Complaint: My Deed was transferred XX/XX/XXXX to Ocwen with no Escrow. In XX/XX/XXXX when my Property taxes come out Ocwen when and paid them. I never signed any kind of papers for them to do this. I have never had a home loan with and escrow account for the 35 years in have been in this home. And never missed a payment. My house payment triples by them doing this. It went from XXXX to XXXX. I kept paying my regular payment for 4 months and it was getting me no where. I stopped paying them. They refuse to do a loan modification. Sent papers they ask for and they would tell you they never received them. I has been a night mare since. They now want to foreclose on me for the 3rd time. I need this stopped. I has been a 4 year battle from XXXX. In beginning of XXXX my loan was transferred to PHH nothing changed. They are very good about taking your money and holding it. Than charge late fees. They add fees for sitting in front of your house to take pictures on a monthly bases. These people can not be trusted they just want your house. They will not do any loan modifications. Complaint: Due to hardship we had to do a mortgage loan modification for both our first and second mortgage in XX/XX/XXXX with Ocwen loan servicing ( government program HAMA ). Upon completing that, the letter we received later in XX/XX/XXXX states that our second mortgage loan was in default, was being transferred to XXXX XXXX XXXX but it never states that our loan was going to be charged off. Since then we have made every payment for over 5 years like clockwork. Sometime between XX/XX/XXXX and XX/XX/XXXX Ocwen " merged '' or " sold to '' or " hired '' PHH mortgage services. We now receive statements for both our first and second mortgage from PHH on PHH letter head. However, the statement for our second mortgage on PHH letter head instructs us to send the payment for just the second mortgage to XXXX XXXX. We find this deceiving and gave us the impression for over 5 years that Ocwen/PHH still held our loan and had not charged it off. Now Ocwen has reported to at least XXXX and XXXX ANOTHER CHARGE OFF in XX/XX/XXXX ( how can they charge it off twice )? We can prove they charged it off in XX/XX/XXXX and are now charging it off AGAIN in XX/XX/XXXX ( at least according to our credit reports ). Also, we believe our credit reports are changing almost weekly since we filed the complaint with Ocwen/PHH/XXXX ( we are not sure which company we should be dealing with? ). We think they are trying to change it to cover their tracks or dates etc. We have pictures of different report dates etc constantly. Both XXXX and XXXX are wrong. But, specifically XXXX is bogus, it even reports a highest balance of {$0.00} for our second mortgage, {$0.00} paid on that loan but then shows a balance of over {$30000.00} and shows as a " charge off '' in both XX/XX/XXXX and XX/XX/XXXX. How can you charge a loan off twice 5 years apart? And report a late payment when we have made payments for over 5 years like clockwork? How can a company charge a loan off twice 5 years apart after we have made the payments AND they send statements from the same company even though we are sending payments to a third company? This slight of hand and bogus credit reporting is ruining our ability to function and get any consumer and business funding/capital. We have attached two pictures below that show two charge offs, one in XX/XX/XXXX and one in XX/XX/XXXX. You can also see that it reports we have paid off {$0.00} of this loan. We paid off almost half of this loan. It also shows highest balance as {$0.00} yet a balance of {$35000.00}. I mean nothing on this is correct. We have been trying to resolve this for over a month with the company and are getting nowhere. We are now filing this complaint and have hired an attorney.

Complaint: THIS IS THE THIRD COMPLAINT. CFP just CLOSED a complaint based on a super flimsy 'reply ' after two months from PHH . I had Multiple complaint topics and PHH ONLY addressed the Property Tax Issue. I will CONTINUE TO RE OPEN UNTIL THEY MEET ALL FAIR LENDING PRACTICES. ~~ ~~~ou have not AGAIN addressed EVERYTHING in my complaint. The mortgage company came back to XXXX after Bankruptcy was SETTLED ( FORCED BANKRUPTCY BECAUSE THEY REFUSED TO TAKE TWO LATE PAYMENTS ) and said " oops, we just found XXXX MORE that you owe. I have since done more digging and this in not allowed. Ocwen should have done ALL their work prior to, and not added debt they just didn't 'find ' soon enough. That was one issue I brought up TWICE now, that is always ignored. Then the other issue that is ignored, is that just a few months ago the payment amount PHH is asking for monthly went up. It is Not supposed to have gone up more with you. We are at the end of our arm interest rate. Nor did PHH send any information to the attorney explaining anything ( I checked with them ). My payment will remain XXXX ( which is what is on my last attorney letter ). There has been no explaination and PHH is not following bankruptcy rules by going through attorney. As far as the 'inconvenience ' of not getting information on OUR OWN account, it has been BEYOND unreasonable. First, we have been communicating with Ocwen for all these years Since it happened, and Suddenly this summer, no one can give us info. THEN when lawyers DO send " required '' signed documents, PHH, Never can find them. So they have been resent multiple times ( delaying communication for months ... .very convenient for PHH ) ~~~ Nothing is settled until all issues are addressed and I see in writing HERE, where there is a record, How TO GET FEES REIMBURSED, AGREEMENT THAT PMT IS NOT RISING, ADJUSTMENT TO LOWER, because I got the property taxes lowered. AND ADDRESS THE ADDITIONAL XXXX added to bankruptcy AFTER THE FACT The Fraud company Only addressed One small complaint. We have called MULTIPLE times and have sent the form ( lawyer signed ) in to be Able to talk about our account. PHH Somehow never Receives the signed forms from the attorney that are faxed ( hmmm ). 1 ) PHH will not communicate at all about mortgage, nor answer any questions, even after forms sent. 2 ) I have written on every cashiers check to be applied Wholely to principal ( I have copies ) and they have not 3 ) There is a balance in Holding not applied to mortgage and PHH will not communicate about it 4 ) they have charged new attorney fees ( and we will not be paying attorney fees associated with their changes. But they keep adding things to mortgage 5 ) OCWEN forced us into bankruptcy by Refusing late pmts when job lost and Then after bankruptcy court came back and said there was money that had not been added into bankruptcy and added XXXX more in back fees ( don't care what your arguement on This ... it IS FRAUDULENT AND UNFAIR LENDING ). 6 ) Per bankruptcy agreement, all changes are suppose to go through attorney, PHH has sent nothing to attorney. I will not be making a payment that changed and not letting attorney verify it with sending them a written, certified notification. WE have been in continual contact with our attorney and now seeking Consumer Finance and BBB to make PHH adhere. PHH can not arbitrarily assign fees and Back pmts due, not go through bankruptcy attorney, hold monies and not apply to principal, disregard my instructions to apply pmts to principal, and keep conveniently loosing paper that give us Rights to talk to XXXX company about OUR mortgage. Next step will be filing suit. We are tired of how they conduct 'business '. We already know the high rate of lawsuits because of Unfair Lending PRactices against Both Ocwen and PHH

Complaint: In XX/XX/XXXX, husband and wife applied for a joint mortgage with Ocwen/Homeward. In XX/XX/XXXX, according to divorce decree, wife was awarded home and a quit claim deed was filed to transfer ownership solely to ex-wife. Per the decree, ex-wife refinanced loan in her name only. Loan was modified from joint to individual. In XX/XX/XXXX, PHH took over loan and reversed loan from individual to joint loan again. I have been trying to resolve this issue since XX/XX/XXXX after reviewing XXXX XXXX. So far, I have contacted XXXX and PHH to no avail. PHH confirmed that the quit claim was signed in XXXX. However, the mortgage is still showing on my credit report. Also, my name is spelled incorrectly with XXXX.

Complaint: PHH Mortgage reported to XXXX that the Mortgage is part of an active bankruptcy and removed it from my credit report last month. There is no active bankruptcy. My bankruptcy was discharged last year and the car and mortgage were excluded. I called PHH to ask them to correct the error and they said they would have to look into it. I need this put back on my credit report and the XXXX point drop in my score fixed as I need to purchase my car and the credit score of XXXX from XXXX is affecting the loan.

Complaint: My loan was recently transferred ( XXXX/2019 ) to PHH which is now attempting to place me in foreclosure. Not only is the loan amount incorrect they are claiming {$50.00} in collected interest which is incorrect by approximately {$15000.00}. in addition my loan balance is incorrect by nearly {$55000.00}. I have end of year statements from OCWEN ( the original lender ) which PHH has completely ignored. I have attempted to contact PHH for statements concerning my loans and after more than a dozen phone calls and requests I was finally faxed a W-2. The W-2 is incorrect not only in the amount owed, but in the interest paid. I am in the process of a short sale and PHH has not provided any documentation at this point. I have spoken to countless agents all of which have provided differing loan amounts and payment requirements. I am XXXX years old and a real estate agent and have never seen such blatant fraud and incompetence. I am fearful that their inability to even provide an accurate statement could cost me my home.

Complaint: My loan with Ocwen was transferred to PHH Mortgage. Their loan servicing website is called ( strangely ), " mortgagequestions.com ''. I was able to log into this website in the past, although it was very bad and hardly functional ; the registration process was full of errors and took me months of work with PHH just to get my account working. Now, for the past several months, the website has been inaccessible due to a bad security certificate. Any web browser will give a message like this one and block access to PHH 's " mortgagequestions '' website : " Attackers might be trying to steal your information from www.mortgagequestions.com ( for example, passwords, messages, or credit cards ). Learn more NET : :ERR_CERT_AUTHORITY_INVALID '' In case you're thinking this is a user error, please note that I have a XXXX. in XXXX XXXX and used to work at XXXX as a XXXX XXXX. The problem is the website, not me. Please require PHH to hire an IT team to bring their website online again so I can check on my mortgage balance, make payments, etc etc. I don't think it's acceptable for a servicing company 's website to be inaccessible for many months in a row. And of course, I don't have a choice here as to who services my loan, so I have zero leverage with this terrible company.

Complaint: Around XX/XX/XXXX I notified Ocwen Mortgage of my divorce to XXXX XXXX XXXX and sent them a copy of my divorce decree and special warranty deed. Both documents show I am no longer responsible for any part of the mortgage of the property located at XXXX XXXX XXXX XXXX, Texas XXXX. XX/XX/XXXX I received a release of liability statement from the Department of Veterans Affairs and faxed that as well. I also faxed all above mentioned documents to all three credit bureaus. The mortgage was removed from all three bureaus around that time. Sometime in XXXX the Ocwen Mortgage reappeared on my XXXX credit report. I found this error only last week unfortunately. I contacted equifax and filed a dispute. XXXX responded with Ocwen said it was a factual debt. I have fought with Ocwen over this mortgage and all the XXXX day lates and I am tired of dealing with something that feels unwinnable. At this time this is the only thing hurting my credit my FICO score would not be in the low 700 's because of a XXXX XXXX credit score because of fraudulent reporting. This is no longer a mistake it's fraud when it is taken of then put back on and the reporting company has the information knowing it shouldn't be there!

Complaint: I sent my delinquent mortgage payment to XXXX XXXX mortgage in the amount {$2600.00} my check was returned by XXXX XXXX and they have set a mortgage foreclosure sale date for XXXX XXXX, 2019. I have sent a request to the mortgage company for a mortgage modification to save my home and stop the foreclosure sale. Letter received from foreclosure attorney was dated XX/XX/2019 and I did not receive the letter until XX/XX/ 2019, 30 days notice was not received before sale date. Researched on the computer Tennessee code says I'm suppose to receive notice at least 30 business days before foreclosure sale. My mortgage company has changed a lot of times but I have not received papers stating who owns my mortgage or if the servicing was assigned to a new owner of my mortgage.

Complaint: On XX/XX/2017, Ocwen Loan Servicing removed the so-called mortgage account from all three major credit reporting agencies and then responded to my CFPB complaint explaining why Ocwen agreed to delete the account from all three major credit reporting agencies. I attached Ocwens written response to CFPB but I am holding on to XXXX XXXX written response directly to me so it can be used in litigation when I file a new lawsuit against Ocwen and PHH for causing me further harm. Ocwen transferred the loan to PHH who is working in-cahoots with Ocwen. PHH and Ocwen are pretender lender loan servicer 's who are making errors intentionally reporting the so-called mortgage loan back on all three major credit reports intentionally reporting inaccurate information to slander my credit so the pretender lender loan servicer 's can cause me more extreme harm after we settled our dispute in litigation. I have made several attempts to get access to my mortgage statements on PHH website but was unable to. I made several attempts to speak to a live PHH representative but was unable to. PHH and Ocwen both once again attempting to pull another scheme on me. Ocwen and PHH are both intentionally selling my personal information to 3rd parties so they can harass me and rip off my home. I am paying my mortgage payments blind folded because I do not know what payments are due after Ocwen intentionally did not cash one of my mortgage payments during the time Ocwen transferred the shuffled up loan file to PHH. I recently disputed the PHH loan reporting on my credit two times but the PHH minions keep slandering my credit reporting inaccurate information to cause me harm. I have no option left other then to file a lawsuit against PHH.
