Complaint: In XXXX of XXXX I was having a hard time with my mortgage payments. I decided to contact my mortgage to see if I would qualify for a loan modification. I sent in my paper work in and followed the program making payments on my mortgage mean while still being reported as late payments went from XX/XX/XXXX till XX/XX/XXXX low and behold was approved with a lower payment. I kept making my payments for XXXX, XXXX and XXXX of XXXX. Then in XXXX of XXXX I received a letter from the mortgage company saying my escrow was short by {$4600.00} and I needed to pay it or my payments would be going back up. I contacted the mortgage company asking them how this happen after just going through a loan modification and Escow being set up when I closed on my home. They said that my taxes went up and insurance. I contacted the city of where I live and they said they did not go up that much and didn't understand such a huge negative. I was in disbelief at this point and did not know what to do. I did not just have {$4600.00} sitting around to give them. So I became delinquent with my payments. I reached out in XXXX of XXXX to see if they could redo my loan modification because of what happen they denied me and said I had to wait another two years before reapplying. I am at a complete loss right now and do not know what else to do to keep my home. I feel this company was very sneaky in what they did which they did not include taxes that they knew would becoming due and just want me out of my home. They certainly had all the information needed to do the loan modification back in XXXX and failed to include the now delinquent escrow amount coming due in XX/XX/XXXX. I deserve an answer and to keep my home because of them messing up my loan modification. Please help!

Complaint: On XX/XX/XXXX, I received a phone call from Selene Finance, informing me that my mortgage payment for the month of XXXX was late, which is {$1200.00}. My mortgage has a 15 day grace period. The agent informed me that it doesnt matter about the grace period, she was charging me a late fee anyway. I have never been late on my mortgage. Im not behind on my mortgage. I dont have a problem paying my mortgage. Selene Finance has no reason to be calling me. What I dont understand is, why with all these complaints against this company, why are they even allowed to deal with mortgages? They are a collection agency.

Complaint: My loan ( which has never had a single late payment ) was sold to Selene Finance earlier this year. In spring 2019 I made a {$5000.00} additional principal payment online in addition to paying a few days early for my next monthly payment. The auto payment feature ( counter to the next due date that posted online ) continued to take money from my account. This resulted in my mortgage paying a month early and occurred twice. The only help/advice I was given was to remove my auto pay and account information, wait for the two months to pass, then set autopay back up. I followed all of these steps and my XX/XX/XXXX payment posted but was immediately followed by a payment reversal. I received no phone call or email about this. I received a letter today, XX/XX/XXXX ( a Friday ), as my first and only notice the account is past due. No one is in the office and there is no ability to leave a message with either the main office or the customer service number. I logged on and paid the account in full, but have not paid the {$72.00} late fee that is also posted. I do not believe I should be held accountable for the late payment. This occurrence of events appears as though Selene Finance is setting me up to have a late payment post to my credit score.

Complaint: We are in the process of selling our home to XXXX, the escrow company XXXX has contacted Selene Finance for a payoff statement on XX/XX/2019, they were advised it would take 24 to 48 hours to " get into the system '' and 5 to 7 days to issue payoff statement. We contacted Selene Finance on Monday, XX/XX/2019 to check on status of payoff statement, they stated it had been sent out to check with the title company, we contacted XXXX XXXX at XXXX to see if she received payoff statement, she had not. XXXX XXXX contacted them once again on Tuesday, XX/XX/2019 for a payoff statement and spoke with a manager XXXX, they were to place a rush on the payoff request. As of today, XX/XX/2019 XXXX has not received the payoff statement. We also requested a payoff statement on XXXX XXXX, 2019, and we are waiting for the payoff statement as well. The closing date has been postponed twice due to Selene Finance not providing a payoff statement.

Complaint: My home sustained severe damage from Hurricane Michael in XXXX of 2018. I filed a homeowners claim with XXXX XXXX XXXX immediately. Insurance came to inspect and wrote me three checks which seemed insufficient to cover the repairs. I tried to contact my insurance company over a period of months regarding their estimate and the man handling my claim would never return my calls. After getting tired of waiting, I hired a public adjuster to help me with my claim ( XXXX XXXX XXXX XXXX ). Long story short, the insurance company and the public adjuster reached an agreement and they sent a check made out to myself, the P.A., and Selene Finance ( my mortgagee ). I sent the check to Selene Finance after the P.A. and I endorsed it about a month ago. This check was for {$90000.00}. Now Selene has over {$110000.00} total that I've sent to them from insurance. ( The contractor 's estimate is {$95000.00} ) Selene Finance is refusing to release funds to cover the 10 % fee charged by the public adjuster.

Complaint: Selene Finance is violating the The Fair Debt Collection Practices Act ( FDCPA ) and the Telephone Consumer Protection Act ( TCPA ). The company is calling me multiple times a day and they are speaking with me during these times. They are lying and saying that they are not verifying that it is me, but this is not true. If they have actually recorded the conversations, it would show that they have spoken with me. The most upsetting thing is, that I am receiving these phone calls and a payment has been scheduled ( in this case for XX/XX/XXXX ). During the month of XXXX ( XXXX ), I have spoken with a representative at least four times and during each of these times, my payment has been scheduled. There is no history of me scheduling a payment and canceling it. Here is a list of calls, from the most recent : XX/XX/XXXX at XXXX call duration 10 minutes and 7 seconds. During this call, the representative ( XXXX ) told me, that it was noted that I had received a call this morning but, there was no verification. I told her that was incorrect and that I hoped this call was being recorded so that it would be on record what she said to me. She was very condescending as if, I was the one not inputting information into their system correctly. XX/XX/XXXX at XXXX call duration 2 minutes and 4 seconds. I verified my information with the male representative and asked him why he was calling when I had spoken with someone on XX/XX/XXXX and a payment was scheduled. He said " you are correct XXXX XXXX and its probably because our system is set for five days. I will note the account. '' I told the representative that I hope the call was being recorded and he said, " yes ''. XX/XX/XXXX at XXXX call duration 18 seconds- I informed that representative that a payment was scheduled. XX/XX/XXXX at XXXX call duration 6 minutes and 35 seconds. This call was placed by me. The reason for this call is because I received a call at XXXX and the representative hung up on me after I verified myself because I was complaining and I had received a call on XX/XX/XXXX. XX/XX/XXXX at XXXX call duration 34 seconds. I asked the representative why I was receiving the call when a payment was scheduled, the male representative hung up on me. As you can see, some of these calls were made before my grace period ended ( there was a call on XX/XX/XXXX too ). The fact that the company continues to lie and use this as the reason I keep receiving calls is unacceptable and a violation of the law. This practice has been going for several months.

Complaint: My loan was transferred to Selene Finance from XXXX XXXX. I didn't know who the loan was transferred to until XX/XX/XXXX. I started to make payments only to find out that the loan was in collections. After numerous phone calls I was able to speak with XXXX XXXX of Selene Finance. I was able to obtain a modification in XX/XX/XXXX from XXXX. I was asked to pay {$6000.00} up front and then $ XXXX monthly until XX/XX/XXXX, to make the account current. I paid amount requested. In XX/XX/XXXX, I spoke with ( XXXX, supposedly person now handling loan ) to ask if there was a grace period with the loan modification and was told that, " as long as I paid by the end of each month there was no late fee and the modification will remain. '' " I was also informed that starting in XX/XX/XXXX if the loan was paid after the XXXX of each month I could incur a late payment. '' I made all payments before the due date. My husband was contacted by a XXXX XXXX on XX/XX/XXXX, who claimed to be the new representative on our loan and informed him that we were in default, and were four months behind ; after my husband explained to him that we have been making payments and had records, he said that they hadn't received XX/XX/XXXX or XX/XX/XXXX payments. Again my husband disagreed. XXXX then informed him they didn't receive XXXX 's payment. My husband again disagreed and reiterated to him our conversation with XXXX. XXXX told him to send him an email with the records from our bank showing payment and he would stop the default ; that email went out the same day to XXXX and XXXX 's Customer Service email. He also requested that we follow up in a couple day to ensure receipt. We ( my husband and I ) have made numerous attempts to contact XXXX, XXXX and XXXX the manager to no avail. We are sent to voicemail after being on hold for upwards of thirty minutes. I even informed their representative XXXX on XX/XX/XXXX, that I was recording our conversation and she refused to give me any information on my loan. On XX/XX/XXXX, a Notice of Default was sent that wasn't delivered until XX/XX/XXXX, and obtained from the Post Office by me on XX/XX/XXXX, threatening a payment of {$12000.00} by XX/XX/XXXX or the loan would be accelerated and go into foreclosure. Please also note that they are still saying that they didn't receive my XX/XX/XXXX payment. It appears from XXXX website that Selene Finance is a predatory leading company who successfully steals, lies and preys on homeowners by claiming non-payment for late fees and foreclosure, not answering phone calls and transferring loans to different representatives with conflicting information. They have an alert on their account with the XXXX confirming all of the above. Please help to regulate these predatory practices. Enclosures.

Complaint: I recently applied for a loan modification with Selene Finance because I missed payments due to a lengthy XXXX period.I have since regained employment but with decreased compensation. I was hoping to receive a forbearance and/or reduced interest rate to reestablish regular payments. I was just told via phone my modification was approved but with a mortgage payment increase of {$500.00} and if I didn't make the first payment ( {$2800.00} ) within two weeks ( XX/XX/XXXX ) Selene would resume the foreclosure process. I explained I would pay but would need to XX/XX/XXXX to realistically come up with this extreme payment and since I haven't even received the offer in writing in the mail to review or sign how could I be prepared for such an amount or know the terms. The customer service department stated the investor on my mortgage will not give any more time. I have researched this loan servicer and they have hundreds of complaints regarding working against homeowners so the investor can foreclose and profit on the resale of homes. They're expecting me to send in a payment without even seeing the terms of my modification which seems very fraudulent. All i need is to be able to review the terms or this modification or repayment and be given a reasonable time to make my first payment. Please assist in making this company accountable for their bad mortgage practices.

Complaint: Grievance Notice under Clause 20of the Mortgage & 12 C.F.R. 1024.35 Selene Loan # XXXX # 1-There is an auction on my property XX/XX/XXXX @ XXXX XXXX County Supreme Court # 2 XXXX $ XXXX-I recently found that the Mortgage with XXXX XXXX did not have a legal/property/tax-description or tax map information only an address thus making it a void instrument thus making the judgment of foreclosure void which does not allow them to proceed with the auction or any other recourse. Document date XX/XX/XXXX recorded XX/XX/XXXX ( attached is also a copy of the mortgage with my signature and notarys proper signature that matches the samples I attached in # 5 ). Recorded mortgage states my home is a 2 family it is actually a 1 Family. # 3 XXXX $ XXXX-also does not have legal/property/tax-description or tax map information only an address thus making it a void instrument also. There is a blank paper with a stamp So in Original various times. Document date XX/XX/XXXX recorded XX/XX/XXXX # 4 Notary XXXX XXXX-was the notary on both files and was incompetent to the point because of his incompetence they also forged my signature on the XXXX XXXX XXXX {$320000.00}. I would think that he lost the XXXX file and then noticed that he didnt record the XXXX file so or the investor signed my name on the XXXX file. # 5 XXXX- samples of signatures from State and court cases ( he is also an attorney ) they are different from the signatures on the mortgages. They dont match at all. I believe someone was signing for him # 5 Deed with the proper legal description XX/XX/XXXX # 6 Samples of my signatures during XXXX # 7 Notes # 8 Limited Power of Attorney naming XXXX XXXX -I had been in the mortgage industry prior to this foreclosure action ( I had a massive XXXX ) for approximately 20+ years as an FHA Underwriter and a loan originator. In my training I know what a Legal Name is. If you look at the mortgage with my proper signature you will find I inserted my middle initial XXXX where needed. In the XXXX XXXX loan, it was done beforehand. Also, that if you sign in the wrong place it could void any legal document. -The attorneys involved have submitted to the courts documents that are of a Fraud and Forged documents that they and the banks knew of beforehand but completely ignored to proceed with this foreclosure. -I plan litigation under the following thus far ; 1 ) 18 USC 1341 : Mail Frauds and Swindles 2 ) New York Penal Law Article 170 : Forgery 3 ) Notary Fraud 4 ) NRS 357- Submission of False Claims to State or Local Government 5 ) Quiet Title Action 6 ) Fraud upon the Court for Perjury by Attorney for the Plaintiff And any other legal means that will be available to me to protect my home.
