Complaint: I purchased my vehicle with Westlake financial Service in XXXX. I had my first hiccup with them in XX/XX/XXXX I sent them a payment for the month by money order from my local post office and put it in the mail using the address that was included on the billing statement. After a day or two passed I called the financial company to check on the status of my payment all to find out that they never received it. They then wanted me to fax them over a copy of my receipt from this as " proof '' so I faxed it over to them got confirmation and waited again all to find out that they never got the fax either. By this point my account with them was days past due and I had to turn around and send them another payment ( this made two payments for one month ). Needing my car I did what I had to do but I wasn't going to let that stop me so I went back to my local post office to inquire about that money order I sent and it came back that the money order was received by someone ( due to law the post office could not disclose this info to me ) and cashed. Fast forwarding to XX/XX/XXXX after changing up the way I made payments to this company now paying them over the phone and keeping a record of all my confirmation numbers I ran into another issue. Something about the month of XXXX huh. After my monthly payment was made to them I got the gut feeling to call them a week later to check on the status of my account saying that just a year ago I had problems this same month. I contacted them and asked the customer service rep if my account with them was current he informed me that it was, I proceeded to ask for a payment book and after being on hold for 10 minutes while he talked to his supervisor I was told that he didn't even know what that was and that they didn't do those but he could give me documentation of my payment history. I took that as proof saying that now im realizing im dealing with a shady finance company I made him send me those details to my email. This phone call took place on XX/XX/XXXX not even two weeks after that phone call I received another phone call from a lady stating that my name was on the repossession list and that my account with them was showing me to be 3 months behind on my payments. I knew this was a lie I told the lady that two weeks ago I just spoke with them and got a copy of my payment history from them sent to me via email and that that showed otherwise. She mentioned I could fax over that information to them I declined because of the previous time they told me to fax something to them. She then insisted that if I paid {$50.00} to them it would take my name off the repossession list. Not having the money at the moment I sent it anyway via XXXX and what went from only {$50.00} turned out to be {$61.00} this money was sent to them on XX/XX/XXXX. On XX/XX/XXXX I walked outside thinking I was going to work and my car was gone. After texting my boss to inform her that i would not be into work that day I immediately called my local police department not knowing where to really start and I was informed that they received my car at the precinct at XXXX XXXX. that morning by law they weren't able to disclose who took it but c'mon im not crazy once I confirmed that it wasn't stolen I knew who came and got it. I called the financial company spoke with XXXX XXXX ( the guy was very rude btw ) and after questioning him about what was gong on he began to ignore and beat around the question but then proceeded to tell me how much i had to pay them in order to get my car back if i wanted it back. After reminding him that he never answered my question as to why they came and got my car, all he could say was because my account was 3 months past due. After explaining to him that i had confirmation numbers for all my payments and telling him that everything went through ( meaning the money was taken out of my bank account ) he got very frustrated made the comment " Well ma'am on your account its showing you are past due, is there anything else i could help you with today '' and everything else after that he continuously cut me off not even letting me get a word in. My boyfriend then tried to talk to him and ask him some of the same questions. One question that was asked was why would you send a person a confirmation number if you haven't gotten your money! ( that's like getting a receipt for something you haven't purchased yet ). XXXX had no answer for that question at all and he got nasty with him too rushed him off the phone and hung up in our faces. This has by far been the worst experience yet within two years and the sad part about it is i now have this on my credit report, no car still to this day because banks wont even look at me for another loan, and i only had less than a year left to pay on that car.

Complaint: Westlake Financial has repeatedly called using different numbers from their call center in an attempt to mirror local numbers ; some of which are similar to my children 's school numbers. This stops me from working so I can answer the phone to see if family in my area code are OK, only to have it be a collection call. Additionally, on this last call, they never told me it was an attempt to collect a debt, did not disclose who they were prior to asking me for verification information, and then told me they were going to intentionally notate my account incorrectly because the woman didn't like my answer to a question. When asked why the account was 20 days late, I stated I didn't know because my wife pays it and she told me she made payment. She said, I'll notate that as non-responsive. I attempted to clarify it with her, and was promptly disconnected ( non-aggressive on both ends ). When I called to talk to a supervisor and asked for my notations, they told me I can't have them and to have an attorney contact them, and they will forward it over to their legal department.

So i received from to fill out saying i never received or cashed. they received the form XX/XX/XXXX ever since then its been a battle to get them to cut me check for my money. I only have till XX/XX/XXXX for them to give it back or they submit my money to the CA Unclaimed Property Program.

Complaint: I have an existing auto loan with Westlake financial. I traded the vehicle on or around the XXXX of XX/XX/2018 and westlake has been calling for the payment due on XX/XX/2018. I stated to them when they called on the XXXX that I traded the vehicle and they have been calling every day 3 to 4 times a day asking for the payment. I have spoken to numerous people at this bank and they are really rude about this saying they have not received the payoff check yet so I gave them the dealership info and they said they can not call them. So I told them I have no control over that payment but they told me my acct is still active so I am responsible for the payment due. I had the finance manager call them and they still calling me harassing me. Please tell me I can sue them for this action.

I have been disputing this fraudulent account for years now. Its now still reporting to my XXXX and giving me the hardest time. Not the mention by state law in XXXX debt collection credit reporting has a Statute of Limitation of 6 years. Now, Ive tried and tried and tried and this company still has not taken this off. Please remove this account as it is not mine and also violates my rights by law of ( SOL ).

Complaint: I had a car loan with their firm. The car was totaled in an accident and the insurance company contacted Westlake Financial for a pay off. The received payment and I signed the car over to the insurance company. Several weeks later I received a bill from Westlake Financial stating I owed a balance. I was not certain how this was possible as they are the ones who gave the pay off amount, and if there were additional funds they should let the insurer know. They kept sending me a bill, charged late fees, kept calling to collect. Even after my repeated requests to send documentation explaining why I would owe and not the insurer they failed to do so and continued with the calls. They ultimately listed it as a charge off on my credit. I received a call from them occasionally, and stated my same request, to no avail. For some reason the past two weeks they have been calling me non stop, 7 days a week, all hours of the day and evening. I have gotten in excess of 10 calls a day. Sometimes when I do answer they hang up. Other times when I do answer I explain to them I would like written documentation of the debt, and also all communications to be in writing. They have failed to do so.

Complaint: On XX/XX/XXXX I purchased a XXXX XXXX XXXX XXXX XXXX Pickup truck, financed by Westlake Financial Services. Payments commenced on XX/XX/XXXX in the amount of {$790.00} monthly with a 10 day grace period. My payments in the amount of {$790.00} were made and recorded by Westlake Financial going forward on the following dates : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and finally XX/XX/XXXX.
I have maintained in good standing full coverage comprehensive, collision and liability on the vehicle from the date of purchase.
On XX/XX/XXXX, I was involved in a high speed head on collision at XXXX XXXX. Following the accident my truck was towed by XXXX XXXX to their wrecker yard where it remained as far as I knew. My injuries in the accident required 24 days of hospitalization and two XXXX XXXX to repair my XXXX XXXX XXXX. While still in the hospital I made the XX/XX/XXXX payment to ensure I was not in default on my loan.
While all of this was going on Westlake Financial Services was plotting a way to STEAL my truck.Although I was not in default in any way, on XX/XX/XXXX, Westlake Financial Services sent a subsidiary, Repossessions Incorporated to XXXX XXXX and REPOSSESSED my truck. I was never contacted in any way nor was any attempt made to contact me. Neither did they contact my insurer nor did they make any attempt to contact my insurer. We discovered these eventualities when my insurance adjuster and I placed a call to XXXX XXXX to find out where my truck was so the assessment and valuation could begin by my insurer.
Upon learning of the repossession on XX/XX/XXXX, XXXX XXXX, my adjuster and I began placing calls to Westlake Financial Services in an effort to get the issue resolved. We spent a total of almost 5 hours on the telephone being bounced around from one person or one department to another. The response from everyone was the same ; we will not tell you anything about the truck. It has been repossessed. If you pay all the fees we can dream up and the fees for the wrecking yard we will begin releasing information on the location of the truck. We were at one point sent to XXXX XXXX XXXX XXXX MN to be told they could not tell us anything about the repossession. Then we were sent to a Public adjuster who Westlake Financial Services retained to process their own nefarious claim on my pickup truck. They too were close mouthed with one exception, they let it slip that the truck was in XXXX LA, still in the local vicinity, but would not tell us exactly where.
We called back to Westlake Financial and again sought a resolution and were rudely rebuffed and talked to like XXXX. All we wanted to know, Why the repo, where is the truck, and what do we have to do to get the truck back in the possession of myself and my insurer. They would not cooperate at all.
Having spent time considering this entire situation, I can only come to one conclusion for their action. It is the intent of Westlake Financial to use their public adjuster to establish a low ball valuation of my truck in order to exacerbate the difference between the payoff and the valuation, thus allowing them to obtain a large judgment against me for the difference. Certainly there are civil violations in their actions. Certainly there are Louisiana Statutory violations in their actions both civil and criminal per the Office of the Attorney General of the State of Louisiana, the Office of Financial Institutions of the State of Louisiana, and the Louisiana Motor Vehicle Commission.
In essence, WEstlake Financial Services Stole my interest in my truck under fraudulent and false pretenses! They have defrauded me, falsely reported to my credit report, and caused me undue stress at a time when I need to be focusing on my physical recovery from my injuries!

Complaint: I had a Auto loan with Pelican Auto Finance ( Account # XXXX ) open in XX/XX/XXXX. My car was stolen and totaled. My insurance company paid the lien amount and all debt owed. However Pelican still closed the account as a charge off Account. After sending in disputes to XXXX the account still shows on my credit report. I wasnt notified of the results within 30 days and the account wasnt removed. XXXX couldnt verify any of the information do to the fact Pelican Auto Finance is out of business. Complaint: This is my last and final attempt to have this issue resolved before seeking legal action against the credit reporting agencies and this company. I have challenged the accuracy, compliance and reportability of these listings to no avail, and my rights have been violated. WESTLAKE FINANCIAL SERVICES has been reporting incorrect information on my credit reports. I have sent in several disputes to have this incorrect information deleted from my credit report.
On XX/XX/2018, I mailed a certified dispute letter to WESTLAKE FINANCIAL SERVICES, which was received by the company on XX/XX/2018. On XX/XX/2018, WESTLAKE FINANCIAL SERVICES sent me a copy of an alleged Retail Installment Contract, which was received on XX/XX/2018.
On XX/XX/2018, I mailed a follow-up certified dispute letter requesting description of the procedure used to determine the accuracy and completeness of the information that was sent to me. I also requested the name, address, and telephone number of each person who personally verified this alleged account, so that I could inquire about how they verified without providing any proof. This follow-up certified letter was received by the company on XX/XX/2018.
On XX/XX/2018, exactly 31 days after the receipt of the certified dispute letter was received by the company, I pulled my credit reports again, only to reveal that WESTLAKE FINANCIAL SERVICES had violated the Fair Credit Reporting Act, FCRA 623 ( a ) ( 3 ) Responsibilities of furnishers of information to consumer reporting agencies [ 15 U.S.C. 1681s-2 ] and the Fair Debt Collection Practices Act Section 807 ( 8 ) by not properly providing the credit bureaus with proper notice within the required 30-day timeframe.
Therefore, on XX/XX/2018, I sent a certified dispute letter alerting the company of such violation, which was received by the company on XX/XX/2018. As of today, XX/XX/2018, WESTLAKE FINANCIAL SERVICES has failed to comply with the laws of the FTC and the FCRA, and they are still reporting inaccurate, incomplete, unverifiable information to the credit bureaus, and they stand in noncompliance with the reportability of these listings thus violating my consumer rights. These violations are damaging my character and to my credit score.
