Complaint: Our complaint is about the incorrect and misinformation provided by Ditech representatives when we were trying to pay on our loan and ultimately bring it up to date. The Ditech Representatives recommend we apply for loan mitigation which took months and now the mitigation was denied. Now we owe {$43000.00} and our home is about to be foreclosed. We could have paid the overdue amount in XX/XX/XXXX but we followed the recommendation of the Ditech Rep. After being in great standing with our loan for over 15 years, we had some misfortunes caused by loss of employment, medical expenses, and helping elderly parents with their finances. We had fallen behind in our payments but where in constant contact with Ditech on what we could pay. We were trying to make a payment every month to catch up. The first occurrence of incorrect information was made by XXXX at number XXXX ext. XXXX in XX/XX/XXXX. She informed us that we needed al least a minimum payment of {$3600.00} by end of XX/XX/XXXX to avoid going into foreclosure. We provided the payment and made it on XX/XX/XXXX. We were told later the payment had been denied and had not been credited toward our account. We contacted XXXX asking her why the payment had been denied. She stated that she had made a mistake and due to the type of loan that we had, we needed at least half what we owed to avoid foreclosure. She said this was her mistake and she would try to find out what happened to our payment. At this time our goal was to come up with the remainder of the money to avoid going into foreclosure. The check was eventually returned to us. By XX/XX/XXXX we had the money ( {$23000.00} ) to make our loan current because they would not accept partial payments. We contacted Ditech for next steps. This is the next occurrence of misinformation and incorrect recommendations. This time we spoke to Senior Account Representative XXXX at XXXX ext XXXX. He strongly recommended that rather than tying our money up that we do a loss mitigation assistance process. He specially stated that we refinance the loan and add the current amount due to the end of the loan since we only had 13 years remaining on the loan. We asked should we just pay the overdue amount and make the loan current. He stated he had been a representative for over 15 years and this was a text book solution for our situation. At his recommendation we went through the loss mitigation assistance process and ask for a loan modification. We were found ineligible because even though we provided a signed contact of employment we were told they could not use projected future income. The Ditech representative we spoke to said we needed at least four weeks of pay stubs and the case would be reopened after the pay stubs where received. We provided the requested information ( pay stubs ) that verified a gross income of {$3600.00} per week and {$15000.00} a month on XX/XX/XXXX. Our combined verified monthly income totaled {$19000.00}. After we submitted the information, we contacted Ditech to ask the status of the mitigation. We were told the case had been closed and could not be reopened. We pushed back that we were told that once we sent in the verified income the case would be reopened. But now they were telling us we had to start the process all over again because 30 days had passed since the process was closed. We gave them the date when the letter was received and when we spoke to Ditech representative which was XX/XX/XXXX. It had not been 30 days. The 30 day time frame was XX/XX/XXXX. The Ditech representative said they did not have the XX/XX/XXXX letter in their system. They only had XX/XX/XXXX letter in their system. We told them we would send them the XX/XX/XXXX letter. The representative said that would not work because only what was in their system mattered. Our only course of action was to submitted the entire package again. We resent the entire package ( 96 pages ) on XX/XX/XXXX. On XX/XX/XXXX we received a letter stating we were ineligible for FHA standard modification due to Your front-end debt to income ratio is in excess of 40 %. We called XXXX XXXX to find out what is going on. She has not returned our call. This entire process could have been avoided if we had just paid the {$23000.00} amount in XX/XX/XXXX and not followed the recommendation of the Ditech Representative. It is very difficult to reach our Account representative XXXX XXXX at ext. XXXX and each time we called her we were routed to a different account rep. We had to explain our situation each time to the different representatives. This resulted in confusion and misinformation. The communication and information provided Ditech Representatives was misleading and wrong which resulted in us being in foreclosure.

Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX CELL XXXX HOME XXXX E-MAIL XXXX To Whom it may Concern We are having difficulty getting funds form our mortgage company that our insurance company paid to us for damages to our home from hurricane Irma we have to this point sent them XXXX roughly and we have been sent XXXX to start the repairs which is there set amount to start the project.this does not meet our needs for the project to start. this process took almost a month. Every document I sent them including the checks were questioned in one way or another they have so many rules and policies set in place it is impossible to collect your money in a timely fashion and repair the damage to our home. I did not receive enough money to repair the home to our standards with contractors, so I will be doing the repairs myself which I am fully experienced to do .And I have explained to them many times that first and foremost we have no heat or a/c in the home and we are currently seeing temps in the 40s and that putting the roof on is done in a sequence with all the needed materials here at one time, we had damage to our siding and soffits and the fascia material it all needs to be replaced to do the repairs so they will last.We are now experiencing ants and other pests in a home were we never had this problem along with mold and mildew in windows and closed areas from the lack of ventalation.They are basicly saying they dont want me to spend the money on something else such as a sofa or new carpets, this is not possible as first off they make the checks payable to the various suppliers and want an inspection when the repairs are complete as does our insurance company.the lender in question is below DITECH FINANCIAL LLC XXXX XXXX XXXX XXXX XXXX SD XXXX XXXX XXXX OUR ACCT NUMBER IS XXXX Time line for the current issue XX/XX/XXXX overnighted 2 checks signed over to ditech XX/XX/XXXX ditech stated endorsement from other lender on check was no good had to prove who signed it even thought it was stamped by the lender when they signed itXX/XX/XXXX sent a check for XXXX to start work 30 % XX/XX/XXXX I requested info on checks and they said my estimates were all wrong and needed work such as store copy of the estimate e-mailed quotes would not work for them and had to have some ones name on it from the supplier they tell you different rules every time you ask for something XX/XX/XXXX sent in store copies with peoples names and contact info 4 total had to take time off from work to get them. XX/XX/XXXX I called and asked if there was any updates person on phone was rude and told me I needed to give them progress reports I then advised one more time that I had no heat and cold weather was coming to us and was told that it was being processed and could take 10-15 days to process I have not heard from them since and have sent several e-mails trying to explain our issues.each e-mail say it takes 3-5 days to respond??? I feel like I am getting no were with them and dont want this to drag out for no reason much less the risk of our safety/health and further damage to our home from not have proper roofing or siding in place. We are in real need of our HVAC system being replaced. Thank you XXXX XXXX

Complaint: Ditech has held my escrow ( personal property taxes and added interest for XX/XX/XXXX and XX/XX/XXXX, now I receive a letter XX/XX/XXXX stating that I need to pay {$3700.00} or our mortgage will go up {$480.00} and if we pay the {$3700.00} payment will still go up {$190.00}. I think that when Ditech pay our personal property taxes and insurance, they need to add it to escrow at that time and not hold it and let it add up and make our escrow short. Now we will have a big payment that we can not afford. When I called XXXX, the lady I spoke with could careless. I do n't have {$3700.00} and I ca n't afford to pay {$1800.00} either. They need to give us more options.

Complaint: I called Ditech Insurance Company about my account and over due payments on XXXX XXXX 2017, to get my account up to date. I called and spoke with a Rep regarding options I may have. my account has been mis-management by this company on several occasions and this time has taken the cake. I told the Rep that I have approximately {$2000.00} in an account labeled unapplied funds. I told the the Rep that I would like these funds back and I would put it together and make up the difference so that it will be a full payment for the month. She said she would put in a request and that I should the funds mailed to me in 3-4 days but that because of the holiday 's it might take a little longer. She also said she does not know if they would honor sending the money back to me because my account is past due. I told her that that 's my money that Ditech is gaining interest from that money in the account and it not even being applied but every month I 'm assessed a penalty which has been going on for 4 years. I told her that I will take legal action regarding this holding of my money and not returning it to me and illegally gaining interest and not applying it to my account. Plus, I am assessed lates fees. If there 's any company that should be investigated it should be this company for the illegally practices they do.

Complaint: OnXX/XX/XXXX, I faxed my mortgage company seeking clarification on fees I was charged. They appeared on myXX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX andXX/XX/XXXX, statements. Fax and statements attached for your review. After two months they send me a payment history, also attached for your review. The history show the charges, which I already show on my statement, however FAIL to detail/clarify, how exactly I incurred those fees. Or how is it that Ditech had the right to charge me those fees. Consequently, NO response was provided, they simply provided the information I already had, in a different format. Ditech has done this in the past. They sneak in fees here and there and hope you do not question them. I highly doubt I am the only person they do that to. I bet they have STOLEN Millions of dollars from customers.

Complaint: Ditech Financial LLC F/K/A XXXX XXXX XXXX XXXX XXXXooking to start foreclosure action against me when they inaccurately changed my mortgage payment and interest rate. Payments they were requesting for months that payments were already made to them. Also, I was n't sure who to legally make payments to because my loan was refinance with XXXX XXXX XXXX. This loan was reassigned so many times with different lenders. Also, I noticed constantly on XXXX, information is being inaccurately reported by different servicing company. My understanding is that XXXXXXXX XXXX XXXXXXXX, filed bankruptcy and I am not sure what 's going on with my note and which bank legally owns this note. I am requesting for this company to be investigated in regards to their claim regarding my mortgage note if they legally own it. They send me incorrect information on my mortgage payment and I am not sure what 's going on if they legally own this note.

Complaint: During the process of selling my home in XXXX, FL the title company, XXXX XXXX XXXX requested a loan payoff amount as is industry norm. XXXX XXXX XXXX received the payoff amount by fax on XX/XX/XXXX from the lender, Ditech, which showed the payoff of XXXX listed on the statment as valid throughXX/XX/XXXX. XXXX XXXX XXXX paid this amount to Ditech on XX/XX/XXXXwith electronic IMAD # XXXX. I received a letter from Ditech approximatelyXX/XX/XXXX that stated that my payment was late. I contacted Ditech and they informed me that they had mis-applied the monies and that they in fact had a surplus in the account that would re-disbursed to me no later thanXX/XX/XXXX. On XX/XX/XXXX I received a letter from Ditech stating that my loan was still open and that I owed in excess of {$800.00} that was dated XX/XX/XXXX. Upon calling Ditech I was told that they paid the taxes on XX/XX/XXXX therefore, the payoff letter was nullified. Ditech charged me in excess of {$1000.00} dollars in interest on the loan during this time. I then paid {$1000.00} from my personal account onXX/XX/XXXXto satisfy any possible outstanding balances even though there was a surplus of more than {$570.00} in my escrow account. Pursuant to federal law, being that the taxes for year to date had not been paid by anyone on XX/XX/XXXX, upon closing, XXXX XXXX XXXX paid the taxes on the property and they were received by XXXX County Tax Collector on XX/XX/XXXXwith a check that cleared that same day. The reference number for the check is XXXX in the amount of {$1200.00}. XXXX County Tax Collectors office informed me by phone on XX/XX/XXXX that they did not receive a check from Ditech for the taxes untilXX/XX/XXXXand the envelope the payment arrived in was post markedXX/XX/XXXXThis does not match the payment date of XX/XX/XXXXas stated by Ditech. The rejection letter for the payment and check were returned to Ditech on XX/XX/XXXXby XXXX County Tax Collector as the account had already been paid by XXXX XXXX XXXX on XX/XX/XXXX XXXX County Tax Collectors Office can be reached at XXXX option 2.I have all documents referenced and those that show I was continued to have interest charged on my account in excess of {$1000.00} even with the exacting dollar amounts listed as pay off delivered within one day of the payoff letter being faxed to XXXX XXXX XXXX. I have spoken to 5 or 6 different employees and each one has " no idea why all this happened '' but they " apologize and will do what they can to help '' which to date has been nothing. These people need to be held accountable for their ILLEGAL and UN-ETHICAL practices. Again, Ditech has not provided truths in this manner and this falls under predatory and illegal practices. Additionally, they have to date REFUSED to put any of the conversations over the phone in writing with me and they have REFUSED to send me a statement of my account with full payment history. They have preyed on me as member of the US Military and I am certain they have done the same to others.

Complaint: My mother and father owned their home for 37 years in XXXX they took out a loan on there home with green tree XXXX company. My father XXXX XXXX in XXXX. My mother XXXX XXXX in XXXX. I then went to court for a quick claim deed to the property. I was granted the deed at My exspence. I Informed greentree of all changed being made and ask them what I could do to take over the mortgage and was told simply pay the payments. I turned in my insurance information that proved i was the name on the insurance not my parents and both XXXX XXXX XXXX as well as all the court documents promptly. They excepted the paper work but still did n't let me take over the laon. A year later they switched from green tree to ditech. That 's were my troubles bega n. They refused my insurance. I had to dispute them in addition my insurance agency has to make contact with them to dispute there action since I had the quick claim deed. After that was settled i was told to only make payments threw there speedway method as the only way to avoid late fees. They would hold my payment as a partial payment and not apply it to my account causing me late fee s after I had already payed for there speedway method. My payments would be applied to other things than my account causing me to have to send more money to complete the partial payment they had takin money out of. I would do one time payment options and Ditech would set up unauthorized payments without my knowledge this action caused my bank account to overdraft XXXX dollars and be closed in XXXX XXXX. I would send them my payment and receive my confirmation number to later find out they did n't take the money out of my account and that caused my account to default my loan. I sent 3x the amount i would have payed of they would not have refused my payment in the first place. My phone records prove they call me 10 x a or more a day from XXXX in the morning till XXXX at night. The line will be dead when I answer it. I have contacted them multiple times in hopes of help saving my home. They tell me to pay up the full mortgage amount or get out. I am currently awaiting my forcloser court date. In XX/XX/XXXX i found out Ditec h was failing to pay property taxes on my property That escrowed in my mortgage i was two years four instalment behind. They did not want to pay it but had no choice or the state was going to take possesion, I payed Ditech and they failed once again on there end. I have tried to refinance the loan and no agency will help me because it is a fema loan. Please help me save my family home. This situation caused because of Ditechs fault and negligence. My parents XXXX in this house.

Complaint: I called XXXX XXXX for a mortgage payoff for the property at XXXX XXXX XXXX, XXXX, NH, LOAN NUMBER XXXX. I was very firmly told to make the XXXX payment because Ditech was going to pay the real estate taxes. I told them I would wire them funds on XXXX XXXX XXXX. Their representative demanded I make the XXXX payment. It is XXXX XXXX XXXX, I do not have my escrow proceeds of {$1200.00} and I do not have my XXXX mortgage payment of {$1400.00}. XXXX XXXX did NOT pay my real estate taxes to the town of XXXX, NH. Ditech owes me {$2700.00}. I have spoken with XXXX XXXX on XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, and today, XXXX XXXX XXXX. XXXX XXXX maintains the United States Postal Service lost the two checks. I asked them to wire the funds and volunteered to pay the wire fee. Today XXXX XXXXXXXX said they could not wire me my money, and that they sent replacement checks on XXXX XXXX XXXX. I wired them the payoff funds per their request on XXXX XXXX XXXX. I want my money returned to me immediately.
