe that my report was supposed to be cleared of a late payment and a never activated account. If they were wrong to tell me what they told me, then American Express needs to train their customer service department better to ensure that no miscommunication and false hope is given to any card member. This is by far my favorite credit card company, and I felt even more fond of the company after believing that they actually cared about my concerns regarding my credit report, but if I was wrong to think that they would live up to what they told me, then maybe I 'm also entirely wrong about the company. I 'm begging you, please help me! This has been so disheartening.

Complaint: I recently received a second settlement check from American express. This check was the result of a lawsuit they lost for deceptive practices. The check they most recently issued to me bounced. I then incurred bank fees for the dishonored check. I called American express they claim that they have no record of my prior gold card and that they never sent the check. I am still in possession of the check.

Complaint: Monday XXXX17 at XXXX there was a transaction charge on my american express serve prepaid card for {$100.00} from XXXX in XXXX, IN. I contacted american express serve XXXX at XXXX and they explained to me there is nothing they can do while the charge is still pending. I must wait 24-48hr for the funds to post, then call back and file a fraud complaint charge. Then I must wait 10 business days for a provisional credit, while compliant is pending up to 45 days. I explained to company that was my only money and I just received my direct deposit into the account Monday XXXX17. I have my physical card in my possesion, only XXXX card per account and I live in XXXX, WI and was at work when the transaction happen. The customer service representatives were rude, careless and kept me on hold for 45 minutes. I must also go through this process again in 48hrs. I asked to whom may I file a complaint, XXXX the supervisor told me they do n't have a department for complaints. He also stated there was no one that I could speak to above him. Now I am broke, needed those funds to make ends meet.
