Complaint: I applied for a mortgage modification with my lenders XX/XX/XXXX, XX/XX/XXXX and was denied because they said in XX/XX/XXXX I did n't get all documents in which is incorrect then XX/XX/XXXX they said they denied me for Tier 1 and tier 2 because of my income I thought when modifying your loan it brings the interest rate down to 31 % of your income. Well now they said I was denied because my investor has decided to drop my taxes and insurance because of the value of my property and its not in their best interest to modify and they will not add escrow. Well when I purchase this home I had taxes and insurance on my mortgage is it legal for them to just take taxes and insurance off my mortgage if they want to? I am now {$28000.00} in arrearages with my mortgage my house is only appraising at {$35000.00} and I owe then {$61000.00}. What are my options to save my home.

Complaint: XXXX XXXX ( servicing company ) sold my mortgage to Select Portfolio Services ( SPS ) in XX/XX/XXXX. I was approx XXXX months behind on my mortgage when the change occurred ( XX/XX/XXXX ), once the loan was transferred to SPS, I paid {$3000.00} on XXXX in effort to catch up to what I was behind, per the statements from XXXX, with a remaining balance of {$300.00}. In XX/XX/XXXX, SPS sent a statement indicating that I was behind {$7600.00} which included the arrears, there was an amount of {$2800.00} was assessed in compounded interest which was deferred interest that should have been added to the end of the loan per a XX/XX/XXXX loan modification agreement I signed with XXXX. The {$2800.00} was instead added to the loan, and I was also advised of a {$1900.00} escrow shortage. I received XXXX notice of a escrow shortage, and there was no indication there was an issue. As a result of the escrow shortage, SPS placed Forced Insurance on my mortgage, and my payment went from {$1200.00} to {$1500.00}. I spoke to SPS about the problem and explained to them the lack of notice about this escrow shortage, and the forced insurance was cancelled but after XXXX months. I was not returned the amount that was assessed as a result of this insurance, when in fact, this insurance should not have been placed on the account in the first place. I ask that CFPB look into the practices by SPS as they have placed a financial burden on me, due to having to my payment going up, and this has caused significant stress this has placed on my personal life.I want to stay in home and would like to continue to make my payment, but the lack of miscommunication, and the error by SPS have been become far too many, and I bring this to your attention, as there very well may be other in my situation.

Complaint: XXXX 's " unsafe and unsound foreclosure practices '' and use of forged and unauthorized assignment of mortgage is being perpetrated in state and federal courts in order to pursue a foreclosure and relief of stay. XXXX has and is continuing to use forged assignment of mortgage allegedly assigned from XXXX XXXX to XXXX in XX/XX/XXXX and XX/XX/XXXX. These assignments are signed by various known robo signers as vice presidents of XXXX and XXXX to proceed in a foreclosure and bankruptcy proceeding. XXXX claim it is the legal owner of the mortgage via transfer, assignment of mortgage on XXXX XXXX, XXXX in a foreclosure complaint. No evidence was presented into the court 's record as to the claim. XXXX is not the original lender, but a debt collector, attempting to collect on a XX/XX/XXXX defaulted debt. XXXX XXXX Mortgage XXXX is the original lender and filed for chapter XXXX bankruptcy on XXXX XXXX, XX/XX/XXXX. XXXX was granted a default judgment in XXXX XX/XX/XXXX, and a relief of stay in the debtor 's bankruptcy proceeding in XX/XX/XXXX, again without any any proof of legal standing. No valid proof of note or assignment transfer, a proof of claim was not filed or any legal valid documentation offered, but the state court default judgment. Upon noticing XXXX 's lawyer that there was not any valid recorded documents of the transfer, or an executed assignment in the recorder of deed on XXXX XXXX, XX/XX/XXXX, an executed assignment dated XXXX XXXX, XX/XX/XXXX was filed into the record and was recorded on XXXX XXXX, XXXX. The assignment was defective and is invalid for numerous reasons. On XXXX XXXX, XX/XX/XXXX, another assignment was executed and recorded on XXXX XXXX, XX/XX/XXXX. This assignment was not a valid assignment. However, the XXXX XXXX, XX/XX/XXXX assignment is being perpetrated into the state and federal court as a valid assignment from XXXX XXXX to XXXX Bank, who was in bankruptcy at the time of the alleged executed assignment. I have attached various documents, including a letter to XXXX in regard their deceptive acts, and other pertinent documents as proof of the issues involved. Complaint: Select Portfilio NOT doing their due diligence & what is in the best interest for the consumer or investor. 1. prior to the XX/XX/XXXX we had perfect credit.We struggled since then until 2 yrs ago when my wife found employment we were forced to file bankruptcy in the meantime and had to re-file a few times until we did it right as we had no funds for a lawyer we went from an income of XXXX per year to XXXX per year. We did our due diligence we didnt file a bk until we truely ran out of funds hoping the market was coming back we depleted XXXX XXXX and savings, we also put XXXX down when we purchased our home in XXXX we tried to modify over and over each month with Select Portfolio XXXX XXXX would set nod dates adding fees and trustee fees, recording fees setting new sale dates making the home out of reach for a modification adding excess of XXXX per month to the arrears they are crooks they want to get you priced out and will do whatever they could do. They told us last turn down we did n't qualify because XXXX per mth short my wife her job and left our ill daughter to take another job 1 to 2 hours everyday to commute to get an extra XXXX per month. They put some peoples arrears and some principal balance reductions for some people but not all, when we questioned what the parameters were and who got reductions or arrears due at maturity we were told they could n't explain that there is no guideline for that it is up to the lender and select portfolio case by case in this case we are clearly being discriminated against in almost a XXXX kind of way because our last name is XXXX. They pick & choose who gets a principal reduction or the arrears to be foregiven or put on the back end of a loan if they a want to they can. we qualify and have asked for just arrears to be on back end. XXXX salaried employees combined make XXXX now as she just got a XXXX per month raise. We have no bills but piti, car pmt XXXX XXXX XXXX to our daughter to help with her schooling. Since our chapter XXXX was discharged. our mortgage " Principal Balance is XXXX and both HAFA and HAMP Say to go off principal balance to XXXX but with arrears taxes and insurance all the filing fees over and every month while trying to modify add another XXXX again if they just forgive the arrears we are willing pay the initial investment so tax payers or investors do not lose. like they have for others also at 2.50 % -3 % interest on either fully amortized over 40or30 years or XXXX. due in 10 years we qualify or split the arrears with us. if they take the property which they did set a sale date for XXXX they will incur more fees and not get more than XXXX for this 3bed-2 bath home in fair to average condition & some people say poor condition. We had a realtor put it on the market he got one call they laughed at the price 3-2 at even XXXX, the investor makes money on their principal investment and we get to stay in our home with our XXXX daughter and start fixing up. We went out of our way to do our due diligence to keep our home and work the Select Portfolio to be clearly discriminated against. When we ask to speak to someone in underwriting or mgmt. to have explain more or get clarified who qualifies for reductions or the arrears to go on back of the loan we told IN RECORDED CONVERSATIONS XXXX XXXX there are no parameters anyone could explain at the point it is up to the underwriter when we ask to talk to mgmt. to explain our circumstances or the investors direct to plead our case there is no one to talk XXXX but clerks who just read off a screen who do not understand. We again cleared our credit got new employment very steady JOBS MINE 32 YEARS WIFES NOW STABLE. This company clearly needs an audit of who got what and moving forward when people in modification I believe all fees should freeze until determined we were priced out

Complaint: Select Portfolio Servicing is attempting to alter the original terms of the mortgage. i currently have a {$10000.00} home insurance deductible and SPS is requiring that I rework the insurance policy to lower the deductible to {$5000.00}. The {$10000.00} deductible also covers all contents within the home. The current assessed value of my home is {$970000.00} but the mortgage balance is {$400000.00}. This mortgage originated 10 years ago and met all insurance requirements. mortgage was bought and sold several times. SPS is the only company requiring I alter my insurance policy.

Complaint: I have just received a " Notice of Default '' from the servicer ( SPS ) on XXXX XXXX, XXXX. I believe my loan is NOT in default. Although my Ch.XXXX bankruptcy was discharged ( to my disbelief! ) recently on XXXX XXXX, XXXX, my case is XXXX pending the Bankruptcy Court 's decision on the Trial hearing next month, on XXXX XXXX, XXXX. The Court is supposed to Determine the Final Cure on XXXX XXXX, XXXX. In the " Notice of Default '', Select Portfolio Servicing ( SPS ) demanded that I paid an unreasonable, unsubstantiated cured amount in 30 days, or they will foreclose my house. The cured amount has been challenged in the bankruptcy court. The evidence of fraud, misrepresentation and other reasons will be submitted to the Court at the up-coming hearing in XXXX XXXX. I respectully request CFPB 's interferring to stop the abuse by the servicer ( SPS ) while waiting for the Court decision. The abuse has continued and carried on after XXXX XXXX XXXX had violated countless rules and regulations for almost 5 years. However, XXXX has MANAGED to try to cover-up by filing certain documents in the Bankruptcy Court and transferring the servicing and ( supposedly ) removed itself from liabilities. My loan originated a XX/XX/XXXX XXXX PASS-THROUGH CERTIFICATE SERIES XX/XX/XXXX-XXXX, modified under HAMP by XXXX in XX/XX/XXXX. Thank you for your time. Respectfully,
