Complaint: I had a home discharged through the bankruptcy courts in XXXX. Now, I have XXXX mortgage companies harassing me over the unpaid debt. I have written them numerous request to cease and desist and yet they continue to harasses me on a weekly basis. Complaint: XXXX, through the servicer Seterus, filed a les pendens against my property while I was making timely payments on my trial loan modification - I had already made 2 payments on time. This appears to be a " dual tracking '' based on what I have read. I called Seterus and they told me this was their standard practice and the lien would be removed when I had made the third payment. I never received any notice of service nor any other communication that they were proceeding with the foreclosure. I did not receive any late notices from them until my loan was 6 months delinquent.

Complaint: I filed chapter XXXX bankruptcy on XXXX/XXXX/14, the bankruptcy was discharged on XXXX/XXXX/2014. I included my XXXX balance of approx. {$34000.00} ; this balance was discharged. XXXX sold the loan to Seterus. I have been making monthly payments to Seterus because I want to avoid a foreclosure. However, Seterus are charging me interest and will not provide me with a statement, nor will they provide me with receipt of my payments. My payments have increased from {$300.00} to over {$400.00}. I have requested pay off statements and the balance keeps increasing. Since this loan was included and discharged in my bankruptcy they should not be charging me interest. I want a refund of all of the interest I have paid them since 2014. I want a detailed list of all of my payments and I want a pay off statement. They refuse to talk to me on the phone because they keep saying I am in bankruptcy. I keep telling them my bankruptcy is discharged and closed. I need this information so that I can sell the property and I want the interest that they have charged me to get refunded. I am not liable to pay this loan because it was discharged. They are breaking the law by charging interest on a loan that was included and discharged in bankruptcy. Please help.

Complaint: I have a mortgage with Seterus. They took it over from XXXX and it is a XXXX mortgage. I am being told that my first payment with XXXX was used to implement the mortgage. Therefore I am behind XXXX payment. When I asked for the statement showing where the money went, they cant or wont produce it. I have all the statements from XXXX and the statements show a normal monthly payment. Seterus tells me to stop asking for this information. I have statements from Seterus that are absolutely inaccurate and ridiculous. I have told them show me where the statement, closing statement, loan origination statement and they refuse to do that. This is now five years old and they are about to foreclose on our home. I have written them and explained to them, just show me the statement and I will immediately send the missing payment and all the late fees that have originated in the last five years. I have never been foreclosed on and have not missed any payments. There most likely will be a court hearing and at that hearing I will present my letters asking for this XXXX item from Seterus. I even sent them a bank statement showing all my payments. Not XXXX is missing.

Complaint: I held a mortgage on my house which was transferred to XXXX XXXX XXXX. For various reasons, I was no longer able to maintain the house, and moved into an apartment. The mortgage was subsequently sold to Seterus for collection. The house was foreclosed, but various issues with previous mortgage companies not clearing the title when I refinanced, the foreclosure auction could not take place. This happened in about XXXX 2014. The title issues have long since been resolved, and no further date has been set for foreclosure auction. I have contacted Seterus numerous times, with no resolution. I finally told them I wanted to turn the property back over to them. I was told I should hear something 'in about 2 weeks '. This was at least 2 months ago. Meanwhile, the house has been vacant for over 2 years, and is deteriorating. I have had XXXX different people contact me about buying through a short sale. The first one was not able to reach an agreement on a price. The second one is also likely to not go through. Meanwhile, I can not get any cooperation from Seterus on returning the property to them. Every call I have made to them, ends up going nowhere. I need help in getting rid of my property ... It seems very unreasonable that all this should have gone on for almost 2 years. Any help you can give would be greatly appreciated ... .. My scanner is not working, so I am unable to attach the foreclosure notice dated XXXX/XXXX/2014, with date of auction scheduled for XXXX/XXXX/2014.

Complaint: Effective XXXX XXXX, XXXX my mortgage was transfer to Seterus from XXXX XXXX XXXX. I was receiving statements prior to XXXX XXXX for over 8 yrs and four of them were during my Chpt XXXX. Seterus is refusing to send monthly statements after several requests in writing. They have yet to acknowledge acceptance of my request in written. On XXXX XXXX, XXXX thru my own investigation, I found they refused to renew my homeowner 's insurance with XXXX and that they had placed their own forced placed insurance on my home without notifying me. My insurance coverage had not lapsed in 9 yrs. Their excuse was I 'm in a active chapter XXXX and they do not have to communicate with me. My bankruptcy attorney has provided docs allowing communication between us and Seterus has verbally acknowledge letter is on file. Yet I can not get a simple, request for verification/proof of insurance. Instead they added insurance coverage and deducted the amount out of payments to Seterus causing a deficit. Imagine my surprise as I spoke with Seterus ' representative. After several days of conversation between Seterus, XXXX and my self, Seterus claimed they had removed the forced placed insurance and sent a check to XXXX ten business days ago. They claimed they refunded my account for insurance payments from the forced placed insurance. When I ask for proof, they " do not have to provide it to me as I 'm in an active chpt XXXX. '' By the way, XXXX has yet to received said payment. Another issue I have with Seterus is I 've been working to refinance my home thru HARP and they have done everything from sending out payoff that expires within XXXX hrs to refusal to provide 30 day payoff, to not giving a payoff that 's long enough for us to close on our loan. They state " it is against our policy '' to provide what seems to be an industry standard. Escalating in this company is pointless. Everything takes 7-10 business days to get, even if the error was on their part. They continue the same error over and over again and yet bill us each time. It takes them 7-10 business days to process your payment once they received it. Industry standards take 24-48 hrs for any of these type of requests. They never acknowledge anything in writing upon requesting information from them. This company is doing what they want to and always quoting it 's their legal right. What rights do I have as a homeowner fighting to keep her home?
