You are required under OHIO LAW U.C.C 1319.12 Taking assignment of debts ( 3 ) The assignment was manifested by a written agreement separate from and in addition to any document intended for the purpose of listing the account, bill, or other evidence of indebtedness with the collection agency. The written agreement shall state the effective date of the assignment and the consideration paid or given, if any, for the assignment and shall expressly authorize the collection agency to refer the assigned account, bill, or other evidence of indebtedness to an attorney admitted to the practice of law in this state for the commencement of litigation.The written agreement also shall disclose that the collection agency may consolidate, for purposes of filing an action, the assigned account, bill, or other evidence of indebtedness with those of other creditors against an individual debtor or co-debtors. Furthermore you have failed to provide any transfer title of ownership on the charged off written of account. Complaint: The debt collector is attempting to collect a debt for a truck that is not my account. Her name is XXXX XXXX and her phone is XXXX XXXX. When I call her back to tell her that this is not my account she asks for the number that SHE is calling. I do not know what number she is calling so I give her the main number to my place of work so she can remove it. That number does not come up in her system so there is nothing she can do. I keep getting calls from her and it is embarrassing and harassing at my professional medical office. This is not my debt and they have the wrong person but she has no way to remove me unless I can tell HER THE CORRECT NUMBER THAT SHE IS CALLING. This seems wrong to me.

Complaint: Every day for at least the past 7 months I come home to a voicemail message looking for a person who does not live here. I recently called back the number and told them that person did not live here and to stop calling and take my number off their list. The calls have continued nonstop. When I reached them they gave me another name -- still someone who doesn't live here. I'm just sick of it!

Complaint: This letter is in regards to a complaint against National Enterprise System for a XXXX Private Student Loan with a Cosigner purchased by National Enterprise System. First and foremost the statute of limitations on this loan has run its course. Loan Amount approximately {$7000.00} Borrowers payments. Borrower has paid over approximately {$3000.00} while principle continues to rise. Initial grievance is with XXXX and National Enterprise System and how loan servicer mishandled against borrower 's best interest using the money paid down towards interest rather than principal balance of loan. During the lawsuit scare XXXX, fully aware of my accounts mishandling and fraudulent behavior, sold the loan to National Enterprise Systems with little to no accurate information on the loan in question. Lender suggested borrower use forbearance to pause monthly payments which racked up crippling additional debt instead of giving a better option like income-driven repayment plan. They intentionally made it very difficult for the borrower to understand and apply for approval for a co-signer. In fact allowing the borrower to finish transaction without cosigner present. An absolute burden that was wrongfully forced on us. These statements have been clearly and verbally stated several times to each loan servicer. Major Immediate Grievance : Severe and Total Harassment of Cosigner by National Enterprise System to the point where cosigner suffered an XXXX XXXX on XX/XX/XXXX due to the Stress from harassment and fraud in signing and taking this loan. ( Document included ) She is suffering from major illness from this loan and the Loan Servicer continue to harass and call at work, and have called repeatedly and continuously. They have called at times when they knew they should not call ( late hours or during a doctors appointment ). They have repeatedly called work even though she has explicitly stated that her employer does NOT approve of these calls and that she is not responsible for the intentional fraudulent National Enterprise System 's from the inception of this loan. Due to this severe harassment and incessant nagging, I am concerned for health and well being! All the calls were recorded on National Enterprise Systems part and show how she is completely distraught, XXXX XXXX, and having a XXXX XXXX on the phone. The doctors have stated that her attacks are due to the stress from the burden of this loan and the harassment that she has been enduring. The financial information National Enterprise System claims to have is not valid. She has not been able to receive the imperative medical care she needs to survive because National Enterprise System has stated that the money on her credit card needs to be used to pay this student loan. And now after the XXXX the doctors are insisting she seek the help she needs ASAP. NATURE OF THE LOAN : ( FRAUD ) Cosigner has not been released despite several requests and attempts. XXXX has intentionally made it impossible to receive proper information on approval for a co-signer release. Financial and Medical situation of Student : 1. XXXX for 2 years 2. Credit Card Debt 3. XXXX/on assistance 4. XXXX affected by fraud and discrimination Financial and Medical Situation of Cosigner : 1. Suffered a XXXX XX/XX/XXXX due to harassment about this loan and a XXXX XXXX on XX/XX/XXXX, delaying proper medical care due to payment of this loan 2. Credit card Debt 3. {$35000.00} Medical Bills left from terrible divorce, family member.. The copy of the original contract presented was illegible and invalid. This loan should not have been given to this student without the presence of the cosigner. The loan was unlawfully sold to National Enterprise System by XXXX. Furthermore, the statute of limitations on this loan has passed. By not working with us, by harassing us when we are picking up and talking to you created an unhealthy and permanently disabling situation.

Complaint: I am a retired XXXX XXXX XXXX. This MAY be an attempt to collect a fraudulent balance for an old credit card account. An account was opened at an Ohio bank many years ago ; the bank kept changing my address without consent and refused to let me see missed monthly statements. I reported this to the creditor as part of my identity theft problem. I paid the amount I had charged, after ordering the account closed with a total amount of less than $ 6K INCLUDING the fraudulent charges. I paid the final $ 4K+ I owed in XXXX and was sued by the account holder, XXXX XXXX , in XXXX or XXXX, where the suit was dismissed in XXXX , VA District Civil Court . I received a form letter from " National Enterprise '' XX/XX/XXXX dated XX/XX/XXXX. I previously began receiving robocalls on my office phone several weeks ago, with one of the caller-I-D signals indicating " National Enterprise ''. The same calls arrive at least daily, often with a different spoofed phone number. There is no live person talking and no mention is made of what " National ' wants.

Complaint: I requested an explanation of the debt and the company sent a copy of a promissory note from another creditor from 2003. Based on this information alone, the debt is past the statute of limitations in Washington state. A proper explanation of the debt includes payments made, amount due, date of last payment, and other relevant data to show the loan the collection agency is trying to collect is a valid debt, under the FCRA. Until National Enterprise Systems can show the valid debt, it should immediately remove the Collection Account from the XXXX credit bureau.
