Complaint: My husband and I receive numerous, repeated phone calls from XXXX XXXX, the service provider/lender of our car loan. We get phone calls from lines in Maryland, XXXX and XXXX California, with the company 's debt staff repeatedly leaving messages stating that they will " escalate our file '', that we are being moved to a Tier 2 trouble situation, that we should take out payday loans or borrow money from friends/family to make our payments, that if we do n't pay now, they will require two car payments in one lump sum, etc. ( Quick backstory : We both lost our jobs in XXXX XXXX and have struggled to make ends meet since then. ) We repeatedly tell them that we will not take out payday loans or borrow from people we know to make the car payment. This morning alone, I have received XXXX - XXXX - phone calls in rapid succession from XXXX ; one from XXXX ; and yesterday, from XXXX, XXXX. XXXX XXXX also calls from XXXX, XXXX, and XXXX.

Complaint: I was helping a friend who had lost his debit card, by cashing a {$200.00} check he wrote me so I could give it back to him. I deposited the check into my account because my friend told me it should be available the same day, but it was not, so he then wrote me another {$200.00} check and I cashed it inside a TCF Bank. A few days later, my account is now negative by {$230.00}. On XX/XX/XXXX, {$200.00} was deposited to another account. On XX/XX/XXXX, I received a {$20.00} deposit fee. On XX/XX/XXXX, {$200.00} was deposited to another account. OnXX/XX/XXXX, I received a {$20.00} deposit fee. I did not deposit any money and I am yet to be told how my account being negative makes sense. I called my bank and the lady who was assisting me told me multiple times ( after being asked multiple times ) that the only way to fix my account is by depositing {$230.00}. When I created my account I said I did not want my account to be able to go negative so I do n't see how this is so. I was told that the money was sent back to the check-owners account because he did not have sufficient funds, so I do not see how this is so. And if neither of our accounts had the funds to cover a {$200.00} check, then why TCF Bank allowed me to cash it, I would like to know.

Complaint: I am writing because we were late on are loan and this company started harassing an telling family members they were going to come looking for us and they have been trying to get a hold of us for months. we have never been 30 days past due with this company. Yes we have been late. I actual called do n't know for sure the name but number is XXXX ext XXXX. I told him this was totally uncalled for, that he was lying to family members and I will be making a payment 1st thing in the morning, his response was he would disconnect the call if I did n't verify who I he was talking to. Even thought he returned by call and said am I speaking to XXXX.

Complaint: XXXX received a notice to levy my account for not filing taxes in WI. They emptied my account on XXXX XXXX and I received notice of this on the XXXX. I remedied the situation right away by filing the missing information and I confirmed on the phone with a WI representative that my money should be returned after they receive it from XXXX. I called WI today, the XXXX, and the person I spoke with said XXXX has n't sent the money yet and that I need to contact them to find out more. He said once they receive it, then they will return it, but they ca n't do anything since XXXX has n't done anything. I went to the local branch and the assistant XXXX said there was n't anything they could do. I asked for proof the money was sent or any type of tracking and he said that they could n't give me any information. Just that when they get a notice, they comply. I said I understand, I just want more information as I was told that Wisconsin has n't seen anything yet and I would like a time line on how things work. They refused to give me any corporate number and said I could try the phone support, but would likely get the same answer. The total amount debited was {$620.00}, the levy was for XXXX. The levy number was based upon a guess for how much tax WI thinks I would owe, had I filed taxes. The previous year I filed was {$0.00}.

Complaint: Some time ago I overdrafted my account because of a check that posted that I 'd forgotten about. I learned in that call to TCF Bank that physical checks will not show pending. They simply post to the account once they are processed. I overdrafted my account another time and in my call to TCF Bank I learned that they post physical checks between 10pm and Midnight. 10pm is the cutoff for deposits and transfers, even internal bank transfers, so if you do n't have enough money in your account to cover checks posting after 10pm, you can expect an overdraft fee. Not an ideal policy in my mind, but I have a choice to bank or not to bank with TCF. Keep in mind however, not everyone has this choice. TCF Bank is one of a few banks that does not reference ChexSystems. ( More than 80 % of banks and credit unions use consumer reports from ChexSystems and other agencies to help them decide about bank account applicants. Banks and credit unions share information about these individuals and whether the institution closed their accounts. ) The reason I am writing this complaint is because of my most recent overdraft. I have been working to complete the trust accounting to solidify the balance of a transfer from XXXX to XXXX, and as of XXXX XXXX XXXX, my operating account had a balance of {$460.00}. I went to bed relieved that I had at least 1 more day to finish and make the complete transfer before any recent checks posted. To my disbelief, I woke up this morning to see 5 checks posting to my operating account dated XXXX XXXX, overdrawing my account to the tune of {$1800.00}. I transferred {$2000.00} of monies free and clear from trust, when I was planning on just finalizing the exact number today, and I promptly called TCF for an explanation. The explanations are confusing, but in a nutshel, I was advised by the first rep that checks began processing on the XXXX and post between midnight and 6am today XXXX XXXX. She explained that they are dated for the XXXX because that is when they began processing??? I was processing my trust accounting yesterday to transfer today, does that mean I get to defy the laws of time and space and backdate my transfer as if it occurred yesterday? But I digress ... The next rep I spoke to explained again the XXXX cutoff for deposits, and the fact that processing checks begins after XXXX but could n't explain why there were no checks posted by the end of XXXX XXXX according to the online banking. She told me that online banking is not delayed, she stated that she could not tell me the actual time the checks posted, but she did state that if they are showing that they posted on the XXXX, then they most of posted on the XXXX, contrary to what the previous rep stated when she explained checks processed yesterday can post between midnight and XXXX. I have a recording of the conversation attached to this complaint. I simply want to understand TCF policy on debits and credits, and I want to know if there is any regulation supporting their policy which in my opinion is clearly in direct conflict with what would be in the best interest of the consumer.

Complaint: Tcf intentionally drops off authorizations and then posts them a week later to accrue fees. I had enough available funds in my account to transfer money over, my account balance was {$3.00} prior to the close of business day. I wake up to see that Im now negative because XXXX XXXX got {$65.00} posted, that charge was authorized and fell off almost a week ago, now for whatever reason it has posted and charged me fees. I have received several fees on my account from this same thing happening. I have 2 checking accounts with your company and the same thing keeps happening on both accounts and I keep getting charged unnecessary fees.

Complaint: I had spoke with someone regarding opting out of overdrafts during the early part of 2017. I was told i could not. I recently discovered the previous suit filled against them and called to have my account opted out and stop any transactions from coming through for a short period of time. They did not do that and claim they have no record of the call. Since then, 3 transactions cleared and 4 overdraft fees of {$37.00} were added. I addressed the issue and they refunded {$89.00} of the {$140.00}. I spoke with two different Department Leads to resolve the remaining fees and they said they could not do so. I 've had many issues with them in the past and do not feel it is ethical for them to hold me accountable for misinformation given to me by numerous employees. I offered to pay for the charges ( {$84.00} ) and not the overdraft fees ( {$59.00} ) and the offer was declined.

Complaint: This appears to be systematic problem that would affect anyone paying off there loan, when they have a different mailing address on file, because XXXX is only mailing refunds to the property address not that of the mailing address on file. I had sold my house and the closing was on XXXX/XXXX/XXXX. The title company then sent the payoff funds on both my XXXX and XXXX mortgage to XXXX. XXXX was overpaid and a refund was due to me on both loans ; however, when I contacted XXXX they told me the XXXX mortgage refund was sent to the property address because I need to send a change of address. I had advised the XXXX that XXXX has my correct mailing address for many years now, because this was a rental property and a " change of address '' to XXXX was not needed. I was already getting mortgage statements, etc. from XXXX at the correct address. Then after the run around, I finally got XXXX to cancel the XXXX refund checks sent to the property address and reissue them. However, they then again sent the refunds to the property address! Again after the run around, XXXX advised they would not issue XXXX more stop pays and they wanted to wait to see if the refunds are returned to them or forwarded to me. I told them my forwarding address expired many years ago, they had my correct mailing address for many years and obviously the new owner did n't return the first checks, the XXXX set probably is n't going to be returned as well. I had told XXXX I was going to file a complaint, if my refund was not sent to me at the correct address and was told there was nothing they could do. Obviously this is well past the 20 days allowed to issue the refund. XXXX then continued to hold my funds at their benefit and continued to rely on their internal system, which did n't make any sense. Instead they kept telling me I needed to send them writing notice of my mailing address, but I then again reminded them it is correct in their system and has been for many years! This was a rental for 12 years, so my mailing address has not been that of the property for some time. ( It appears they only look for a newly filed change of address to send the refunds to the mailing address rather then the property address. ) This process/system needs to be investigated! I finally got XXXX refunds dated XXXX/XXXX/XXXX and received them in the mail shortly thereafter.

Complaint: I have been behind on my payments with XXXX Mortgage for over a year. Almost always less than 30 days behind. XXXX has done nothing to help me get up to date. I have asked for help and they indicated they can not help unless my payment is current. I am currently 30+ days delinquent and they showed up at my house to tell me they are going to start foreclosure! Can they even do that? My husband is XXXX and this has put him over the edge! I have always handled our finances and they knew that. They went to my husband ( he is on the mortgage ) without any warning. I am furious! Lastly, XXXX has refused to help me get caught up by offering a loan adjustment, and have been raking in a $ XXXX late fee for over a year.
