On my most recent statements, Seterus has been charging a monthly charge of {$260.00} for insurance and taxes. I have complained to the company ( letter attached ) that it is double-billing me, because since I took ownership of the property I have paid the property taxes ( recent XXXX County tax bill attached ), and have carried my own insurance. I have asked Seterus for an itemized statement of complete charges for insurance and tax charges, so I may claim insurance and property tax refunds.

Complaint: During the XXXX XXXX my tenants left without notice, I called the bank and I asked for a repayment plant for the month of XX/XX/XXXX, I was not late when I called. The suppose to give a repayment plan without affecting my credit but they lied not only that they charged me for a fee that I didnt agreed upon. I called several times XXXX I kept receiving these late fees letters and everytime I called I was told the repayment plan will take care of it that I wasnt being charged form them. I made my last payment in XX/XX/XXXX. My credit score went down 31 points thats when I found out they reported late payments. Im very disappointed, I complaint and they suppose to start an investigation but apparently that was never done. They are cheaters and liers they dont have a good customer service most of them dont know even simple math. They need to be investigated they dont even seem a serious bank. My loan was sold to them by my bank and at this point I cant even refinance with other bank because of the bad report. I havent been late with a mortgage payment in many years I believe they did this in porpoise because I threaten them with leaving the bank. Thank you

Complaint: The purpose of this written request is to request an explanation and documentation as to why a secondary corrected IRS Form 1098 was issued for loan # XXXX. This information is necessary to file an amended 2017 Federal and State Tax Return and to file a formal complaint with Internal Revenue Service against Seterus Inc. and file a formal complaint with the District Attorney Office of XXXX XXXX. It appears based on this information provided that Seterus Inc. has been manipulating and wrongfully distributing the contractual principal and interest payments in to a defunct escrow account and suspension account thus resulting in a corrected Form 1098 to be generated. It also shows that Seterus Inc. is wrongfully administering the contractual principal and interest payments in order to fabricate a delinquent mortgage account with an intent to generate a loan modification for which Seterus Inc. has a financial gain interest in and/or a notice of default to produce unverifiable fees and service charges.

Complaint: Daily multiple harrasemnt by phone for a debt that is not owed. Have sent proof multiple times to Seterus Inc. they refuse to correct their accounting errors. They have sent people to my home multiple times have illegaly entered my home, I have been threatened with physical harm by these people. I have served Seterus twice with cease and desist letters they refuse to comply, They have violated FTC rules and regulations have misshandled funds have illegaly held funds causing late payments and pyramiding late charges, they send monthly threats for two years to place me in forclosure, One of their inspectors was caught in my garage when I confronted him he brandished a XXXX XXXX XXXX forcing me to flee inside in fear of my life. They have made it so my family does not feel safe in their own home. Have trespassed multiple times on my property after being served in writing that they are not allowed on my property. I do not even know how they ended up with my mortgage.

Complaint: My parents passed away in rapid succession. The home is in a real estate trust. My sister lives in the home and we want to keep it. There is a mortgage on the home of XXXX. Seterus is servicing the loan for XXXX XXXX, according to the loan instrument there was no requirement to escrow insurance. Once Seterus began servicing the loan it immediately went into default. They never notified me or my sister and were sending notices to a mail box that had been closed for two years. I kept calling and tried to make a payment because I knew there was a payment. It took two years and multiple attempts to add me to the loan as Trustee of the Trust. Seterus keeps asking me to assume the loan and I told them I am not responsible for the debt but will pay because we want to keep the house. My sister is living in the house and was making the mortgage payments. I reviewed an escrow statement and saw they were charging us for forced place insurance, despite the fact we had insurance. This went on for over a year and I didn't know because my sister was paying the bill. I asked them to correct it because we had XXXX and they refused. The insurance finally took affect in XX/XX/XXXX despite the fact I had been paying it for months. I asked them to refund the difference and issue a new escrow statement on the phone. Yesterday I got a notice of foreclosure mailed to XXXX XXXX where I live, the notice was dated XX/XX/XXXX. I didn't get it until the XXXX of XX/XX/XXXX. I called them immediately to make a payment and check to see if the escrow had been corrected. The woman told me I had until XX/XX/XXXX to pay XXXX dollars. She checked and the XXXX insurance is finally showing for XXXX XXXX and XXXX. I asked to make a payment over the phone for XXXX, told them I would make another next week and would be able to make a third payment in a week or so to get the loan current now that the escrow is fixed and would coordinate with my sister to make the final payment. I don't think its fair to give me approximately a weeks notice to come up with XXXX dollars since they created the problem by screwing up the escrow. I can't make payments online because its in an estate and the woman wouldn't except my payment on the phone. So I am basically offering to pay the full amount before XX/XX/XXXX although it would be helpful to have additional time. She told me to pay XXXX XXXX speed pay. 1. Do they have a right to make the loan escrowed, used to be XXXX now serviced by Seterus who XXXX the mortgage used to be XXXX before I fixed the escrow they were charging XXXX. I also noticed they charged late fees and property inspection fees despite the fact they have had my contact info for 3 plus years and the home has been occupied the entire time. My Mom died in XXXX of XXXX and my sister lives in the house. I don't think they inspected the home and these fees are bogus and a way to XXXX people with fake fees. My sister has seasonal employment and gets her checks every two to three months. 2. They told me to pay with XXXX XXXX speed pay but I was uncomfortable doing that because I have no assurance they won't take the money and foreclose anyway. 3. I signed the letter yesterday XX/XX/XXXX and the letter said 30 days for XX/XX/XXXX. I think I should have 30 days from receipt. Complaint: I received my mortgage statement, due for XX/XX/2018. On that statement, Seterus, the servicer failed to account for receiving my mortgage payment on time, on XX/XX/2018. I have proof of payment from my bank, showing the electronic transfer being received by Seterus ( attached ). Instead however, Seterus dated my XXXX mortgage statement on XX/XX/2018, five ( 5 ) days before the date the payment is considered late and assessed a late fee. Again, XXXX received my mortgage payment on time and I have proof. Nonetheless, they assessed a late fee -- this is in violation of the Note and Deed of Trust, which states the payment is not late until the XXXX of each month. This must be a newest/lateest tactic to assess late fees .. telling the borrower he/she is late even before the late fee can legally be assessed. Moreover, my XXXX mortgage statement was not received in the mail until XX/XX/2018. It does not take 10 days for the mail, so the fact that the statement is dated XX/XX/2018 means they held on to it before placing it in the mail. This company should not be servicing loans. A few months ago I was forced to file a complaint because for over 1 year Seterus refused to send me my statements in the mail. And, now that they have finally started sending me my mortgage statement in the mail they are assessing late fees prior to the date they are legally entitled to do so.

Complaint: XXXX I signed a modification document, that stated unknown to me that I would be liable for XXXX for the modification. That amount showed up on my loan XX/XX/XXXX, and I was shocked. I did not realize such a thing existed. I feel I was taken advantage of during a time when all others were losing their homes, and I tried to retain mine. As a senior ciziten, I feel horrible that someone would even write such a document to keep someone in their home. Seterus enforced this and I am opposed to it. It is unhuman to do this to another person. Seterus, has received XXXX from Keep Your Home California for me XXXX, XXXX, to be applied to the principal balance, a statement that I asked to see prior to signing but they are not allowed to send until I sign the proposed modification which is fraud. I want to know where did the money go, what is the new principal balance and the documents sent does not clarity that. Why is my payment still so high. My payment prior to reciving the XXXX was XXXX per month. Now, with the XXXX applied my payment are only reduced by XXXX a month. When contacting Keep Your Home California they said it's should be worked out between me and the service but Seterus told me to sign or else. I fear Seterus as they are not a good company and they do not have clients interest especially elders at hearXXXX. Can you help me!

Complaint: An audit of the escrow account discovered that the outside tax processing vendor Seterus contracted with for monitoring, processing, and maintain the requirements of the escrow and failed to meet its contractual obligation to maintain an escrow account within compliance of RESPA for escrow accounts. BetweenXX/XX/XXXX andXX/XX/XXXX Seterus outside tax processing vendor failed to pay the correct tax payment resulting in XXXX tax default noticed placed on the property. In addition, Seterus outside tax processing vendor failed to monitor and update the financial requirements for county taxes resulting in negative escrow balance of $ XXXX. In addition, the escrow analysis that was conduct in XX/XX/XXXX, Seterus outside tax processing vendor stated it had paid the property to County of XXXX on XX/XX/XXXX for the amount of {$2300.00}. However, that payment was never made resulting in the borrower having to pay the property taxes in order to prevent a tax default for the third time. This discrepancy was brought to Seterus attention which resulted in refund to escrow account. This refund caused a significant overage in the escrow account. As a result of the borrower now paying the property tax and insurance, the significant overage in the escrow account that existed inXX/XX/XXXX, the prior tax defaults, and escrow deficiencies due to poor management by Seterus outside tax processing vendor, the borrower requested control of paying the property taxes and insurance going forward. The borrower worked with customer service manager XXXX XXXX who would work with the departments and resources required to close the escrow account. XXXX XXXX instructed the borrower to make the contractual loan payment for principle and interest in the amount of {$1200.00} thus omitting the escrow payment and going forward and pay the property tax. The borrower abided by these temporary terms. Between XX/XX/XXXX and XX/XX/XXXX XXXX XXXX worked diligently to close the escrow account, however the tasks that were entered into Seterus system to close the escrow account were not completed or deleted on several occasions. Because of this, the account fell into a deep default in XX/XX/XXXXdue to the automated payment processing system Seterus utilizes was continuing to fund the escrow account and was shorting the contractual principle and interest payment. This resulted in an escrow account that had substantial overage, but a defaulted account. Since XXXX XXXX had exhausted all her efforts to close the escrow account and corrected the default, XXXX XXXX assumed the effort. In XX/XX/XXXX XXXX XXXX discussed the option of correcting the default by paying the escrow payments that were omitted for the prior months and that Seterus would roll the payments back toXX/XX/XXXX and correct the payment history and bring the account current up toXX/XX/XXXX. The borrower agreed and on XX/XX/XXXX the borrower issued a payment to Seterus for {$2300.00}. Once payment was received, Just XXXX gave specific instruction in a task for account to complete the transaction correction. However, an error occurred and the accounting department to did not complete the task correctly. XXXX XXXX discussed the error with the borrower and because the grace period for XX/XX/XXXX had passed, an additional payment of {$1000.00} was needed to have enough funds available for the accounting department to run the payment correction again. However, the accounting department failed to process the correction correctly. In XX/XX/XXXX, another attempt was made and the borrower issued another payment in the amount of {$1000.00} issued. Once again accounting failed to complete the payment correction. It was determined that the payment system was continuing to acknowledge that an escrow account existed and was continuing to fund that account. As XX/XX/XXXX, the escrow overage had increased to {$6800.00}. Another attempt was made inXX/XX/XXXX to correct the account and required the borrower to provide another {$380.00} which was issued by the borrower onXX/XX/XXXX. Again the effort to correct the account failed. In XX/XX/XXXXthe option of using the escrow surplus to correct the default was discussed. The borrower made the contractual payment of {$1200.00} in order to meet his obligation to the loan. After internal discussion at Seterus, the borrower would need to submit a request to authorize the use of escrow funds to correct the default on the account. That is where this request stems from. The request was to be submitted in XXXX, however an accidental payment for homeowners insurance was issued in the amount of {$890.00}. The borrower needed to wait until the payment was refunded before submitting the request. The refund was credited back to the escrow account on or about XX/XX/XXXX. On XX/XX/XXXX, the borrower made another contractual payment to Seterus for {$1200.00} to keep the account current on contractual payments.

Complaint: Seterus, Inc. took over my mortgage loan. I have had problems with this company for several years. They told me for a very long time I had missed a payment, after sending them all of my bank statements to prove that I hadn't missed a payment, they found out they applied a payment of mine to the principal amount, not my mortgage payment. I have been told I was late several times when I mail my mortgage check to them several weeks early. I have been told that I've missed payments and been late and have to continue to scan them documentation to support that they have cashed my checks. I have tried to refinance with a new mortgage company but I also have problems with this because Seterus does not report any payments to the credit bureau.

Complaint: We were in foreclosure on our home. We went and spoke to a housing counseling agency who told us to begin saving all of our payments and the past due payments until our court date. On our court date we were told the foreclosure had been dismissed by Seterus although we had received a new foreclosure notice about 2 weeks prior. We asked our housing agency counselor how do we get current we have saved the payments and can pay up to date. She asked the attorney to send us a reinstatement letter. We received that letter after 2 additional requests for it. We went to the bank and wired the funds by the due date XX/XX/XXXX. Plus an additional {$930.00} to cover the XXXX mortgage payment. For a total wire of {$10000.00}. When I called in the following Friday XX/XX/XXXX to confirm Seterus receipt of our payment and that we were in good stAnding I was informed that we still owed the XX/XX/XXXX payment. That we had to pay {$10000.00} based on a statement we received from the company on XX/XX/XXXX. But that statement was received and dated prior to the attorneys letter that we received on XX/XX/XXXX. Seterus is telling us that they have nothing to do with what their attorney sent us. That those numbers were wrong.

Complaint: Seterus Inc. Is the servicer of my mortgage. I was late one payment but i caught up. They are trying to say i owe 2 months and late fees and im behind 3 minths on my mortgage. I called and spoke with a representative by the name of XXXX who said it was an error and i would get a corrected statement. Never recieved it. They sent loan modification papers via fedex why. Im not behind. Called again spoke to XXXX XXXX stated that sorry was an error would get a stated showing corrected amount by XX/XX/XXXX. Never happened asked to speak with a supervisor was never given the opportunity but said supervisor XXXX XXXX would contact me never happen. But i recieved an intent to forclose on XX/XX/XXXX. Complaint: I have been asking my loan servicer -Seterus Inc. 2 years, for the " rights '' to pay my own property tax myself, rather than they pay it. The reason for that is they change my monthly payment amount so often, which made it difficult for me to understand their bills. For example, the bill I have received this month stated the payment should be {$1600.00}. But amount due is {$1700.00}. and total charge is {$15.00}. I am an XXXX, seen bills and invoiced every day, but could not understand their billing at all. Please see attached 1. In early XX/XX/XXXX, I paid my monthly payment of XXXX from my checking account with XXXX. However, I was not aware that the checking account did not have sufficient fund, and XXXX ignore the fact that I have authorized to transfer from saving to checking whenever such issue happened. I found the issue on XX/XX/XXXX, and immediately went to a XXXX branch, transferred fund and cut two checks for both XX/XX/XXXX andXX/XX/XXXX. The funds were withdrawn from my account on XX/XX/XXXX, due to the holidays. Please see attached 2. Seterus determined that I did not pay " on time '' and charged me for penalty and interest. I have called and explained the situation, and asked a waiver for the penalties since this is the first time in the year that the payment was ever late, and I have paid the next month 's ahead of the due date as my gesture of apology and a try of making it up for Seterus. Seterus cashed my XX/XX/XXXX mortgage check on XX/XX/XXXX, and ignore the fact that it was a mistake which I believe should be forgiven. As a contrast, XXXX did waive its over withdrew fee for me. I have called the company, the Rep told me that he would waive the late fee and charges, if I pay an additional check of {$76.00}, and change monthly payment from $ XXXX.to XXXX which I did. In addition, he asked me to pay XX/XX/XXXX mortgage before XX/XX/XXXX, which I also did. He promised that if I paid as he requested, he would waived the charges and not to report to damage my credit. I have paid on XX/XX/XXXX for both of the amounts that he requested. Please see the attachment 3 and 4. Seterus received and cashed out all these payments, but did not waive any fee and/or charges. Moreover, Seterus ignored all my good gesture and reported to the credit bureau which caused my credit score went down from XXXX to XXXX, and claimed that it is its right to do so and further hurt me. See attached 5. I think the above actions and tactics that Seterus used is not acceptable. My request are : a. Please waive the charges and interests that were added to my account, for the above stated and backed-up reason, b. Please take away the credit report which has been damaging me since Seterus Rep himself agreed it should not be there. I have realized what Seterus is practicing and using against homeowners like me is particular with this company. They are not only improper, but also deceiving. The only possible result is to have more people to voice our anger on the web, and gave Seterus bad remarks, which I have realized that Seterus doesnt care. Maybe some hundreds dollars are more important to Seterus than a good reputation of the company. I have read many comments on the web regarding Seterus. Many people claimed it is the worst company, and experienced same nightmare as I did. I understand that Seterus has more issues with people who can pay than those who cant pay. I believe it is due to the fact that this company is more interested in taking away our home, rather than to find a way to solve these issues. All these fact made me feel really sick of my mortgage server Seterus. I wish that I do not have anything to do with it. I want to be able to pay tax myself at the minimum, so that I dont have to deal with its ever changed and bills. I was told by Seterus that I couldn't because it is a XXXX XXXX loan, therefore it is not allowed. I never get a reasonable answer. I understood that if the loan to value is below 70 % ( mine loan to value is Approx 57 % ), and if the payments is always on time ( which I did, except the incident mentioned above ), and if the credit score is okay ( I do not have any bad remarks except from Seterus ) it should be sufficient for the approval. Please let me why it is not allowed in my case. Please help!

Complaint: My mortgage was behind because I was working part-time and then lost my job. Florida 's Hardest Hit payed the past due, plus 12 payments. The loan was in default again because I still had no income. I was told that I didn't qualify for modification without income. Once my social security XXXX was approved I applied for modification. I was told that I needed to pay the past due amount so I did. I was then told that I didn't qualify for modification because I was not past due. I was then told that once I begin making partial payments I would fall behind again and would then qualify. I contacted XXXX for assistance but Seterus would not speak to me with them on the line, so I spoke with Seterus on my own. I only had a few days to make a decision and I was sick with the XXXX. I later realized that my interest rate remained the same, my payment was reduced by a minimal amount and my loan terms were extended an additional 30 years. The original mortgage was 30 years and I have approximately 20 years of payments. I would like to know why the modification ( which I thought was designed to benefit me as well as my lender ) has left me with a 40 year mortgage. I called on XX/XX/2018 and asked for an explanation of the terms of the modification.

Complaint: I have been fighting a foreclosure for eight years. My loan was about {$130000.00} and my house was worth much more - about {$290000.00}. XXXX refused to refinance or even give me an application. They kept saying all that I could do was turn over my house to them. They sued me and then withdrew. I believe XXXX does not have proper legal standing. Meanwhile, XXXX and Seterus have hired property management companies who have illegally entered my home and stole my personal property. They have done this numerous times. They say they have locksmith keys and able to unlock my doors and enter my home. There are no provisions in my mortgage for them to do this. From XXXX through XX/XX/XXXX, a property inspector has been entering my home and was removing my personal property. He took my beautiful collection of Christmas Ornaments that I have had for many years, pearls, bake ware, stamps and more. I placed a sign on the door that my home was owner occupied and that they had no right to enter my home. The sign was disregarded and they entered again and took more of my property. I have found my personal papers ransacked. One time. The property manager smashed up my door with a hammer. In XXXX, my friend and neighbor tried to stop two men who were drilling out my locks. My friend and neighbor insisted that the house was not abandoned. That did not deter the two men who could barely speak English. I found they stole three brand new XXXX handbags, my gold ring and lots more. A XXXX employee was coercing me on the phone telling me that the break-ins would continue until I signed a new mortgage or turned over my house to them. The banks 's property inspectors have disconnected my washing machine, dryer, dishwasher, and they have tampered with my well. They have cut down my beautiful bushes and intimidated my friend off the property with a machete. On another occasion in XX/XX/XXXX, a group of property inspectors ransacked my house stealing my tools, camera lenses, silverware, XXXX jewelry, XXXX Tin and a postcard and lots more, They even defecated and wiped themselves with my towels. XXXX and Seterus and their property inspectors have caused me significant emotional distress. I want the following information : 1. All the purchase orders that XXXX and Seterus have given to all the property management companies and or their contractors that they have hired ; 2. Every document giving the property inspectors authorization for the services they were to preform at my house ; 3. I want all the reports, photographs and all other records prepared by the contractors and transfered to XXXX and Seterus and the property manager including XXXX XXXX, XXXX and XXXX XXXX XXXX and any other property inspector. 4. I want all the names of the contractors and the times and dates that they entered my home ; 5. The Inspector indicated that they had passkeys and were allowed to enter HUD houses. A week earlier, when I came home, I discovered her lock had been removed from the storm door and her interior door window smashed. No stickers were left. I believe that this incident was connected to XXXX. On or about XX/XX/XXXX, I discovered that her storm door was unlocked forcibly. Upon a closer look, she realized that the locks on her interior door had been changed. I called a locksmith who drilled out the locks. When she entered the house she found her house had been ransacked, furniture broken, and property missing. The friend indicated that he had advised the men that the house was owner occupied. The men insisted on proceeding because they had explicit permission from the bank to change the locks and winterize the house. The friend said that he felt intimidated by the men, one was carrying a machete. I left her job in XXXX XXXX XXXX and rushed home. There discovered the house locked up with a latch and padlock on her storm door and a lock box placed on the interior doorknob and the locks changed. Once I gained access to her home again, she found that her gold ring, 3 brand new XXXX handbags, a fifty-dollar bill and additional things were missing from her home. I contacted XXXX XXXX who indicated that they had received a purchase order from XXXX authorizing the work and entry to the house. Icontacted the XXXX as well. A neighbor had also encountered the two men who claimed that they were code enforcers.
