Without explanation I was put on hold and transferred to a woman named XXXX ( Her direct number is XXXX XXXX XXXX ext XXXX ) XXXX informed me that the collection account was sent to National Enterprise Systems by a company called XXXX XXXX XXXX. XXXX promised me that she would request document verification ( promissory note ) and send that to my email at XXXX. I had recently applied for a loan and reviewed my credit report today. My credit report shows a collection account that was filed by National Enterprise Systems on XX/XX/2019. This collection was reported to the Credit Bureau before the demand latter was even sent to me by National Enterprise Systems and they have made no attempt to provide me with documents, remove the collection from my credit or show that the collection is in dispute. My phone conversation was knowingly recorder by the collection agency. I also have a recording of the conversation.

Attempts to collect debt not owed

Debt collection: Private student loan debt

Debt was result of identity theft
Complaint: There was a fraudulent private student loan taken out under my identity. I filed a police report and the investigator confirmed it was identity theft. I notified the creditor " XXXX '' and the XXXX credit reporting companies but nothing was done until XXXX after the credit repair company I hired sent the credit reporting companies the police report did they remove it from my credit report. After it was removed, creditor XXXX sold the loan to debt collector National Enterprise Systems even though they were fully aware I didn't acquire the loan. I advised National Enterprise Systems to provide me evidence that I owned the loan. The promissory note they emailed me indicated they forged the document by adding my name and other information using a pen because the form was barely readable. The promissory note also has the wrong birthday and social security number. I was then notified this morning XX/XX/XXXX that National Enterprise Systems reported the fraudulent student loan to XXXX with an additional {$100000.00} added to the original amount it was reporting.

False statements or representation

Debt collection: Credit card debt

Attempted to collect wrong amount
Complaint: I had an agreement with the company for paying the lowest amount monthly. They agreed on paying the 100 monthly without charging fees and interest. I started paying on what we have agreed. The balance was {$5000.00} when paying when down to {$3900.00}. I received a statement stated that I owed them {$5700.00}. This is incorrect information and balance. They had charge me fees and interest. I've contacted them over and over again. They said that now I have to pay {$470.00} a month even though we agreed on the payment of $ 100 monthly. I have tried to call them and they wont help me anymore. I'm very frustrated because they closed the account and now I am in collection.

Incorrect information on your report

Credit reporting, credit repair services, or other personal consumer reports: Credit reporting

Information belongs to someone else
Complaint: National Enterprise Systems has violated my rights under the Fair Credit Reporting Act by fraudulently and illegally placing an outdated account that is not mine into my credit report. The account, from XX/XX/XXXX, was placed into my credit report well over a decade later in XX/XX/XXXX when I discovered it. I have learned the account was charged off in XXXX when XXXX XXXX XXXX filed for and declared Chapter XXXX bankruptcy, going out of business. National Enterprise Systems refuses full transparency as I have asked for and refuses to provide me with the information that I have requested. Instead they told me to contact XXXX XXXX XXXX, which they know does not even exist. NES has also told me that they are not responsible for putting this into my credit report, when in fact it is them. Each time I file a dispute with XXXX, NES provides additional false information to them which I have documented. One example is how NES put into my credit report " Last payment made on XX/XX/XXXX '' to make it look like I was making payments. This is a complete fraud, abusive, unfair practice, and misrepresentation of debt by falsifying information to XXXX XXXX. NES refuses to supply me with further documentation showing the amount of this payment, method paid, and person responsible for paying it ... because it is an abuse of power which should be stripped away from National Enterprise Systems.

Dealing with your lender or servicer

Student loan: Federal student loan servicing

Don't agree with the fees charged
Complaint: I have been paying regularly every month to try to rid myself of this predatory loan for YEARS. XXXX XXXX passed MY loan onto this criminal enterprise called NES and NES continues to find a way to INCREASE the balance of the loan despite receiving {$3500.00} worth of payments from me in XXXX alone. I even paid twice one month on this loan and the balance of the loan has gone UP. This collection agency National Enterprise Systems has not explained how this is possible. They have NO signature from me agreeing to any new loan terms that would cause the balance to go up. On XX/XX/XXXX, I checked the balance of this loan ( document attached ). I CONTINUED MAKING payments. I made {$530.00} in payments in XXXX alone. - after getting over {$500.00} from me in addition to the regular {$330.00} I've paid each month, the loan balance INCREASED by more than {$150.00}. There is no way this can even be legal. I have been PAYING THIS LOAN. {$330.00} per month for YEARS. And the balance continues to CLIMB. I have pleaded with your office for assistance. Please note I graduated in XXXX and this loan is 23 YEARS OLD. Despite my efforts to pay and get this burden off my back, the balance NEVER goes down. NES continue to lie with NO EVIDENCE showing I agreed to ANYTHING and NO evidence showing they explained ANYTHING about how they can add to this loan despite GETTING PAID and despite me not agreeing to borrow ONE additional penny. I was advised by phone that the amount I needed to pay to get the principal balance to go down was {$330.00} per month. Every time in the past I has ASKED NES to please review the TAPES of my phone calls, they lie and say there are none even though their voice recording on the phone SAYS they record the calls. CAN YOU PLEASE HELP ME!? I am being ROBBED and no one who is able to assist will even bother! They HAVE NO legal standing to keep ADDING TO THE BALANCE when I am DOING WHAT THEY TOLD ME TO DO TO LOWER IT and they have NO signature from me agreeing to anything different. I have contacted the MD State Atty General 's Office to request that suit be filed because XXXX XXXX LIED about the terms of this loan and they are pretending to not have recordings of the calls where their representives LIED about the terms of the forebearances and LIED about the interest and failed to present all possible options for loan repayment. Mr XXXX XXXX, the atty general is too busy trying to become famous for fighting w/ the president over immigration to take action even as other states such as Pennsylvania and Ohio and have had much success in class action suits against NES and XXXX and other predatory loan sharks. And now I've been passed around to this collections agency who keeps RAISING THE BALANCE OF THIS LOAN DESPITE GETTING PAID and has not given me a single word of information about how they can legally do that. NO ONE WILL HELP ME.

Attempts to collect debt not owed

Debt collection: Federal student loan debt

Debt was already discharged in bankruptcy and is no longer owed
Complaint: XX/XX/XXXX SENT VIA CERTIFIED MAIL RETURN RECEIPT REQUESTED NATIONAL ENTERPRISE SYSTEMS XXXX XXXX XXXX XXXX XXXX XXXX, OH XXXX Re : Current Creditor : XXXX XXXX XXXX Debt Description : XXXX XXXX Account Number : XXXX Account Number : NES Account Number : Balance : {$6100.00} To Whom It May Concern : I have been contacted by your organization by letter ( dated XX/XX/XXXX ) received on or about XX/XX/XXXX, attempting to collect on the above referenced debt. As discussed on my phone call to your office on XX/XX/XXXX, I filed for bankruptcy under Chapter XXXX of the United States Bankruptcy Code, on XX/XX/XXXX. The account referenced in your letter and as outlined above was discharged under bankruptcy, case number XXXX, in the U.S. Bankruptcy Court for the XXXX District of Ohio on XX/XX/XXXX. I have enclosed a copy of the Order of Discharge ( Official Form XXXX ) XXXX, for your reference and a copy of page 8 of the Schedule E/F : Creditors Who Have Unsecured Claims ( Official Form XXXX ) showing the above referenced debt listed on the debt schedule. I believe the current creditors attempt as well as your own attempt to collect and/or induce payment on this otherwise discharged debt is in violation of the Courts Order and the Bankruptcy Code. Discharge Orders extinguished all education-related debt that was not excepted from discharge by 11 U.S.C. 523 ( a ) ( 8 ). As you and the current creditor are aware of this discharge and know, any attempt to collect on a discharged debt is in violation of both the Fair Debt Collection Practices Act ( FDCPA ) and the Bankruptcy Protection Law. Although a debt collectors knowledge or intent is irrelevant, by sending this collection notice to collect on an uncollectible debt, I believe you and the current creditor listed in your letter also mis-stated the character and legal status of the discharged debt, and violated the FDCPA, specifically 15 U.S.C. 1692e ( 2 ). I demand your organization as well as the current creditor referenced in your letter cease all collection efforts of the alleged debt and immediately stop and remove the reporting of this account as delinquent to the major credit bureaus. Any attempt to report this account as delinquent to the major credit bureaus is an attempt to compel payment - also a violation. I will be documenting all illegal actions and violations by contacting and filing complaints beginning with, but not limited to, the organization ( s ) listed below. Furthermore, you are hereby notified that at no point in time and under no circumstances is your organization ; an employee of your organization ; a representative for your organization or affiliates ( which includes the current creditor you identified in your letter ) to contact me or any member of my family by any means other than in writing via the US mail system. I also hereby reserve my right to take any legal action including private civil action against you and or the current creditor to recover damages. Attempts to collect debt not owed

Debt collection: Other debt

Debt was paid
Complaint: The original creditor for this debt is XXXX XXXX XXXX. I spoke with them in XX/XX/XXXX and they instructed me to turn instrument in to local music store and said they would remove debt. Debt was originally reporting over {$2000.00}. After turning instrument in on XXXX XX/XX/XXXX, I thought everything was cleared as they said it would be. In XXXX, I found out that XXXX ( XXXX ) claimed I owe {$390.00} and added that to my credit report! I contacted them and explained I turned instrument in. They told me everything was fine and it would be removed from report. I called back because it was not removed but was told they could not talk to me about this issue anymore because National Enterprise Systems ( NES ) was handling this account. I spoke with NES and sent them proof of receipt for returned instrument. They in turn sent a bill to me for over {$2100.00} when XXXX is reporting {$390.00}. I called and asked them to provide in writing the details that could sum my owing what they claim. I scanned to them proof that XXXX is reporting {$390.00} on XXXX XX/XX/XXXX. My initial conversation started with NES on XXXX XX/XX/XXXX. They always transfer me to about 3 to 4 different people per call before getting some type of information about this debt. They end up telling me that XXXX have been contacted with my concern and they were waiting to hear their response. I have scanned them what XXXX is reporting and they said they will contact XXXX again with this information. I am exhausted dealing with this debt that has been taken care of. If XXXX is reporting this account then why is NES involved which is a collections company as well. I would like this removed from my credit report. Thank you in advanced!
