Complaint: Due to loss of employment I was unable to pay my mortgage. I put the home up for sale in XX/XX/2017. We knew it needed to be a short sale because of the amount owed on the first mortgage and a huge second mortgage. A contract was received in XX/XX/2017. OCWEN has continued to play games for over 7 months stating they didn't receive the offer, then they lost our offer. We had a preliminary acceptance via email after 5 months but they needed an appraisal or BPO for final acceptance. The person that claimed to do the BPO NEVER entered the home as we have electronic records of entry and she valued the home the same as totally updated homes in the subdivision. We filed a complaint and have NEVER heard back. Repeated phone calls, emails, voice mails go unanswered!
The buyer of 7 months walked away from the transaction! This is their way of trying to force me to foreclose and pay back the money. I'm XXXX years old and only have social security to live on and that barely puts food on my table.
They still will not respond!!!!

Please provide information on who debt was being collected for and proof debt was being paid. Vacate foreclosure and return all money due. According to the Truth and lending, Predatory Lending, DODD Frank until thorough investigation is completed, I've received letters claiming the are the alleged servicer. Please provide information on whom you are servicing and/or collecting/collected a debt for. Meanwhile I will be paying my taxes and insurance. Complaint: Ask them to send payment quote and they say {$60000.00} was due on home. This look like a balloon payment that we don't know where it came from. We missed 6 payment so the Government paid this amount {$24000.00}. Don't know why it is so high. I don't know where the {$34000.00} came from. Complaint: Ocwen loan servicing will not let me make my payment. I have tried repeatedly! On Friday they would not let me pay it over the phone. They said they would call me on Monday and didnt. They called me tonight and said that if I had answered the phone yesterday I could have paid over the phone but now I need to go to the bank and get a certified payment and they would allow me to make one months payment. Im not kidding they will not let me pay my payment. And this has gone on for months. And, they said that my account rolled into foreclosure today even though I tried to reach them for the last several months.
Tonights rep was especially arrogant and rude He claims to be XXXX XXXX, # XXXX.
Ive also dealt with XXXX and ... XXXX??
I can never, ever reach the agent who was supposed to be assisting me that they assigned.

Complaint: My name is XXXX XXXX and I have a loan with Ocwen loan services. They have put me in a loan that is now illegal but at the time it was not, a negative amortization ARM loan. I have been making my payments diligently either by phone or by internet. Never once have I missed a payment in the last 24 months. However, Ocwen has reported me as being late multiple times throughout the past 24 months. I have tried to speak with them about removing the late payments, but they have refused to delete the late payments. I truly believe they are just trying to hold down my credit so I can not refinance my mortgage loan. They are telling me it is due to increased fees and different payment amounts. What I don't understand, is that I always call in or pay online the payment that they say is owed. I don't just send in the same payment every month by check, I always pay what they say is owed. I have attached a bunch of documents clearing this up and will work on getting bank statements to show all payments have been made. Ocwen has already been sued for deceptive mortgage practices, which I have attached the documentation. Every time I try to call over to them, they have their call centers in XXXX and XXXX and there is a language barrier as well. Because of this it is very hard to get anything resolved because it is hard to communicate.

Complaint: I filed Chapter XXXX bankruptcy in XX/XX/XXXX. It is now XX/XX/XXXX and it appears as if I have just bought my home. Through the course of this bankruptcy I have paid 12 to {$1300.00} per month which amounts to approximately {$50000.00}. My principle has not decreased and OCWEN states via mail they have only received {$8000.00} over the course of this process. They are threatening foreclosure if I do not pay {$8000.00} by XX/XX/XXXX.

Complaint: " 60 Days Late '' reported in XX/XX/XXXX on my Credit Report is incorrect.
After Hurricane Irma that passed through XXXX Florida in XX/XX/XXXX, banks were offering homeowners " Federally Declared Disaster Forbearance '' on their mortgages and Ocwen Loan Servicing, LLC was included. Upon my request, Ocwen deferred my mortgage payments for XXXX, XXXX, and XX/XX/XXXX, until XX/XX/XXXX. As requested by Ocwen, I started making my mortgage payments on XX/XX/XXXX and continued monthly until present. During the interim, in XX/XX/XXXX, Ocwen instructed me to complete a request for a loan modification which wasn't approved until XX/XX/XXXX. However, I did not like the terms of the modification so I declined to sign it. On XX/XX/XXXX an Ocwen 's relationship manager then requested full payment of the outstanding balance of {$7100.00} which was the deferred monthly payments for XXXX, XXXX and XX/XX/XXXX. I felt that Ocwen demanded the 3-months " deferred '' payment in full due to my declination to sign their modification agreement. On XX/XX/XXXX I paid the {$7100.00} to Ocwen bringing my mortgage account current.
After requesting and reviewing my credit report, I saw that Ocwen had negatively reported false data to the Credit Bureaus. Based on the Forbearance Agreement approved by Ocwen, those three months " deferred '' payments should not have been reported as late payments. That Forbearance Agreement should still stand whether or not I accepted their Loan Modification.

Complaint: I contacted Ocwen Loan Servicing LLC 's customer service and their consumer ombudsman since XX/XX/XXXX requesting specifically for a copy of my appraisal report for the loan used to purchase my home back in XX/XX/XXXX because the lender never provided a copy to me that I paid for {$370.00}. I was told the lender would mail my copy but never came. Ocwen Loan sent me a property valuation instead on XX/XX/XXXX. I spoke to Ocwen 's representatives at different times and they knew what I was asking for but gave me something else. It was not an appraisal report.

Complaint: Ocwen loan servicing has been returning my mortgage payments since XX/XX/XXXX, lastly I sent a Cashiers check of XXXX for a written agreement for a repayment plan.
I am actually behind about {$8000.00} but Ocwen imposed penalties and late fees. I should not be penalized at all for this mortgage fraud since I was in Chapter XXXX bankruptcy. Also, in XX/XX/XXXX, Ocwen told me I needed to fall behind in payments in order to qualify for a Loan Modification. Now ocwen is threatening Foreclosure.
Please add me to the Class Action lawsuit against Ocwen for Mortgage Fraud.

The complaint alleged that debris material had been buried on the site. The results revealed there was large amount of waste that had been disposed of on the site, including hazardous waste.
On XX/XX/XXXX, A Trustees Deed Upon Sale was recorded on the property in XXXX. XXXX XXXX XXXX, Trustee ( a wholly owned division of XXXX XXXX XXXX ) deeded the foreclosed property to the lien holder XXXX XXXX XXXX XXXX XXXX. of XXXX XXXX XXXX, XXXX XXXX, XXXX DE XXXX. The sale price was {$200000.00} and was recorded by XXXX XXXX of California, a wholly owned subsidiary of XXXX XXXX XXXX.
On XX/XX/XXXX, Ocwen Loan Servicing Company ( division of XXXX XXXX ), conducted the sale of the property at XXXX XXXX XXXX XXXX, XXXX, CA XXXX. They intentionally concealed the fact the Environmental Health Department of XXXX XXXX conducted a complaint inspection for dumping and sold the property for {$290000.00} to XXXX and XXXX XXXX & XXXX XXXX.
The Sellers exclusive REO disposition agent, XXXX XXXX XXXX, actively concealed materially adverse information that this property had been used as a dumping site prior to sale at auction, with hazardous waste buried on the site.
" This is considered an illegal site operated post regulation - it must meet Title 27 California Code of Regulation ( T27CCR ) for closure or be clean closed. XXXX XXXX, Program Coordinator XXXX, Environmental Health Department, XX/XX/XXXX.
The Seller retains strict liability for the burial of hazardous waste, and AS-IS proclamations do not relieve the seller of any responsibility whatsoever under CERCLA.
XXXX and XXXX XXXX XXXX meet the criteria of innocent buyers under CERCLA and the Brownfields Amendments federal law, as they acquired the property without knowledge of contamination on the property.
A visual inspection could not have revealed buried hazardous waste, and they were expressly prohibited from trespassing on the property prior to the sale as the tenants resisted eviction, and they feared for their safety. It took over 6 months to recover the property from the occupants.
California law requires sellers to disclose material details that may materially affect the potential buyers desire to purchase the property. AS-IS and like disclaimers are ineffectual in removing liability from the Seller and Sellers Agent.
Dumping hazardous materials is clearly a material fact, and Ocwen Loan Servicing, LLC, that orchestrated the REO sale for XXXX XXXX XXXX, and XXXX XXXX XXXX ( Trustee ) and XXXX XXXX [ the latter two owned by XXXX ( Sellers Agents ) ] can face severe penalties for intentionally concealing such known material facts.
Since they actively concealed a known material adverse fact, this is fraudulent misrepresentation under the law.
Remedies include compensatory damages, punitive damages and contract rescission. In such a case, fraudulent misrepresentation may even be considered a criminal offense. The Seller and Sellers Agents actively and fraudulently concealed this information to obtain a higher price at auction.
XXXX XXXX and XXXX XXXX XXXX have an ongoing financial interest in maximizing REO sales through deception. The Purchase Contract devised by XXXX XXXX XXXX induced XXXX and XXXX XXXX to engage the XXXX XXXX XXXX ( a subsidiary of XXXX ) by refusing to pay customary title fees unless XXXX XXXX was selected by Buyer, in full knowledge that the standard ethical buyer/seller arrangements would not be followed.
XXXX and XXXX XXXX believed XXXX XXXX would follow all legal and ethical norms, including providing known materially adverse information that impacts the marketability of the property. On page 1, Section 1 of California REO Advisory Requirements, the notice clearly states that : the Seller is not exempt from common law and statutory duties concerning fraud and deceit, even though the specific TDS Form is not required to be completed. Seller remains obligated to disclose known material facts affecting the value and Desirability of the Property. C.A.R. form REO Advisory, Revised XX/XX/XXXX There are literally tens of thousands of complaints against the unethical, illegal practices of these two related organizations ( Ocwen is a shareholder of XXXX, with an exclusive Reo disposition agreement ).
As they intentionally concealed material adverse information known before the sale in order to cheat the Buyers, XXXX must take appropriate corrective actions, pay punitive damages, and their license to operate should be reviewed.

I truly wish to resolve my mortgage issues, and my modification was rejected because at Ocwen stated that I was too far behind on payments. This is truly discriminatory and I now have an attorney representing my wishes. I deserve a modification as my son has agreed to join me on payments and he also has an excellent income.
