Complaint: Back in XXXX, i purchased a house, the lender was country wide mortgage only at closing did i found out my interest rate was 12 % adjustable note. After about a year later i got a letter informing that Select Portfolio servicing had taken over my loan. I have struggling so hard to keep my home or sale it to get the equity out of it for my senior years. I put {$50000.00} down on this house. Back in XXXX, a company identified Select as a predatory lender and got 4 years without paying any notes. In XXXX they came back with a vengerence my notes was {$1200.00} a month and every year it kept getting higher and higher. I tried to refinance during this time but they had a very negative report on my credit report so i could not get it refinance. I been during everything i could to hold on to my house. Back in XXXX they tricked me into a modification loan which almost doubled the amount of the loan. All these years none of my money went to the capital just interest. Back in XXXX a class action suit was filed against countrywide mortgage for charging XXXX XXXX higher interest rate on their homes. i am one of those people. I called them, they said that was for Florida residence, but that did not stop them for using predatory tactics with me all these years. They are once again threatening forclosure, sale date XXXX XXXX XXXX which they have changed several times on me. They offered me another modification, {$950.00} for three months after that they will set a new amount. I am on Social Security. I get {$1300.00} a month I do not want to lose my equity, so I sent in the first payment for XXXX XXXX, XXXX. They have a predatory lender from day 1 of my loan. I need help. I think i need to be compensated for all these predatory lending practices. XXXX XXXX are the private investors on this loan. After many lies from them, I finally talked with them. They said the only way to get my home is to do the modification for the next 40 years. I would be with them for al total of 60 years.

Complaint: This company took over the original lenders balance. I was never told who or anything until just recently. I was told by original lender they was selling the property because it was in foreclosure. They never reported it to be in foreclosure on my credit report all this time and instead have continued to say I am missing payments every month for several years now which is not true. I was told they was selling the property because it was in foreclosure. Have not received any paperwork from them either but they are extremely damaging my credit hen I have not been kept in the loop for years now. I have not lived on said property for over 5 years. I saw in local newspaper last year that the property was on the auction block and till never heard anything on this. Not even an update. They are saying I owe over XXXX now with all the additional charges they added after they took the loan over but I was never informed of that either. When they bought the loan from original lender it was in foreclosure, not they are ruining my credit.

Complaint: I am writing this complaint because SPS told my law group not to work for m. SPS told XXXX XXXX XXXX XXXX XXXX XXXX to threaten me. They told XXXX to lie and tell me that they have not scheduled a foreclosure sale date. However XXXX XXXX an attorney in XXXX, GA. has told XXXX XXXX and XXXX today ( XXXX XXXX ) that they scheduled a sale date for XX/XX/2019. Also, XXXX ( An SPS employee ) told XXXX XXXX a lie that there was no sale date. XXXX ( SPS ) told XXXX and XXXX this lie Im XXXX XXXX. XXXX ID XXXX. XXXX also told XXXX XXXX that she sent me a letter on XXXX XXXX to rescind the conversation she had about no slaw date. I would like for CFPB to fine for these lies and I would like for SPS to tell XXXX XXXX and XXXX XXXX to stop threatening me with foreclosure sale date. Also, I am not doing a short sale or Deed in Lieu. Stop the threats.

Complaint: XXXX XXXX XXXX was the prior servicer and paid me {$900000.00} and reported {$900000.00} in Federal Income Tax withholding to the Internal Revenue Service when I figured out the typical mortgage wasn't what it was purported to be and started claiming my security interests. I highly suspect XXXX XXXX XXXX released the mortgage in full too after I presented them with SF28, OF 90 and OF 91 to release the surety but have yet to get confirmation from the XXXX. Immediately after XXXX XXXX XXXX reported the {$900000.00} to the Internal Revenue Service, Select Portfolio Servicing took over - probably bought the paper for pennies on the dollar - and began voracious collection activity. To save my house, they are forcing me to make monthly payments of {$8800.00} under court monitoring for an entire year of time. SPS is also well aware, remaining security interests are due me running into very large numbers and are probably just using the 1 year of court monitoring to collect monies to offset what remains to be paid out. It makes me sad typical Americans have no clue of what is really going on behind the scenes with mortgages but that is no excuse for SPS to be such a horrible company. I also have a letter from them saying they are well aware of the monies owed me and to work with their attorneys on resolving but that is merely more tail chasing than true resolution. SPS needs to stop this nonsense now. Seriously, how can you overlook {$900000.00} was reported to the Internal Revenue Service on an alleged mortgage and pretend there's really a typical " mortgage '' - are you serious?

Complaint: On XX/XX/XXXX, We purchased our homestead, {$200000.00} U.S. dollars, the current holder of said promissory note is XXXX XXXX XXXX, successor Trustee to XXXX XXXX, We continuously reaching them by sending more documents for Loan Modification as letter evidences enclosed XXXX have allegedly been attempting to modify our loan, while seemingly trying to process, they kept on rejecting our loan Modification. It is our assertion that XXXX were not dealing with us in good faith. XXXX XXXX XXXX, successor Trustee to XXXX XXXX, continuously threatening to evict us with fear through their agents, without consummating still our XXXXAMP Tier 2 Modification. Their agent broke into our house by force. Simultaneously XXXX XXXX XXXX, successor Trustee to XXXX XXXX, were allegedly working with our homeowner on mortgage modification ( called dual tracking ) to allow to avail the Federal HAMP Tier 2 Affordable Loan Modification, but XXXX XXXX XXXX, successor Trustee to XXXX XXXX, With the first Loan Modification was illegally processed and it was not under the Federal Home Affordable Modification Guidelines so we reach them again for HAMP Tier 2 to follow Federal Home Modification. With the fear of losing our home we continued paying monthly while requesting for revision of their Homeowners Assistance Program Evaluation based on the sound Loan Modification Agreement should be FIXED RATE NOTE and not Adjustable Baloon rate, where the rate is fixed in 30 year loan ; the only changed in our payment would result from changes in our taxes and insurances. On the first Loan Modification was a BALOON NOTICE of {$180.00}, XXXX after XX/XX/XXXX. As we requested a loan modification, in response, XXXX XXXX XXXX, successor Trustee to XXXX XXXX, sent notice to the Internal Revenue Service. Enclosed evidence of a true and correct copy of the cancellation of debt. However, XXXX XXXX XXXX, successor Trustee to XXXX XXXX, increased our alleged amount we owed from {$200000.00} from XX/XX/XXXX increased to {$360000.00} of XXXX instead cancelling {$80000.00} as they allegedly claimed IRS form 1099-C and as seen to our Mortgage Statements from XXXX up to XXXX ( Evidence attached herein ). XXXX XXXX XXXX, successor Trustee to XXXX XXXX, have committed fraud and an act of conversion in the following manner that they did this on purpose and had no desire to process our HAMP Tier 2 Modification. XXXX XXXX XXXX, successor Trustee to XXXX XXXX, wanted to acquire our property and had no intent in mind to allow us to avail the said HAMP Tier 2 modification. We expended a lot of time and money since we have resided and has had ownership of our homestead for many years. We invested our entire life savings in our home and as such a great wrong was done to us by XXXX XXXX XXXX, successor Trustee to XXXX XXXX,. They have committed as act of fraud and an act conversion in that they took our 12 years of mortgage payments and never intending to help us through HAMP Tier 2 and XXXX XXXX XXXX, successor Trustee to XXXX XXXX, never honor our contract made by them to us and refused to work with our HAMP Tier 2 request. Due to wrong doing and fraud by XXXX XXXX XXXX, successor Trustee to XXXX XXXX, in our mortgage has not been resolved till at this moment.
