Complaint: I filed a complaint a couple of weeks ago. Seterus, Inc responded. Not all the info provided by the Seterus associate was correct. Obviously all the recordings were not listened to. At a fault of my on, I said the month of XXXX ... maybe all this began in XXXX. But that's ok. My main concern about their response was the associate responded about the removal of my 1st Sale date was because of the amount of homes in foreclosure. There were simply too many foreclosures so they changed my date to a later one. When in fact, if he would listen to the recordings the young lady told me Seterus, Inc. removed the date ( with no future sale date ) to help me out. She said she wanted me to send in additional information and to be more persistent with my involvement. She said I wasn't calling in enough to check on my status and to make sure all paperwork had been received and that they didn't need anything else. I had explained to her I always scared to call b/c I am scared of being told no. She said to call anyway. It will show that I am determined. So I did. I called frequently. Obviously, by the sound of this Seterus, Inc. was going to work with me. If Seterus says this conversation did not happen they are lying. This phone call happened after they removed the 1st sale date. Also, one of the modifications was a principal change. Look at the reasons for the modifications. They are very legit and there was no way around them. Natural disasters are a terrible thing. Also, I would like to request to hear the recording of the lady telling me the date was moved by Seterus, Inc. to assist me.

Complaint: I have filed previous complaints and I was asked to deal directly with the Seterus call center representatives as opposed to filing a complaint with the CFPB. That is not working. Despite my concern for constant threats of foreclosure on my loan and constant errors in making my payments I have still had my home loan turned over to an attorney for foreclosure. I spoke with a representative XX/XX/XXXX who I told I was able to make two payments on my mortgage. The representative got a supervisor on the phone who said I had to make three payments. I sent the three payments. I checked my account my check had not cleared. I tried to submit an electronic payment for the three payments since the money was still in my account. I made another attempt and I have been blocked from making payments electronically or on Seterus website and my check has not been cashed. I am being told by Seterus that my account had been turned over to an attorney for foreclosure. The last representative I spoke with told me the person I spoke with previously who had put me on a payment plan was in her group and she would not have made a mistake. She told me my payment plan had defaulted. The payment plan defaulted before it got started or was not set up properly. When I got the letter it was entirely different than what we had discussed. There is no way that I can become current with my mortgage when I am constantly threatened with foreclosure, blocked from making payments by Seterus website, electronic pay system and my checks or being held.The last payment I was able to make electronically was XX/XX/XXXX. It cost me extra but is less hassle than having to constantly go back and forth with the call center representatives. I still have not had the issue resolved for all the fees from when I got out of bankruptcy XX/XX/XXXX and called continuously trying to get some one to help me and was refused help until XX/XX/XXXX because no one would talk to me because I was continually told I was still in bankruptcy and when a complaint was finally filed with the CFPB. I then started to see retaliation because I complained. I have been told that the fees were not being considered right now just the mortgage payments due, that is not true. I am also not getting consistent information as everyone I talk to gives different information. I'm just trying to get this resolved without continually overpaying and all other fees being attached to my mortgage. When the history is told on this mortgage and the " three modifications '' are continually mentioned all the facts are not brought forward. I have mentioned in previous complaints that this was a mortgage that started out at {$52000.00} in XX/XX/XXXX. This mortgage is currently {$58000.00} in XX/XX/XXXX, has had by your records three modifications, one of which was {$5000.00} over the course of the loan would be {$20000.00} alone. There is no mention that {$35000.00} was paid to bring the mortgage current in XX/XX/XXXXafter numerous documented servicing errors and payment refusal by XXXX XXXX before they went out of business, who then transferred the loan to XXXX XXXX who then transferred it to Seterus wrapping and stacking the errors as the mortgage was growing and transferring. There has never been any loan forgiveness during any point and time under any so called OBAMA program or National Mortgage programs coming forth to resolve or correct this type problem by any of the mortgage companies involved. Someone should ask themselves how a mortgage can be no where near to being paid off after 18 eighteen years of payments and {$35000.00} and loan balance being more now than when in its origination. This gives a whole new meaning to home ownership. Someone should certainly ascertain my concerns about not being able to correct this situation without another abundant payout and increase in my loan. Walk in my shoes?

XX/XX/XXXX - Seterus Incorporated received a policy renewal notice XX/XX/XXXX - Seterus Incorporated paid {$2900.00} for policy renewal XX/XX/XXXX, XXXX Effective date of policy XX/XX/XXXX - Policy changes after review XX/XX/XXXX - XXXX forwarded new policy to Seterus Incorporated, documentation available XX/XX/XXXX - XXXX issued Seterus Incorporated an adjustment of {$600.00} XX/XX/XXXX - Seterus Incorporated posts adjustment XX/XX/XXXX - Seterus Incorporated writes letter stating insurance has expired XX/XX/XXXX - I faxed Seterus Incorporation the policy information again, documentation available. XX/XX/XXXX FORCED-PLACE insurance activated Seterus Incorporated is in violation of Title 12 chapter 27 2605 ( k ). Seterus Incorporated had documentation, supplied by myself and the insurance company, that should have brought into question Seterus Incorporations ASSUMPTION that property insurance was not in force. Additionally, though this would take some thought, a yearly policy that cost {$2900.00} canceled forty-five days after activation should warrant a refund of about {$2500.00} NOT {$600.00}.

Complaint: We purchased our house in XX/XX/XXXX.Since then we have been through several montage servicing companies. XXXX XXXX, XXXX XXXX XXXXXXXX, Saterus and currently XXXX XXXX XXXX. To start when we got the house just like a lot of other people we had to get the extra insurance to protect the home loan. We were told that after a few years that we stayed on track with the payments all we had to do was call and stop the that insurance. Well after a few years we did get several letters saying that we could take off that insurance. When I called they said I had to pay to have an appraisal of the house. So to this date we still pay for this insurance. And since then I've heard that some companies have had lawsuits because of this or something similar. We did fall behind. Unfortunately with the unexpected passing of my Father in XX/XX/XXXX. In XX/XX/XXXXwe tried to have a modification at the time with XXXX XXXX XXXX. After all the paper work and time, all that was accomplished was to have maybe {$200.00} off of the regular payment. That by this time it was almost {$1700.00}. A year later we got the letter that Seterus was our new servicing company.. Once again tried to apply for a modification they were of no help. To the point of us being two weeks away to start a short sale. Received a letter that if we had the intent of keeping our house we needed to call to make an agreement and they would work with us on a payment that was doable on our behalf. We did come to an agreement on the payments and the other condition was that we had to agree on the dates that these payments would be automatically taken of our account. Finally we got back on track. Everything was going well. Then out of the blue we stopped getting our monthly statements. When I called they said that its because we were on a coupon-payment system. Yes I did received them in the mail but I have always made my payments through my bank. So now that XXXX XXXX XXXX has sent us monthly statements, I have notice that our balance is about 100,000 dollars different form a statement that I found from Seterus. This is the part that has me looking for HELP ... How it can be possible that we have been paying our house for over ten years and we basically owe the same amount of when we bought our house in XX/XX/XXXX One other thing that I almost forgot is that our loan was set to where the first ten years of payments were only interest. Can someone please help us? I would like to be informed before I give them a call and try to get some answers.. Of all those times asking for help from these servicing companies all I have experienced that its so hard to get help from them cause they don't care about who they XXXX over. Also its so stressful just to try and get answers. When all you get is the run around. I do want to mention that in the middle of all this I did find one person that, I believe did something. XXXX XXXX from Help Center Counselor. I think because of him we didn't lose our house. I have tried to get in contact with him. Unfortunately he doesnt work there anymore..

Complaint: I fell behind on payments a year ago. I actually borrowed money from my mother last XX/XX/XXXX to catch up the payments. But when I contacted Seterus, they advised me that they would be happy to simply roll the payments to the end of the loan not to make a payment at that time, and therefore I would not have to borrow from my family. I did as they suggested. I was denied the modification. I called them to ask why and they said I had already had the max limit of modifications. One occasion they are counting as a modification is a principal adjustment. I explained to them I had the money to make my payment and bring my account current and they suggested I not make the payment to apply for modification to roll the payment to the end. I asked why they informed me I could roll the payments to the end of the modification. She asked my story. After I explained my situation I was informed to try again. I was denied numerous times and was encouraged to keep trying. I was given a sale date of XX/XX/2018. Seterus, Inc. informed me that they removed the date to assist me and wanted me to be involved more, for example call in every day to make sure they have received all paperwork and to make sure they don't need anything else. Seterus, Inc. requested I send the following information : A copy of my husbands license to prove he still resided in the home, check stubs, and another letter stating my terrible situation ( My entire city flooded, XXXX, LA and my little brother passed away shortly after ) and reasons for previous modification. I sent in all requested information they requested the very same day. Seterus, Inc. gave me hope that I would indeed receive the modification. After all, they stopped the sale date for me ( or so I was told ). I have once again been served papers notifying me of a Sheriff 's sale. My new sale date is XX/XX/2018. When I call Seterus, Inc. they tell me they know nothing of a sales date. I have contacted them several times about the date and they still inform me they have no information about a sales date. I give them the date every time I call. As well as not being aware of my sales date Seterus, Inc. now says there is absolutely nothing they can do to assist me. They can not stop the sales date. The only thing I can do is pay the {$27000.00} to bring the loan payment current. This is unfair. I tried to make a payment back in XX/XX/XXXX. Now I owe {$27000.00} due to late fees and legal fees. Just appears to me this was a set up since XX/XX/XXXX. I even called the HOPE Foundation and XXXX XXXX XXXX and they both ran my name and said Seterus, Inc. can indeed roll these payments to the end of my mortgage even with my previous modifications. They told me this back in XX/XX/XXXX. They have encouraged me what to say to Seterus, Inc. the entire time because Seterus refuses to discuss anything with these companies ( even with me present with them giving my permission for them to speak ) because these companies want to record the phone call and Seterus will not talk if the line is being recorded. Seterus informs me they record all messages, but I can't. But due to the fact that Seterus does indeed record all phone calls all my above information can be proven to be fact. And I'm not talking about the notes they take because they never read back all the information from previous phone calls. Please listen to all of the recorded phone calls from the first day I called in. One more thing, Seterus, Inc. has my house appraised at {$170000.00}. I owe {$180000.00}. Honestly, I do not believe the house to be worth {$170000.00}.

Complaint: I am filing a formal complaint against the following corporate entity : XXXX XXXX XXXX XXXX - Debt Collectors XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX On XX/XX/XXXX XXXX XXXX XXXX XXXX willfully and Knowingly Filed a Fraudulent Complaint without a lawful contract and submitted Counterfeit and forged Documents on behalf of XXXX XXXX and to date even though they are in violation of the statute of limitations they continue to perpetuate the fraud. They submitted more than 2 differently altered and forged Notes obtained by fraud and belonging to a deceased corporation ( XXXX XXXX ), fraudulent lost note affidavit, fraudulent assignments, notaries fraud and Robo signers fraud. I was not properly served by the Debt Collectors. They ignored motion for XXXX XXXX. XXXX XXXX XXXX XXXX XXXX ignored Jury Demand. They ignored and violated court orders. Federal Complaint Case No. XXXX and Case No. XXXX XXXX XXXX and their corporate clients defaulted. Their complaint alleges causes of action for breach of contract to which to date lacks evidentiary support. Standing is lacking as well as jurisdiction. The Debt Collectors filed in court a foreclosure complaint for their client XXXX XXXX on XX/XX/XXXX, with No Contract, no business address, no business phone and fax number. There was no account number attached to their frivolous complaint. They have provided a complete lack of evidence to their complaint during and over the two years period of proceedings and are in violation of the Truth In Lending Act ( TILA ), 15 U.S.C. 1601, FDCPA, FCRA, SEC and FDIC. XXXX XXXX, SETERUS, XXXX XXXX XXXX, XXXX XXXX XXXX and their accomplice XXXX XXXX XXXX XXXX are administrative agencies under the Administrative Procedure Act have fraudulently created a fictitious Real Party in interest to initiate an unjust action against the private property of the Real Party in interest. They are guilty of fraud upon the court, unlawful harassing phone calls threatening arrest, fraudulent conversion, collusion and misprision of felony. XXXX XXXX XXXX XXXX is also guilty of misprision of felony and must be disbarred. 18 U.S. Code 4 - Misprision of felony. In addition to the penalties of 18 U.S.C. 4, a licensed attorney in violation of section 4 must face immediate disbarment. XXXX XXXX XXXX XXXX XXXX turned a blind eye to the evidence of fraud and was complicit. He never enforced administrative agencies court orders to provide proof of debt. XXXX XXXX, SETERUS, XXXX XXXX XXXX, XXXX XXXX XXXX and their accomplice XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX acted outside the jurisdiction of the laws. XXXX XXXX and XXXX XXXX to date are in violation of court order dated XX/XX/XXXX to show Orignal Note and Mortgage Contract. ( copy included in documents submitted ) Assignment and endorsement of the note must be effectuated before foreclosure is filed because their client XXXX XXXX must have standing at that time : Standing can not be acquired after suit is filed. As Debt Collectors XXXX XXXX XXXX XXXX are fully aware. Standing is lacking as well as jurisdiction. The Debt Collectors knew that XXXX XXXX is not the named mortgagor that is described in the alleged copy Note attached to its complaint. They also knew that XXXX XXXX used fraudulent documents to attached their name to the mortgage. They have not provided information and evidence as to the lawful transfer of ownership of the mortgage, not even a signed agreement or contract transferring the right to foreclose to them. Without a lawful Original Note, Deed of Trust and mutually signed contract ( with wet ink signature ), XXXX XXXX have no standing. The counterfeit XXXX mortgage assignment submitted by XXXX XXXX and their Debt Collector was issued in XXXX and signed by a notary from XXXX ( Robo signer ) and missing Assignee signature. The Debt Collectors and XXXX XXXX lacks first hand knowledge about the mortgage and are in an untenable position as they have not met their burden of proof. These Debt Collectors have intentionally ignored all Court Orders and have gone around in circles so as to avoid submitting evidence that is paramount to their attempt to foreclose on a property not belonging to their client XXXX XXXX. The Supreme Court of the United States of America said : Evidence not presented is considered not to exist. They are in violation of the statute of limitations. The Debt Collectors must demonstrate that their client XXXX XXXX had possession of the note and that the transferor was the holder at the time of the transfer to the transferee in order to enforce the note. Therefore I claim all rights and protections provided for in Law, starting with the Verification of Debt under the Fair Debt Collection Practices Act and under TILA. The Debt Collectors attaches documents to the complaint that conflict with the allegations of material facts in the complaint in which the XXXX XXXX claims that they owns the Note and Mortgage by virtue of an unrecorded assignment that does not allege when the assignment occurred. Unable to prove, the Debt Collectors perjured themselves and submitted a document ( exhibit J ) claiming that I Closed with XXXX XXXX the same day I Closed with XXXX XXXX on XX/XX/XXXX. ( the original lender - account number XXXX ) XXXX XXXX - REPEATEDLY Reported false information to XXXX and XXXX Credit Bureaus. Date of first delinquent reporting was on XXXX, XXXX. Manufactured Foreclosure was also reported. INVASION OF PRIVACY violation and MORTGAGE FRAUD, FRAUDULENT CONVERSION AND IDENTITY THEFT. SETERUS - REPEATEDLY Reported false information to XXXX and XXXX Credit Bureaus. Date of first delinquent reporting was on XX/XX/XXXX. Manufactured foreclosure was also reported. They are guilty of INVASION OF PRIVACY, MORTGAGE FRAUD, FRAUDULENT CONVERSION and IDENTITY THEFT. According to the Fair Credit Reporting Act, Section 609 ( a ) ( 1 ) ( A ), They are required by federal law to verify, through the physical verification of the original signed consumer contract on any and all credit accounts. The Supreme Court of the United States of America said : Evidence not presented is considered not to exist. As a result of these deficiencies, XXXX XXXX have failed to state a cause of action and to date failed to validate the debt with the original note and mortgage contract. I have been receiving harassing and threatening phone calls and voicemail messages are saved. They have demonstrated the lengths they will go to continue their unethical conduct. XXXX XXXX, SETERUS, XXXX XXXX XXXX, XXXX XXXX XXXX and their accomplice XXXX XXXX XXXX XXXX are in violation of XXXX Consumer Fraud Act, and Deceptive Business Practices, 815 ILCS 505/1, et seq. Federal violation of Unfair and deceptive collection practices 15USC1692. United States Code Sec 471 : Obligations or Securities of the United States Whoever, with intent to defraud, falsely makes, forges, counterfeit, or alter any obligation or other security of the United States, shall be fined under this title or imprisoned not more than 20 years, or both. Willful Violation. United States Code Sec. 473 : Dealing in counterfeit obligations or Securities Whoever buys, sells, exchanges, transfers, receives, or delivers any false, forged, counterfeited, or altered obligation or other security of the United States, with intent that same be passed, published, or used as true and genuine, shall be fined under this title or imprisoned not more than 20 years or both. Willful Violation. Under FDIC regulations : DOCUMENTATION AS EVIDENCE.In any action involving a consumer, any documentation required by this section to be given to the consumer which indicates that an electronic fund transfer was made to another person shall be admissible as evidence of such transfer and shall constitute prima facie proof that such transfer was made. https : XXXX Proof was not provided.
