Complaint: On XX/XX/2007 WELLS FARGO BANK.N.A. Committed loan fraud. XX/XX/2007 Wells Fargo sent crafted uniformed instrument documents to sign - exhibit- A as a security agreement endorsable for funds. Wells Fargo clearly makes a statement that a loan was made, this is false. Wells Fargo does n't and has not shown any accurate records according GAAP where the said loan came from after repeated inquiries. Wells Fargo has cleverly crafted the reading to make you believe that a loan was made to you. The wording usually goes like this in the beginning of the contract : " In return for a loan that I have received, '' I promise to pay .... Wells Fargo brought nothing to the table as collator for a loan. Wells Fargo even required XXXX Dollars just to get the loan papers brought me to sign, which I paid. Then Wells Fargo took the created a securitized note with my signature and stole it to XXXX or Stole it as a derivative on the stock market. Either way Wells Fargo did make a loan but made copies of a securitized promissory notes and has a past practices of selling them as toxic loans to other investors.

Managing the loan or lease

Consumer Loan: Vehicle loan

Complaint: My husband and I have an auto loan through Wells Fargo Dealer Services. The vehicle was in an accident on XX/XX/2017 which resulted in a total loss. The insurance company paid the claim on XX/XX/2017 and the service contract was cancelled which produced a refund being sent back to Wells Fargo. Even with these payments, there was still a balance left due. Prior to the payments being made, I spoke with Wells Fargo in order to set up some sort of settlement. I was told they would not enter any negotiations until the payments were applied to my account. I spoke with Wells Fargo Dealer Services on XX/XX/XXXX on a recorded line to attempt to settle the balance. XXXX, the representative, offered a settlement amount and I asked if it was possible to settlement for an amount about {$500.00} less. He was going to check with his supervisor to see if this was agreeable and then call me back. I called to follow-up on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX and never received a response back. On XX/XX/XXXX I received notification that they had reported to the credit bureaus that my account was 30 days past due. My account is not past due, in fact it is about 3 years ahead due to the payments from the insurance company and the service contract. I believe the lack of response from the representative, XXXX, and the reporting on my credit was a willful scare tactic to bully me into paying the full amount due. Further, they have been making several collections calls to both mine and my husband 's cell phone. I have repeatedly told them to not call my husband 's cell phone during the day as he works XXXX and it disturbs his sleep. They have called him on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. These repeated calls after our numerous requests for them not to call his cell phone are harassing. Also, whenever we are able to answer the call we tell them the vehicle was a total loss and we are negotiating with their total loss department. They tell us we can then disregard the call, however we continue to get called. These calls have all been on recorded lines. In addition to these unethical collection practices, they also willfully extended a loan to us which was well over the value of the vehicle and denied us the option to purchase gap insurance. This unethical practice is why we are in the predicament we are in.

Complaint: Consumer Financial Protection Bureau ( Online Complaint ) I have a home loan with Wells Fargo which is currently in arrears. I have owned my home for 17 years and have been trying to work with Wells Fargo agents on negotiating a reasonable payment plan, restructure, either a restructure or loan modification. However I can not seem to get through the red tape. No real help has been offered, nor have I been accurately reviewed for any other options that would lower my monthly payments. I have done everything I can think of to resolve matters with Wells Fargo, again to be ignored. They never designated a single point of contact. With Wells Fargo receiving {$25.00} billion dollars in incentive relief for assisting struggling home owners like myself for a loan modifications from the Department of Treasury, as part of programs such as Making Homes Affordable. I am now facing foreclosure and in desperate need of assistance as my husband and I are in our eighties and have nowhere to live. In XX/XX/2016 our financial issues began. Before that we had tendered our payments on time as agreed. And with our adult son with " XXXX " who was living in our home it was suggested in XX/XX/XXXX/XX/XX/XXXX by his XXXX that perhaps it would benefit him to be placed in a XXXX with more accessible XXXX. This would take a healthy sum of money up front. He was trying to get XXXX but he now has to go to court and fight for it with an attorney. He has some medical conditions that require doctor 's visits as well as medications. On his XXXX birthday in XX/XX/XXXX he lost his health insurance and we are now forced to pay out of pocket for both until we find out if he will be awarded XXXX or XXXX our he is given XXXX. I am thrilled to say that he has gotten part time work within walking distance to our home and he is thrilled to be making a small contribution to our family 's income. The same year my father took very ill. He fell and broke his XXXX and since then has been back and forth, in and out of hospitals and XXXX. I have been trying to see him and care for his needs as much as I can ; sadly he lives in Ohio so my commutes are very taxing on our income as well as wear and tear on our already old vehicle. I am trying to get FMLA to help us out financially when the time comes that I need to make that trip but so far, it has been unsuccessful. Both XXXX and I have both gone through changes at our current positions which has caused monetary hardships DESIRED RESOLUTION : I want Wells Fargo to immediately stop this foreclosure activity and take a long, hard look at my CURRENT financial situation in an effort to assess my ability to pay a lower monthly mortgage payment. I also believe I qualify for other programs and thus would like to be considered for any and all government programs and home-retention options that are available to me. I do not want Wells Fargo to foreclose on me. I disparately want Wells Fargo to give me a second chance to save my family home. Why ca n't Wells Fargo restructure my loan to give me some relief in accordance with government guidelines? Please help me convey to Wells Fargo to stop all foreclosure activity and review my file. Sincerely, XXXX & XXXX XXXX

Complaint: On XX/XX/XXXX, I deposited {$440.00} to my checking account. The last XXXX digits of my account number is XXXX. I went to the WF XXXX XXXX in XXXX, N.C. I did not have any deposit slips so I gave my ATM card to XXXX, the teller. I told XXXX that I wanted to deposit that money in my checking account. About 4 days later, while checking my online account, I could not see the {$500.00} deposit. I called the XXXX branch and told them that I made on deposit on XX/XX/2017 that was not showing up. The person on the phone directed me to go to the bank. I went to the bank and talked to the service manager. I told her what happene. She looked it up on her computer and told me that the {$500.00} was placed on a loan that my son XXXX XXXX, XXXX has with WF. I told her that account was none of my business and that I wanted my money back. She called the loan division where the check was deposited. She told me that she was instructed to write a letter on WF letterhead explaining what happened. She told me that she was advised that when they received the letter, my money would be refunded to me. That has not happend. I have received the run around from WF. Each time that I have made an inquiry, I was told to call back in 2-3 days. It has now been over 3 weeks. I want my {$440.00} back.

Bank account or service: Other bank product/service

Complaint: I went into the Wells Fargo Bank at XXXX, GA on XXXX XXXX at around XXXX EST to deposit an overpayment refund check that I received from XXXX for an amount of just over {$3300.00}. This check was written to me using my nickname, in which I showed the bank tellers the card that was associated with the check and also offered to show them account statements and my XXXX mobile account information to verify, match, and authenticate that I was truly the person that was listed on the check. I also offered them my Driver 's License which they did not even acknowledge. I told them I would happily allow them to verifiy my nickname was connected to my legal name by calling XXXX. I also stated to them that XXXX was willing to call the bank manager directly to verbally acknowledge the check #, account number, and name on the check belonged to me and matched with the information on my license. This is something that other financial institutions have done for me and I have never had an issue. But today Wells Fargo decided to have 3 different tellers look at the check I was trying to deposit, and scream across the bank at me that they would not be able to deposit it because it would make my account negative because their back office would not approve it. This was very embarrassing and had everyone in the bank staring at me. Then one of the bank telllers that was not even handling my transaction, and left a customer in the drive thru ( and was just being nosey ), told me that I need to have recurring overpayment checks from XXXX XXXX put in my legal name. I told her this was not a recurring payment that i was receiving from them. She asked me ( while I was standing in the lobby, and she was sitting at the drive thru window ) if the name " XXXX '' on the check was registered with the Secretary of State. She said it in a very condescending tone. She also stated the amount of my check in front of everyone in the bank and said it was too big to deposit which again made everyone in the bank stare at me and made me uncomfortable with everyone knowing how much I was attempting to deposit. This was a breach of my privacy! Where is Wells Fargo 's confidentiality assurance? This is the worst experience I have ever had with everyone in the bank now knowing how much my check was written for and knowing what institution it was written from. All of the tellers ( except for the man ) were rude to me and did not even greet me when I came in the door. My privacy was compromised and they did not even call a manager/bank specialist over to try and privately handle this situation.

Complaint: On XX/XX/XXXX our XXXX of XXXX.. passed away. On XX/XX/XXXX XXXX of the church went to the Wells Fargo Bank ( XXXX, MD XXXX ). They spoke with Personal Banker NMLSR ID : XXXX. XXXX. The XXXX presented the certified copy with raised seal of our Articles of Inc., tax ID letter, church check books, bank statements, and their driver and non-driver ID ( matching the signatures on the church articles of incorporation. Personal Banker NMLSR ID : XXXX was informed that on XX/XX/XXXX two men were not members of XXXX. had been allowed to put their name on our church bank accounts at the XXXX MD XXXX. Counter checks were created for their use. A check was written on XX/XX/XXXX to one of these men in the amount of {$900.00}. It is our understanding that they met with Personal Banker NMLSR : XXXX located at XXXX MD. XXXX. Banker NMLSR ID : XXXX contacted the Wells Fargo Bank legal department. The legal department stated that they would correct this matter after the articles of incorporation where taken to the Maryland State Department to be updated. The articles of incorporation were updated and returned to Banker NMLSR ID : XXXX approximately XXXX on XX/XX/XXXX. XXXX XXXX NMLSR ID : XXXX sent a copy of the certified articles of Inc.. to the legal department. The control and proper names were applied to the account. After the banks error we requested to have a new bank account. Sadly Wells Fargo allowed the processing of a second counter check signed by one of the men who was not a member of our church in the amount of {$600.00} written on XX/XX/XXXX. On XX/XX/XXXX we spoke with the Service Manager ( XXXX MD XXXX ) due to are bank cards not working properly. When we discovered that the reason for the trouble was that the Personal Banker NMLSR : XXXX located at XX/XX/XXXX MD. XXXX had removed our names from the account and replaced them again with these same men and added a woman who was also not a member of our church. The actions of Wells Fargo Bank allowing these people without proper documentation to be assigned to our account as signers. This has caused tremendous stress and hardship upon the church as a whole. We are greatly disappointed that these actions were allowed to happen. To this date we have not received any report of any investigation or any resolution to this matter.

Complaint: Evidence is attached of Fraud by Wells Fargo and the Arkansas Tax Collector for XXXX County. Attached is one of thousands of examples resulting in $ Millions of dollars of Fraud to Wells Fargo customers in the State of Arkansas : 1 ) For example 2015 Tax Payment Receipt # XXXX is listed as a bulk lot payment of {$11000.00} for several parcels with Escrow holdings by Wells Fargo. However when you go into each tax record individually several of the Tax Parcels claimed to have been paid by Wells Fargo were actually paid by the Homeowners themselves or other Escrow Holding Companies. Not Wells Fargo. XXXX 2 ) This intentional mis-grouping of tax payment records results in an opportunity to steal in the tax collectors office and the opportunity to send money tagged as " over-payment '' back to Wells Fargo Executives. This is intentional deceit and intentional theft. 3 ) With this fraud scheme Wells Fargo Executives overcharge the Escrow accounts of mortgage customers, then intentionally send over-payment to County Tax Collectors in Arkansas. Wells Fargo cleanly benefits when money is returned to them by the Arkansas Tax Collector as " over-payment/duplicate payments '' for accounts that have already been paid by other parties. 4 ) The Arkansas Tax Collector keeps some of the " over-payment/duplicate payments '' in a holding fund for disbursement as they see fit. The Tax Collector and Bank Officials conspire in advance how much money will be overpaid and held each year. The Arkansas Tax Collector knows that Arkansas State only Audits the Summary Tax Records which show the Banks payments were legitimately accounted for : No one checks the individual tax record descriptions which show Wells Fargo was returned funds because that parcel tax record was already paid by another party. 5. There are thousands of Examples of Fraud currently on the XXXX County Tax Assessors website especially in XXXX County. False Summary Tax Receipts List " WELLS FARGO REAL ESTATE TAX SERVICES '' as the Payee of Parcel Tax Records that were actually paid by the homeowner or another Escrow servicing company. The misapplication of tax dollars represents $ Millions of dollars of Fraud. 6. Examples of Fraud are provided in this Compliant.

Credit card:

Complaint: I currently bank with Wells Fargo. Back in XX/XX/XXXX I opened a credit card through the bank. This past month I realized that my credit card was being charged a monthly fee of {$31.00} for " Credit Defense XXXX ''. When I realize this I immediately went into a branch to research what the charges were for and why they were happening. I spoke to a card services representative who indicated that the service was for in the event that I would become XXXX this was insurance on the card to make the minimum payment for me. I did not enroll or consent to such a service. The bank asked for 10 days to respond to me in writing, which they did ; indicating that they had confirmed that I did not enroll in the service. " As a courtesy '' they were going to refund my account {$180.00} for the past 6 months of service charges. The charges began appearing on my bill in XX/XX/XXXX meaning for the services alone ( not including interest charges and other fees ) they owe me a refund of at least {$330.00} which they are refusing to pay.
