Debt collection: I do not know

Frequent or repeated calls
Complaint: We are receiving repeating calls for an entity calling themselves " Municipal Services '' requesting us to call XXXX. They identify themselves as a debt collection company. They give absolutely no information as to the nature of this alleged debt. Because I have never received a letter of demand for payment and the lack of information, the generic pre-recorded nature of the call I am sure this is some kind of scam.

Dealing with your lender or servicer

Student loan: Private student loan

Received bad information about your loan
Complaint: I am receiving 10 - 12 harassing messages a day about a student loan that I paid off XXXX years ago. When I contact Sally Mae servicing they show my student loan has been paid in full, but are attempting to contact me regarding " someone else '' who they feel I may know or be in in contact with regarding their outstanding loan. First of all, I thought it was illegal to discuss others financial information with outside parties and second the non stop harassing messages ( I have them saved in my cell phone voice mails ) need to stop immediately. The last message I received was regarding my name and loan, so I immediately called into Sally Mae, was informed indeed my loans have been paid off, but they are continually trying to contact me for information on another persons account. They have also harassed other members of my family. The individual in question on the loans is my son 's girlfriend and under no circumstances should I be involved in her personal account information and receiving phone calls on her account.

Struggling to repay your loan

Student loan: Private student loan

Can't get other flexible options for repaying your loan
Complaint: I graduated from the University of Illinois in 2011. In total I borrowed {$20000.00} in private student loans with Navient. Since 2011, I have paid a total of about {$16000.00} but my principal balance is still {$19000.00}. How can this be legal? How could only {$800.00} be applied to my principle balance? Aside from this, it is ridiculous that Navient refuses to give you any accurate or helpful information about your account. I called to find out how much I have paid so far, and I was told something would have to be mailed out because they dont have access to that information. It seems odd that anyone could give me accurate information about my account if they cant see my payment history. When I inquired about making an additional {$50.00} payment through a round up app ( an app that helps you pay off your student loans by rounding up your purchases to the nearest dollar ), I was told that making additional payments would cause my minimum payment to go up {$200.00} because my rate reduction program would be cancelled. But when I asked how I can get my loans paid off faster I was told to make extra payments. Then I was told that I could make a payment for the entire balance. Navient does not care about their borrowers and has bankrupted my generation. As others have called it, this is financial terrorism.

Debt collection: Private student loan debt

You told them to stop contacting you, but they keep trying
Complaint: Navient has called me at work over five times in total. After the very first call, I made it clear to the representative on the phone this type of communication is prohibited by my employer and they are not to call my work number. I then gave the rep my personal number, verified my address, and gave them the best time to contact me. This first instance was over a year ago. In this month alone I have received XXXX more calls from Navient at work. I received a call on XX/XX/19, XX/XX/19 ( the rep hung up when I answered XXXX, and again today on XX/XX/19. On the XX/XX/XXXX call, I reminded the rep that my employer doesn't want me taking these calls and could lead to trouble. I again gave them my number and best times to call. The person on the phone confirmed that they would use my given method of contact to communicate with me in the future. During the prohibited office call today, I asked the rep immediately if there were any notes from my XX/XX/XXXX discussion with them. They noted everything that was discussed on XX/XX/XXXX except for me telling them not to call me at work. This is utterly ridiculous. I would've hoped that after explaining to the Navient reps that calling me at work is strictly prohibited that they would stop. This has not been the case. I am attaching a signed document that I have faxed to Navient tonight stating that they are only authorized to contact me at the address and number listed.

Keep getting calls about your loan
Complaint: I strongly suspect that my loan servicer has sold my private information to scammers as I have received numerous text messages and calls over the last few weeks regarding illegitimate offers to " forgive my student loans ''. I never signed any document agreeing to allow my servicer to share or sell my information. This is a clear breach of my privacy as their client and it should not have happened in the first place. These scam organizations should not have access to my phone number, the name of my loan servicer, nor should they be privy to the fact that I have a student loan at all. A sampling of some of the text messages I have received are included in the attachments.

Struggling to repay your loan

Student loan: Private student loan

Problem lowering your monthly payments
Complaint: The problem I am having, is I pay every month but my balance and monthly payments aren't going down. These are student private loans, and because of their % rates & late fees, i'm not going to get these paid off. There should be better practices with these high interest rates and late fees, especially when you are making my monthly payments. Here is an example of the interest rates, late fees, and the monthly payments I've made in the last two years. Navient has too many hidden rates and fees.

Student loan: Private student loan

Received bad information about your loan
Complaint: Years ago I was having trouble making payments, and was advised by Navient to do forebearance. They told me that the interest would be tagged on to my loan. After the forebearance ended, they said 6 months of missed payments were due. My loans are still past due with over {$17000.00} due right now and in default. Not only was it impossible to pay, but the fees just keep piling up and they refused to do anything about it when I called. Get calls about 8-10 times a day, collection letters from them and another collection agency, and can't even start to get out from being underwater. To be honest, the only thing keeping me from having XXXX XXXX is that they would go after my mom if I did. They also call and harrass my sister, and she isn't even on the loans.

Dealing with your lender or servicer

Student loan: Federal student loan servicing

Received bad information about your loan
Complaint: I personally filed a complaint against Navient, alleging that Navient promised that my loan was eligible for public service loan forgiveness, only to find out later that my loans did not qualify. Phone recordings from Navient, selectively produced by Navient, seem to indicate that I was told my loans don't qualify. However, Navient never told me that my ineligible loans could be made eligible very easily by converting my loans to direct consolidated loans. I assumed that if my loans were not eligible for PSLF that I could never take advantage of PSLF. I didn't know that the nature of my loans could be changed, as Navient never told me they could. Instead, Navient told me I wasnt eligible for PSLF, but that there was good news because I qualified for lower payments with an income- based repayment plan. I have a phone recording from Navient ( given to me by Navient ), wherein a Navient supervisor tells me that Navient reps, once they know you are a public servant, are supposed to immediately notify you that to qualify for PSLF, you must convert to a direct loan. I posited that it must not be in Navient 's best interests to tell public servants about converting because that would mean that Navient loses my loan and interest payments to XXXX XXXX. The supervisor agreed with me. Then she reiterated that she was shocked that I wasn't told to convert to a direct loan. Navient has had my loan since XXXX. Had they told me about converting to a direct loan back then, I would have been eligible for PSLF by XXXX! Now, I'm not eligible until XXXX, 6 years after i'm scheduled to retire! I am also curious as to whether CFPB 's lawsuit against Navient is at least partially based on Navient, in order not to lose thousands of loans, not telling public servants of the need to convert to eligibility direct loans to qualify for PSLF.

False statements or representation

Debt collection: Private student loan debt

Attempted to collect wrong amount
Complaint: The amount just over {$50000.00} was originally owed to Sallie Mae. I paid Sallie Mae faithfully until XX/XX/XXXX when I filed bankruptcy. That bankruptcy was dismissed in XX/XX/XXXX after never being confirmed. I contacted Sallie Mae and resumed repaying Sallie Mae from then on. In XXXX Sallie Mae assigned my account to Navient without notifying Navient of ANY previous payments. It's as if I never paid Sallie Mae ANYTHING from XXXX XXXX, and XXXX XXXX when my account was then sent to Navient. Navient says I now owe the same original amount of {$50000.00} plus {$20000.00} additional money DESPITE monthly payments to them of amounts fluctuating from $ XXXX since XXXX. Why hasn't or doesn't that amount change with 6 years of regular monthly payments and why has that total initial amount been raised {$20000.00}? The amount owed does not change and mst often goes Up after payment has been made. I have paid $ 1,000s and $ 1,000s of dollars and have gotten nowhere in the reduction of my current balance.

Struggling to repay your loan

Student loan: Federal student loan servicing

Problem lowering your monthly payments
Complaint: Navient continues to send me correspondence stating that I owe an amount that I can not pay per month. I was paying the required minimum amount. I spoke with a a customer service rep for Navient and continue to get bothersome calls from them. The rep and myself never came to an agreement for repayment then I received bills that took my payment from {$5.00} per month to {$310.00} per month. I can not afford this monthly payment amount and I fear this will go back on my credit. I have worked hard to make the monthly payments I could afford to get this off of my credit. When I call regarding this I am told that it is income based and This is the amount I should be able to afford based on my gross income. I am currently attending college and paying my tuition out of pocket and have a child in college and can not afford this payment.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Account information incorrect
Complaint: Navient has a history of misapplying payments on my student loans. As they've admitted in the past, there were delinquent marks on my credit ( and co-signer ' credit ) for years that they refused to fix, in addition to late fees. I filed a previous complaint against the company, Navient. Navient admitted to issues with the payment processing on their end and stated payments were set up incorrectly. I previously spoke with their office of the consumer advocate ( associate XXXX XXXX XXXX about a year ago with respect to this issue. Since then, I've had to renew my payment plan. I recently received correspondence that my account is being reported over 40 days past due with late fees/credit reporting again. I contacted Navient, and they stated that the payments are again being applied incorrectly on their end. The recorded calls with the company will demonstrate all of this. It's clear at this point that Navient has engaged in negligence, bad debt practices, breach of contact, infliction of emotional distress, and the like. They are unable to competently set up a payment plan and apply payments in correctly, which has resulted in continued harassment for myself and by co-signers. I've attached proof of this non-compliance to this case in addition to a recent past due letter that I've received.

Struggling to repay your loan

Student loan: Federal student loan servicing

Problem lowering your monthly payments
Complaint: I graduated college back in XXXX. Back then, my school loan was with NY Department of Education and afterwards Sallie Mae. I was told numerous times that my starting salary in my field would be around $ 50k. With some smart saving I thought I would be able to still pay off my loan while my wife and I lived in a small 1 bedroom apartment. When I was finally offered a permanent job, it was at $ XXXX/hr in my field. A far cry from the $ XXXX that my college said I would start at. I called Sallie Mae and was never offered the income based payback method. Everything was with them was always deferment. This went on for years even after Navient took over. I went from under a $ 30k student loan to $ XXXX student loan because of all the deferments and the high interest rate of 8.125 %. The difference is all capitalized interest and whatever other fees they tacked on through the years. Navient wouldn't let me refinance at a lower rate because they said I was ineligible. They knew what they were doing and never told me I could of paid based on my tiny take home paycheck starting back in XXXX! Fast forward to XXXX. Im finally making a little money hoping to start making payments to bring this ridiculous monster debt that I shouldnt have down. Now all of a sudden they want to do income driven repayment. I told them I cant do more than $ 150/month. Everything they calculated was through my tax returns. Nobody from Navient would work with me regarding what I could actually afford to pay. Jump to XXXX and now Navient wants $ XXXX/month which I definitely cant do. The company seems to forget that I dont get to keep what the IRS reports and that Navient is not my only bill. I have to pay for my vehicles to get me to work to earn my paycheck. Pay for gas to get me back and forth to work as well as insurance. Pay for the roof over my head because in my job, I need to be awake and very alert. Pay for the various personal insurances. Monthly utility bills because heat would be nice in the cold months and a little a/c in the summer since where I live it gets very hot. The credit cards because thats the only way we can afford to buy our food and those are maxed out. My wife packs everything up for me and I dont order out because we cant afford it. Then there are other bills as well. You get my drift. I have told Navient time and time again, even paying $ XXXX/month is pushing it but I can do that on time every month unlike the {$720.00} payment. I want to pay it off, but I simply cant afford that much even though my tax returns look like I can. By the time everything is paid, Im lucky if we have {$5.00} left in the bank. So maybe Navient will step up and work with me since I had no choice but to come on here and complain.

Struggling to repay your loan

Student loan: Federal student loan servicing

Can't get other flexible options for repaying your loan
Complaint: When I was married, my ( ex ) husband and I consolidated our loans into a spousal consolidation. He filed for divorce XXXX months later. Our divorce settlement ordered him to be responsible for the debt of the loan. He has failed to pay the loan and deferrred it for multiple years, without my consent. My understanding is that BOTH spouses must qualify for financial hardship. Im a XXXX and make an income that wouldnt have qualified me. My ex either forged my signature or falsified information. Navient never contacted me to verify my income, and deferred the loan multiple times. Now, years later the interest has almost doubled the loan. My ex has stopped making payments. Ive been forced to make the payments for the last 3.5 years. We are on the income based repayment plan and the reduced payment is $ XXXX/month. Im struggling to afford this and also know its only paying the interest on the loan, which is {$160000.00}. My portion of the loan is only {$27000.00}. Im exasperated that Im held responsible for all the interest and that Navient never contacted me to verify my income. They approved the deferement without my consent. This is very wrong. I realize that Navient doesnt care about our divorce agreement. I would like to pay for my share of the student loan and not be responsible for my exes share. This isnt fair! Ive consulted with attorneys, but Id rather communicate directly with the server or government. Please let me know what I can do. Thank you

Dealing with your lender or servicer

Student loan: Federal student loan servicing

Problem with customer service
Complaint: Navient has been a problem and I have filed multiple complains about them in the past. Navient misallocated payments and steered me through multiple forbearances instead of income-driven repayment plans. Then, they started mailing letters to me at a previous address and had the wrong telephone number to reach me. This resulted in mis-allocation of XXXX seperate loans that I was consistently paying ( as was agreed, and they do not dispute ), and hit my credit score hard. When I reached out to them and tried to resolve this issue, they could not pull up my account because they had the wrong address and telephone number on file. It took multiple complaints to the CFPB to get them to even communicate with me ( thanks, CFPB ). We worked through this issue, all of the fees that they charged were returned, and I refinanced the student loans with a different servicer. By the way - no issues so far from the new servicer. What this complaint is about is the fact that Navient was supposed to expunge my credit report, and they did not. This was their mistake, they acknowledged as much and returned the fees ( on paper ) they had charged me. And yet, I'm still paying for it. I can't call them, because I'm not a customer any longer. Maybe the CFPB can help me expunge my credit report from Navient 's mistake. I can show a current credit report showing XXXX loans that have XXXX hits that are 90+ days old - 84 times I was reported and it hurt my credit. Aside from that, my credit is spotless. However, this mark on my credit is costing me thousands of dollars in a refinance of my property.
