Complaint: I spoke with XXXX XXXX XX/XX/19 @ XXXX re : more flexible payments for loan. A {$50.00} good faith fee is required for any delay in payment. This fee is the cost of the monthly loan payment. When the delay in payment has been needed and used, often I borrowed from someone to pay the fee. When this option is used, it can only be done 3 months at a time. This poses a major problem because it puts me in a position of owing other people. Now, I'm laid off from employment as of XX/XX/19 and called again XX/XX/19. The representative told me there are no other options to assist me other than again paying the fee. This means I must borrow the money from another person ( this is not sustainable for me or the individual ). XXXX XXXX wanted me to post date a time to pay in 30 days. Again I don't have money at the moment, I'm awaiting an interview with unemployment and am unsure of how I will pay my mortgage and other household sustaining bills for me and my child. Whether I'll have money to pay XXXX XXXX is unknown at this time. XXXX XXXX stated the only other option is to miss the payment, fall into default and the collections department will contact me. What I need is another recourse of action while I am currently unemployed. What else can be done to keep my credit report from suffering while I have no employment if I'm communicating and being proactive. Why is money to pay for an extension the only option, especially if I have no money or employment a this time. Thank you for help.

Complaint: Ive been fighting with XXXX XXXX for months on getting a lower payment. I only make {$13.00} an hour with a car note of {$310.00}, phone bill {$120.00}, utilities {$300.00}, groceries {$200.00} and rent {$350.00} and other expenses not mentioned above. That alone is being paid throughout the month. They told me in order to talk with loan modification or be put into the loan reduction program I had to be past due indicating that I would have to miss my payment. Now I have this outstanding amount of money I owe. It was originally {$780.00} now I owe {$1500.00}. They have given me options for repayment and they include : Forbearance, interest only payments and wait for approval from the military office that of which I was already denied. They have been giving me the run around for the last two weeks now Im in default with a outstanding balance. Mind you many of my loans are variable some have interest rate of 11.7 percent. Im in need of help.

Complaint: hello I have a XXXX XXXX loan that I have been paying since XX/XX/2008, it was a XXXX twelve year loan. I have been making my minimum payment and I still owe XXXX after ten years. I have spoken to XXXX XXXX manager his name is XXXX ( XXXX ) and he tells me there is no way for me to pay on principal only above and beyond my monthly payments. I have paid extra on my loan multiple times and it all seems to go to interest and fees and isn't applied to principal. I need help if I am ever going to get out of debt. I thought it was illegal for a company not to allow me to pay on principal as long as I was making my monthly payment.

Complaint: I contacted the financial institution and requested to speak to a supervisor. I was promised on multiple occasions I would receive a call back because a supervisor was not available. I never received any calls nor written communication from the financial institution. I wanted to discuss my loans and qualifications for a future loan. Recently I applied for a loan and was told I needed a co-signer. I'm uncertain as to why I'm unable to qualify on my own. I'm still unable to get someone on the phone to assist me with my inquiry. I want to know why I was denied a loan on my own. I have just one more semester until I graduate and I begin working full-time. If they are unable to assist then I will consolidate my loans and take my business elsewhere.

Complaint: I am a victim of identity theft, and have notified the owner of the fraudulent loans, Sallie Mae, regarding the fraud but have not received any response. I am providing a copy of the most recent fraud report sent to Sallie Mae that I have not received any response to, and will provide a summary of my dispute below. The following Sallie Mae loan account numbers have been obtained in my name without my knowledge or consent : XXXX XXXX XXXX XXXX XXXX On XX/XX/2017, I receive a phone call regarding the above-referenced loans and was told that I needed to pay a large sum of money immediately for a loan that I supposedly co-signed for or I would be sued and taken to court. I said that I have never signed or agreed to any such loan. I immediately obtained the number for the fraud department and called. I have been attempting, since receiving notice that there was fraudulent loans in my name, to alert Sallie Mae and remove the loans from my name and off of my credit report, but no action has been taken by Sallie Mae, and I have never received any responsive communications addressing the loans or what steps they were taking to investigate my situation. As stated in my attached identity theft affidavit, I have not opened any student loans or co-signed on any student loans with Sallie Mae. The accounts cited above are harming my credit, have caused harassing phone calls, and have harmed my financial situation and my quality of life.

Complaint: XXXX XXXX student Loans company and XXXX XXXX XXXX reported a negative trade line to my credit report without sending any verification relating to particulars in the amount of {$62000.00} for XXXX XXXX and {$2300.00} for XXXX. XXXX XXXX XXXX XXXX has also contacted me in efforts to collect alleged debt, ( in the amount of {$26000.00} ), in unlawful and unjust manners. They have contacted me directly via phone, mail, and email without my consent, as well as my family members who have no relations to the alleged debt. According to title 15-1692B of the FDPCA dealing with communication with third parties, the only way a collection agency can communicate about any debt, 1 ) they MUST have a post judgement from a court or competent jurisdiction or 2 ) prior to consent from the consumer giving express consent to a court of competent jurisdiction. This is in violation of New York General Business Law Section 349- Deceptive Acts, Section 380S- Identity Theft and title 15 U.S.C Section 1030- Access Device. The reporting agency did not follow laws under title 15 U.S.C 1681S-2 ( a ) - Duty of Furnishers of Information to provide Accurate Information.

Complaint: In XX/XX/2017, I initiated automatic payments over the phone with a XXXX XXXX representative, XXXX XXXX. I provided my bank account information over the phone to set up the automatic payments. The customer service agent took down and processed the incorrect bank account number when setting up the auto payment. When the payment did not withdraw from my bank account, I contacted XXXX at XXXX XXXX and he clarified that this was an error on his end. He assured me that it would be resolved and it was nothing to be concerned about and it would not be marked as a late payment or a derogatory mark on my payment history and credit. However, it was never corrected. I have made countless calls to XXXX XXXX over the last year and a half and was told by various representative and supervisors that these events never happened, and that I gave the wrong numbers, even though their representative explained to me that it was he who made the clerical error. They will not allow me to speak with XXXX, the account manager who initially worked with me to set up the payments and who made a human error in recording my account information. They told me there is a recording available of our phone conversation which they reviewed, but they will not allow me to hear it nor provide me with any additional documents or recordings to support their claim that it was I who made the mistake. Due to nothing more than an error of a XXXX XXXX representative, the payment was not received and considered late and is still showing as a derogatory mark on my credit, and the only late payment.

Complaint: In XX/XX/XXXX, I was going through a financial hardship and struggled to repay my loan with XXXX XXXX. I called their office in XXXX, Delaware and told them that I was making less than {$12000.00} a year and needed either a lower monthly payment amount, which at the time was {$200.00} or a forbearance. A representative stated that I was ineligible for an income based repayment plan, but suggested a forebearance. She stated, that I needed to pay three on time installment payments for the months of XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX, in order for the forebearance to be effective starting XX/XX/XXXX. I struggled to make my forbearance payments for the months of XXXX & XXXX, which led to my forebearnace being revoked and receiving non stop harassing calls from XXXX XXXX demanding payment. Also, they contacted my elderly grandmother at her home several times as well, to demand payment. In XX/XX/XXXX, I was able to find a higher paying job and paid my past due balance with XXXX XXXX, which at the time was only {$1200.00}. I paid XXXX XXXX more money than what was owed. My taxes from XXXX XXXX reflected in XXXX, I paid them approximately {$2300.00}, may I add that they increased my monthly payment from {$200.00} to {$250.00} as a result of missing 3 months of payment. In XX/XX/XXXX, I requested a forbearance and again XXXX XXXX stated I had to pay three installment amounts, in order for the forbearance to be applied to my account. I missed the final month of XX/XX/XXXX and my account went into default. XXXX XXXX continuously harassed me, refused to give me an income based repayment plan and misreported my payments to the credit bureaus leading to a decline in my credit score. XXXX XXXX contacted the credit bureaus and told them I failed to pay my student loan the months of XXXX and XX/XX/XXXX, which was inaccurate. I contacted several credit agencies to dispute the misinformation on my credit report. XXXX XXXX called me from several different numbers, left countless voicemails, called me at XXXX, XXXX and any and every chance they could contact me throughout the day, which was in non-compliance with the Fair Debt Collections Practices Act. The harassment continued day by day and my grandmother ( CO-signer ) who is XXXX years old was also subjected to the same type of harassment. In XX/XX/XXXX, I went onto my XXXX XXXX account and my loan was not available. I contacted XXXX XXXX and they stated that my loan was in default and they needed my full balance of {$19000.00} to be paid. I objected to this proposition and pleaded that my loan be reinstated and try a monthly income based repayment plan. A representative by the name of XXXX and XXXX XXXX stated that I ruined my opportunity to negotiate monthly repayment. XXXX stated that non repayment of my private loan to XXXX XXXX came with consequences. XXXX stated she could try to lower the amount due from {$19000.00} to {$12000.00}, but id have to pay it in full. I mentioned that I could not afford that type of offer and XXXX proceeded to ask me if I had a family member or friend that I could borrow money from. At this point I feel harassed, extorted, belittled and betrayed from the fraudulent acts committed by this student loan company. Had I initially been granted the opportunity to have an income based repayment plan for my student loan, I couldve avoided defaulting on the unnecessarily high repayment plan that was given to me six months following my college graduation, based upon the amount I owed. I would like a full investigation to be conducted on XXXX XXXX and their unethical business practices!

Complaint: On XX/XX/2019, voicemails were left for myself and a reference that were against the FDCPA. The voicemail left for myself was harassing by stating how long theyve tried to contact me, threatening by stating that hes called my refenences and extremely unprofessional by the tone of his voice. The voicemail to my references stated that he has been trying to contact me all month long, as well as stating directly where he was calling from. There was a phone to my other reference on this day as well and he spoke to her tell her his name, where he was from ( without being asked ), stated that hes tried to call me all month long and left a message with her to call me back. He left his name, number, and extension with the reference. For the voicemails left I have copies of both the voicemail left for myself and the voicemail left for my reference. However, they will not attach as they are not paper files. I contacted XXXX XXXX directly at XXXX XXXX and tried to explain that he violated FDCPA, he basically told me he didnt care and that I was past due {$250.00} and that my account needed taken care of. I asked to speak to a manager and was connected with a woman, who I told the violations to and explained how rude and unprofessional XXXX was. She apologized, but you could hear in her voice that she truly didnt care and was walking through the motions.

Complaint: To whom it concerns I am the mother of XXXX children who needed me to co-sign to get college student loans. I am happy to say that XXXX have XXXX and XXXX is set to finish next year. They are all employed and tax payers. YAY My problem is the fact that these lenders have no desire to help my children pay back their loans. I have also found another little ugly secret. My daugher has loans with only XXXX XXXX. Her balance was {$34000.00}. We stopped using student loans for her in 2015. She is still in school, set to XXXX next spring. Her balance is NOW {$51000.00}. As stated above, we have not taken any more loans for her since 2015. Her balance has increased by {$20000.00} and she has not even graduated nor taken a loan from XXXX XXXX since 2015. This is criminal ( in my opinion ) and explains what I could never figure out. With all XXXX kids my student loan debt is over {$100000.00}. Actually closer to {$200000.00}. I knew there was no way we took out that much debt. Now I get it. They tack on ridiculous interest even though these loans are in deferrment. WOW, this is not right. We want to pay back the loans. I ( we ) always pay our bills on time. There is no way to get out from under this massive debt and these servicers could care less. I NEED your help. This is not right. {$20000.00} more than what the original amount was when we stopped taking out loans in 2015??? There is no way I owe the {$200000.00} on all of my children. I can afford to pay for one ( which is what we have been doing since 2015 ) I co-signed with the intention of paying back what we borrowed. If {$34000.00} can add up to {$51000.00} and the student has NOT even graduated yet no wonder my overall student loan debt is so high. As the overseer of these private loan institutions, what are you doing to fix this?? My children could not qualify for Federal ( taxpayer funded ) student loans. Funny, as a taxpayer I don't qualify but someone who probably does not pay taxes gets the sweet heart deals. I am sure most did not even graduate. My kids have. There has got to be justice here. This is just not right!! I look forward to an explanation from you as to how this is fair. If you have no jurisdiction over these predatory lenders, then what exactly is YOUR JOB.
