Complaint: When I was underpaid and struggling to pay my loans from Fall XX/XX/XXXX to XX/XX/XXXX, Navient repeatedly encouraged me to take in school forbearances rather than giving me income sensitive repayment options. Forbearances were simple and could be approved over the phone and were pushed by the Navient employees. As a result of these forbearances, tens of thousands of dollars of interest became capitalized and I am paying much more for much longer than needed to be the case.

Complaint: I have called Navient many times after XXXX discharged this issue on the complaint XXXX. Last contact date to Navient was XX/XX/XXXX. They refuse to remove the late payments and Navient stated I would have to call the credit bureaus to have it removed. Navient discharged the fraudulent account on XXXX and then sold the accounts to XXXX in which I had to have this issue discharged with XXXX.XXXX resold it back to Navient. This issue is bouncing around after I notify them of fraud. Lastly, Navient new of this matter and they still have the discharge information from when I notified them and left the account on my profile. This matter shows currently open on my XXXX report as well as 120-180 late payments. Navient has not furnished me a promissory note to show proof of the said debt. Complaint: I called last year in XXXX to try to lower my payments. I was told that they couldnt lower my payments. They offered me {$15.00} cheaper but my interest rate would be higher and it will add 2 more years to pay it off. I told them that it was too high and that is insane to pay {$15.00} less and have 2 more years added to pay that off so I stuck with the higher payment but shorter year. I also told them I was in school so do I get a forebearance because of it. They said no. I felt like no one tried to help and they were going to make me pay no matter what.

Complaint: I have no idea what is happening to my student loans from XX/XX/2009. I originally had 2 loans when graduating totaling roughly 17k. Ive sent money sparingly over the years, have bad wage garnishments, and now these 2 companies Navient & XXXX own the debt. I am outraged, last month I got a letter saying one of the loans principal was at XXXX and a month later they tacked on a XXXX fee! This was from XXXX. So now Im at roughly 45-50k off of XXXX. This Navient company only ever sends me these forbearance texts and emails where a simple yes puts Them into forbearance. I need help. I have no idea what to do about my loans. Its emotionally and financially devestating knowing what This has become. Im wondering what type of options I have. Im currently unemployed and am willing to find a public service job if it means I can get some of this crippling debt erased. I have countless letters and documents from these people.

Complaint: Navient ignored my " borrowers '' best interests in violation of its government contract to prevent borrowers from moving to XXXX ( the student loan servicer that administers the Public Service Loan Forgiveness program ), so that Navient could continue to earn fees. During XX/XX/XXXX - XX/XX/XXXX I was advised by ancient to enter into an unemployment deferment. I was eligible to enter into an IBR that would count towards my 120 payments in a PSLF program. In XX/XX/XXXX, I was then advised to enter into standard repayment. Only because I could not afford repayment I looked into the matter further and realized I could have been an an IBR plan. During XX/XX/XXXX - XX/XX/XXXX, I went against advisement and managed my account and entered an IBR. My financial situation was exactly the same as the previous 3 years. I was part-time employed at several colleges working over 30 hrs. In fact, since I was working over 30 hours I did not qualify for the deferment that was suggested. I am requesting that the months from XX/XX/XXXX - XX/XX/XXXX be counted towards my IBR. I am willing to pay back payments at the same rate that was determined for the period between XX/XX/XXXX - XX/XX/XXXX. My current IBR payment is slightly high because I am now full-time which is a different financial situation. I have requested documentation from navies but was referred to my online account. they informed me all the information I need is there. but dates on deferments do not show.

Complaint: My private loan from XXXX was transferred to XXXX, then from XXXX to Navient. Where with Navient has consistently increasing my interest rate and is up 3 % from initial distribution. I do not receive any notification of the change. My loan will never get paid off at this rate and only increases. I have autopay with XXXX and have never paid late and had a 100 % payment on-time record. This is ridiculous how my interest rate is just going up instead of going down for good performance. I have had my loan changed by 3 providers so I can not get any information from the providers about the history of my loan and Navient will not provide me with a statement of my interest rate. In a year it's gone up over 1 % for no reason!

Complaint: In XXXX of 2018 Navient debited my account for my monthly installment 2 days before the payment due date. I had more than enough money in my account to cover the payment but for some arbitrary reason then 'reversed the payment ' without any notification that there was a problem on their end. Then I receive a message AFTER the payment due date saying that I've missed payment. I call in only to told there is nothing I can do about the incurred interest due to a missed payment even though I didn't miss a payment. I know it sounds petty to worry about the incurred interest but when you have almost 90,000 in student loans and the interest rate is nearly 7 %, I need to worry about every single penny of my balance.

Complaint: Now for the issue. For the last 6 months I have been aggressively working on my credit score in order to purchase a new car in XX/XX/2019. My credit score was 27 points from reaching XXXX. Then to my surprise I receive a notification that my credit score dropped 36 points. So first pull my credit report to see what in the world could be the change because I dont have any added debt and Ive been paying all my bills on time. The issue why my credit score dropped 36 points was because on XX/XX/2019 Navient reported to all three agencies that my student loan balance increased by {$3100.00} and then Navient on the same day reported that my student loan increased by {$2400.00} for a total of {$5600.00} in increase debt. So I call Navient and speak to Customer Representative # XXXX to see what was going on because I am not back in school and I havent taken any additional loans and the representative lets me know that I dont have any new student loans and there isnt an increase of {$5600.00} on my student loans there is only an increase of about {$300.00} and she doesnt know why Navient reported an additional {$5300.00} to the credit agencies. I have attached documentation reflecting the only change in my credit report. I also called all three agencies regarding the 36 point drop and each customer representative informed me that the change is due to an increase in my debt indicated by my student loan provider of {$5600.00}. I was also told that it could take months for my score to increase by the 36 points even if Navient fixes the mistake. Navient inaccurately report on my credit reports and why no one has caught this. The 36 point decrease has put me in a completely different credit score bracket with a completely different interest rate for the car I have been planning to purchase. This error affects me in the long run and my financial well being. I need a person to give me a call to resolve this. I would like a live person to give me a call and explain why {$5600.00} was reported to the credit agencies and what is being done to fix the situation.

Complaint: At XXXX MST on Saturday, XX/XX/19, a person identifying themselves as XXXX XXXX left a message on my home phone stating that she was calling regarding a time sensitive personal business matter and asking to be called back during ordinary business hours at XXXX, ext XXXX. No other information was given. My phone recorded the call as having come from NAVIENT and the calling number as XXXX. I still have the recorded message. I tried unsuccessfully to call back that afternoon. The recorded message was that I had reached something known as XXXX XXXX XXXX, but that the business was closed. When I called back several times on the next business day, Monday, XX/XX/19, the person answering the phone on each occasion also identified the business as XXXX XXXX XXXX. I have never had any dealings, business or otherwise, with either NAVIENT or XXXX. When I finally reached Ms. XXXX she asked for the last 4 digits of my Social Security Number. I refused to give that information to her without her explaining why she was calling, and why she found it necessary to call before XXXX in the morning. She stated that her company was contacting me in connection with some contract they had with some taxing entity of the State of New Jersey. I told her I had never lived in or had any business with New Jersey. As for the time of her call to my home phone which has a XXXX area code ( peculiar to a small portion of Colorado in the XXXX area ) she dismissed that with well, it could be a cell phone number so we wouldnt know where it was at the time we called!! I guess its OK with her to call any number at any time, regardless of the law. As it happens, my home phone which she called is a land line. She also claimed, falsely, to have sent me a letter, and to have spoken previously with my wife. Ms. XXXX finally gave me the full name of the person she was trying to contact, and I think I was able to convince her that I am not that person. We have similar names, which I will be happy to share, if necessary. According to Ms. XXXX, our conversation was recorded. Her actions constitute, at the very least, violations of the FDCPA : specifically, 15 USC 1692c ( a ) ( 1 ) calling before XXXX at the consumers location ; and 1692e ( 10 ) and ( 11 ) making false representations, and failing to give mini Miranda warnings ; and the Colorado Uniform Consumer Credit Code : specifically, CRS 5-5-109 ( 2 ) and ( 4 ) ( b ) engaging in unconscionable conduct, such as communicating at an unusual hour so as to harass the consumer

Complaint: On XX/XX/2018 I logged into my account, looked at the ready to pay off this loan amount for online repayment, and chose the specify for each loan option and chose this loan to pay off the full balance of {$12000.00}. I went onto the account about a week later and noticed they distributed the payments between two loans and did not pay off the full balance of the one loan I specified. They applied {$3600.00} to this loan leaving me with almost a {$9000.00} on this consolidated subsidized loan and applied the remainder to the larger loan. This made it so my payments didnt decrease, I still have balances on both loans with a 6.25 % interest rate. The point of me paying it off was to decrease my debt and start to make a dent in my over {$80000.00} in student loan debt. When I called to complain they told me it was the department of education that redistributed the loan and that I couldnt do anything about it. I am never going to get these loans paid off if I cant take one loan at a time to pay off. These loans show two separate pay off amounts, I make two separate payments each month on them that get applied just fine. I wasnt behind on any of the payments and had made the payment for that month to the other loan already. They used my money how they wanted even though I specified where the money was to go and they had the option online to specify where the money is to go. Also, the full repayment amount for each loan is not showing as one lump sum, it is showing for each loan by itself. And although it let me specify which loan I paid at the time of each payment ( even standard monthly payments ), when you look at all the payments it doesnt specify which loan was chosen in the pending and past payment history. It is deceitful and completely unethical.

Complaint: I applied to Navient for their private loan permanent rate reduction program due to my inability to pay the astronomical rates they were charging me. As a reference, I am a prior student/victim of the XXXX XXXX predatory student lending scams. They approved my interest rate reduction to 1 % for ALL my private student loans and I have been making on time payments ever since. I had been making two separate payments for five different loans ; one for about {$140.00} on three of them, and one for about {$64.00} on two of them, the sum equaling roughly {$200.00}. This was a long arduous process to which took about two months of negotiation and was finalized sometime in XX/XX/XXXX. I received a notice in XX/XX/XXXX, that my payment status had changed. They said that two of the five loans were no longer in this interest reduction program. After 2.5 hours and arguing, pushing, and inquiring with several " specialists '' that this was not right because this change was supposed to be permanent for all five loans, they finally combed through my account and realized this was a clerical error on their end. They said they would rectify the account, erase the late fees and put all five loans under one payment within the rate reduction program as it was originally supposed to have been processed two years ago. During this process I lost time from work sorting this out on the phone. Before the call I received no notice on this change. They assessed late fees and my interest rates sky-rocketed which pushed my loan amount up and thus effected my credit negatively. They kept insisting that this was always what was going to happen yet they could not provide proof to me that this was the agreement but consistently tried to push me off the phone, dismissing me as if I was being ridiculous. Once they finally realized their error they said that moving forward all five loans would be under one payment of the same amount from before, approximately {$200.00} as they are all under the same program. But I just received a statement saying that the late fees are still be assessed for {$35.00}. The payments were still processed as two separate payments and not just one as they stated. This concerns me in that despite what they said, the clerical error is obviously still present. This is not the first time I have had an issue in dealing with the incompetence of Navient in their loan servicing. I should not have to push and dig to get answers and to correct THEIR errors. I should not have to continually communicate with a large corporation to which has the financial means to maintain their clerical staff and systems efficiently, and that should also not put lower middle-class citizens like me through the rigor morale every single time they falter. I only wonder if this happens to me, what about the plenty of other blue-collar citizens who don't have the wherewithal to push like I do. Does Navient perform quality assurance checks? Do they get audited where small clerical mistakes like this cost student loan holders thousands of dollars they already don't have beyond what they owe? Are these financial mishaps recompensed to those who overpaid due to Navient 's error? Lastly, I caught this one, what if I didn't catch others? Please audit this company. Please scrutinize their billing efforts. Stop letting this happen to good people who just want to do the right thing and pay what they owe but still want to have some quality of life where they aren't being cheated by big money hungry corporations.

Complaint: After receiving a letter threatening to garnish my wages over a {$3500.00} loan that's halfway paid off from the Department of Education, I submitted the documents they requested showing that would cause a hardship under two different categories via certified mail and it was delivered. Last week I received another letter requesting the same documents plus additional ones be sent to a collection company in New York within 15 days of the DATE OF THE LETTER. I live in California it took me almost a week just to get the letter and one of the requested documents would take at least 10 days to get from XXXX. On top of that they're requesting a letter of termination from my previous employer that I was never given and can't ask for now. In fact I don't know a single person who has ever received a " letter of termination '' from a job. I can't afford to have my wages garnished, they've already taken and continue to take my tax refunds yearly this is just extreme.

Upon Graduation, I requested that Navient would put my loans in deferment until I was able to get a job and start repaying my loans, which they agreed to do. On my credit report, it is showing that all 6 loans from Navient has a 90-day late payment as of XX/XX/XXXX. I called Navient today ( XX/XX/XXXX ) and spoke with XXXX about this issue. XXXX agreed with me that the marks should have never been placed on my account and caused my credit and payment history to suffer, but that she was not able to do anything about it.
