Complaint: On XXXX XXXX I made my typical mortgage payment online which was on auto pay for {$700.00} though my bank. In XXXX I received a letter stating that my payment was in suspense and that a late charge had been assessed for not making my payment on time. When I researched this, I found that my payment had increased in XXXX 2015 to {$780.00}. I immediately called the main office and paid the delinquent amount of {$86.00}. At this time I also found out they did not have an accurate phone number for me as well, which I have updated. I pride myself on paying my bills on time and this was an oversight on my part. I understand the importance of this issue and I should have paid more attention to the statement. I 'm currently in the process of refinancing my primary residence and the late reporting has crushed my credit report to the point I no longer qualify. I am simply asking for a onetime retraction. I know this is not common, but have found out that many lenders have done this in certain circumstances. I have called several times and written correspondence asking for them to rectify the mistake. When I do call, I 'm not able to actually talk to someone that can make a decision. They say that there is no " customer facing '' person that I can talk to. The only communication that is allowed is through letters.

Complaint: I have been working with Seterus Mortgage Acct # XXXX to obtain a Deed in Lieu. I submitted all documentation including proof of discharge of 2nd mortgage etc. After submitting all docs a required under XXXX Seterus said they can not complete a Deed in Lieu because there are {$7500.00} in judgements against me. I believe under XXXX There is money allotted for this. I have had to declare bankruptcy and will now face foreclosure. I attempted this with XXXX and XXXX servicing. I finally received the discharge from XXXX and face this disaster. Thank you.

Complaint: To whom it may concern, My income was reduced and I was having trouble making my mortgage payment so I contacted my Lender ( Seterus ) XX/XX/XXXX. I soon found out it was to be the worst customer service I have ever experienced. They were/are flat out rude, arrogant and very unprofessional. I was only trying to do the right thing and contact them to let them know my situation and to ask for assistance, and they flat out told me we were going to lose out house and there was no hope for us. Please see attached fax coversheet information dated XX/XX/XXXX when I originally sent in our request for assistance. I filed out and sent over all the correct mortgage assistance paperwork and Seterus confirmed they received it, but when we called to inquire about the status the representative was outright rude. I insisted on speaking with a Manager and then XXXX come on the line ( XX/XX/XXXX on or about XXXX ), I soon became aware this was obviously not the right thing to ask for. He was XXXX ruder than the first person I spoke with, probably one of the rudest persons I have ever spoke to. He started threaten me as well, stating we would never be able to save our house no matter what we did and/or asked for. He went on to say, we would never, ever qualify for a loan modification. He would not even listen when my wife and I was trying to answer the questions that he was asking us, he just ranted on and on and on, telling us we were just going to lose our house. He made it impossible for us to even talk to him. We just gave up. Then recently, I applied for mortgage assistance again XXXX because we were flat out denied the first time we tried. After sending in all the required documents we received XXXX ( XXXX ) very different responses in the mail. Please the see attached letters -- - now I am very confused on how to proceed. This is ridiculous. So I called the help line again at XXXX ( XX/XX/XXXX XXXX ) to try and find out what is really going on and spoke to XXXX individuals this last time. XXXX XXXX and then her manager. The Manager said if we do n't make our mortgage payment by XXXX XXXX, 2016 they will not modify us at all. We feel everyone deserves a fair chance, and should not have to be treated like some criminal when talking to these big-shot lenders. For what it is worth, that is my story. It is truly unfortunate that they treat consumers the way they do.

Complaint: Seterus, Inc., my mortgage servicer has refused to answer my questions about the servicing of my mortgage ( fee charges that do n't seem reasonable and corrected XXXX mortgage interest form that does not agree with my statements ) despite repeated phone calls. All phone calls are met with an exceptional lassaiz faire attitude followed by no answers to questions. I feel I have no where else to turn -- they hold all of the cards. Complaint: Seterus claims they paid my property taxes but they DID NOT. They keep saying they have fixed the problem and now I have a negative escrow balance that I do not owe. So unless I send extra money they will not accept my payment. I have been forced to pay them and extra {$180.00} so last months payment could get credited. They said it would be fixed within 7 days and now I 'm forced to pay an additional {$90.00} per month until the {$3300.00} negative escrow balance is paid. I have contacted the XXXX and Seterus has never paid any property taxes. I have documentation showing that I paid them I do n't have an escrow acct. I have forwarded this info to Seterus and they said it was handled and now I find out that they still think they paid property taxes in XXXX of 2015 but they did not. They can not produce any proof of payment either. I feel they are scamming me so I looked online and saw over XXXX complaints of similar nature. They are running a scam where they are adding escrow accts and using the money and will never give a straight answer. I have spent several hours on the phone only to be restarted back ant square XXXX.

Distributed to my lend Seterius Acct # XXXX Instructed by Seterus to NOT submit any payments until I receive the NEW invoice which would reflect the NEW decrease monthly payments. Notarized new contract XXXX 2016. During the reconstruct of loan, I have been invoiced showing negative balances. XXXX invoice had credit balance XXXX invoice had credit balance XXXX invoice had credit balance However, received a XXXX notice in XXXX this time a Notice of Default. We were lead to believe that funding from Keep Your Home XXXX would be applied to catch loan up current and then we would receive an appropriate invoice reflecting new payment. Seterus NEVER invoiced me properly, did Seterus follow appropriate guidelines in regards to processing and now invoicing me the borrow? Is this legal business practice for a lender? I fell behind in my loan due to a medical illness, that has left me permanently disable. Extremely stressful to be placed back into yet another stressful situation. Complaint: SETERUS is the WORST customer service in history of the world. In the dozen of times I have contacted them only twice have they been helpful and address my issues. Complaint: I am disputing the allocation of the {$7500.00} I submitted to Seterus in XXXX XXXX. In addition, my dispute encompass the XXXX XXXX Foreclosure Notice and the XXXX delinquent outstanding loan payments totaling {$3400.00} identified on the XXXX XXXX, XXXX account statement. On XXXX XXXX, XXXX, I received a " Transfer of Servicing Notice '' from Seterus informing me that effective XXXX XXXX, XXXX the servicing of my loan was being transferred from XXXX XXXX XXXX, XXXX. to Seterus , Inc . The next month, I received an account statement dated XXXX XXXX, XXXX, requesting I pay {$15000.00} with a due date of XXXX XXXX, XXXX. At which time, I was in a Chapter XXXX Bankruptcy, with a prepetition payment of {$470.00}. On page XXXX, of the XXXX XXXX, XXXX account statement, identified as Delinquency Notice, listed XXXX payments past due and authorized I pay immediately to avoid further action. The XXXX payments listed as follow : ( 1 ) XXXX XXXX, XXXX due {$470.00} ( 2 ) XXXX XXXX, XXXX due {$470.00} ( 3 ) XXXX XXXX, XXXX due {$470.00} ( 4 ) XXXX XXXX, XXXX due {$470.00} ( 5 ) XXXX XXXX, XXXX due {$470.00} ( 6 ) XXXX XXXX, XXXX due {$470.00}, totaling {$2800.00}. On XXXX XXXX, I submitted XXXX payments to Seterus , Inc . The first payment was for {$5000.00} to pay for the XXXX outstanding payments listed on page XXXX on the account statement dated XXXX XXXX, XXXX ( {$2800.00} ) in addition ( {$1400.00} ) to pay the agreed Chapter XXXX prepetition payments for XXXX XXXX due {$470.00}, XXXX XXXX due {$470.00}, and XXXX, XXXX due {$470.00} at which point my account should have been made current. I then submitted in XXXX XXXX, an additional payment in the amount of {$2500.00} to pay the agreed Chapter XXXX prepetition payments for ( 1 ) XXXX XXXX in the amount of {$470.00}, ( 2 ) XXXX XXXX {$470.00}, ( 3 ) XXXX XXXX {$470.00}, ( 4 ) XXXX XXXX, and ( 5 ) XXXX XXXX {$470.00} totaling {$2300.00}. By me paying these payments in advance my next payment should not have been until XXXX XXXX. On XXXX XXXX, XXXX, I received an XXXX Foreclosure Notice from Seterus informing me that my account was in foreclosure and I was XXXX payments delinquent. This time the months listed were as follow : ( 1 ) XXXX XXXX, XXXX due {$480.00} ( 2 ) XXXX XXXX, XXXX due {$480.00} ( 3 ) XXXX XXXX, XXXX due {$480.00} ( 4 ) XXXX XXXX, XXXX due {$480.00} ( 5 ) XXXX XXXX, XXXX due {$480.00}, and ( 6 ) XXXX XXXX, XXXX due {$480.00}. Totaling {$2900.00} plus and additional {$120.00} for Advances. I immediately called Seterus to confirm receipt of the {$7500.00} payment and was informed yes they received the {$7500.00} and applied it to payments back in XXXX. The money I submitted was applied to payments from two years ago all the way back to XXXX. This was surprising considering, I never received a notice from XXXX XXXX XXXX who was my loan servicer back in XXXX informing me or my bankruptcy attorney of any outstanding prepetition payments. This also raise a concern because Seterus did not notify my bankruptcy attorney or myself in writing of the months in XXXX that they applied the funds to. This could pose a serious problem not only a violation of my bankruptcy but furthermore, considering I have receipts for all my payments I made to XXXX XXXX XXXX in XXXX as my obligation in the Chapter XXXX Bankruptcy for my prepetition payments. On XXXX XXXX, XXXX, I contacted Seterus Bankruptcy Department and spoke with XXXX XXXX. XXXX informed me that as of the XXXX of XXXX XXXX, the trustee was still dispersing payments to my account. Despite, showing a discharge in XXXX XXXX, payments was still coming in and being posted to my account. She stated the last payment they received was on XXXX XXXX, XXXX in the amount of {$5800.00} from the trustee. She stated that my account is not settled as of the date of our conversation and that they ( Seterus Bankruptcy Department ) was still waiting to reconcile the account. She stated it looked as if the trustee was releasing p

Complaint: My mortgage loan servicer was changed by a federal government directive. My loan was moved from XXXX to Seterus. I was told by XXXX that the terms of my loan would not change and I would not incur any expenses. Seterus wants me to pay {$470.00} for Title and miscellaneous costs. I did not request a change in servicers. It was forced upon me. Seterus is going to make {$10.00} of XXXX of dollars on the life of my loan. I will file a complaint with Seterus to waive the fees. I am sure thousands of people are experiencing the same issues with the forced change in mortgage servicers. I think it is underhanded to charge consumers fees on servicer change that was not within my control.
