Complaint: I had a XXXX and XXXX mtg XXXX XXXX for my house in XXXX, XXXX I was working for XXXX and forced to quit during the recession in XX/XX/XXXX. I was over XXXX and been in the company 25 yrs and made twice as much as everyone else. I found work but the wage was significantly less and was in XXXX. We could not sell the house so we rented it out for {$1000.00} pr/month and paid the {$600.00} difference in mtg payment. Over the years we paid over {$23000.00} to supplement the rent payments for the mortgage. We emptied out My {$44000.00} XXXX and my wife 's {$20000.00} XXXX to do this. I approached XXXX several times to ask for assistance with refinancing the mortgages. We kept the mortgage payments current. The XXXX mortgage was only 15 year term and could have been extended. They refused several times as we did not live at the house. After several years I asked if we could turn in the keys " in lieu of ''. I was told that XXXX XXXX XXXX prefers to do that with empty homes. So I waited until the rental agreement had run out and the renters moved. Then in XXXX XXXX XXXX I filled out the XXXX paperwork to turn in the keys or short sale. They kept putting me off saying they needed me to fill out a form a different way or more information. I was a XXXX yr XXXX Bank XXXX. I knew how to fill out paperwork. It was designed to put me off. Then I asked about short sale. They told me to get a good offer first, then make a proposal to them. They then sold the XXXX mtg to Seterus mortgage. I continued to fill out and send paperwork and copies of all my financial information, tax returns, pay stubs, bank statements. On approx XXXX XXXX XXXX we received a very good cash offer of $ XXXX on a $ XXXX balance between the XXXX and XXXX that my realtor put through homepath. It has been 9 months since I first tried to do this and 4 months since putting through the short sale offer. Seterus has neither approved nor denied the offer. Just a few weeks ago they asked me for more information and XXXX tax returns. Even though they acknowledge that I have previously sent it to them. I have literally sent over XXXX XXXX pages of financials. As you can tell I am extremely frustrated. This can all be verified through my realtor and homepath.

Complaint: My mortgage servicer, Seterus, Inc has not been able to explain material mis-calculations on my pay-off statement. Most recently, it refused me access to my account information such us the form XXXX. A representative of Seterus ( XXXX ) refused to talk to me and asked me to communicate to my lawyer when there has always been an authorization on file for me to speak with the representatives directly. I asked for the manager ( XXXX ) who XXXX also refused. Seterus, Inc has had a long track record of making errors, for example, my loan modification process was delayed by more than six months because of its internal process error. When I questioned the manager, he threatened me with not giving me the modification. This is a very bad loan servicer who does not care about the XXXX of money they are entrusted by the home owners. Seterus, Inc can easily cost a homeowner XXXX of dollars if it is not watched very carefully.

Complaint: My mortgage servicer was transferred to Seterus from XXXX. XXXX transferred the loan with an error of an outstanding balance that was refunded to XXXX from a tax authority. XXXX corrected their mistake 4 months after the loan was transferred to Seterus. The balance was wired from XXXX to Seterus. Seterus has misapplied payments and I supplied them with a transaction report and letter from XXXX stating when they wired the funds to Seterus. They still have not correct their mistake and refuse to take my payments forcing the home in foreclosure. I have to call every week to dispute the action and they keep postponing a foreclosure. They are trying to take my home for an error they are refusing to correct. I need help or please direct me to who I can file a lawsuit against Seterus to keep my home and asset.

Complaint: I default on my mortgage due to work related injury, and apply for help to Keep Your Home California and was able to get approve for {$39000.00} to Principal Reduction program ( PRP ). To Pay any past due amounts and reduce remaining balance of first mortgage and bring monthly Mortgage to an affordable.. So in months later Seterus, INC had send me a Loan Modification to sign and return and Seterus representative call me stating that the only way to get approve for the money founded to my account from " KYHC '' is by signing modification. next day later Seterus Manager XXXX XXXX Call me again asking for the sign modification, And said if they did n't receive with in a week they were going to reject my founded money back to " KYHC '' and the house would be foreclose. So I had filled out Documents to keep my home and have a reduce Monthly affordable payment. I send this documents back to Them sign. On XX/XX/XXXX I paid my mortgage ( {$1700.00} ) upon agreement and they call me back stating that I was short on my payment that my payment was suppose to be at ( {$2100.00} ) So I was short ( {$440.00} ) So I ask to explain how was that possible when I had filled a mortgage modification and I had a principal reduction to bring down my mortgage to affordable payment. and that was not affordable my payment when up {$440.00}, and is not on the documents that I had sign. Seterus Representative could n't not give me an straight answer and they got higher Supervisor to assist and She first said that it just gone up So that 's what I need to pay, And I told her to Explain why she said that Property taxes when up and It did n't and than she Said That because of PMI insurance, Then she said because of Shortage on property taxes or it could be something but she does n't know for fact..

Complaint: Seterus, Inc. continues to report that our mortgage payment is late, at this point they have reported this for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. We contacted them in XX/XX/XXXX and told them that we were going through a financial hardship because of a job loss and then having to relocate to another state once a job was found. We tried to sell the house but were unable to do so and let them know that we were no longer able to pay both the mortgage and our new rent and asked what options we had. They suggested a deed in lieu of foreclosure so we completed and submitted the necessary forms. We were approved XX/XX/XXXX and we continued to receive threatening letters from Seterus and their law group, XXXX XXXX XXXX that we owed for XX/XX/XXXX and then XX/XX/XXXX. This was all while we completed the paperwork that needed to be notarized and sent back to the XXXX XXXX XXXX. In this paperwork we signed over the property to Seterus , Inc. on XXXX XXXX. They received this packet on XXXX XXXX via XXXX. On a trip up to visit family on XXXX XXXX we went past our old home and found a note attached to the front door stating that XXXX owned the property that was dated XXXX XXXX. We are in the process of filing disputes with the credit bureaus but we would like this matter resolved and for Seterus , Inc. to stop reporting that we are still late. We would also like them to file the necessary paperwork with the county since we are still listed as the owners of the property. Therefore we have our old HOA contacting us as if we still own the property and claiming that we owe them for HOA dues for XX/XX/XXXX and XX/XX/XXXX.

Complaint: My mortgage was owned by XXXX XXXX XXXX. It was then, as customary, my mortgage is now being handled by Seterus, which in the past 2 years have been, by far the worse .... even worse than XXXX XXXX XXXX. XXXX XXXX, 2015 I sent Seterus a check from XXXX XXXX to have return to XXXX being that I decided to go with another Insurance Company. A year later, Seterus claims I owe that money and they had never received the funds.Of course they increased my ESCROW so I had to do their job, contact XXXX, have them re-issue the check, send it to Seterus via Register Return Receipt, once I confirmed the check was received by Seterus, I called to follow up, and they still claimed the check had not been receive, I lost it and told them off.They increased my mortgage payment and said once they received the check, they will do another escrow analysis and it would take up to 30 business days to make any adjustments in my account. XXXX & behold they made the adjustments and 30 days exactly my mortgage payment was re-adjusted, ( which leads me to believe they had the check all along and did not want to admit it ). Yesterday I come to find that the taxes on my home have not been paid. Seterus was returned a payment of {$1600.00} from XXXX XXXX XXXX Collector and has been sitting on it for 1 month.Yesterday I received an email form them indicating my taxes are past due and that further penalties and fees are being accrued for lack of payment. I called Seterus once again spoke to a representative by the name of XXXX, and was told she would put an " urgent action required '' note in my file and I would have to call back and follow up. Really? do I have to follow up and do their job? why in XXXX are they managing something they ca n't obviously not able to handle? I am the victim here, not only has my home insurance been jeopardize but now my taxes? Seriously? Does n't Seterus and their " reps '' know I can have my home be taken away for not paying my Insurance or Taxes? What kind of a joint are they running there? If these XXXX ups are the lack of service Seterus creates, then why nothing is being done, why does n't Seterus pay out of their pockets these kind of financial XXXX ups caused by their lack of service? I am sure they have liability insurance. I refuse to pay for their XXXX ups anymore, nor do their job for them. I WANT SETERUS TO PAY FOR ALL THE AGGRAVATION, HARDSHIP, FRUSTRATION AND PUNITIVE DAMAGES THEY HAVE CAUSED ME.

Complaint: I have a loan through Seterus Mortgage Company. We are getting ready to sell our house. I called them up to get a payoff amount sent to our title agency. The first person I talked to said they would send the fax now. I thought that meant that they would send the fax now. When I talked to my title agency later in the day they said they had not received the fax. I called Seterus back and it was then that they informed me that they would not be able to send the fax for at least XXXX3 business days and possibly up to 10 days at the latest! So now our closing will have to be delayed for an uncertain amount of days until they can get the fax done. To me, this is the definition of the word ineptitude and irresponsiblity. I was told I could n't get a rush on the payment info unless I got a court order to make that happen. Their inability to clearly state that they would need XXXX3 days to make this happen also shows a lack of coherent communication skills, something this industry needs desperately.

Complaint: Filed Complaint number : XXXX on XXXX against XXXX mortgage company. Got response via CFPB on XXXX/XXXX/XXXX XXXX PM from mortgage holder XXXX and via my investigate learned mortgage XXXX Estate of XXXX XXXX XXXX was sold to Seterus, Inc., XXXX XXXX XXXX, XXXX XXXX, MI XXXX. Nothing I saw from CFPB within their portion of response mentioned any deadline to respond ( can supply response copy if requested ). When I called I was chastised for not seeing that a deadline was given to respond and told complaint was closed and had to file another complaint. I am doing so. XXXX XXXX XXXX XXXX was holding the mortgage for XXXX XXXX XXXX XXXX XXXX, Fl XXXX. That unit has been in default of condominium fees for over 3 years. In XXXX XXXX XXXX filed a motion for default against the defendant unit owner. However, the default had not been entered. The condo fees are in arrears for now well over {$6500.00}. XXXX sold the loan to : Seterus , Inc . XXXX XXXX XXXX XXXX XXXX, MI XXXX XXXX and now Seterus are protected under safe harbor. The other XXXX retired senior citizen unit owners in XXXX XXXX have no protection or rights and are having to make up the difference for this defaulting mortgage holder every month of every year this goes on. If Seterus forecloses and we can set a viable owner in the unit, this nightmare stops for all unit owners. Again we are asking the Consumer Financial Protection Bureau to assist us in attempting to move Seterus forward with foreclosing on this unit and selling it so that indeed we can start receiving condo fee 's again. Other units have sold for well over the {$66000.00} that we believe is the mortgage amount so there is no excuse for this to continue. Seterus, like XXXX, is dragging its feet on its responsibility for this unit and is causing continuation of unnecessary and undue financial penalty to XXXX other senior citizen unit owners within this XXXX condominium association. This is a horrendous situation where mortgages just keep getting sold off and are protected when the remaining unit owners are not. This should not be allowed to continue. Help us please.
