Complaint: I have made multiple attempts to get information on why the mortgage with this company is still reporting on my credit report. This debt was obtained in the name on myself and my ex-wife. Since then we had been divorced and the mortgage has been taken over by my wife. I had submitted a quit claim deed and was told by the services that I will no longer be obligated for the debt on my account as she assumed the loan. Every time that I call them since this transaction happened, they state that I am no longer on this loan when the loan number is provided to them. They state that they can't find me anywhere in their system by social security number or name. When I provide them with the full account number, I am told that this loan doesn't belong to me and that they can't provide me any information on this loan. I've also called the company directly with my ex-wife and my current loan officer and was told that they can't verify that I have any liability to this loan. I've stated that this is impossible because they are still reporting negatively to the credit bureaus and that improper handling of the payments on this loan that my wife has made has made it impossible to acquire new financing. They still can't provide any information on why it is reporting this way.

Complaint: A late fee of {$39.00} was assessed to my XX/XX/XXXX mortgage statement for account XXXX on XX/XX/XXXX. My mortgage was not late on this day. Seterus received 3 mortgage payments from me via Priority express mail where I mailed 3 separate checks to cover 3 separate mortgages of different addresses in XX/XX/XXXX. Seterus chose to credit the payments for the other 2 mortgages on XX/XX/XXXX, but held off on crediting account XXXX until XX/XX/XXXX. I have a 16 day grace period under account XXXX before a late fee is assessed. However, a late fee was assessed to this account on XX/XX/XXXX, when Seterus had in fact received the payment well before this date. Even if Seterus had received the payment for account XXXX on XX/XX/XXXX, they should NOT have assessed a late fee to this account. Seterus will not remove the fee from my account, and thus, I am asking your office to intervene on my behalf. My mortgage statement for XX/XX/XXXXshows a late fee assessed to account XXXX on XX/XX/XXXX. Also, can you ask Seterus to STOP sending me out double mortgage payment statements for account XXXX, as this seems like intimidation to make me pay 2 months of mortgages ahead of time. I have the right to pay my mortgage on the dates due and should be assessed a late fee if the payment is late, but Seterus does NOT have the right to force me to pay mortgage payments ahead of time, nor should they assess late fees to me on dates when fees should not be assessed. Complaint: It appears that Seterus may be using a delay tactic to provide a mortgage loan borrower potential assistance or information she is legally entitled to in a timely manner. Seterus Correspondence Response Team is sending written correspondence to a Legal Aid 's Executive Director about a mortgage loan he never inquired about. One of the Legal Aid 's staff member represented the borrower on said mortgage loan in the past. The Executive Director was never part of the services provided to said borrower. Per the XX/XX/XXXX correspondence, Seterus records indicated that the Legal Aid currently represents mortgage loan borrower and Seterus did not have the authorization to communicate directly with the borrower. They further went on to confirm that the correspondences the Executive Director had received were not sent in error. The Legal Aid 's staff member that assisted the borrower sent written correspondence to Seterus on XX/XX/XXXX confirming they were no longer representing the borrower. She requested that all future correspondence was addressed to the borrower. On XX/XX/XXXX she sent a second written correspondence to Seterus, which included Seterus internal Third Party Authorization form so their staff could proceed communication with borrower and her daughter who had Power of Attorney.

Complaint: The principal amount owed on my mortgage is {$190000.00}. The original appraised value of the home was {$250000.00}. I am still being charged for PMI each month even though my principal is below 78 % of the original appraised value. I called Seterus in XX/XX/XXXX and they told me that I would no longer be charged for PMI as of my XX/XX/XXXX statement. I was charged for XX/XX/XXXX and my XX/XX/XXXX statement shows that I am still being billed for PMI.

Complaint: On XX/XX/2018 @ XXXX XXXX I submitted a payment to Seterus in the amount of {$1000.00} as I do each month. When the payment did not clear the bank, I called Seterus and they told me that they had just been notified that the payment came back because it had been submitted under the wrong account number. The payments are made through XXXX XXXX on the Seterus website and I received a payment confirmation that I would not have received if I had entered the incorrect loan number. Furthermore, how did they report me delinquent to the credit bureau BEFORE they claim they received the payment back? I immediately contacted the bank and they had no clue what I was talking about. To date I have received no notification from Seterus or the bank, but my credit score dropped 58+ points. I had a loan modification 2 yrs. ago due to unemployment and have diligently made my payments since and have never been delinquent. Seterus had the unmitigated gall to tell me that once they reported me late they could not change it. I have worked in mortgage banking over 20 years and know that to be a blatant lie. I was not late and nothing supports I was. They delayed the payment whether intentionally or not, I want it removed from the credit report that I have worked so hard to improve. They are one of the worst servicers in the business and I will not allow them to ruin what I have worked so hard to achieve.

Complaint: I had a mortgage bought & serviced by Seterus , Inc . I received an email from them on XX/XX/XXXX that stated if I paid off the late fees I would receive a discount of 50 % of these fees if paid by XX/XX/XXXX. I contacted a rep ( either XXXX XXXX or XXXX XXXX ) on or about XX/XX/XXXX regarding a payoff as I was in the process of selling the home. After extended periods on hold and questions I was assured that I would receive an escrow refund as well as the late charge refund within 30 days as required by regulation. I had issues with his responses and asked to speak with a supervisor ( XXXX XXXX ) who indicated the same. I paid off the loan in full ( including the full amount of late charges ) on XX/XX/XXXX. I received a check ( with no explanation or accounting whatsoever ) that stated " escrow disbursement '' with no refund for fees. I spoke with a XXXX XXXX who indicated I would need to send emails to his legal department to receive my refund. I asked to speak with his supervisor ( XXXX XXXX ) who tried to explain that there is an issue that I paid in full rather than just the late charges. The email did not specify any of this and again I was promised by several employees I would recieve my refund within the 30 day regulatory period. I indicated it was their ( Seterus ) issue and they should talk to legal. He refused and I asked to speak with his supervisor ( XXXX XXXX ) whom has not called as of yet. I do not feel like I need to battle their legal department for the refund they promised several times. I can forward all information including the refund email along with loan # 's etc. if necessary.

Complaint: I received a response that doesnt answer my complaint. They are telling the truth I was promised the repayment will not affect my credit score, they lied. I want them to jorobe their word. All the agreements were verbally made and they refused to listen to the conversations. They just dont care. If I knew the repayment will affect my credit I would have chosen a very different route their unethical behavior is affecting many people they dont stand behind their employees, the fact they are not properly trained is not the consiners fault. I just want sereterus to stand by their word, they are legally committed to what they said.

Complaint: Every time I contact Seterus and attempt to make my mortgage payment, they will not allow me to make my payment. Each of their agents keep me on the phone for long periods of time asking the same questions over and over attempting to badger me into committing to payments and payment dates that I know I can not keep. My payment is only one month behind but since they will not allow me to make the payment, I am in danger of falling further behind and I am incurring additional late fees. The tactics used are forcing me to incur late fees and damaging information being added to my credit report. At this point, I feel the company is attempting to force me into foreclosure and using very heavy handed tactics. At the end of the conversation today on XX/XX/2018 at XXXX, the agent would not allow me to make my payment.

Complaint: We have had many problems with communication with Seterus regarding our home mortgage. They do not send us regular statements that tell us the payment amount or how much we have paid. And at the start of every year they recalculate the escrow but do not send us a new statement telling us the new payment amount unless we call them. This change in payment has caused us to get behind as payments we sent to them came up short of the new amount. We recently got just 4 months behind. I had been calling them trying to work things out. They ended up refusing 2 payments that we sent them in XX/XX/XXXX and XX/XX/XXXX and instead put us into foreclosure. I am still trying to get the payment money back, but we made those payments in cash at XXXX and I am having difficulty getting them to return the money even though Seterus did not accept the electronic payments from XXXX. Something else that came out of my initial phone conversations was that we discovered that they had put force-placed home insurace on us. We were unaware of this. It turns out that the monthly payment for force-placed insurance is extra high and does not even provide coverage for our home 's contents! I think it's just a way for Seterus to try to make some extra money. We have gotten a quote for our own insurance and found it will save us about {$100.00} per month. If we can get a modifaction or something similar passed we will eliminate the force-place insurance and use our own better, cheaper insurance. Once I found out that they had moved it to foreclosure we began the process of trying to get a loan modification. They had approved us for a modification quite a few years ago, and told me on the phone we were a good canditate for a new modification. I submitted multiple documents online but never heard back from them if the modification review had begun. So I contacted them by phone and they told me they did not like some of the documents so I resubmitted new documents online and then had to contact them by phone several days later. When I reached them by phone they checked to see if they had received them and then told me that we were DECLINED for a modification. I was originally told there would be a 30-day review so I was really surprised that they would decline us so fast. When I asked why we were delcined the the person I spoke with was very vague about the reasons. There was no one else I could speak with to give me an exact reason. When I pressed her she said that the payment amount may have to be increased if a modification was approved and they didn't want to do that because they didn't know if we could handle an increased payment. I explained that we had been in the house for 14 years and made some 168 payments and did not want to leave our home. We have XXXX children whom we have raised in this home and do not want our family to be forcibly relocated. We can continue to make payments, but what we really need is a reset and a chance to move forward with a clean slate. We can not pay 4 mortagages all at once, but with modification we can continue being a good customer. I have recently begun substitute work that pays at a higher rate than I had previously, and my husband has been driving for XXXX on the side to make extra money. Plus we will be saving $ XXXX/month with the new insurance. We will do whatever it takes to make this work, even if the payment is a little bit higher we have shown that we can afford it. After they told us by phone that they had declined our modification we went to a local government approved credit counseling service. They are trying to help us to get a new modification and we are very grateful for their help. But I am just not confidant that even they can get Seterus to take any action to help us. Just the other day we received an auction sale letter in the mail. It seems like Seterus really just wants to take ownership of the house and doesn't want to help us. I know they say it's a sellers market and it seems like they want to decline a modification and move this to an auction sale and cash in for a quick big profit. If there is anything you can do to hold Seterus accountable and to encourage them to take an honest look at our modification request. We are open to any other options they may have to bring our mortgage to being current. Thank you very much for your help.

According to my bank ( XXXX XXXX XXXX XXXX ), SETERUS, Inc. always cashes my checks between the XXXX and XXXX day of each month. However, on XX/XX/2018 SETERUS sent an offer to reduce fees owed. The letter states that my account is in good standing but I owe {$1000.00} in unpaid late fees. I believe that SETERUS, Inc. is committing fraud because I have never been late with my payments. Complaint: In XX/XX/XXXX, my brother, XXXX XXXX XXXX, a borrower from Seterus Mortgage, suffered a home fire. I, XXXX XXXX, XXXX 's brother, was an Alabama XXXX XXXX at that time, and agreed to give XXXX an estimate for his property repairs, and to share contacts with him that could perform the needed repairs. At no time did I perform any work during the repair project, other than sharing contacts that could perform the work with my brother. XXXX 's home insurance company, XXXX, sent a check for {$25000.00} to Seterus Mortgage. In turn, Seterus, cut a check for the funds, and sent the funds, in increments as the work was completed. XXXX had reported my name as the general contractor for the work, so I endorsed the checks along with my brother XXXX. XXXX was the person who paid all the contractors that I sent to do the work, and has receipts for all the money spent, both on labor and materials. In Spring, XXXX, I received a 1099 from Seterus, stating that the {$25000.00} was considered to be my personal income. I immediately contacted Seterus and was informed by a representative that nothing could be located, and to disregard the 1099. In XX/XX/XXXX I received a letter from the IRS, expecting me to pay taxes on the money that was erroneously reported by the IRS to have been received by me. After speaking to an IRS representative, I was told that I needed to ask Seterus to re issue an amended 10-99, showing that I did not receive this income. After being added as an individual that can discuss the account, by the account holders, and numerous phone calls, both individually and on 3-way call I was told that Seterus needed the receipts showing that the money had been used for materials and labor before they could revise the 1099. On XX/XX/XXXX, I overnighted all the needed receipts and called Seterus two days later to confirm receipt. These were receipts that showed all the money spent, both on labor and materials, and showed that I personally received none of the money. I was told at that they had received the receipts that I would receive a letter within 7 days to confirm their receipt and that another 30 days would be required for them to review and make their decision. After two weeks when I still hadn't received a letter from them I contacted them again asking about the letter. They answered that the letter had been mailed 10 days prior. Today is XX/XX/XXXX and I still have received no letter from them. I contacted Seterus again attempting to resolve this. A representative told me that according to the file he was reading from that my request for a revised 10-99 had been denied by them 3 days ago. Today I still have not received notice of this in the mail. I am only authorized to speak with Seterus regarding this issue until the end of XX/XX/XXXX by the mortgage holders. Seterus has not done what they said in regards to sending me mail documenting receipts that I have sent them. If so, I have not received them. I am concerned that this issue be resolved soon as I am only authorized to speak with Seterus by the mortgage holders through the end of this month. If it is not resolved we will have to go through all the " hoops '' to get this extended for me to be able to continue to discuss this issue. The IRS also, was asking that the amended 10-99 be sent to them by the 3rd week of XX/XX/XXXX.

Complaint: To Whom It May Concern : In lateXX/XX/XXXXor early XX/XX/XXXX, after hurricane Irma hit South Florida I called my mortgage company Seterus Inc. and inquired about a forbearance. A forbearance was granted for eight months and the full payments would be due at the end of XX/XX/XXXX. A few months later I called Seterus and asked about setting up a repayment plan for the months that I was in forbearance. The customer representative said, while your loan is in a forbearance we can't set up a payment plan, but don't worry your account is flagged because you are in a disaster state, and at the end of the forbearance you can apply for a repayment plan for six months to catch up and if that is not enough time we can extend it for another six months. On XX/XX/XXXX, I spoke with XXXX from XXXX XXXX from Clear Point. XXXX took my finances and told me I was a candidate for the Disaster Modification and that I should call the mortgage company and find out the Maturity Date of my loan.XX/XX/XXXX, I spoke again with Tiffany from XXXX XXXX and a representative from Seterus Inc. was on the line. XXXX spoke to the representative of Seterus, and advised that she had reviewed my finances and that I was good candidate for a Disaster Modification. Subsequently, the Seterus representative told me to go online and fill out the Borrower Assistance Form and send it back to them. I completed the Borrower Assistance Form on XX/XX/XXXX, and electronically submitted on the same day. A week later I submitted electronically two months of the requested paystubs. The following week, I received a letter from Seterus Inc. stating that I was denied the modification. ( See Attachment A1-A6-1 and A7-A27 ) I called Seterus to see about a repayment plan, and I was told that I needed to come up with {$18000.00} by the end of the week or make plans to liquidate my property through a Deed in-Lieu or Short-Sale. I feel that Seterus Inc. has not been of any help. I had requested a forbearance due to hardship because of the Hurricane, and when I was not granted a repayment plan or given a modification Seterus Inc. added to my hardship instead of helping me. Prior to Hurricane Irma and before the forbearance, I was current with my mortgage payments. If Seterus Inc. had no plans of helping me by way of a repayment plan or modification as told to me by one of Seterus agents, then Seterus should have not given me eight months of forbearance that was going to make my hardship worse. I feel that Seterus Inc. has set me up to lose my property as they have offered no viable solution. I feel that Seterus Inc. has deceived me when it failed to honor their promise to put me on a payment plan or modify for the payments that were in forbearance. Seterus has not offered to help me at all. Furthermore, Seterus through one of its agents has deceived me again. Seterus Inc. through one of its agents deceived me by asking me to pay {$900.00} toward a past due escrow of {$1800.00}. On Thursday XX/XX/XXXX, I received a call at XXXX from Seterus Loan Company , their phone number XXXX XXXX XXXX XXXX. Loan modification officer XXXX XXXX left me a message regarding my property and asked me to call him at XXXX ( See Attachment B-1 ). On XX/XX/XXXX, I returned the call to XXXX XXXX on Friday XX/XX/XXXX as indicated in the voice message. I left a message. At around XXXX, I received an incoming call from Seterus Inc XXXX XXXX XXXX. XXXX XXXX ID # XXXX stated that I had four options to help me with my loan. He indicated the four options as follows : 1. Repayment Plan 2. XXXX or no job 3. Modification 4. Foreclosure I told him that I wanted to keep my property and that foreclosure was not an option for me. He said he could get me in a modification. He reported that based on my credit score/rating 1-10 my score fell at a 5 which was not bad or good but that he could help me. I asked if I could call him back in a few minutes because I needed to speak with someone he said yes. I called a very trustworthy friend of mine and we called Seterus Inc. back and spoke with XXXX XXXX she asked him why he could grant a Modification after I had already been turned down and he replied, I am over the Modification Department and I will grant her the modification if she pays the good faith {$1800.00} which is the amount shes behind on her Escrow Balance. He stated that the call was being recorded. We asked that the agreement be provided in writing, but he stated I needed to show good faith by paying the {$1800.00}. In order to assure me that the agreement was valid, he indicated that the call was being recorded, and that once Seterus Inc received the {$1800.00} the modification process would be finalized. I told XXXX XXXX that I only had half on the money, and the other half I would pay on XX/XX/XXXX. He stated that he needed to ask accounting if that was okay and that he would call me back. I didnt wait for the return call and I called him back. He stated I was just about to call you and that accounting said the {$900.00} payment towards the {$1800.00} would be fine and that the remaining {$910.00} would be due on XX/XX/XXXX. He took my XXXX XXXX Bank debit card information for {$900.00}. He called me back a few minutes later and said that because my account was delinquent the payment had to be electronically sent. When I asked him how to do that he stated that it could be done through XXXX XXXX. He told me to call him when I got to the XXXX and hed give me the information to write on the money transfer form. When I got to XXXX, I called him back and he told me what to write on the send money form. He gave me the following information to write : XXXX XXXX XXXX, phone # XXXX, property address XXXX XXXX XXXX XXXX XXXX, Fl. XXXX. Receiver information was an attorney named XXXX XXXX XXXX, XXXX, Florida XXXX. He stayed on the line while the Customer Service person at XXXX assisted me. Once the transaction was completed he asked for the reference # XXXX. He told me that he would call me back within 45 minutes to let me know if the fund had been received. He didnt call me back so I called him back at XXXX XXXX XX/XX/XXXX and left a message. He returned my call from the main number at Seterus Inc XXXX at XXXX XXXX to tell me that it was received. And the reference number was # XXXX. While on the line he also stated that he was working on my modification and that he would be in contact with me on Monday XX/XX/XXXX. Well Monday came and left and XXXX XXXX did not call me back. On XX/XX/XXXX at XXXX, I called XXXX XXXX XXXX , but I only got his voice message. I called him repeatedly ( at least 8 times and I left 2 messages ) but he never responded back. So, at XXXX, I called Seterus Incs main phone number XXXX. After following the prompt, a representative came on the line I asked to speak with XXXX XXXX XXXX in the modification department. The lady asked me what questions do you have about your modification? I told her what had transpired on XX/XX/XXXX between XXXX XXXX XXXX and myself. She asked that I hold on, when she returned she said she was unable to locate anyone by that name at Seterus Inc. She asked that I recap the events that transpired again for the email she was sending to the Seterus Fraud Department. I was in tears as I talked to the Seterus representative she told me she was sorry that I went through that. I asked her how could someone call me from their main phone line, and ask me to call them on a different number. She said that she did not know what had happened. The calls from XXXX XXXX came from Seterus Inc. direct line, and Seterus Inc. has failed to account for the {$900.00} paid. Before the call ended, I told her I still wanted to save my home and what I could do, she paused and said, you still have options one of which is a SHORT SALE. As referenced above my mortgage was current until I entered into the eight months forbearance agreement due to hardship because of the storm. If I thought that Seterus Inc. was not going to help me with the forbearance payment through a repayment plan or a modification, I would have never accepted the forbearance. I thought that Seterus Inc. was helping me, but instead they were creating a bigger hardship for me since there is no way that I can come up with a lump sum of {$23000.00}. In addition, Seterus Inc, through his agent XXXX XXXX took {$900.00} from me. I asked that the {$900.00} be applied towards my mortgage or be refunded to me. I am also, asking for the opportunity to save my home. I am a XXXX XXXX of 32 years, a single parent, and I have a minor child living with me.
