Complaint: We are in the midst of a loan modification ( mailed XX/XX/19, emailed XX/XX/19 and mailed again XX/XX/19 ) and today received notice of foreclosure and scheduled sheriff sale!!! I thought this was not legal?! We are in the midst of the modification and I have been actively communicating with PHH. I let them know the paperwork was coming more than 7 days ago ( the day it was first put in the mail ), resent by sending scanned and emailed the documents on XX/XX/XXXX and then put them in the mail *again* today XX/XX/19. PHH is dual tracking. They are predatorily pushing us out of our home and wreaking havoc on my family. I have already submitted a complaint about their unfair and incorrect attempt at ignoring our original loan modification, which was approved by Ocwen before PHH took over. That is a separate complaint ( XXXX. ). They required us to re-apply for the modification after I spent 5 months trying to correct the problem, which was their mistake and was met only with calls they had me on hold for up to two hours! XXXX And now they are pushing us out while we are applying for a new modification ( and they know full well that our circumstances have changed and will make it harder for us to get approved for a modification! ) Please please help get this company on the straight and narrow. Please help us save our home. We are not without money, we are honest hard working people who have suffered great hardships and have tried to kept an open dialog with PHH. Complaint: PHH Mortgage took over servicing from Ocwen approximately six months ago and I have never ( 1 ) received a statement and an ( 2 ) escrow statement reflecting a current breakdown of principal, interest, insurance, and taxes. Furthermore, online payments have been setup since inception of the loan ( serviced through XXXX, XXXX and Ocwen ) and every month since PHH has taken over servicing they have canceled my online payment profile. Correspondence sent alerting me of this cancellation has indicated that I am in bankruptcy, which is completely inaccurate. One letter states, " per my request, direct payments have been discontinued. '' This too is 100 % false and inaccurate. PHH has also rejected one online payment without reason. I was under the impression that it was " declined '' when, in fact, the bank account had more than sufficient funds. I was then forced to submit an online payment in order to avoid late fees. As far as I can tell, no fees were charged despite the warning that one-time online payments are subject to fees. What is more interesting, this online payment was accepted whereas past online payments with the exact same banking information were being cancelled every month, for reasons described above. It is not clear why they could accept this method of online payment but reject the payment when it was setup for monthly payments.

Complaint: I recently refinanced my home from PHH Mortgage. According to PHH Mortgage I was to receive a refund within 2-3 business days of the note being paid off. That check cleared on XXXX. I have contacted PHH again and they are stating they have requested a copy of deed from the town and they have not received. They further stated the refund can take up to 90 days. Just because I have had numerous issues with this bank I am inquiring if this is legal. Thank you!
