Complaint: I acquired my family home when my mother XXXX XXXX in XX/XX/XXXX 2016. She left the house to me through a deed of trust that she established many years earlier. I have an existing mortgage. When I informed the mortgage company, Seterus Inc. that my mother passed away, and I informed them of the deed of trust, I was told that I could not become " owner '' of the property unless I moved into it as a primary residence. I was also forced into an assumption mortgage although the property was mine legally through inheritance. I moved into the property, making it my primary residence although I had a home with a mortgage, made payments through a " trial '' period for a property that was already legally mine, and suffered through all of the unnecessary processes that Seterus presented. Recently I got a new job. It is a better paying job that will more easily allow me to pay two ( 2 ) mortgages- my own and the acquired mortgage. While waiting for my first paycheck, I fell behind on both payments. My own mortgage company understood and is working with me. Seterus is quite another matter. I need intervention so that I can keep the property to do with it as I please. There is a considerable amount of equity at stake that I feel Seterus is aware of. I also believe this awareness motivates how they are handling the entire situation. I will not lose this house. Resolution : Seterus should provide a real modification, not the in-house non-sense offered. The current principle and interest are only {$30000.00}. My payments are over {$900.00} per month. Complaint: We are writing this in hopes you can help keep a family in their home. XXXX and I have a child with XXXX problems. Treatment was expensive, and even with the continued expense of necessary medication, we paid our mortgage on time until XXXX lost his job. After this, it became impossible to make the house payments. During most of this time we barely had enough money to eat. It was a trying time, but we tried our best. When we were finally on our feet enough to be able to put together a month or two, Seterus declined the payment. They wouldnt take our money or work with us to make it right. We wanted to get back to paying on time, as we had before, but they said they wouldnt do anything until we paid the entire balance.

Complaint: Seterus Inc. is willfully attempting to collect escrow payments which will not be disbursed. Seterus IncXXXX has negatively effected my my credit score and my ability to perform obligations of my employment. I have verbally and in certified postage attempted to point out the mistake however Seterus IncXXXX continuously redefines the date Seterus Inc. is obligated to respond to my inquiry. Seterus, Inc. operates as a subsidiary of XXXX XXXX XXXX XXXX ( XXXX ) ; thus the same corporation that boosts of XXXX a natural language, question answering computer can not determine the date a mortgage will be paid off utilizing a simple mortgage amortization schedule. My loan was transferred to Seterus Inc. after the banking failure in 2008. Payments have been on time for the full duration of the loan. I have paid additional principal payments from time to time ; therefore my loan will be paid off six months early. Seterus Inc. is attempting to collect tax and insurance payments that are not due until after the loan is paid off. Seterus Inc. representatives admit the funds collected will not be disbursed from my escrow account because the date the tax and insurance payments are due is after the date the loan will be payed off. I have been told that I can apply for a refund after the account is closed ; this is affectively a penalty for prepaying my principal. Seterus Inc. has breached several tenets of the signed mortgage. I have received notification that payments received by Seterus Inc. are not being honored and are held in a suspense account. I have verbally explained to Seterus Inc. representatives the errors Seterus Inc. has made. No attempt to correct the errors has been made, nor has an explanation been offered by Seterus Inc. why Seterus Inc. believes no error had occurred.

Complaint: This has been a disaster for me. From my point of view there are many different companies, people, agencies and financial companies involved but my problem began when XXXX XXXX XXXXXXXX took over my mortgage in XX/XX/XXXX. This mortgage was for my home where I had lived since the early XX/XX/XXXXs. I had NEVER made a late payment. I refinanced after my mother XXXX and arranged for my payments to be taken out of my account every other week. I did n't realize it at the time but at the time my " prime '' mortgage had been exchanged for a subprime mortgage. When this happened the mortgage had been sold several times until finally it wound up the hands of XXXX XXXX XXXXXXXX. And this is where my nightmare began. At first XXXX was accepting my payments and and then : I received a notice from XXXX XXXX XXXX XXXX ( XXXX ). This was a debt collection agency. I was stunned. In my entire adult life I had NEVER been late with a payment for anything. I called XXXX about this. I was told that they did n't accept bi-weekly payments ( although they did take the money from my account ... it just was n't credited to the account ). The solution? Refinance again. At great expense to me and another 30 year mortgage for a home I had lived in for 25 years. I was n't sure what to do. This was a strange experience for me. I figured if I paid a bill the creditor would apply the payment to my account. XXXX obviously had other ideas. I told my problems to a few people. Finally I decided XXXX was a big company and so was a XXXX. I thought that this was probably a clerical error and would eventually work its way out. The nightmare got worse. I did refinance. I knew that every time my mortgage switched companies there was money to be made for someone. That was okay with me as long as my payments were being properly applied. But when XXXX and XXXX started to " handle '' my mortgage this was n't happening. And I 'm not even sure if any other reps I talked with at XXXX even knew where they worked or what they were doing. My mortgage payments were about 4 times as much as they were originally. And when I tried to contact XXXX they suggested I refinance again. I was paying and paying and paying money. Somewhere along the line XXXX changed to the name of Seterus. Foreclosure was threatend. I called a lawyer. He suggested I file for bankruptcy. I was stunned. I had never not paid a bill in my entire life. But when XXXX, XXXX, Seterus or whatever it 's called right now I was in a corner. I had used my savings, I had use my retirement funds, I liquidated all my investments. I had to file for bankruptcy because I had no money because my on time payments ( actually I was a little ahead of the payment schedule ) was n't good enough for XXXX. I thought I would settle this the right way by contacting XXXX directly. I had done this more than once. Last XX/XX/XXXX I received a phone call from XXXX XXXX 's office at XXXX XXXX XXXXXXXX. I was told that XXXX had every right to sell my ON TIME mortgage to a debt collection agency. It was then that I realized that this was n't a clerical error. I told the rep I had made every effort to pay ( and pay and pay and pay until I had nothing else ). I had used every one of my financial assets to save my home. To no avail. For some reason my 950 square foot post XXXX XXXX XXXX track house almost directly underneath XXXX 'XXXX XXXX airport where I had lived for over 25 years was a huge financial asset to XXXX, Seturus and the real estate company that sold my home. So what happened ... in mid-XX/XX/XXXX, almost 30 years to the day I was evicted from my home. I had not only lost everything the stellar credit rating I had before XXXX sold my mortgage was in the gutter. This caused even more problems. I did n't mean to yell, scream and cry and when the rep from XXXX called me and told me that they had every right to sell my on time mortgage to Seterus ( or any place else ) and there was nothing I could do. But she was very very sorry that I lost my home, my savings, my retirement accounts and any investment I might have had. Really.

Complaint: Several months ago we were approved for a loan modification we accepted the offer and made our 1st monthly payment. About a week later we were served with paperwork from the court saying they were4 trying to foreclose on our property. I replied to the notice with a written answer as well as submitted all the paperwork regarding the approval for the modification and documentation of our 1st payment. Went to court and the judge did not understand why we were there when were in the middle of a trial modification and meeting the requirements, he also did not understand why Seterus was " dual tracking '' our loan. The judge found that as long as we made the remaining 2 payments within the required time frame we would be set for a permanent modification. Well here I am on my 3rd and final month to make my last payment before finalization & I receive a letter in the mail on XXXX/XXXX/XXXX stating that as of XX/XX/XXXX our mortgage was being transferred to a new servicer ( less than 10 days notice!! ) Frantic I called Seterus and asked how this was going to effect the modification and after being placed on hold multiple times for over 15-20 minutes I was told that I would have to reapply for a loan modification with the new servicer, even though there are federal guidelines in place to protect consumers from having to reapply. I was told that the previous payments essentially meant nothing and even though they knew the current terms of the loan it did not matter. How is this legal my guess is that it is not they entered into a legal agreement and I kept the terms, they did not and now am in the middle of retaining legal counsel to try and save my home as well as pursue legal action against Seterus and their shady, unethical, shady business practices. I am also filing multiple state and federal complaints regarding their disregard for the regulations set in place to prevent " businesses '' like them from doing this to people and hopefully prevent them from doing business period. I will also pursue any and all legal avenues to make sure that EVERYONE knows what kind of company Seterus is while making them responsible for their actions, I will not go quietly, this is just wrong! It should not be this hard to save your home. I was so happy to be back on track and felt a sense of relief that my home was safe, to now be told that I have to start all over again is devastating to say the least. I also researched the new servicer XXXX XXXX XXXX have had/ or are currently in the middle of class action lawsuits, investigations, fraud investigations etc.This is our home, the only home my children have ever known, I have worked hard to get back on track, but to make us start the process over with a new shadier servicer and potentially risk foreclosure/dual tracking in the process is CORRUPT

Complaint: I have XXXX mortgages with Seterus ; I send XXXX separate checks each month. XXXX of XXXX, seterus posted a payment for loan XXXX to loan XXXX ( both checks attached ). I have continued to send two checks each month for these loans ( see attached invoices ). After numerous calls and speaking to supervisors, I was told they can see the problem and they will fix it and notify the credit bureaus of their mistake. This has NOT happened and I am in the mist of buying a house and need this cleared up. Please HELP.

Complaint: I was layed-off of my job XX/XX/XXXX and XXXX foreclosed on my first mortgage XX/XX/XXXX. I filed for Chapter XXXX BK on XXXX/XXXX/XXXX. The XXXX foreclosure was illegal, and had to be rescinded XX/XX/XXXX. About 3 years into the bankruptcy, my account was transferred to Seterus for servicing. I completed my Chapter XXXX BK plan and received my discharge on XX/XX/XXXX and the BK case was closed on XX/XX/XXXX. During the bankruptcy, all 60 mortgage/property tax payments were made on time and in full with Cashier 's Checks that were sent by priority mail with tracking. So I have documented that every single payment was sent and received in full and on time. Seterus agreed on XX/XX/XXXX that I was totally current in their Final Cure response. The BK Judge agreed that I was in full compliance and there should be no fees or late charges - and I got my discharge. Since the bankruptcy case, I have sent and documented and tracked all of the 22 payments I have made right up to XX/XX/XXXX. So, I have documented that the last 82 payments were made in full by Cashier 's Checks and received on time for my first mortgage - full contractual compliance. There can be no late charges or any other fees, and all I owe is the remaining principal. I am now selling my house, and I am in Escrow. I called and tried to get a payoff statement from Seterus, and they told me that they must review my bankruptcy file - and it could take as long as 6 months! Escrow is now talking to them, and twice Seterus said they would send the payoff statement to Escrow, but did not do it. For some reason, they are really dragging their feet, and this could obviously put my home sale in jeopardy and cause me great damage.

Complaint: we have been trying for the past 10 years to get a loan modification we have contacted so many people including you now our loan is with seterus where it has been for the past two years we have been working with a hud certified counseling center first home alliance and our worker is XXXX XXXX XXXX she has been working with us for the past 10 years we have been continuing being thrown into foreclosure after months on end of filing out paper work and then being told that person is no longer there and having to start all over we have hired and paid for attorneys and filed for chap XXXX but judge XXXX and XXXX XXXX did n't believe us and threw us out of bankruptcy court not allowing us the protection we need and more important the payment history corrected and made public to us we have never received a payment history to date and we purchased the house in XXXX. our house is being put on the the foreclosure block this Friday we just found out again with little or not notice like usual there is no legal reason why we should n't be allowed to have a loan mod my partner makes {$100000.00} a year the mortgage company and XXXX XXXX refuse to work with us and the worst thing is our loan mod was based on an amount owed of {$380000.00} and they are selling the house Friday for XXXX how does this happen and why is it oaky. I will continue to fight even if the house is sold, seterus blocked XXXX XXXX from accepting our cash payments and we paid cash payments for two years that we have never received credit for and XXXX XXXX has copies of those payments but not on our mortgage history. they do n't care.

Complaint: I am having trouble getting the mortgage servicer to speak with me. The mortgage company is Seterus. I am going through a divorce. My ex-husband is the person who borrowed the money, but I am on the deed and I also signed the mortgage. He moved out and down to Florida ( Im in South Carolina ) in XX/XX/XXXX. He has been court ordered to make the mortgage payments since XX/XX/XXXX, but has not done so. We got help from the hardest hit fund ( SCHELP ) to reinstate the mortgage through XX/XX/XXXX or XX/XX/XXXX, but he did not make any payments after that like he was ordered to do. I was sued for foreclosure in XX/XX/XXXX and I am trying to save my home. I am a XXXX senior citizen, and I do not want to be homeless. I have tried to speak with Seterus maybe six times in the last six months or so, and each time the Seterus representative refused to speak with me. I am a part owner of the property, and my name is on the mortgage along with my exs. I want Seterus to speak with me so that I can try to save my home from foreclosure now that my ex has abandoned me.

Complaint: Seterus overpaid my XXXX taxes by {$660.00}. My county tax office refunded the overpayment on XXXX XXXX. There was NO change in my XXXX tax rate from XXXX. Seterus increased my XXXX mortgage by {$69.00}. I called Seterus tax dept. on XXXX XXXX, and after an hour and a half of discussion with Seterus tax and customer service was assured they would correct their mistake in 7-10 days. They assured me my escrow would be adjusted to the correct taxes. They could not explain WHY they overpaid my taxes in the first place!! My XXXX mortgage bill came in {$55.00} higher than normal. I called Seterus again today and was told my taxes STILL show as {$1300.00} DESPITE the fact that they NEVER received a bill from my county tax department for {$1300.00} and when they paid {$1300.00} instead of the bill which was {$640.00} the county tax people refunded Seterus the {$660.00} overpayment. After another hour and a half on the phone the customer services rep said she will resubmit what had already been submitted but I would have to pay the increased mortgage rate AGAIN in XXXX. So far Seterus has effectively extorted {$120.00}. For a person who is XXXX on a very limited income this is equivalent to attempting to price me out of my home. Seterus made the mistake. Seterus received a refund in XXXX for their mistake. Seterus is still demanding an unsubstantiated increased mortgage amount from me. Seterus is still stalling saying they have to start a process all over that they promised last month would be resolved. When Seterus received a check for {$660.00} in XXXX from the County Tax Department that should have triggered an escrow analysis. County tax departments do not just issues refunds. Instead they pocketed the money and increased my Mortgage! I want my {$120.00} back. I want them to get their act together and bill customers according to the actual escrow bills.
