Complaint: Due to employment issues ( taking demotion in lieu of layoff XX/XX/2014 ), I fell behind on my mortgage. Since that time, I was not only reinstated ( XXXX 2014 ), but promoted twice in a year. Seterus offered me a modification, I made the trial payments, and tried to continue paying, but they rejected those payments telling me I had to wait for the paperwork. My next contact was from the county telling me my house was going to foreclosure sale.

Complaint: CFPB, In XXXX 2012, I sold a property located in XXXX, CA that had a loan serviced by XXXX. It was listed at {$100000.00}, which would have resulted in a short sale. Fortunately, I was able to get the property into contract and sell for significantly more, thus avoiding a short sale. However, Seterus is reporting this as a short sale, which is damaging my credit. I have tried working with Seterus and the credit bureaus to get this corrected, but thus far, have been unsuccessful and that is why I am now asking for your help. The property sold on XXXX/XXXX/12 for {$120000.00}. A logical person would ask, " How the heck did they come up with that unusual sales price? '' This was the exact amount needed to fully satisfy Seterus ' payoff demand so there would be no short sale and I would n't walk from close with any cash. Seterus ' payoff demand was {$110000.00}. My principal balance was {$110000.00}. Seterus was paid their full payoff demand which was significantly more than my principal balance and yet, they are reporting this as a short sale. I am trying to refi my home and this is negatively impacting my ability to do so. I have reached out to Seterus and the credit bureaus several times ( I am attaching my most recent request ) to get this fixed but Seterus has refused to change their reporting and I have never received an explanation of how they consider this a short sale when clearly, they received a full principal pay off plus expenses. I believe the problem is that the sale started with their short sale department and we were told it had to be closed by the short sale department ( even though at the final sales price it was n't a short sale ). But once it started with the short sale dept and was closed by them, it automatically just got classified in their system as a short sale. And no one at Seterus seems interested or cares that this erroneous reporting is very damaging to my credit and ability to refinance my house. It seems pretty cut and dried, but all I get in trying to talk with Seterus is a fax # to which I have submitted my complaint, but it seems to just disappear into a XXXX hole. I appreciate your assistance in helping resolve this very frustrating situation.

Complaint: After being denied on a recent credit request, I discovered that our mortgage company, Seterus, had placed negative information on our XXXX credit report even though it clearly states in the remarks section that the mortgage was included in a 2010 bankrupcy. Seterus reported {$21000.00} past due of payment amounts of monthly {$1100.00}. My understanding is that when the mortgage has been discharged, it is illegal to place this information on our credit reports and this is adversely affecting my credit rating and ability to obtain credit. XXXX and XXXX display the correct information of {$0.00} balance and {$0.00} payments due so evidently Seterus chose to report the incorrect information to XXXX. We are still in the house while we work on turning the deed over to Seterus but is immaterial to Seterus taking the action they did on our credit report. We already took the damage to our credit with the bankrupcy, they should not be dinging our credit for a debt no longer valid because it was dismissed. Any help to have the negative information removed off our XXXX report would be greatly appreciated. Thank you.

Complaint: My father passed away and left a house to my XXXX siblings and myself. I have lived in the house since it was purchased 9 years ago, and make the mortgage payment. In XXXX, 2015, XXXX XXXX XXXX, the mortgage holder, sold the loan to Seterus. Since that time I have been trying to get information about the loan, but they will not talk to me about it. They say they must have the name of the Administrator or Executor of the estate. There is not one. My father died in XXXX, without a will, and we completed a Small Summary Administration where the Judge divided the property among the XXXX of us and it was complete. The judge said she had no jurisdiction over the house because it was in XXXX. After several conversations with Seterus since they took over the note in XXXX, 2015, I have done and sent everything they have asked for. I have sent the Summary Administration from XXXX and the Affidavit of Heirship from XXXX, along with my father 's death certificate, as requested from Seterus. During the last two conversations with Seterus, I was told first that the legal documents were not sufficient and then that ( apparently they were ) they could not talk to me, but could talk to my sister. I then began to receive mail from them, at the house address where I live, with her name on it. Not only has my sister never spoken with them, but she has had repeated brain surgeries since XXXX of last year and is not involved in the house matter. The only way that Seterus could have my sister 's name is someone picking a name off of one of the legal documents - her name happens to be listed first. I retained an attorney this week, she called, and they wo n't speak to her either. I have paid what I believed to be the mortgage payment every month, but I am not sure what the amount is, due to several pieces of mail from Seterus with differing amounts due. At the end of the last conversation with Seterus, I asked the young lady what I should do since they would not tell me anything about the loan. She said to just keep paying the mortgage. I asked how, since I was unsure of the monthly amount due ( the change in amount came when they set up an escrow account ). She told me that, though she should n't be telling me, the amount I had paid 4 days before, {$1000.00}, was the correct amount. Several days later I received a statement that the payment was {$1200.00} per month. The next day I received mail stating that the mortgage was behing one month, and that if they did n't receive {$1700.00} by XXXX XXXX, they were going to begin foreclosure proceedings. Two days later I received a statement saying that {$1900.00} was owed. I have done everything they have asked. With the exception of XXXX people, they have been extremely rude and unyielding. When I asked for someone in their legal department, they said they could n't help me. I am at my wits end. I have made payments every month, calculated by what the original amount was, plus the yearly property taxes divided by XXXX. Please help. I do n't want to lose my home, but I can not seem to get through to these people. Thank you in advance.

Complaint: While we appreciate fixing the issues with the XXXX and taking off the XXXX late payment reference that has not completely fixed the issue. We sent back notarized copies of the deed in lieu paperwork prior to the XXXX XXXX deadline and the notarized copy shows that it was in effect XXXX XXXX, 2016. Having that paperwork in prior to XXXX XXXX there is no way that we can held responsible for there being a late payment of XXXX and would request that this late payment be removed as well. My husband pulled his credit report today and noticed that the XXXX late payment has been removed but now Seterus , Inc. has reported that we were late in XXXX all of a sudden when that had not been the case prior. We would like Seterus , Inc. to stop changing other payment information without notifying us of this case since it does not appear in the XXXX documentation which is the same as in this XXXX file attached. We have attached a copy of the deed in lieu paperwork that has been referenced above.

Complaint: We were verbally denied for XXXX. After requesting information regarding the denial over the phone we were told that any request for information would not be granted unless it was written request. We have since made several written requests regarding our XXXX denial, the status of the modification and mistakes we found on our loan in XXXX 2016. We never received any information we requested or any corrections to the mistakes on our loan. We have followed up those written requests with other letters that have also been left unanswered since XXXX 2016 - it is now XXXX 2016. Our mortgage servicer via telephone says it can not answer the questions that we have asked and we have to wait for written answers to our inquiries even if we are well outside the allotted 60 business days they say we should receive our answers in.

Complaint: On XXXX I sent a letter requesting information about a loan payment increase due to an escrow shortage. But, I my pmts were misapplied as mortgage pmts and I dont have a shortage. I also asked about my pmt history report. The company said the have 60 business days to respond, but have not and I have applied for a HARP loan that can not move forward until I get these issues resolved. They keep telling me they escalated the issue, then at end of the 12 weeks, I get a letter stating they need more time. But, 60 business days equals 90 calendar days and I still have to pay the aditional fee for the shortage, can not get my HARP refinance, and cannit get anyone to explain why it is taking so long to send the information requested and fix an escrow pmt error.

Complaint: Seterus has exercised vague and unbound fees which represent undocumented modification to the original contract while presenting complex and confusing billing that present past due amounts that include future due payments Exhibit " 1 '' is a bill from XXXX XXXX, 2016 shows a Payment due date '' of XXXX XXXX 2016. This bill is a clear miss-representation of my account. The past due amount at the time of the bill is B - C : XXXX - XXXX = XXXX Furthermore, I have " E '' ( Suspense credit ) in the amount of {$370.00} Thus the amount really owed is : B - C - E : XXXX - XXXX XXXX = {$280.00} Shown on Exhibit " 1 ''. The line item named " Total Charges '' ( D ), is vague, and un-bound as it includes no finite number or description of what activity can or will be charged. This seems like an illegal contract as it is impossible to know that you are in compliance with a vague, and unbound clause of a contract. These fees are also created and imposed without any notice or option of the consumer to contest the implementation. To add further to the confusion, and emotional distress, the consumer is left to guess at what this charge is, and how they are being paid off. Here is Proof : Exhibit " 1 '' is a bill from XXXX XXXX, 2016 shows " Total Charges '' ( D ) of {$76.00}. Exhibit " M '' is an explanation by Seterus titled " HOW TO READ YOUR STATEMENT ''. In this sheet " Total Charges '' line item showing that " K '' of the sheet is the definition : '' Unpaid charges at the close of the statement cycle, which may include late charges, returned check charges, attorney fees, etc. '' What is " etc. '' exactly? Where on the bill is an explanation of what this fees consists of? Is It in the section titled " Past Payment Breakdown ''? in line item ( F ) " Charges '' is a value of {$12.00}. However, the heading is " Paid Since Last Statement ''. So that 's not it. At the bottom of the billing statement is ( G ) " Activity Since Last Statement ''. But, nothing in that section even adds up to {$76.00}. I also received another enclosure Exhibit " N '' titled " GENERAL SCHEDULE OF FEES AND COSTS ''. I was unable to match any of the definitions or fees on this schedule to the " Total Charges '' ( XXXX ) of {$76.00}. If there is a charge on the bill why is n't it expressly shown? I have a hard time believing that this is not required by law. It seem to me that In order to get credit for the next payment, I should subtract the " Suspense credit '' of : {$370.00} from the " Regular Payment '' of : {$470.00} : C - E : XXXX XXXX = XXXX So I made a payment of {$120.00} on XXXX XXXX, it was received on XXXX XXXX and shown on XXXX XXXX. So this is not shown on the XXXX XXXX billing, but is shown on the XXXX XXXX billing. However, there is still confusion : XXXX XXXX, " Suspense credit '' is {$370.00}, an XXXX XXXX, " Suspense credit '' is {$370.00}, XXXX XXXX, " Suspense credit '' is {$1.00} ( After the {$120.00} payment. ) XXXX XXXX, Exhibt-4 {$120.00} payment and USPS Return Receipt. But XXXX XXXX, " Amount Due '' of : {$1100.00} XXXX XXXX, Amount Due '' of : {$1100.00}, XXXX XXXX, Amount Due '' of : {$1000.00} ( After the {$120.00} payment. ) In Exhibit-3, It seems clear that the Suspense account has been depleted. However, where did it go? XXXX XXXX, Amount Due '' of : {$1100.00}, XXXX XXXX, Amount Due '' of : {$1000.00} XXXX - XXXX = XXXX The calculation should be : XXXX - XXXX - XXXX = XXXX So why is {$1000.00} shown due? So not only are there not specific descriptions on this form for these fees, but no reasonable effort on my part has yielded any definitive explanation of the charges, or where payments went.
