Complaint: In XXXX my husband and i separated, i left the home at that time ... it took 7 years to come to a conclusion and a divorce with my husband retaining ownership of the home and property. We were divorced XX/XX/XXXX. At that time the mortgage was in good standing and up to date. The divorce agreement stated that my ex husband had to put the home in his name ( refinance ). He never did. And his last payment to the mortgage company was XX/XX/XXXX. He apparently didn't want the house but didn't want me to have it either. so fast forward to XXXX, i have very little power in this process due to the divorce agreement itself, i gave up my rights to the home with the understanding he would refinance, the house sits empty, i have worked hand in hand to the fullest extent i am allowed to, and finally signed a quit claim deed in XXXX. 6 mos later i am called by selene finance who states that the quit claim deed failed. I go thru the process with them all over again and it ended with this email From : XXXX XXXX [ mailto : XXXX ] Sent : Wednesday, XX/XX/XXXX XXXX XXXX To : XXXX XXXX XXXX Subject : RE : 2nd part of email Correct. You are no longer the owner. You deeded the property back to XXXX XXXX who is the investor/noteholder. Every noteholder is required to have a servicer. XXXX and Selene are servicers. Hope that helps! You should be receiving your check sometime next week!
it is now XX/XX/XXXX and i am still receiving statements from selene finance stating that i owe them money for the above named property, it still sits as an unpaid account on MY credit.. I have called, i have emailed, never any response, no help, answers or a game plan. this has destroyed my life ... i have no idea what do to next. i am now XXXX years old, i left at the age of XXXX i would like to have my own home again. NEVER NEVER would i ever do business with these people again, to say that they couldn't care less is an absolute understatement.

Complaint: Selene Finance has given my realtor and myself the go around in order to get a letter stating what is owed on the mortgage. We have had to reschedule our closing on this home twice now. I have called the company every day for the last week, multiple times in a day to get the letter either emailed or faxed to me with no luck.

Complaint: XX/XX/XXXX I wrote Selene Finance on the following : Loan # XXXX I closed on this modification XX/XX/XXXX and on my monthly statement one year later, XX/XX/XXXX they billed me {$210.00} for lawyer fees on this modification. My husband made the payment and did not notice this charge. Selene refused my request on phone for refund of this amount. I told them you can't come back one year later and say opps ... my lawyers are charging a fee. Not reasonable. I closed in my name and Selene did not change their records UNTIL XX/XX/XXXX Statement due XX/XX/XXXX. All this time I made the payments to XXXX XXXX name on statements. These people just can't get this modification right. I have to complain all the time.
My escrow account is all messed up also. Yearly total incorrect. XX/XX/XXXX statement shows {$710.00} with XX/XX/XXXX taxes paid on your behalf segment as {$210.00} - this is contradiction that it was an attorney fee which I paid because they added it to my monthly mortgage statement as due amount in XX/XX/XXXX in amount of {$1100.00} which my husband paid in error. My regular payment is {$900.00}. I sent them a complete breakdown of my escrow account and showed how they were incorrect. They send double monthly statements.
At modification my payment was suppose to be {$890.00} but due to a escrow shortage it was XXXX. A difference of {$17.00} which they said was going to a shortage. Yet my starting escrow on XX/XX/XXXX was XXXX. Can't get an explanation as to why payment is up and where does the XXXX go. I have all the papers I sent to them. I can fax to you if you want to see the correct figures. They never explain the difference and why they can't get it right. I have to keep calling.
Breakdown : XX/XX/XXXX Bal XXXX Due XX/XX/XXXX Then Due XXXX Bal XXXX Due XX/XX/XXXX Bal XXXX Then they increased escrow {$290.00} per month up til due XX/XX/XXXX. So XXXX x 12 = {$3500.00} plus the 2 x XXXX = XXXX comes to grand total of {$4000.00}. ; XXXX You take that amount and pay off taxes XXXX and insurance XXXX = {$870.00} balance in escrow. They show {$130.00} on my statement due XX/XX/XXXX Where is my {$730.00} -- -- difference they show and I actually paid???? You won't get a clear response from them. This is not an A RATED mortgage co.

Complaint: On XX/XX/XXXX my HOME SOLD. The reason my home sold was due to I had to file a BK and i could not drive the 4-5 hrs to the court house to get to file the BK docs so i did it all by mail and it had it overnight-ed to the lender and the post office sent a letter stating they had recd my packet on a Saturday ( please see attached letters ) the packet should have been deliveried on Monday XX/XX/2018 and it was not. I requested that the foreclosure attorney and the lender please rescind the property back to me as it was not my fault of the post office mistake and they should honer the BK cause it was filed before the sale date on XX/XX/2018 and cause of the post office i lost my home.
When calling the lender and the foreclosure attorney they choose to not HELP me keep my home at all. I have been very sick over all this and my medical conditions are not that good. I fel they could of rescinded the property back to me. Understand i know it was the 11th hour but due to my health and surgeries i have had i could not drive that far to the court house.

Complaint: I am making this complaint due to it now being 2 months trying to deal with Selene Finance on getting my mortgage up to date like it should. I was told that we had a shortage in our escrow originally for the amount of {$1400.00} in the month of XX/XX/XXXX. I was told that it would be broken down over 36 months and our mortgage payment would be recalculated to {$840.00}. I received a letter dated for XX/XX/2018 saying our shortage was {$1300.00} and that it was broken down over 36 months in the amount of {$38.00}. I then receive another letter dated for XX/XX/2018 saying our shortage was {$850.00} to then be told that now my payment that suppose to be {$840.00} is now {$1000.00} due to the {$850.00} but speaking with someone on the phone they tell me its due to the escrow being more than they thought when they actually had the bill 60 days in advance to XX/XX/2018 in which my insurance company XXXX XXXX told me as of XX/XX/2018. I was told over the phone 2 weeks ago that my insurance was left completely off my analysis but it actually wasn't. Selene sent me an email on XX/XX/2018 with the analysis that they were suppose to have sent out in XX/XX/XXXX that I didn't get until XX/XX/2018 when it was emailed to me for me to look at. I called in XX/XX/XXXX to make my mortgage payment to be told that I needed to make a payment of {$990.00} and that the money sitting in suspense would be added to get my payments back on track since the escrow issues have been showing behind. Well fast forward almost 3 weeks and nothing has been fixed. The account is now worse off than it was and I'm being told that I have no payment for XX/XX/XXXX which is clearly was paid and has come out of my account. This company refuses to allow me to speak with someone of management in the escalations department and continues to XXXX us up worse than we were. I have written so many letters and email with no response to my issues. I really need someone to hold Selene accountable for this behavior when we are doing everything that is asked and making our payments every month. I don't want to lose my home because we are dealing with a company who can care less and no one holds them accountable for their actions.

Complaint: My ex wife and I purchased our home in XXXX. The lender was XXXX. I was the XXXX XXXX at the time. I discovered the fraud committed in XXXX. It has been a nightmare ever since. We were modified in XXXX. We were forced to file bankruptcy in XXXX and was closed in XXXX.
XXXX claimed to be a new servicer in XXXX, although we were in a bankruptcy stay they continued to harass and threaten foreclosure ever since. I explained to them that we had reconveyed already. Our statements were ignored they attempted to remove fraudulent from stay in XXXX unsuccessfully. Then XXXX XXXX claimed to be the servicer, although never seen an assignment. They tried to remove from my ex wifes bankruptcy in XXXX. Then Selene is now the servicer and have attempted to foreclose on XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. They Prestige Default Services are the self declared Trustee now and the loan numbers were changed as well as the TS numbers. Notifications were not sent. I sent them proof that their assignments were fraud and they ignored and continue to foreclose based on the direction of Selene Finance. See Attached Fraud from original HUD to Assignments as well as Notice of Default invalid.

Complaint: Effective XXXX our mortgage was transferred to XXXX XXXX. In the opening letter, XXXX stated that effective XX/XX/XXXX we were to begin making mortgage payments of {$2400.00} to them instead of the previous mortgage company. T In the letter they state that the amount due is {$2400.00} and that will be the amount of subsequent payments. We paid in XXXX, XXXX, and XXXX. As of a few weeks ago they started contacting us staying that we were delinquent. I called and spoke with four representatives and a supervisor, all of which gave a different story. Initially the first representative stated that because I paid XXXX cent over on one of the payments, that payement went into a supspnse account. He further stated that he email the cash department and they will move the funds and everything will be cleared up. When I started paying the mortgage for XXXX XXXX it was still showing delinquent and I called again. This time a supervisor stated that they sent to XXXX payment to another mortgage company and as a result, we were delinquent. I asked advised home that, as instructed in the transfer agreement, we sent the payment to XXXX every month on tine and did not authorize the payments to be used for anything else. He further stated the the account remains delinquent because they shifted the funds from the suspense account. I have made all payments per the transfer agreement and can provide evidence via Bank XXXX XXXX and XXXX is trying to say we are still delinquent.

Complaint: Selene Finance is not giving us credit for mortgage payments that we made by putting the payments in suspense accounts and not crediting our account. As of XX/XX/XXXX our statement showed that we are {$0.00} past due. Selene accepted this payment on XX/XX/XXXX. About two weeks later we get a " Notice of Default and Intent to Accelerate.
This company appears to be using unethical, possibly illegal practices and trying to push a intent to accelerate to take customer home. This type of behavior should be investigated.

Complaint: I faxed mortgage modification request and financials to XXXX XXXX XX/XX/2018.
I've had a change in my financial circumstances I need assistance with bringing my mortgage current. A follow up call was made to Selene XX/XX/2018 inquiring if they received modification documents and financials and if there any other documents needed at this time. I was informed by XXXX Selene modification dept. the documents were received, the property foreclosure sale wouldn't be put on hold even though they had all required documents in their possession and the file is being processed.Selene has been uncooperative and hard to work with. I feel they are discriminating against me and trying to let my home foreclose. I don't want to lose my home.I received a property foreclosure letter from the Attorney XXXX and XXXX dated XX/XX/2018 with a property sale date of XX/XX/2018. I researched the Tennessee statue in regards to property foreclosure sales and Tennessee Code Annotated states the homeowner is to be given 30 day notice prior to the foreclosure. I did not receive the 30 day notice as required by Tennessee Law. Please, Please, Assist me

Complaint: On XX/XX/2018 I received a letter from my insurance company ( XXXX ) stating that my insurance policy would be cancelled as of XX/XX/2018 because Selene Finance had submitted a letter stating the property was vacant. The Rep. from XXXX stated they received the information from Selene on XX/XX/2018. While seeking with the Rep. from XXXX today ( XX/XX/2018 ) I informed her that I still was residing at the property that Selene stated was unoccupied. I was informed to send in a current utility bill and to also call Selene. I informed the Rep. that I was in the process of calling them and I am on hold waiting for someone to answer my call. I spoke with XXXX from Selene around XXXX and made him aware of my compliant and how it is not right that Selene Finance send out false information other provider. I also informed him that I had been in contact with Selene a few time in XXXX since they did not credit a payment correctly which was finally resolved. I did ask XXXX if he could request that someone from the Insurance Dept. at Selene give me a call so that they could setup a time to come to my and visualize that I reside at the said address on file. I also informed him that I would be send over a utility bill and contacting Dept. of Banking consumer Affairs to file a compliant regarding falsifying document. This is not the first time that I had to deal with Selene about falsifying documents. How long does a consumer have to tolerate this type of action. I guess when the lender sees a well well groomed property they just assume that no lives there.
