Complaint: On XX/XX/XXXX, Seterus Inc sent me a notice that my mortgage had been transferred from XXXX XXXX XXXX to them. I was given a document that showed my original loan date and principal balance along with the interest rate. Based on several mortgage calculators from several different banks, the amount Seterus has been charging me monthly for principal and interest is very much higher than all loan calculators show. My original loan amount was {$100000.00} based on 30 years of 12 monthly payments with the loan start date as XX/XX/XXXX and end date of XX/XX/XXXX. The interest rate was a fixed rate of 6.5 %. When all this is enter into a mortgage calculator, the principal and interest on all bank calculator I have tested equals {$650.00}. My payments from Seterus have been {$720.00} which is {$74.00} higher. This has been going on since the loan was taken over by Seterus and they state that the payments were established by XXXX XXXX XXXX prior to the transfer. At some point when the information was entered into Seterus ' computer system, this error should have been caught. Over the course of just 1 year, this over-payment would amount to {$890.00} and it has been almost 4 years since they have had this mortgage so we are close to a {$3600.00} over-payment. A Seterus customer service rep would not ( actually said could not ) transfer me to someone who works with loan calculations. I was told I would have to submit a written letter to them disputing the mortgage payments. I did not think I would get a response or an actual justification without going through a consumer protection agency. Also, when the mortgage was transferred, Seterus claimed that XXXX XXXX XXXX had service charges that needed to be paid. A total of {$100.00} in late fees from both XXXX XXXX XXXX and Seterus combined. On XX/XX/XXXX, Seterus gave me the option to pay these fees at a 50 % discounted rate if paid by XX/XX/XXXX. I chose to do this. I paid Seterus {$54.00} which is half of what was due. I have the Seterus documentation verifying the payment as well as the date. My payment was deducted from the outstanding fee balance however, Seterus never removed the other 50 % from the balance. Seterus has also been charging me late fees when in fact the payment has indeed been received within the 15 day grace period for mortgage payments. I have documentation showing when the payment was received at Seterus and signed for by someone at Seterus. However, Seterus chooses to use the date they process the payment instead of the date they Receive the payment. I submitted a complaint through consumer protection about this on one other occasion and Seterus corrected the errors. Seterus continues to use this practice so even though they receive my payment within the grace period, they charge a late fee if the payment was processed past the grace period date. I believe this is an unethical or possibly illegal procedure which Seterus refuses to correct or stop. I refuse to pay any of these fees because I've already shown that Seterus does not deduct them properly from the fee balance. This company is a very sly, unethical company and refuses to make any statements over the phone if advised they are being recorded. Once you mention that the call is being recorded, they hang up the phone. If they didn't have any illegal dealing or something to hide, why would they refuse to be recorded? We as consumers are always advised that our calls are being recorded whether we like it or not. Shouldn't companies like this also be recorded to show how corrupt they really are? I would like my mortgage reviewed and definitely would prefer it be transferred to a reputable mortgage holding bank. Seterus is a debt collection agency who does everything they can to hope for a default. I get calls within a day after the first of the month when the mortgage is due even though there is a 15 day grace period. They seem to be very quick in trying to get their payment but yet when you call them to question their practices, you never seem to get any answers. They will not transfer you to any person who has any true knowledge of home mortgages or loan calculations. They will not give you any answers on the phone and always require that you submit a letter which may never get a response. I would like CFPB to help me get this payment discrepancy resolved and hopefully help me get this loan out of their hands. This company should be investigated for the procedures they use and their corrupt business practices. Documentation and proof of all facts listed above has been verified by representatives at Seterus. Customer services rep have stated that they have copies of the letter I have referred to. I can supply copies of all documentation if needed to resolve this issue. I can also supply verification for each and every payment received by Seterus with a signature from a Seterus rep. One payment was sent back to me because of an address change which I was never notified about. Of course, Seterus applied a late fee even though the payment was delivered to the same address that had been used for several months but could not be delivered on one particular month. When they were contacted, I was informed that they had moved that office and I should not have been sending to that office in the first place because they were not a payment processing facility. However, several payments had been sent to that office prior to this and all payments were processed that were sent to that office. I was never told that this was not the proper address until the office was moved.

Complaint: In XX/XX/XXXX, I received notification from Seterus, my mortgage servicer, that my taxes went up over {$300.00} a month and I was expected to start paying the added amount as of XX/XX/XXXX. This seemed odd to me so I contacted the Tax Assessor 's Office and discovered an error was made. Unbeknown to me my property was incorrectly recorded as a sale on XX/XX/XXXX and was assessed as such. It was assessed at XXXX price as opposed to XXXX when I bought the property. The Tax Assessor sent me notification of the error ( attached ) and I forwarded it to Seterus. In the meantime I paid my regular payments but did not have the money to pay the added incorrect amount. I kept getting late payment notices with warnings of foreclosing. Seterus would not change the amount I owed for taxes until they received the next tax bill in mid-late XXXX eventhough I sent them proof that it was a mistake.. In fact, the Assessors office sent me a check for {$1500.00} overpayment for XXXX and both the Assessor and myself notified Seterus of the overpayment. On XX/XX/XXXX, when I had the money, I spoke with XXXX at Seterus and set up a payment plan so they would take no further steps consisting of 3 payments ending XX/XX/XXXX. However I paid it off in XXXX. When I discovered they reported me 2 months delinquent on my mortgage to the credit bureaus I requested XXXX XXXX to investigate.. Seterus still refused to remove the negative remark from my credit report.

Complaint: On XX/XX/XXXXSeterus purchased and enforced a forced place insurance policy on XXXX XXXX XXXX XXXX without notice and while the property was under a federal stay. The XXXX had insurance on file in the case documents for the property with the bankruptcy court at the time of the placement. This illegal creation of the escrow account for forced place insurance in XX/XX/XXXX lead Seterus to pay off one of the Debtors tax plan agreements in XX/XX/2013. The XXXX XXXX XXXX XXXX treasure had agreed on plan and this payment plan was part of the Debtors confirmed bankruptcy plan in the amount of {$1500.00}. Seterus then added the tax plan balance to the illegal insurance escrow balance and began trying to collect from the debtor. Seterus was notified by the debtor that these actions were illegal in XX/XX/XXXX. The XXXX refused to pay the added illegal expense. Seterus raised the monthly payment to force the Debtor to pay the added bill or face foreclosure action. I have enclosed a Conditional stay of relief as a exhibit. Seterus will state that because of this relief they had the right to insure this is not true for two reasons. 1 the insurance predates the file date of the relief. 2. I had insurance on file with the court. Seterus just flat out violated my bankruptcy plan by paying off my tax plan and billing me the balance at a shorter term. Seterus needs to recognize what they have done and correct the loan back to the improper insurance XX/XX/XXXX. Seterus has been avoiding sending back a answer though the CFPB because the company has violated my bankruptcy rights and the FDCPA by trying to collect bankruptcy XXXX debt along with insurance fraud.

Seterus failed to placed the {$51000.00} in the class XXXX claims and by not doing so was discharged at the confirmation of the plan. Seterus failed to adjust the loan to match docket XXXX asking for discharged debt on my monthly statements as " Interest Arrearage '' and in a payoffs. Seterus did adjust the loan on XX/XX/XXXX only after Seterus had violated the bankruptcy code and FDCPA. Seterus during the bankruptcy stay placed forced place insurance on the loan raising the monthly payment not to comply with Docket XXXX when in fact the property insurance was up to date and on file with the Bankruptcy court and only needed to be petitioned. Serterus in XXXX paid off a 3 year confirmed bankruptcy tax plan that per the confirmed plan under Class XXXX ; Claims for Real Estate Taxes the plan states that the payments were to be made according to the agreed tax payment plan between the debtor and treasure. Seterus did not let this happen paid them off and then demanded the amount in full.

Complaint: In XX/XX/XXXX, I entered into a six month forbearance due to damage to my home from Hurricane XXXX. I was told by Seterus that the forbearance would apply until XX/XX/XXXX. I began making mortgage payments in XX/XX/XXXX. Once I began making payments, I was placed into a loan modification program, and was told that my forbearance would be suppressed until the modification was complete. It was my understanding that the forbearance would be applied to the end of my loan and this would not have a negative affect to my credit. Effective XX/XX/XXXX, my mortgage company informed me that a forbearance due to a natural disaster would no longer be suppressed to the credit bureaus. I went from a FICO score of XXXX to XXXX. I have never had a delinquent payment in any of my credit accounts.

Complaint: I have been requesting information from Seterus Incorporated since XX/XX/XXXX and Seterus Incorporated has never answered the questions. The following is one of many questions not answered. Please keep in mind a response differs from an explanation and under RESPA ( Title:12 Chapter:27 Section:2605 ) I am do an explanation. Paragraph two, Section three of the mortgage signed on XX/XX/XXXX states : Lender may, at any time, collect and hold Funds in an amount ( a ) sufficient to permit Lender to apply the Funds at the time specified under RESPA, and ( b ) not to exceed the maximum amount a lender can require under RESPA. Lender shall estimate the amount of Funds due on the basis of current data and reasonable estimates of expenditures of future Escrow Items or otherwise in accordance with Applicable Law. The phrase a LENDER SHALL defines an obligation. The phrase estimate the Funds due based on current data and reasonable estimates of expenditures of future Escrow Items states that Seterus Incorporated is obligated to look at future events that will effect escrow payments. The payoff of the Note effects future escrow payments ; Seterus Incorporated has NO legal standing to collect escrow payments if the Note has been paid. Seterus Incorporated has the information necessary to determine projected payoff ; in fact I have sent Seterus Incorporated, nearly a year ago, a payment schedule which showed an XXXX payoff. THE QUESTION : Why did Seterus Incorporated fail to fulfill the obligation of correctly estimating the escrow funds? Why was the XXXX payoff not considered? I do not need another copy of incomplete transaction records. I do not need a explanation of how my insurance and taxes increased. I need an answer to why the payoff was not considered.

Complaint: . Seterus reported late mortgage payments on my credit report that are not accurate. They have listed me as being late 30 days XX/XX/2017,XX/XX/2017 and XX/XX/2017 and 60 days late XX/XX/2017 ( I was 30 days late on the XX/XX/2017 payment ). Many payments were not credited to my account correctly. I have tried to dispute this though the credit bureaus, but was told that the information had been verified, but received no proof of this. This is damaging my credit score. I made on line payments and telephone within the grace periods, but these were not credited to my account in a timely manner.

Complaint: I have owned my home for 35 years and face foreclosure auction on XX/XX/XXXX. My mortgage servicer Seterus refuses to consider my application for homeowner assistance programs even though I have had a recent change in my financial circumstances. I have a XXXX XXXX loan backed by the government and I know that there are new government programs available to help people in my situation. I was in a plan with Seterus but due to several default accounts from clients I was in a financial struggle. I called in and thought I had things worked out with them to make the next payment a couple of weeks late, but I was suddenly blindsided with a Notice of Default. Since that time all negotiations have stopped, even though I took action to dramatically increase my income so that I could save my home. However, XXXXeterus is not even bothering to consider this information and has now told me the only option is full reinstatement or they will sell my home. My mother and I bought this house in XXXX and I have put so much money into this place and I don't know what I would do. I need this matter to be investigated, because I know there are options available to fix this problem such as modification, forbearance or repayment plan that Seterus is denying access to. My mother and I bought this home back in XXXX. I have owned and operated my own business XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX for 30 years and have made a good living. I entered this loan through XXXX in XXXX -- I had done a loan with them in the past and their agents contacted me and pitched and prodded me to refinance again to take advantage of the equity and the fact that they would not require any income documentation, and that the loan would be their fast and easy program. I did not realize that the adjustable rate would make my payment gradually increase over the years until it became difficult to afford. After the loan was transferred to Seterus I ended up applying for and was approved for a loan modification. About a year ago I had some issues with clients who did not pay me for the services rendered. It is tough when you are a woman and a small business because some people feel they can take advantage and not pay in full for services rendered because they know you will not take them to court. This caused me to default on my modification. I contacted Seterus and worked out a repayment plan where I would pay {$2200.00} a month ( instead of regular payment of {$1500.00} a month ) to catch up on the delinquent payments over time. I was to make 6 of these payments. I made the first three with no problem then I ran into financial troubles again. I called in and asked if I could make the payment late, and they accepted the phone payment. I explained that I would be late again the following month because I was still not caught up and was told that would be fine. However, the following month before I could make my payment I received a Notice of Default and then Seterus refused to accept a single payment from me and began telling me that I needed to reinstate the full past due balance. I began frantically trying to get documents in for review for a new modification but have been given various excusesall documents not received, not eligible because I had a modification before, unable to lower payment because of current rate. I then provided proof of a change in financial circumstances due to adding a boarder and rental income several months ago, but their underwriters refuse to review this information. I believe the statement by Seterus that there is nothing that can be done is false. I have the means to make a reasonable payment and had been in a repayment plan. There are programs and plans that could be presented to avoid foreclosure but instead of reviewing my current and correct financial information Seterus wants to auction my home.

Complaint: My mortgage is current with Seterus Inc., and has been paid on time over the past 9 years. The payment is due on the first ; the grace period is until the XX/XX/XXXXof the month. My payments for XX/XX/XXXX and XX/XX/XXXX were paid after the XX/XX/XXXX but before the XX/XX/XXXX. When receiving the statements, they show a past due amount because the company sends out statements dated the XX/XX/XXXX. There is no past due payment on these statements. When speaking with a rep, I was told this is what the company does and a lot of customers get upset about it. It doesnt look good to get a statement showing past due when that is NOT the case. This could be very confusing to some clients who scramble each month to keep their payments current. They could end up forwarding additional payments thinking theyre past due. The company should be able to change their practice and not send statements out until after the XX/XX/XXXX of the month.

Complaint: Hello We are in desperate need of help with our mortgage servicer. The name of the company is Seterus. We feel this company continue to treat their clients unfairly. They have continued to do so, because no one is holding them accountable. If you look at their reviews from every site, the reviews are terrible and the stories are very sad. This company places your funds into an suspense account and make up ridiculous fees in order to apply the funds to it. They keep applying an NSF fee, which we took care of months ago. Then there is property inspection fees even when your loan is current. They also state the loan is past due or not current, it's like when you pay the amount they say is due, they find ways to say even more funds are needed. We have called several times to get an explanation of fees and how they apply extra funds. Each and every time, the call last at least an hour. The representatives have never been able to give us a clear explanation of fees/overages. They place you on hold for extended periods of time then transfer you to another rep, who is unable to explain fees or answer questions. [ We have spent months looking at their reviews and again, it breaks my heart how this company is behaving. This prompt me to file a XXXX case, which is still somewhat open. Seterus response was that they are not doing anything unethical ... ... Even the report they provided is unclear regarding fees. A customer relations rep, XXXX XXXX responded to XXXX, denying allegations. My response back to XXXX, was why should we believe her, when her voicemail greeting states she will be back in the office on XX/XX/XXXX, we are currently inXX/XX/2018. Why haven't her manager held her accountable regarding voicemail greeting. After bringing it to the XXXX attention, Ms. XXXX updated her voicemail greeting, but I was able to allow several people to listen to voicemail greeting as proof. We even told the company they could possibly feel the wraft of government officials and appear before XXXX XXXX, but they continue to deceive customers. Again, we know you along with your staff is very very very busy, but please please please help us with this matter. If you can not help, please please please point us in the right direction to get some help for us and many others being BULLIED by this company. Thank you

Complaint: My house was impacted by Hurricane Irma. There was damage to roof and interior. The lender, Seterus Inc reached out and offered disaster assistance in the form of a 6 month forebearance. Prior to accepting the offer I asked several times about how this would impact my credit. I was told that nothing would be reported due to the disaster. During that time I attempted to refinance the property to pay for the repairs. I was unable to get a loan due to the lender not reporting. So I waited until the forebearance plan was to end. Before the end of the 6 month forebearance I contacted Seterus to inquire about the return to payments. I was told that I had options going forward. They told me that if I was to make 3 payments over the next few months that my loan would be adjusted. I made the payments but then Seterus reported me as late 150 days to credit burea. When I called and complained I was told that it would be labeled with a code that showed disaster Irma and this would not hurt credit. My credit score dropped over XXXX points. When I called back I was told that the reporting rules changes. They then allowed me to make 2 months payments ahead and brought my account current and adjusted the loan. However they again reported me as 150 days late. Today it shows as current but due to the negative marks I can not refi my house to make repairs.

Complaint: On XX/XX/18, my home was hit by a tornado. My neighborhood was designated a federal disaster area. My home was damaged and needs a new roof and other repairs. My insurance, XXXX XXXX, completed assessment and gave me a check for {$13000.00} to complete repairs. But the check was made out to me and my mortgage service company, Seterus , Inc . They have kept the funds and will only release 25 % to each contractor after the contractor signs and completes three forms, one which must be notarized. After all forms are received, they mail 25 %, which can take up to two weeks. Then, once the job is complete, Seterus sends an inspector to take pictures. Then, they wait the full 5 business days, review the inspection, then mail the rest of the funds for the job completed. So, needless to say, when I talk to contractors to get roof estimate and explain the above process, the contractors decide not to work with me as they have plenty of work to do for people who already have their insurance money to complete the work. My roof has still not been repaired as of this date and it continues to leak more and more and cause more damage to my home. Seterus told me they could release 100 % of the funds as less than {$10000.00} was left. They said they could if I found a contractor to complete all repairs and write a letter explaining why the funds are needed up front. I was able to find someone to agree to this. We completed everything Seterus asked for, sent it in, and they still only sent 25 %. I have spoken with them many times asking for them to please send my money. They have money XXXX XXXX gave them for a tree I already paid to remove, which was {$750.00}. This was done day after storm and I don't know how to get in touch with that contractor. There is also money to repair a mailbox and some other small repairs that do not require licensed contractor. Seters did send two payments to the tree removal contractor and electricians. It took such a very long time to receive the money, I was getting calls and texts from the contractors daily. It was so stressful and the continued damage to my home and inability to get my needed repairs done with my insurance money has caused so much stress and trauma following a federal disaster, which was already the hardest thing I have lived through. No one at the company will try to help me or even try to understand when I talk about neighbors two doors down and one street behind whose homes were completely destroyed. I missed work and income due to the storm as well. All I want is for Seterus to release the funds XXXX XXXX provided to me as their longtime customer.

Complaint: I am a Puerto Rico resident trying to receive an important information needed by XXXX XXXX XXXX XXXX XXXX XXXX, in XXXX XXXX, in order to receive my payment taxes reimbursement. The form No. XXXX, has an incorrect information in the elecronic filing confirmation Number. I had contact the company many times requesting this important information with no positive response. I also sent a letter dated XX/XX/2018, but as today, no action has been taken to process my request.

Complaint: My house and everything i owned was lost due to hurricane Sandy. I am in the process of rebuilding my home and i have had to rent a place while my home gets rebuilt. I qualified and recieved a Certification of Eligibility Sandy-Impacted Forbearance Certification and presented this along with documented evidance that my home was being rebuilt and was denied by Seterus my mortgage provider. I am ccurrently renting another place while i rebuild and would like to have this forebearance honored by my mortgage provide Seterus which will help enable me to complete the rebuilding of my home while renting a place to live. any advise or assistance would be greatly appreciated.
