Complaint: I am trying to retain ownership of my condominium through a modification process. I applied for a modification with Ocwen in XXXX XXXX On XXXX XXXX XXXX I was informed via telephone that my modification had been approved. Ocwen has their loans serviced in XXXX. My relationship manager has a very thick accent and I am unable to understand what they are offering me. I have called back several times and received different responses from different individuals all of whom were nearly impossible to understand. I have requested numerous times that my call be transferred stateside to the US and it is virtually impossible to get them to comply with my request. The language barrier and comprehension of my questions/concerns are proving too difficult to understand my legal obligations. On XXXX XXXX XXXX I spoke with XXXX ( ID # XXXX ) and he informed me that the modification was temporary. My payment was dropped from {$490.00} to {$340.00}. I inquired about the details of the permanent modification and they refused to give me any details in writing about it. I asked for it via email and US Mail and was told that it was not possible. I have numerous questions regarding the terms of my temporary modification and what is likely to be on the permanent modification. I am very hesitant to sign the temporary modification because I feel that the deal is too good to be true. Additionally, I need for my relationship manager to be located in the US. A mortgage is a long-term commitment and binding legal document that I want to be sure that I understand everything before I sign on the dotted line.

Complaint: We surrendered our home to previous mortgage holder in XXXX of 2012. Ocwen financial bought the mortgage and refused to honor a died in lieu of foreclosure. Ocwen, by misplacing or loosing our paper work caused us to go to foreclosure we attempted to work with them submitted paper work on 3 times, but they refused to examine our paperwork, we tried to work with them for years submitting died in lieu paperwork. They kept delaying on us until we had a a foreclosure date and told us that they would not examine our paperwork because the foreclosure was going through anyway. My wife and are both XXXX and this has taken a visible toll on our ability to obtain credit and to find rental housing.

Complaint: This complaint is a restatement of the fact that Ocwen Financial Mortgage refused to acknowledge any court documentation, subpoenas or correspondence from their lawyers XXXX XXXX XXXX to my lawyers XXXX XXXX and XXXX XXXX of XXXX, Ohio. All of these legal forms were submitted from attorneys with loan numbers and the XXXX County Court of Common Pleas seal at XXXX.
Ocwen assigned XXXX XXXX of the Florida location who demonstrated no interest to the correspondence from CPFB and closed the case with a letter stating there was no lawsuit against me. The paper work indicated that XXXX XXXX XXXX owned by XXXX XXXX had assumed mortgage assumption and refused to pay the bank for the property. I presented the contract and I was sued by Ocwen.
Finally, I was responsible for the legal fees, the homeowners insurance, the utilities and up keep of the property as this suit remained in court for almost two years. I have records of the amount of monies that I spent at XXXX XXXX XXXX XXXX, Ohio parcel # XXXX.

Complaint: Im requesting your help to resolve this issue. I received a modification mortgage from Ocwen Mortgage company, XXXX of 2013. Before the modification my mortgage loan was from XXXX XXXX. I have been paying my mortgage on time since the modification. I am in the process of refinancing my car and was told by my bank, XXXX residential is still reporting to XXXX credit company. It looks like I have two loans on the same property. I have mailed them a copy of my credit report and still nothing has happened. I spoke to Ocwen and they see the reporting but always says they will investigate, but still no correction. I have only XXXX loan on this property. Complaint: Based on my research, My original Servicer was XXXX, which filed bankrupcty 2008, and later discover third party debt collector known as Ocwen loan servicing and XXXX shown as the lender/beneficiary. Based on my discovery I 've notice Respa violations, Truth n Lending, Preditory, Adjustable Rate Mortgage, the whole entire loan was in violated under the Underwriting Deceptive Practice Act.
Third Party debt collector known as Ocwen Loan Servicing does not have a license/ or consent order in the state of Maryland with XXXX Commissioner Finance Office to as as a Servicer /Debt Collector/Lender based on updated research. Therefore they need to investigated. Also XXXX XXXX XXXX XXXX needs to be investigated, never had a contract agreement or any fair dealings pertaining to the loan and the equity interest in the property.

Complaint: I seem to now have to issue 's, so I 'll begin with the first ( this will lead up to the second ) ... Around XX/XX/XXXX or XX/XX/XXXX if this year I notice my mortgage was not reporting to XXXX, but was reporting correctly to XXXX and XXXX. I contacted Ocwen Loan Servicing and ask if they would report my account to XXXX. The representative replied to me that they report to all four major credit reporting agencies. I was instructed to fax to them proof they were not reporting my account. I faxed over to them all the required information to prove my case. Now I do n't want to make this real long so please understand that for months I 've gone back and forth with XXXX and Ocwen to get this resolve. As of today, it still not showing with XXXX. On XX/XX/2016, I spoke with XXXX and transducers me to inform Ocwen to get the person that works for XXXX and handles their account to get involved. I fax a written request to Ocwen asking them to speak with the liaison the have that works for XXXX to correct this. I still have not heard anything back from them as of today. Now this brings me to my second issue .... I went online to bring up my account with Ocwen to get their phone number and call them to get an update. I notice my name was different on the most updated statement and on there website page. My name has always been correct and written on all documents as : ( I 'll write it later ) the missing part on my current statement is XXXX And on their website, rather XXXX on it, it has an!, not sure why these changes are and if this is legal. Complaint: The complete request for short sale packet was submitted to Ocwen on XXXX XXXX XXXX. On XXXX XXXX I received my first payoff which I confirmed that the loan with Ocwen would be paid in full from sale proceeds. At THAT time on XXXX XXXX when I called and spoke to the short sale department to let them know that we would only be doing a short sale on the second because this loan ( loan with ocwen ) would be paid off in full that the foreclosure date was suspended. And I was told to just be sure to send in the 2nd lien approval as soon as it is received. I received the second lien approval on XXXX XXXX and called and spoke to someone in customer service to again confirm full payoff status and the closing date of XXXX XXXX ( I do not have the name because the call was outsourced to someone in XXXX XXXX and the names and spelling are difficult to register. I was told to email the letter and the hud that matched and also confirm the suspension was still in place. I had no reason to think we were in danger as I hadnt received any calls or correspondence from Ocwen that would raise suspicion of the foreclosure suspension being lifted. On XXXX XXXX when I called in for an updated payoff for our closing date the following week you can imagine my shock and the sickness I felt when I was told the property was sold to a third party on XXXX XXXX.

Complaint: Ocwen holds our 2nd mortgage on our home.Our bill was ALWAYS due on the XXXX of each month. Even tho I always paid it w/in the grace period, Ocwen would call and pester me about the payment. So, I worked REALLY hard to get to where I could pay the bill paid ahead of time to avoid the calls. Then, suddenly, w/o warning, Ocwen changed the due date to the middle of the month. Once again I worked to get the bill paid 2 weeks BEFORE it's due date and now, once again the due date is changed to the XXXX of the month. My payment was due XX/XX/XXXX, I sent a check on XX/XX/XXXX which Ocwen got on XX/XX/XXXX. NOW I have a bill that says it's due on XX/XX/XXXX! 2 weeks between due dates??? I called customer service and was told in about 10 days they will email me about my inquiry/complaint! WHY IS THIS COMPANY PUNISHING ME FOR PAYING MY PAYMENT EARLY??? On top of their predatory loan interest rates, it apparently takes them over a week to provide customer service. WHY??? I have yet to have one positive experience when dealing w/this company.

Complaint: QWR Notice of Error Subject property address : XXXX XXXX XXXX XXXX XXXX, Ohio XXXX Owner : XXXX XXXX XXXX XXXX ( last four S.S. XXXX ) XXXX XXXX XXXX XXXX, Ohio XXXX Phone : ( XXXX ) XXXX Loan # : XXXX Forced Placed Insurance : I am putting Ocwen The Loan Servicer and the investor of my loan that there has been improper placement of Forced placed insurance on my loan under Regulation X 12 CFR 1024.37 a lender shall not exceed the amount of force placed insurance placed on a property greater than the investors secured interest. XXXX XXXX XXXX serviced this loan before Ocwen and while the property was under a federal bankruptcy stay placed force place insurance on the property without which was not needed if only XXXX would of asked the courts for the insurance policy in XX/XX/XXXX it would have been provide nevertheless the forced place insurance was in the amount of {$77000.00} which at the time of the placement this insurance would of still been in violation of 12 CRF 1024.37 because the investor only had an interest in the property per a reaffirmation agreement see Exhibit T. When executed this agreement crammed down the debt from {$65000.00} to {$35000.00} the new loan amount caps the maximum amount of forced placed insurance allowed to be placed on the property at {$35000.00}. Ocwen after sending me a transfer notice ( RESPA ) on XX/XX/XXXX see ( Exhibit E ) this notice listed an incorrect balance loan balance of only {$64000.00} and Owcen still executed a forced placed policy in the amount of {$150000.00} on the property this was clearly a violation of 12 CFR 1024.37. This company has been fined by the CFPB for this illegal action in the past and this action has now added a large amount of insurance policy premiums to my pay off. I have listed all the policies for your review as see Exhibits W, V, X, U, T I have also enclosed a letter from Ocwen see Exhibit I. This notice list the type of insurance they obtained and what it covers and how much insurance they place on the property see Exhibit I pg 2 The Insurance We Obtain 4 Hazard insurance. Ocwen has never been compliant under 12 CFR 1024.37 on this loan. I have 4 loans with this company and all four have had this issue it seems to be a pattern see Exhibit I, K.
Attempting to Collect Discharged Bankruptcy Debt : On XX/XX/XXXX I signed a reaffirmation agreement on the subject property see ( Exhibit F ). I began making the new payment of per the agreement to XXXX XXXX XXXX per there internet payment center which was showing the wrong balance of the note after months of internet payments I asked XXXX to start sending me monthly billing statements they complied and as I suspected the bankruptcy debt was listed on the periodic statement and the reaffirmation was not applied to this loan. I called XXXX only to be told that they could not speak to me and was placed on hold for hours with no results and the statements just kept coming in see ( Exhibit 1,2,3,4,5 ) I then received a notice of transfer from XXXX see ( Exhibit D ). On XX/XX/XXXX I received a notice of transfer ( RESPA ) from Ocwen see ( Exhibit E ) this notice also listed the bankruptcy debt as owed. On XX/XX/XXXX I received my first monthly billing statement from Ocwen see ( Exhibit C ) this statement listed the dischargedXX/XX/XXXX bankruptcy debt as stilled owed and now a new post-petition debt in the amount of {$21000.00} along with fees in the amount of {$22000.00} not understanding what this was for I contacted Ocwen only to be told that I was still under a bankruptcy stay and they could not talk to me. This in fact was not true because the bankruptcy was closed on XX/XX/XXXX the stay was already lifted see ( Exhibit Z ). This was to be the only monthly billing statement I would receive from Ocwen over the next three years. QWR XX/XX/XXXX In an attempt to get back on track with the lender In XX/XX/XXXX I faxed over a QWR for all 4 loans and Ocwen sent me notice of receiving my correspondence on XX/XX/XXXX see ( Exhibit N, K ). I sent this over in response to a notice of default I received in the mail on XX/XX/XXXX showing I only owed a balance due of {$15000.00} see ( Exhibit H ). This balance was not in agreement to the only billing statement that I had received in XX/XX/XXXX which stated that I owed a past due amount of {$21000.00} and post-petition payment s in the amount of {$22000.00} which I believe to be the discharged debt see ( Exhibit C ). As a result of the QWR Ocwen sent me documents in which I had never seen before such as a XX/XX/XXXX notice that Ocwen was placing more force place insurance on the property in the amount of {$150000.00}. This document had in itself a loan history and printout showing a balance on the loan as of XX/XX/XXXX {$34000.00} see Exhibit B. This payoff quote see Exhibit Y ) only showed a balance of {$44000.00} owed. Summary In XX/XX/XXXX requested another payoff quote and a payment history of the loan. The printout of the history of the loan shows the mismanagement of the loan on XX/XX/XXXX the balance of the note was shown to have been {$64000.00} and the mortgage balance was not corrected per the print out to reflect the court ordered cram down until XX/XX/XXXX see ( Exhibit H ). After my QWR notice had been sent to Ocwen and someone realize the issues of my loan. I was still never notified of the servicers discrepancies and mismanagement of my loan but I was notified that I was being foreclosed on by a law firm see ( Exhibit M ). Ocwen has since being in XX/XX/XXXX sending me out periodoci monthly billy statements listing fees such as insurance premiums and now taxes that I should not owe on the property. I never received a correct statement from Ocwen for about 36 months which is a violation of the Regulation X CFR 1026.41. Also the asking of by phone or mail any discharged bankruptcy debt is a violation of the bankruptcy code 11 U.S. Code 1141 and can result of a heavy fine if needed to be brought back into Bankruptcy Court. See ( Exhibits E, C,1,2,3,4,5,6,7,8,9,10,11,12,13,14,15,16,17,18,19,20,21,22,23 ) all can oppose a fine by the CFPB of up to {$2000.00} for each occurrence not including the months a statement was not delivered and any Bankruptcy violations that the Federal Judge might sanction. Please review this material that I have provided and get back to me with what you might see is a reasonable offer to settle this matter as always I have found it better for both sides to settle this out of court. Complaint: Im not sure if this is correctly routed as I am just the buyer on the home and not the seller but nonetheless this needs to be reported. After months of searching a super tough market and i found a home i could afford and that was perfect. It was a short sale so i had to wait a few months to go through the process. I got into contract late XX/XX/XXXX and we wen through all the proceedings and settled on a close date of XX/XX/XXXX. Ocwen and XX/XX/XXXX were the lien holders. We had extensions in place, my loan was approved, appraisal and inspection done and so much work and money put into other parts of the loan .... only to receive an email from XX/XX/XXXX ( negotiators on this deal ) that Ocwen had wrongfully foreclosed on the property without notifying anyone and breaking the contracts/suspension we had in place. The property i was to close on this week is sold. The investor who bought it is going to resell it but for XX/XX/XXXX more ... not something i have. This has been beyond devastating and heartbreaking. I am still in shock. This is beyond NOT ok.

Complaint: In XX/XX/XXXXI 've experience some water damage to my property my insurance company was XXXX. Over time of investigation they did release {$27000.00} which were to be broken-up in 23 payments of {$9100.00}. My 1st draw came to me in XX/XX/XXXX around the XX/XX/XXXX I hire XXXX XXXX XXXX XXXX to replace the damage carpet in the home.The amount to replace came up to {$3900.00} because that check came in their name and my name ocwen did not have a separate check for them for the {$3900.00} and XXXX XXXX XXXX would not sign off on the {$9000.00} check so I have to give them the whole check when problems occur with the contractor XXXX XXXX XXXX XXXX the price of the carpet to over {$6000.00} I chose not to use them but them would n't give me my money back. Because they thought Owen would Sue after speaking with ocwen said it was OK for them to give me the money back But our current would not tell them bad nor write a letter stating that so I did not receive the money back So XXXX XXXX still has the {$6600.00} and had it since XX/XX/XXXX And I try to get it back but they will not give it to me So moving forward I asked ocwen what can I do to we see the next draw in order to finish to work on my home they gave me an option to send in some documents which include it receipts from work I 've already done myself an proof that I try to get the money back from XXXX XXXX.After sending the information ocwen order an inspection the inspection prove that 50 % of the work in the home has already been done .The importance of that number is because each draw was based on a percentage of the work done so if 30 % of the work is done on the 1st draw then the next draw was supposed to be release so Owen sent me a check for {$3600.00} not the amount of the next draw what they sent to me was the amount of what I 've already spent in my home that 's not the correct procedure And also sent me a letter stating that when I 'm done doing all the work on the home myself an inspection is done then they will send me the rest of the money that 's not how it 's supposed to be done the insurance money is supposed to be sent to me to do the work not my own money to be used.

Complaint: I recieved an offer from Ocwen Loan servicing to reduce my mortgage payments by {$500.00} a month if I would particpate in a 3 month trial period. I did so and made payments of {$1100.00} on XX/XX/XXXX and again {$1100.00} on XX/XX/XXXX and a final payment of {$1100.00} on XX/XX/XXXX. At the end of the 3 months I was to receive paperwork that would restructure my agreement with Ocwen Loan servicing however, no agreement was received. I had been scammed out of {$3400.00}.
I called Ocwen Loan Servicing and related the problem to them and sent the information about the transaction at which time I was told there would be a fraud investigation. When I asked if I should be making my regular mortgage payments I was told to wait until the investigation was completed.

Complaint: I am a 3rd party Mortgage Broker attempting to obtain a payoff for our client who has an account with Ocwen Loan Servicing LLC. We frequently struggle to obtain payoff information from Ocwen within a reasonable amount of time, however, this is our first complaint. As per Regulation Z, a servicer is required to provide an accurate payoff within 7 days of the request. So far, Ocwen has taken 22 days for this request and has projected at least another month before a payoff can be provided.
- Our first attempt to order a payoff was on XXXX XXXX, 2017, we provided our client 's signature authorization, account number, and projected payoff date. We received a written response on XX/XX/XXXX stating a new request is required and the new request must contain the appraisal due to the type of account ( Original Loan was modified to an Equity Share Arrangement ) OR, they may simply use their own Broker Price Opinion.
- A new request was submitted on XXXX XXXX, 2017, including the appraisal, customer 's authorization, account information and projected payoff date.
- On XXXX XXXX, 2017, a call was placed to Ocwen to ensure the request was received. After verifying the customer 's information, we were informed that Ocwen is not authorized to talk to us about the account until the borrower 's signature authorization was validated which will take 2 days.
- On XXXX XXXX, 2017, another call was placed to Ocwen, all information was again verified, and Ocwen still would not answer any questions regarding the account, or regarding whether they received our request for a payoff quote. Ocwen advised us that the customer had to call them to validate the signed borrower 's authorization before they could speak to us.
- On XXXX XXXX, 2017, the customer called Ocwen and gave verbal authorization to speak to our company.
- On XXXX XXXX, 2017, a call was placed to Ocwen, XXXX, ID # XXXX stated the customer did not authorize us to speak to them on his behalf. So, a conference call was made with the customer, who again authorized Ocwen to speak with us. While on the call, the customer verified his information and XXXX advised he did actually see that the customer made the authorization on XX/XX/XXXX, but it was not for our entire company, only his Loan Officer. Once the customer disconnected from the conference call, XXXX advised us that in order to obtain a payoff, we must speak to the relationship manager, XXXX XXXX, who 's schedule is so full, he can not talk to us for at least another month.
- The client is current on his mortgage payments with Ocwen, and the refinance loan that our client applied for will save him nearly {$900.00} per month on his mortgage payments, however it is required that his Ocwen account is paid in full.
