Complaint: I have made several payments in addition to my regular monthly payments. I have never missed or been late for a payment and have actually paid ahead of the amortization schedule.
Each time I make an additional payment, even notating it as pay down on principle, the company, Dovenmuehle mortgage company, holds the payment in limbo until they receive what they deem to be a full payment. They do not credit the money to my account on the day they receive it, but instead wait until other payments come in that total up to or exceed a monthly payment total. For instance in XXXX I made two additional principle payments of XXXX and XXXX dollars. The last of these was made on XX/XX/XXXX. As of today it has never been credited to my account. I called them last Tuesday XX/XX/XXXX to ask why this was so. They said it is their policy to NOT credit anything until another full payment amount is received. I asked specifically that they credit the XXXX dollars to principle and do it as of the date they received the money ( XX/XX/XXXX ) they said they would have to clear that with a supervisor and it would take at least 5 days and they doubted they could back date the payment. This seems a violation of many laws and truth in lending practices.

Complaint: Sir/ Madam I am XXXX XXXX , had a mortgage with Dovenmuehle Mortgage Inc , loan no is XXXX. I refinanced my mortgage with another lender and closed Dovenmuehle 's mortgage on XX/XX/2019 as per their pay-off letter which is attached with this complaints.
My new lender paid {$500000.00} on XX/XX/2019 as per payoff letter for principal and interest on remaining days.
But after the closing, they over charged unethically against my escrow balance. These are the charges.
1. Mbs pool settlement charge as {$1000.00} on XX/XX/2019 ( It is not mentioned in payoff letter ) 2. Mip/pmi mortgage insurance as {$360.00} on XX/XX/2019 ( PMI for 2 months ).
They already paid one month PMI insurance on XX/XX/2019 as {$180.00}. Please see the attached loan activity statement.
They took unlawfully {$1400.00} from me, it is not an ethical and professional actions from Dovenmuehle Mortgage Inc to very good standing customer such as me.

Complaint: This complaint concerns Dovenmuehle Mortgage with sub-servicer CHFA-Colorado Housing and Finance Authority, the servicer of our XXXX XXXX mortgage loan which has an escrow account. Dovenmuehle Mortgage personnel refuse to issue us a full refund for windstorm insurance coverage they had purchased ( a forced lenders policy ) even though we provided proof of coverage BEFORE they purchased the forced lenders policy.
We moved to Florida and built a new home through a builder XXXX XXXX financed the construction loan and then converted it to a traditional mortgage once the house was built. When the house was completed in XX/XX/XXXX, we purchased our homeowner 's insurance through XXXX.
We purchased hazard and flood insurance ( the location of our lot did not require flood insurance, but we purchased it anyway since we prefer to be fully covered ). Being new to Florida, we assumed that the hazard policy was all-inclusive that windstorm coverage was part of the general hazard coverage.
In XX/XX/XXXX, XXXX notified us that we did not have windstorm coverage within our policy and a separate wind policy could be arranged through XXXX XXXX XXXX, a non-profit established by the Florida Legislature. They gave us instructions on how to request an inspector to come out and perform a wind inspection on the house, which was needed for the windstorm coverage.
On XX/XX/XXXX, we applied for windstorm coverage through XXXX XXXX XXXX submitting it with an effective date of XX/XX/XXXX ( XXXX would later tell us that a 30-day waiting period was required, thus the revised effective date of XX/XX/XXXX ).
We also requested the wind inspection.
On XX/XX/XXXX, we verified via our XXXX online account that windstorm coverage was recorded in our loan with XXXX XXXX as the lender. We understood it was common practice for the insurance company to also submit that information to the lender.
The inspector came out on XX/XX/XXXX, performed the wind inspection, and then processed the necessary inspection documents.
On XX/XX/XXXX, once we received confirmation that our windstorm policy was being written, we submitted the coverage information on ihaveinsurance.com ( we were told this site forwards the information to the lender ).
On XX/XX/XXXX, a XXXX insurance agent called us to process payment on the policy.
We paid {$990.00} for an annual policy that ran XX/XX/XXXX XX/XX/XXXX.
On XX/XX/XXXX, we emailed the proof of windstorm coverage to Dovenmuehle ( CHFA ) Mortgage servicer via the email address their personnel told me to use : XXXX We also submitted an online request to XXXX XXXX to verify they received the insurance information.
On XX/XX/XXXX, we received a mailed notification from XXXX XXXX that they received our inquiry and referred it to the appropriate are for review. This notification included this statement : We will make every effort to provide a response to your inquiry as promptly as possible. In any event, we will do within the time limit required by law.
On XX/XX/XXXX, we received notice that XXXX XXXX purchased a windstorm insurance policy on XX/XX/XXXX through XXXX XXXX XXXX XXXX for {$10000.00} with a coverage term of XX/XX/XXXX XX/XX/XXXX.
On XX/XX/XXXX, we emailed Dovenmuehle/XXXX to inform them they unnecessarily purchased another windstorm insurance policy on our home. We attached our insurance coverage information and informed them we had already submitted the coverage information to them earlier in the month.
On XX/XX/XXXX ( or a couple of days after ), we received from XXXX XXXX a mailed notification letter similar to the letter received on XX/XX/XXXX that they received our inquiry and referred it to the appropriate are for review. This notification also included the statement : We will make every effort to provide a response to your inquiry as promptly as possible. In any event, we will do within the time limit required by law.
We also called our servicer ( Dovenmuehle Mortgage/XXXX XXXX ) and they told us they would issue a refund but that it could take a few weeks to appear. Nothing was said to us at this time that a full refund would not be given.
On XX/XX/XXXX, we noticed the refund appeared in our online account but that they only refunded {$9500.00}. On the same day, we received in the mail a policy cancellation notice from XXXX XXXX XXXX XXXX that they cancelled the policy and refunded {$9500.00} due to duplicate coverage the cancellation effective date was XX/XX/XXXX.
They retained {$1100.00} for the policys effective term of XX/XX/XXXX to XX/XX/XXXX.
On XX/XX/XXXX, we called Dovenmuehle Mortgage/XXXX XXXX and asked why we did not receive the full refund. Both the initial person we spoke with at Dovenmuehle Mortgage and their supervisor said it was only partial because the policy had to be paid for the effective term of XX/XX/XXXX XX/XX/XXXX.
When we asked why they purchased the policy on XX/XX/XXXX when they had already received proof of coverage from us before that date, they said their records show our information was scanned into the system on XX/XX/XXXX.
When we asked why they purchased insurance on XX/XX/XXXX when they scanned our information into the system on XX/XX/XXXX, their response was that it takes time to process that information. Their automated system had not been updated with our information so an annual windstorm policy was purchased.
Despite my contention that a forced lenders policy should not have been purchased when we demonstrated due diligence in obtaining insurance ( not to mention our loan was in good standing ), we were told their system purchased the insurance automatically and that we were still responsible for paying for the term of the policy for the lapsed coverage.
We can not fathom how it is ethical, or even legal, to force a customer to pay an exorbitantly high cost XXXX {$1100.00} for 5 weeks coverage compared to our {$990.00} cost for a years worth of coverage ) when we did everything within our power to obtain windstorm insurance as soon as we were informed of the gap in coverage ESPECIALLY since we did obtain coverage and provided proof of that additional coverage BEFORE the forced lenders policy was purchased.

Complaint: The loan was paid off when the property was sold on XX/XX/2019. I logged onto Dovenmuehle 's website to disable automatic payments. When I did, I noticed that the balance was XXXX, and the system said my account wasn't eligible for online payments when clicking on automatic payments.
Because the system was smart enough to not let me adjust automatic payments on a XXXX balance account, and because it was at XXXX balance, I figured that they wouldn't withdrawal payment. I was wrong. On XX/XX/2019 Dovenmuehle withdrew XXXX from my bank account.
I called to complain, but they say it takes 2-3 weeks to get that refunded, and they will only mail a check. Of course, I'm between addresses, and close on my new house in a week, so it's causing me some serious problems.
They don't seem to care, they say my issue is escalated and that's it. Nothing I can do.

Complaint: I want you to know that I understand my financial obligations, and have an excellent repayment record. I requested to explore my loss mitigation options in XX/XX/XXXX to eliminate any financial penalties (late fees, credit worthiness) after suffering from an unfortunate and unforeseen life event leaving me with a $XXXX bill. I was assigned to XX/XX/XXXXTay who struggled to communicate the terms of the repayment plan and next steps. I sent a money order by completing instructions from XXXX and signed the repayment agreement. I continuously followed up via phone and email to check status and confirm that everything was properly in place. There were some lapses in communication but I was informed that while my contract and payment was received as agreed Dovenmuehle’s bank couldn’t process the payment and would resend it via traditional mail. I also was informed that money had been sent to me via XXXX XXXX which wasn’t correct. I called XX/XX/XXXX several times to understand how to quickly remedy this issue and to advise that I had not received my returned payment. Additionally I specifically inquired about how this would impact me financially (reporting and fees) and she stated it would not. If she had responded to questions differently (accurately) I would have never entered into this agreement. I emailed to ask how I could pay instantly as I had issues getting a refund for XXXX since it appeared to be processed however I never received a response. To remedy this manner as soon as possible please remove the late payment that was reported. I also do not trust the advisement received from my loss specialist (XX/XX/XXXX Tay) and believe that I deserve counseling from another rep to truly understand the terms of the agreement. I have canceled the repayment plan that I was in compliance with (&was told this would be the agreement I needed to honor for 12 months) in order to create a win-win for all involved. I truly believe that the measure does not reflect the accuracy of this situation, my creditworthiness and commitment to repaying my debts. To show my dedication for resolving this issue I provided full payment on XX/XX/2019 to cancel my utilization of the repayment plan. After this traumatic and deceptive experience I believe this company should better train their staff and remove this mark immediately

Complaint: Good morning, I had to increase my Insurance coverage, so I had an additional premium that was due outside of my yearly premium. Originally when I received the bill, I noticed it had the wrong Mortgagee clause still ( my loan was sold from XXXX XXXX to Dovenmuehle. ) I faxed the bill to Dovenmuehle and called on XX/XX/XXXX. They stated with the bill being due on the XXXX, it wasn't enough time to pay out of my escrow account ( which I understood. ) I called my agent and explained the clause was wrong and I was going to pay out of pocket. They updated my policy and with this update, they faxed the bill to Dovenmuehle and changed the due date to XX/XX/XXXX. I called Dovenmuehle back to explain that I was going to let the bill be paid out of escrow, since it was enough time. They stated they'd do this.
I called back on XX/XX/XXXX to check the status. At this point, the bill has been sent to the company 2-3 times by myself and my agent. The person I spoke with said she received the bill, she even told me the premium amount so I knew she had the bill in front of her. I confirmed that I wanted it paid out of escrows and she stated it would be paid.
I spoke to my Insurance agent on XXXX to see if they received the payment, they state they haven't.
Fast forward to today, XX/XX/XXXX- the bill is due. I call Dovenmuehle to check to ensure payment went out. The agent states that the bill was received but no one on their end had opened up an order to issue the payment on the account. I ask why, and he states the agent I spoke with on XX/XX/XXXX " messed up ''. I ask what can be done, but he states very little with the payment being due today. They can overnight, but it would still be late. I ask how this can happen when I specifically asked them to pay it and he keeps saying sorry but that it was Dovenmuehle 's fault. He explains premiums outside of the yearly payment aren't always paid, but I state, again, that I spoke to several people to ensure this payment is processed. I stated to the agent I spoke with today that I authorization this payment through my escrow agent. Two agents advised me on separate occasions that the payment will be made out of my escrows. According to the agent, I did everything correct by stating this payment was to be made. Dovenmuehle is at fault for not paying my premium like me ( the customer ) requested -- several times.
I am now in the situation to pay my premium out of pocket today due to the neglect of Dovenmuehle Mortgage. Mistakes happen, but this needs to be addressed. It needs to be corrected by the company because they are clearly and admittedly, at fault. My escrow account is set up to handle these payments so I don't need to budget for Insurance and taxes out of pocket.

Complaint: My mortgage has been serviced by Dovenmuehle since XXXX and I am unable to get cooperation with the company on settling two outstanding modification issues : Applying my mortgage payments from XXXX to my outstanding balance Sending my escrow refund in the amount of {$2600.00} UNAPPLIED MORTGAGE PAYMENTS I have patiently waited for my monthly mortgage payments from XXXX ( that were held in escrow ) to be applied to my current outstanding principal balance. To date none of the funds have been properly credited to my mortgage account. Attached is Dovenmuehle 's letter acknowledging the payments were received while my modification was being processed.
Just to recap my situation, Dovenmuehle purchased my loan from XXXX XXXX XXXX XXXX before it was fully modified in XX/XX/XXXX. I continued to pay my mortgage for over 18 months before the loan was modified. Dovenmuehle stated the funds were being held in an escrow account to be applied after the modification was completed. The modification has been completed for over a year and to date, the funds have not been applied to my account.
My modification was only carried out after I contacted my Senator Office and requested assistance. Senator XXXX XXXX office is the reason my loan was modified despite Dovenmuhle collecting my mortgage payment every month, this company refused to modify my loan which Dovenmuehle purchased from XXXX XXXX XXXX XXXX. Please see attached letter from Senator XXXX XXXX office On XX/XX/XXXX I followed up with Dovenmuehle and requested that my past monthly mortgage payments be applied to the principal balance ( which still has not occurred ) and that my escrow account be reviewed for an additional refund.
ESCROW REFUND Attached is the escrow analysis I received on XX/XX/XXXX which states that I will receive a refund in the amount of {$2600.00} within 30 days per the escrow statement instructions. I have not received my refund and have contacted Dovenmuehle 8 times. Each time I speak to a representative I received another excuse for not receiving my check. Please keep in mind this is an escrow refund from XXXX therefore Dovenmuehle has been withholding my escrow refund that rightfully belongs to me for over two years ( interest-free ).
Just to recap this situation, I have been trying to get my escrow corrected since XXXX. Attached is the letter dated XX/XX/XXXX from XXXX XXXX XXXX Bank confirming I have {$4500.00} refund in my escrow account ( see XXXX XXXX XXXX Document ). Upon receipt of the XXXX XXXX XXXX XXXX Statement I called and the XXXX XXXX XXXX and confirmed the refund was accurate and my check would be mailed in a couple of weeks ( which is also stated at the bottom of the attached document ). Shortly afterwards my loan was transferred to Dovenmuehle and I followed up with Dovenmuehle on the refund status. Despite my clear evidence and documentation that I was due additional escrow refund Dovenmuehle has withheld on {$2600.00} rightfully owed to me since XXXX. Only through my persistence have I been able to prove this.
My goal is to address and complete each bullet within the next 30 days. I am willing to provide any additional documentation and/or conversation needed to expedite this process. I have tried over the last 18 months to be flexible and ( while paying my mortgage every month ). Dovenmuehle is unable or unwilling to address these issues in a timely matter and I seek your assistance in getting this corrected.

Complaint: I was XXXX years old when I lost my job in XX/XX/XXXX. I applied for unemployment in DC in XX/XX/XXXX and received unemployment benefits until XX/XX/XXXX when my benefits were exhausted. I currently live in a town home at XXXX XXXX XXXX XXXX, XXXX, VA XXXX and have a mortgage thru Dovenmuehle ( loan XXXX ). It is a 15 year fixed that was initiated in XX/XX/XXXX and matures in XX/XX/XXXX. My property value is about {$460000.00}, and the outstanding balance on my loan is {$170000.00}. My monthly payment is {$2200.00}, which is a 15 year fixed at 2.875 %, of which over {$1400.00} is principle ( see attachment ).
Because I am unemployed ( and may remain unemployed for some time ), I have little to no money coming in. Therefore, on XX/XX/XXXX, I sought assistance thru Dovenmuehle 's Loss Mitigation Department and requested a loan modification where my loan could be streamed so that I do not have to pay so much principal every month at a time I am not receiving much money ( see attachement ).
My case was assigned to a XXXX XXXX at Dovenmuehle. However, instead of receiving a loan modification, I received in late XXXX via an overnight urgent delivery XXXX package from Dovenmuehle dated XX/XX/XXXX ( see attachment ) asking me to sign on an urgent basis ( i.e. Due XX/XX/XXXX) a 3 month forbearance agreement where I would not have to pay any mortgage payments for 3 months. This was the only Option Dovenmuehle presented me, as I was not offered any loan modification option. I immediately called Dovenmuehle, and I told them i ) this is not what I wanted or needed, ii ) that this was bad for me as I would be subjected to a balloon payment at the end of the 3 month forbearance period to make my loan current at a time I was not earning money. I was told by XXXX XXXX and XXXX XXXX at Dovenmuehle as well as XXXX at XX/XX/XXXX that they could not offer me a loan modification at this point because I failed the Imminent Default Test, but if I accepted the forbearance agreement, I would later be eligible for a loan modification as per XX/XX/XXXX rules. They explained that Forbearance would allow me to go into default without incurring any fees and penalties, so that I could later pass the Imminent Default Test and therefore later be able to recieve a loan modification. I was encouraged to accept the forbearance agreement ( Dovenmuehle 's only Option offered ) and then apply for one or more renewals of forbearance in additional 3 month blocks, after which I should then apply for a loan modification. They indicated that I would have to undergo a minimum of 6 months of forbearance, but could undergo 12 months maximum of forbearance by such renewals.
They also characterized my situation as " temporary '', which I took umbrage to as I felt that my unemployment is likely to be longer term.
Being suspicious of all of this, I called HUD. HUD urged me not to sign the forbearance argeement because in addition to damaging my my credit and FICO score, forbearance may not lead to a loan modification. In other words, HUD explained to me that even if I went thru 6 or 12 months on forbearance, Dovenmuehle could still refuse to offer me a loan modification if I at that time I do not have a sufficient income stream ( this again goes to Dovenmuehle characterizing my situation as temporary when it is likely to be longer term ). HUD also explained to me that Dovenmuehle could offer me a loan modification at any time, but it was not in their interest to do so as it incurred time, fuss and expense on their part.
At this point, I realized that I was esentially being set up for a trap whereby I would be lured into signing the forbearance agreement under the belief that a loan modification would follow, but after accruing 6 to 12 months of missed payments in forbearance, I would be forced to make a balloon payment of {$30000.00} to make the loan current after 12 months of forbearance because Dovenmuehle is likely to deny me a loan modification because I still did not have a sufficient income stream to modify my loan. In other words, I realized that I would be severely damaged by their forbearance offer.
On XX/XX/XXXX, I received a call from XXXX ( initials XXXX ) at Dovenmuehle. I again explained the situation to her, and she urged me to file an appeal. Consequently, on XX/XX/XXXX, I appealed the XX/XX/XXXX decision ( see attached ), and this appeal was denied on XX/XX/XXXX ( see decision attached ).
Since then, I complained to XXXX and XXXX, and since that, I received a lot of unusual behavior from Dovenmuehle, such as their Collections department calling me on XX/XX/XXXX saying I missed my XX/XX/XXXX payment when in fact I had paid them electronically on XX/XX/XXXX, etc.

Complaint: My monthly payments to Dovenmuehle ( loan XXXX ) is {$2200.00} and was due on XX/XX/2019. If I fail to pay by XX/XX/XXXX, I am subject to a {$91.00} late fee and possibly issues with my credability. I made an online payment from by checking account at XXXX XXXX XXXX bank for the {$2200.00} on XX/XX/2019. Since this is an electronic payment, Dovenmuehle should ( and usually does ) receive the payment by the next business day, which was XX/XX/XXXX. The full amount of {$2200.00} was deducted from my checking account XXXX at XXXX XXXX XXXX bank on XX/XX/2019 with an entry " BP-Dovenmuehle Mortg Conf # - XXXX '' See XXXX XXXX XXXX Statement attached ). However, on XX/XX/2019 and to my surprise and dismay, I got a call from XXXX at Dovenmuehle 's Collections Department saying I failed to make the XX/XX/XXXX payment and that I now owe them the {$91.00} for the late fee. I told XXXX that I paid Dovenmuehle on XX/XX/XXXX. She later confirmed this. I asked her to investigate why I was being called when I in fact made the payment. XXXX was unable to help.
Then, on XX/XX/XXXX, Dovenmuehle finally issed a statement ( see attached ) to reflect my XX/XX/XXXX payment ( this is usually done only a couple of days after I pay ) saying I made the XX/XX/XXXX payment on XX/XX/XXXX. No where does it say in the statement or elsewhere that my payment was timely.
I need a written statement from Dovenmuehle that my XX/XX/XXXX payment was timely and not subject to a late fee and was received well before the XX/XX/XXXX payment. I also want investigated whether this behavior on the part of Dovenmuehle is in any way retaliatory or connected with my recent application for loan modification to XXXX XXXX at Dovenmuehle due to me being unemployed and being the subject of another complaint I am making to Dovenmuehle. In other words, this instant unusual behavior seems to occur just after I applied for and then appealed and was denied a loan modification due to my long term unemployment, and my subsequent complaint to XXXX and XXXX. I would like to know if they are bullying me as a result and if I shluld expect more of this kind of behavior from Dovenmuehle in the future.
