Complaint: I was a resident at XXXX XXXX XXXX XXXX apartment complex in XXXX, MO. When I moved out XX/XX/XXXX I paid all applicable fees ( rent and included utilities ) and had a {$0.00} balance. XX/XX/XXXX I received a collections notice from Fair Collections and Out stating I had a debt of {$140.00} due to XXXX XXXX. I immediately called and advised this was not my debt as my balance was paid when I vacated the property to the property manager XXXX XXXX. I also made a call to XXXX XXXX XXXX XXXX and spoke with XXXX as XXXX XXXX was no longer with the company, who advised I have a {$0.00} balance and the debt was an error. Since this I have not received any collections calls but this debt is still reporting incorrectly on my credit report. I spoke with the debt collector on XX/XX/XXXX and asked to send proof that this debt belongs to me and was advised they don't do that. They only have to verify with XXXX XXXX and if they say I owe it then that is what they go by but no one can send me any proof that this debt is factual.

Complaint: I recieved a notice in the mail off a debt of {$7300.00} dollars with my name on it from this Company in XX/XX/XXXX which I have no Knowledge of. When I decided to look into it I noticed that the Companies name was on all three of my credit reports. I do remember disputing this matter earlier in XXXX with all 3 credit bureaus but the account still remains on my reports. XX/XX/XXXX I sent the company a letter asking them to validate this account they never responded to my request. XX/XX/XXXX I decided to dispute it again with the with XXXX, XXXX and XXXX only to have this account remain on my report without changes. XX/XX/XXXX I emailed this company with the same request for validation of this account thinking I would get a response from them this time on the matter. With no response from the mailed letter and email, I decided to send a second email to them of the same request. This time they responded to me stating that they will contact me after they do a investagation which I think was just said to get me to stop sending my request for validation. I been trying do get answers for a year now by myself but to this day this account have not been validated to me with any documentation.

Complaint: On XX/XX/XXXX FCO ( Fair Collections & OutSourcing and I reached a settlement agreement that with a payment of XXXX my account with them would be considered closed and settled and updated to reflect that on my credit report to reflect settled in full ( See attached ). The payment was made to them and I received a confirmation letter dated XX/XX/XXXX. In XX/XX/XXXX i checked my credit and the account reflected as : Open and with a balance of {$3400.00}. At this point I disputed the information and received a letter back from the creditor ( See attached ) stating that the account has been reported correctly. They have not stuck up to their part of the agreement and my credit has been impacted from XX/XX/XXXX until today. I would like this information to be updated on my credit to what was agreed upon. I have been turned down for an apartment due to their inaccurate reporting because it does not reflect that i have paid them in a settlement.

Complaint: XXXX XXXX has acted in bad faith in violation of both California law as well as Federal law by illegally retaining my security deposit and deducting expenses without providing valid documentation. The debt Fair Collections and Outsourcing ( FCO ) is attempting to collect on their behalf, {$610.00}, is invalid.
I sent the attached letter by certified mail to XXXX XXXX detailing that they were in violation of California law and had not provided me with any receipts detailing the deductions taken in compliance with their obligations as a landlord. I also explained that any further action taken to collect or retain my deposit would be considered as being taken in bad faith and that they would be liable for enhanced penalties, attorneys fees, and fines should further legal action become necessary. After XXXX XXXX received the letter on XX/XX/XXXX, they stopped responding and refused to send my security deposit refund as required. Several months later I was contacted by FCO and notified that this illegal and alleged debt owed by me had been referred to debt collection in bad faith, thereby placing them in violation of the FCRA.
In addition to the issues stated above, I also dispute the charges listed as being patently untrue and blatant attempts at scheming more money out of their tenants. For instance, the move in sheet provided in the documentation sent by FCO clearly states that the apartment was in an unclean condition at the time of move in, XX/XX/XXXX. This sheet was signed by XXXX XXXX acknowledging the condition at the time. Therefore, as required by California law, I am required to return the apartment in the same condition received, minus any normal wear and tear. The carpets were in great condition as evidenced by the move out inspection conducted by XXXX ( head maintenance employee ) as well as the apartment in general. As for any stains or damage to the oven range and the refrigerator, the maintenance records retained by XXXX XXXX, which they refuse to provide, clearly show that these units were old replacement units brought in mid-way through my tenancy since the original units were broken. These units came with stains and damage already on them and this was acknowledged by both XXXX and XXXX, employees of XXXX XXXX. Lastly, the bill for XXXX is incorrect and should not have been deducted from my security deposit.

Complaint: I received an itemized list of the reason portions of my security deposit was being withheld, the amount totaled {$190.00}. Items listed were final water bill, - {$57.00} and 3 days of pro-rated rent - {$130.00}. After receiving the check I reached out to my rental company outlining why my full security deposit should be return, the email is attached. Beginning on XX/XX/XXXX I started receiving phone calls from a debit collector, Fair Collections & Outsourcing , Inc. ( FCO ) and it wasn't until I XX/XX/XXXX when I finally spoke with the collector to determine the reason for the call. XXXX XXXX, whom had already withheld the - {$190.00}, turned me over to this collection agency to collect a debt that was already withheld from the security deposit. Thus FCO is attempting to collect a debt already paid, please see the documents attached.
You will notice that the reason for the collection, pro-rated rent and " damage charges '' differ from the final notice sent by XXXX XXXX, which states " final water bill - {$57.00}, also attached. I feel that I'm being retaliated against by XXXX XXXX for my persistence in asking them to return my full security deposit as the claims are bogus.

Complaint: To whom it may concern, About two weeks ago, I saw in my credit report a record like this XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/2017 {$260.00} XXXX XXXX XXXX XXXX XXXX, MD XXXX ( XXXX ) XXXX I realized " XXXX XXXX XXXX '' was the apartment I moved out half year ago. But I never receive any notification about this payment. Not in the form or mail or phone call or email. I contact " XXXX XXXX XXXX '' immediately for this, it was a move-out fee. It was a reasonable charging and I emailed the check for payment immediately. But I do dispute the collection shouldn't be on my credit report for two reasons 1 ) " XXXX XXXX XXXX '' didn't notify me properly. And I didn't receive my acknowledgement for this payment. And they turn it to " XXXX XXXX XXXX XXXX '' without my knowledge.
2 ) " XXXX XXXX XXXX XXXX '' didn't notify me properly either. And I didn't receive any email or phone call. And when I try to dispute with them for this. They said it past the deadline I can dispute, since the account is opened on XX/XX/XXXX and this is XX/XX/XXXX. But how can I dispute a debt I didn't even know?
To summarize, " XXXX XXXX XXXX XXXX '' didn't notify me properly on this, and they never got my acknowledgement until around XX/XX/XXXX. From that time, I tried to dispute with them, but they said it can not be disputed since it passed the deadline. So my right of being notified of the existence of the debt and my right of dispute is not being respected.

Complaint: Fair Collection and Outsourcing does not have a signed contract to that states I agree to pay them. The Fair Debt Collection Practices Act and the Fair Credit Reporting Act clearly state this. In my past dealings with FCO, they were very non communicative, rude and dismissive when a consumer disputes an account with them. FCO will tell you can only dispute an account twice. Which is violation of the FCRA and the FDCPA. Reporting an noncollectable account with the Credit Bureaus as a current balance a violation of the FDCPA.
