Complaint: In XX/XX/XXXX, after ten years paying XXXX XXXX account # XXXX, XXXX XXXX sold my mortgage loan services to Green Tree. I pay my mortgages by check mailed from XXXX XXXX 's main XXXX XXXX on XXXX XXXX in XXXX XXXX on the XX/XX/XXXX. The first seven XX/XX/XXXX payments went to GreenTree account # XXXX. The last five XX/XX/XXXX payments went to Ditech account # XXXX. GreenTree 's XX/XX/XXXX updated statement represented a 'principal balance ' of {$47000.00}. I made all $ 2000 monthly payments since XX/XX/XXXX in time through XX/XX/XXXX. Accordingly, Ditech 's XX/XX/XXXX 's statement showed a 'principal balance ' of just over {$24000.00}. XX/XX/XXXX statement 's declining 'principal balance ' reflected just over {$22000.00}. I appeal to CFPB here because Ditech 's subsequent three XX/XX/XXXX monthly statements for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX reflected the same 'principal balance ' amount of just over {$22000.00}. Furthermore, Ditech 's XX/XX/XXXX counts my XX/XX/XXXX payment in a " Total Paid Year to Date '' amount of exactly {$24000.00} or 12 times {$2000.00}. My primary appeal to CFPB believes I have paid off the mortgage for XXXX XXXX XXXX XXXX, XXXX XXXX, although Ditech disagrees.
My secondary CFPB appeal here questions first GreenTree 's and now Ditech 's increasing, instead of decreasing, monthly statements ' 'amount due ' amounts. XXXX XXXX 's monthly 'amount due ' amounts annually decreased from $ XXXX in XX/XX/XXXX to $ XXXX in XX/XX/XXXX when GreenTree became my mortgage service provider, decreasing because I always paid {$2000.00} each month on a fixed rate mortgage pegged at 4.875 %. In less than four years GreenTree and Ditech increased the monthly 'amount due ' amount to {$1900.00} due by JXX/XX/XXXX. In XX/XX/XXXX, the year GreenTree became my mortgage service provider, Vermont 's attorney general had GreenTree restore Vermont citizens ' money paid to GreenTree for GreenTree 's fraudulent mortgage services. XXXX 's first Attorney General, XXXX XXXX, first won election in XX/XX/XXXX. GreenTree 's Vermont legal outcome, GreenTree and Ditech 's annually increasing 'amount due ' amounts, my own XX/XX/XXXX $ 22,000+ 'principal balance ', and XX/XX/XXXX statement 's {$24000.00} 'total paid year to date ' amount, all let me wonder if I my mortgage payoff completion passed with XX/XX/XXXX 's pay receipt. If so then Ditech owes me at least {$2000.00} instead of me owing Ditech {$6900.00} more.
This CFPB appeal should also inform Ditech of XX/XX/XXXX payment 's possible late arrival if at all. My faith in transparency urges CFPB 's publishing with account numbers and the aforementioned DC address.

Complaint: My mortgage company Ditech has denied me access to government homeowner assistance programs that could help me save my home and have scheduled a foreclosure sale date for XXXX XXXX, XXXX. I started a new job as a XXXX XXXX with the state of New Jersey a year ago and have been trying to get Ditech to consider me for homeowner assistance options due to a prior delinquency. I was told by their agent over the phone that I qualified. Then I sent in my paperwork and it is repeatedly lost or misplaced and I am transferred from department to department and the assigned account manager keeps getting changed. It has been close to a year and Ditech has failed to actually conduct a review of my current and correct financial information. Instead they have scheduled a foreclosure sale date even though they did not offer me mediation as required by the state of New Jersey. It is obvious that Ditech believes the rules do not apply to them.
I proudly served in the XXXX XXXX for 21 years and have owned my home in XXXX for 20 years. Once out of the military I worked as a XXXX XXXX XXXX for several years. My hours were cut and I was struggling financially and applied for and was approved for a loan modification. I began making the trial payments on the modification and then got laid off. I scrambled to make my payments but ended up defaulting on the modification. I then went through a rough period where I could not find full time workI collected XXXX and worked part time for XXXX XXXX and I fell further behind on my mortgage. About one year ago I was hired by the state of New Jersey as a XXXX XXXX. I began reaching out to Ditech right after I started, because I was back in a position where I could afford a fair and reasonable mortgage payment. I contacted their office to try and get a review opened of my financial information so that I can fix the delinquent payments, but have been met by obstacles and roadblocks. I was initially told that based on my financial information that I qualified for a modification but then I would send in the paperwork and Ditech would go dark. As mentioned I have been given the runaround by their agents, who transfer me from department to department, lose my paperwork and they constantly reassign account managers. I have never been able to get reviewed.
I occupy my home with my wife and son and grandson. I fell on hard times due to job loss but have gotten everything back on track and just need Ditech to work with me so that I can save my home. I dont know what I would do if I lost my home. I am not able to reinstate the loan, I need Ditech to stop this sale date and work with me towards a solution.

Complaint: On XX/XX/XXXX an attorney representing Ditech Finncial LLC., and I reached a signed loan modification agreement. Subsequently, Ditech mailed out modification paperwork for me to sign which was incoorect. The agreed upon principle balance amount was incorrect. The agreement was to have the principle balance of the modification to be {$210000.00}. However, when the paperwork was sent out the principle balance was {$220000.00}.
On XX/XX/XXXX I called into Ditech and spoke to XXXX at ext # XXXX and informed her of this discrepancy. XXXX acknowledged the mistake and informed me she would request a corrected loan paperwork package be mailed out. However, when the second set of papers were sent out, they were also incorrect ; Still showing the higher than agreed upon balance of {$220000.00}.
I have since sent Ditech two written qualified requests, asking for this matter to be corrected but Ditech still has not conformed.
I also asked for the new modified loan papers to only include my name only ( and not my ex wife ) as I have a recorded document with my county ( quit claim deed ) but, again this request also was not complied with by Ditech.
Finally, in conclusion, Ditech also has illegally kept more than {$12000.00} in escrow overage for more than 3 years. I have sent written requests, asking for the excess overage to be refunded. Ditech has not returned these funds either. It is my opinion Ditech has not acted in good faith on many counts in their dealings with me on this mortgage account. I am including copies of all documentation. Please help me convince Ditech Financial LLC. to act in good faith and honestly to correct my account, without using their predatory practices in the future.

Complaint: I received a certified letter dated XXXX/XXXX/XXXX asking us to {$3200.00} by XXXX/XXXX/XXXX. I phoned Ditech because the amount showing du online was a different amount. When I phoned in spoke with a representative named XXXX that informed me to disregard the letter and pay the amount showing due on line for I believe {$2200.00}. I paid the amount due on line. and discarded the letter as advised. He states that by paying this amount would catch my loan up and everything would be fine. I then received a letter dated XXXX/XXXX/XXXX stating that I did not pay the full {$32000.00} by the due date and necessary action would be taken. I received this letter on Saturday Saturday XXXX XXXX. First thing Monday morning I phone ditech to inform them that I received this letter and am not sure because I paid the amount advised by ditech. The representative that I spoke with fist was XXXX XXXX Collector Id XXXX. I read the letter to her that I received on XXXX XXXX, XXXX and she states to disregard that letter. My account is fine and is not going to be forclosed upon. I wanted to make sure so I phone back a second time an read the letter to another Ditech representative and she stated the same. to please disregard that letter. It was automatically geterated from their system and that I should discard it. My loan is fine and is not going into forclosure. I am writing the complaint mainly to document the events that happended.

Complaint: I " inherited '' them as my servicer when they purchased the company that held my loan. Green tree and now ditech bought forced insurance on my property, at double the going rate. I have a Co-Op which means the building has its own insurance. After numerous complaints and hiring a attorney, ditech conceded that they made a mistake. Their lawyers admitted that they were wrong and ditech sent me a letter admitting their error. This is after months of them threatening to foreclose my home and ruining my credit rating. Then ditech sent me a bill for an escrow fund which I did n't understand but paid it for the amount of {$4000.00}. I then realized that they use this escrow account to PAY for the forced insurance which they ADMITTED it was incorrect. I telephoned them about this and after speaking with several people they stated that they will " look into it. '' And when you ask them, repeatedly, and nicely as a customer for them to fix their errors they continue to gameplay. Furthermore, they continue to not cashed my past mortgage payments then they add late fees or worse send a foreclosure letter. I 'm also attaching a letter emailed to them.

Complaint: Ditech sold my mortgage to XXXX as of XXXX XXXX. They told me that all payments go to XXXX, now they have put on my credit that I still owe them a payment of XXXX for XXXX. XXXX XXXX, XXXX I sent XXXX XXXX for XXXX, XXXX and XXXX payments. Ditech sent XXXX XXXX to my account for overpayment. Now Ditech says I owe them XXXX payment and it shows up on my credit report that I am a month behind. I called Ditech and they are insisting that I make the payment to take this off my credit report, XXXX says that I am up to date on my payments. Attached are my payments and dates for both companies, look carefully at Ditech XXXX XXXX, XXXX the interest for that month is twice what it is suppose to be for a total of XXXX, when I questioned they told me that was what I owed. But I paid XXXX and they put payment of XXXX, try to figure this one out. I would like to have this cleared and my credit cleared up ... ... .notice that I paid more then the required payment.

Complaint: mobile home contract ended XX/XX/XXXX after paying 20yrs. now Ditech greentree states after contract ended, i still owe 8 thousand some dollars. all monies have been paid every month even after bankruptcy in XX/XX/XXXX and had been paying my original amount of XXXX and they came back and took me to court saying i had not made my payments of XXXX made me pay an additional XXXX dollars to keep my home on top of monies paid monthly. some months they had never even sent statements and monthly payment was paid.the only way more money can be owed is if my monthly payment was manipulated into complete interest instead of applied to the principal.. i have tried talking to them in the past and i get treated like an XXXX. also i have been divorced from my x wife that i bought the mobile home with for many years. have sent them my divorce papers many times over the years. since XX/XX/XXXX they have been sending my monthly statements in my x wifes name. ditech greentree does what they want when they want with no altenative for the consumer that uses their service. they recently sent a statement of default cure. i actually have been paying monthly since my contract ended just so i dont lose my home, now they want 5000+ dollars in 20 days or they are taking it. i can pay this off when i get my income return with my current wife but we feel that we shouldnt have too because our contract ended. x wife is XXXX, XXXX XX/XX/XXXX in XXXX texas. can not obtain XXXX certificate.

XXXX XXXX, XXXX : Received correspondence letter from Ditech Financial LLC re : " missed payment '' in the amount of {$1500.00} which was due XXXX/XXXX/XXXX.
XXXX XXXX, XXXX : Phone call to Ditech Financial LLC to discuss " missed payment ''. The customer service agent " XXXX '' was unable to explain why correspondence was sent. When asked to confirm receipt of XXXX XXXX payment of {$1600.00}, " XXXX '' informed me that my payment had been " reversed '' on XXXX XXXX, XXXX. I advised " XXXX '' that this payment was not " reversed '' back into my bank account. At this point " XXXX '' stated she would be forwarding my inquiry to her supervisor " XXXX ID # XXXX '' for researching and I will be contacted within 10 business days for follow up. I attempted to reach ANYONE at Ditech phone center at XXXX and XXXX and received automated message at BOTH numbers " experiencing technical difficulties and can not assist ''. I was unable to reach anyone by phone despite multiple attempts throughout the day.
XXXX XXXX, XXXX TO XXXX XXXX, XXXX : Due to the fact that I could no longer reach ANYONE at Ditech Financial LLC ( previous servicer ) I attempted to resolve this issue with current servicer XXXX XXXX XXXX XXXX. Dozens of phone calls to various customer service representatives who could never give me a straight answer, emailing of documents per their request, more follow up phone calls, tickets being opened then closed then re-opened due to what can only be described as inconsistencies with their policies and incompetent staff. At the end of these most agonizing three months of dealing with this mess, NOTHING is resolved. My XXXX XXXX, XXXX payment continues to be missing and my account is now being assessed a late fee as of XXXX XXXX, XXXX.
In reality what has happened here is theft. In the real world one is punished for stealing but apparently in the mortgage lending world it is acceptable practice!
