Complaint: Hello, Please help me resolve this long standing, stressful, mistake ridden, situation with Seterus , Inc . It has been since XXXX XXXX XXXX XXXX, XXXX. I live in Georgia. My home has been in foreclosure 3 times. It has not foreclosed. I am the homeowner. I own the home secured by this note, the note is in my former late husband 's name and the security deed, security deed was in both of our names since XXXX XXXX, ( this was a refi loan XXXX ). When XXXX died suddenly on XXXX/XXXX/XXXX the ownership transferred solely to me. We had Joint Tenants With Right of Survivorship. XXXX XXXX XXXX stated in XXXX XXXX, if I brought the loan current ( with Life Insurance moneys ) they would modify after 12 months of on time payment.XX/XX/XXXX, I paid approx. {$56000.00} and continued making payments of {$2200.00} thru XXXX XXXX. When I tried to apply for help in XXXX XXXX, XXXX stated " no '' it was a non-conforming loan. I could no longer afford the {$2200.00} per mo. After loosing XXXX, his death, XXXX kids, XXXX XXXX was hit hard, a drastic decline in the economy, I ended up loosing my business.
They refused to speak with me, until my first complaint in XXXX with CFPB. This is a XXXX mortgage loan. It began in XXXX the XXXX Help Center, XXXX, GA contacted me to help reduce the interest rate of XXXX to a current much lower affordable rate. They knew XXXX was the borrower, All parties knew he passed away.
XXXX XXXX brokered the mortgage to XXXX XXXX Loans, ( same day ) then to XXXX XXXX XXXX and then to Seterus in XXXX.
IN XXXX The XXXX help Center advised me to " assume '' the mortgage before a modification was done. I contacted Seterus, they stated there was " no such thing as an assumption, it was an outdated practice from the XXXX.The XXXX help center is not available. XXXX did not work. I worked a mortgage counselor-free, hired an atty who 's firm case mgr promised me a modification, yet my home went up for foreclosure while I retained them. The Friday before foreclosure was referred to a XXXX atty to help stop the process FOR {$5000.00} I put into atty # XXXX 's acct, to be advised by atty # XXXX, they all collaborated, to do a CH XXXX, filed but did not happen, harmed my credit. I contacted you and everyone I could think of as " the successor of interest '' info on security deed and thru your info on your website. I believe I am an owner of interest, as well of successor of interest. After my complaint Seterus contacted me. They tried to offer a modification pkg with era 's from dates not matching to wrong information. I asked them to correct all. It was many times, mine was a 'special case ' 'having to be written by hand '. I asked for XXXX. Seterus said NO. XXXX qualified me for HAMP. I had correct info, 3 month trial plan XXXX, XXXX, and XXXX. During this time I received two letters. # 1 CONGRATS you are about to receive permanent modification. # 2 There is no possible way to assume this mortgage while it is in modification. XXXXSeterus told me to ignore it. I was then told I no longer qualified for a HAMP due to " non payment ''. They never had me assume the loan nor provided clear info on how to proceed after the trial period. After more pursuing, I have been offered assumption and modification, XXXX streamlined mod BUT IT IS 48 % of my income. I was told that I was no longer eligible for HAMP due to non payment. I did not assume it. I would like the HAMP.
Same date : XXXX XXXX, XXXX assumption had to be complete, XXXX payment made and FORECLOSURE letter and foreclosure would start XXXX/XXXX/XXXX. The assumption has multiple incorrect info on it. I scratched out, initialed it, signed under duress of foreclosure, sent it in. I have not made the payment, 48 % of my income is a potential problem. Can anything XXXX/Seterus make good on mistakes? I have accrued a lot of interest, I have done everything they have asked. All is documented.

Complaint: See Prior CFPB Case # XXXX SETERUS - Fraudulent and bad faith lending practices. Fraudulent foreclosure. Misrepresentations in lending.
In XXXX, my mother passed away and I inherited her condominium located at XXXX XXXX XXXX XXXX, XXXX, California XXXX. As the estate was finalizing, the Lender was transferred from XXXX to XXXX ( see prior complaint against XXXX ). After multiple 'lies '' by XXXX and bad faith, XXXX then transferred the Loan to Seterus in XXXX which required me to start the process over of assuming a loan. Seterus, throughout the process, has misled me, committed fraud, backdated letters sent to me, indicated they sent letters which were never sent and are attempting to 'steal ' a property and I am doing everything possible to assume. They have set a foreclosure date of XXXX XXXX, XXXX so that matter is urgent! I am providing extensive documentation of my communication with XXXX and Seterus and their bad faith and fraudulent lending practices. Where is process now? After being told by Seterus on multiple occasions that a Loan Assumption Packet was complete ( originally completed XXXX XXXX, XXXX ), Seterus is now requiring a new packet. I received XXXX letters from Seterus this past weekend XXXX XXXX XXXX, XXXX ) which indicated the loan was " in process ''. I had spoken with XXXX XXXX of Seterus on XXXX XXXX, XXXX who indicated my Assumption packet was complete with the exception of a utility bill and an address. I immediately faxed the requested information ( attached ). Thankfully, I phoned Seterus today ( XXXX XXXX, XXXX ). I spoke with XXXX XXXX who informed me that XXXX XXXX was incorrect and an entirely NEW Loan Assumption packet was needed. This was the first time I was informed as such. It is clear that Seterus and committing fraud and bad faith and attempting to steal my property. At all times, I 've tried to pay the mortgage and assume the loan, but Seterus continues to misrepresent the status of my assumption packet in an effort to sell my property. This is my home and I want to keep this property. Please read prior Case # XXXX.
I have now initiated at least 8 phone calls with Seterus and am basically lied to or mislead in every call. As an attorney myself, I 've never encountered such fraud and bad faith. Please help. I 've done everything I can to assume this loan and the predatory lending practices by Seterus will not stop.

Complaint: XXXX XXXX, XXXX I received a letter giving me a trial modification with Seterus. The trial went from XXXX XXXX, XXXX to XXXX XXXX, XXXX. I paid all the trial payments on time and did n't receive a modification. I have n't received anything in writing to inform me of the status of my loan.
After the XXXX XXXX was made I called asking about converting the trial modification over to a permanent modification I was told it was n't completed. I was verbal directed to continue paying the modification amount until I heard from Seterus.
I am on emergency mortgage assistance program under CT Housing Finance Authority. I pay a portion of my mortgage to CHFA and they pay Seterus my whole mortgage payment. Toward the end of the trial I found out CHFA was paying the whole amount of my mortgage not the modification amount. When CHFA called Seterus wanting the difference back between the mortgage amount & the modification amount they were told the difference went to my principal balance. I was told my trial mod was n't hurt due to the higher payment being made.
When I called XXXX XXXX, XXXX I was verbally told I was n't getting the mod because my account was n't behind, it was now up to date. I upheld my side of the agreement - Seterus failed to upheld their side of the agreement. Seterus has not converted my mortgage to a permanent modification.

Complaint: My now-deceased mom was offered a second mortgage for {$250000.00} on her co-op in XX/XX/XXXX when she was XXXX years old, her only income was XXXX a year social security and in poor health. The lender, XXXX XXXX XXXX, could never have expected this loan to be repaid, as it was a 30-year mortgage with the first ten years 'interest-only, ' not going to the principal. She obviously had no ability to repay but must have accepted the offer to pay other debts, including her medical bills. It was only after she passed in XX/XX/XXXX I discovered these shenanigans. But I have insufficient resources to pay this underwater mortgage. They then declared a foreclosure sale date twice, but canceled both times. Now, the servicer refuses to offer a principal reduction or deed in lieu of foreclosure, and the contact person, XXXX XXXX at Seterus, XXXX extension XXXX, does n't even answer the phone or emails! They keep sending requests for documentation of my meager income, which is irrelevant, as I am not on the mortgage and my mom left no will. When I explained this, they falsely declared I " withdrew my request for assistance. '' My question is : what benefit are citizens getting from the XXXX, XXXX XXXX settlement XXXX XXXX XXXX supposedly paid for mortgage fraud? Thank you!

Complaint: " Please be advised that in order for loans to be eligible for modification assistance, they typically must be over 60 days delinquent. However, based on the information you provided, you demonstrated danger of imminent default and became eligible for the four month Trial Period Plan. Under the terms of the Program, reduced payments of {$630.00} were due XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX, XXXX, and XXXX XXXX, XXXX. The reduced payments were designed to put your loan delinquent in order to meet the requirements of the owner of the loan, XXXX. Because you did not perform on the proposed Trial Period Plan terms ; rather, you remitted your XXXX Trial Period Plan payments early and the loan remained contractually current. Therefore, the Trial Payment was denied on XXXX XXXX, XXXX. '' Once again XXXX XXXX XXXX & XXXX XXXX of Seterus has given incorrect information. The letter of XXXX which I received on XXXX/XXXX/XXXX from XXXX states that the payments of XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX were received were designed to put my loan in default. If that was the case, I could not have made the payments early as stated since SETERUS took the payments out directly from my XXXX bank act and if they wanted to make them delinquent, that was their priority. I was also advised by them to " never be late '' as well as Making Home Affordable " to never be late '' and Seterus told me to allow them to take the $ out of my account directly so this would happen. I was told when the Denial came to me to make up all the payments or I would be charged late charges on everything, causing me to have a foreclosure. And that my Credit Score would also be affected. ( I have been advised to go directly to XXXX and one other Government Official if Seterus does not grant me the Modification. ) At this point it is very difficult for me to make these payments because my situation is about the same if not a little worse. However I would rather starve then let Seterus claim my home. And going through all the paper works that I went through the first time put my health in jeopardy. CFPB has records of my previous complaints on file and I could not respond or dispute the last XXXX because of a computer problem. Thank You for helping me, CFPB in this matter.

Talked to a third party about my debt
Complaint: Started refinancing. Closing statement ordered on XXXX/XXXX/2016. Closed, i thought, on XX/XX/XXXX. My attorny pd taxes and insurance, perdium for the days past guarantee. Tax pmt and insurance satisfied by our payments. Seterus, the company who my loan was with refused to honor closing and now asking me to pay XX/XX/XXXX house and escrow. They said they pd taxes on XX/XX/XXXX. Money was removed from my escrow acct between XX/XX/XXXX and XX/XX/XXXX. XXXX county ia treasurere has not received the pmt from seterus and they are now demanding pmt for both XX/XX/XXXX and XX/XX/XXXX. They also spoke with my attorney 's office and discussed the specifics of my accout without me on the line and even voiced that they were unable to talk and proceeded to discuss. I am reporting them fir violating my consumer protection rights. Today i recvd papers from them for being 30 days behind on a payment i should never had to pay and for an empty escrow acct that shouldnt be empty until XXXX XXXX.

Complaint: I contacted my current mortgage servicer, Seterus , Inc. to make payments on my mortgage account. However, after more than a week, Seterus. Inc did not process the payments and the amount remained in my bank account. I called Seterus, Inc. again to inquire about why the payment was not processed. They told me to contact the bank because it did posted to the account. When I called the bank, the bank informed me that Seterus, Inc made no effort to process the payment through my account. In the interim, I received a notice of default for my mortgage. Another attempt was made to process the payment through a different account. I decided to close my checking account and resend the payment ( XXXX XXXX XXXX ), but allow it to come out of my savings account instead. Without my personal authorization, this payment was some how rejected, as well. Nonetheless, I made another attempt to process my mortgage payment, but this time from a totally different account. Although, Seterus, Inc is agreeing to accept my payments and providing me with a confirmation numbers, Seterus, Inc. is not processing the payments. Although, I have made several attempts to make mortgage payments to Seterus, Inc., if payments are not properly posted to the account, additional interest and fees are accumulate, raising the balance on my mortgage. Furthermore, even though numerous efforts have been made to make payments on my mortgage account, Seterus , Inc, is trying to force my loan into foreclosure.

Complaint: Our son passed away on XXXX XXXX, 2015.
His mortgage was with XXXX XXXX but they sent it to Seterus for processing.
After sending Seterus our sons death certificate twice, they continue to call our mobile and home phone asking to speak to our deceased son.
This has caused XXXX to his mother and prolonging her grief leading to a decline in her health.
