Complaint: Ditech Mortgage - I called on these dates : XXXX/XXXX/XXXX XXXX XXXX CST spoke to XXXX XXXX XXXX in AZ about Loss Mitigation Group letter sent XXXX/XXXX/XXXX ; said they needed more documents to complete application. I uploaded requested documents through the website which clearly showed income and GIFTS and other deposits in my checking for the entire year. XXXX/XXXX/XXXX Called XXXX, he said they used $ XXXX monthly income to determine my loan modification request. I told him that was gift money and unemployment which is not applicable as my income. XXXX/XXXX/XXXX XXXX XXXX CST I called XXXX XXXX at XXXX XXXX at XXXX and left a message that my income was incorrect and I was uploading document to the website. Several pdfs uploaded ONLINE MESSAGE XXXX/XXXX/XXXX sent a message thru online message center for Ditech also : " I will be uploading Loan Modification Appeal documents due to the information was incorrect that was used to determine my eligibility. Please have someone contact me regarding this matter. Fri XXXX/XXXX/XXXX XXXX XXXX CST I received an email to download an Loan Modification Appeal resolution document which again denied my request using INCORRECT Income amounts and the letter said my appeal was denied due to I made too much money. Tuesday XXXX called approx XXXX CST Called Ditech and got XXXX XXXX she immediately put me on hold ; Asked for XXXX official representative at XXXX - She put me on hold and then came back and said he is not available. I asked for manager level - she said she had to verify information for security purposes ; Gave her my account #, property address, last 4 # of social, I asked to speak to manager- she said she was not available and would have to call me back. I said never mind and hung up. immediately following phone call, I tried to send an online letter while logged in to my account and after composing and hitting send ; it said Error could not send. Tue XXXX/XXXX/XXXX XXXX XXXX -- I sent email thru my personal email and automated response said could be XXXX days before someone contacted me, I logged in again online and sent the same letter. Tue XXXX/XXXX/XXXX XXXX XXXX Called second time XXXX put in extension for XXXX x XXXX went to voicemail - said mailbox is full ; Tried another extension XXXX XXXX XXXX XXXX - was not available =left my name and number & said I want to make a payment Each month they have sent correspondence that says I have a different account rep. and I try to connect - call - leave a message and do not get any call back. For the Loan Modification request and appeal, I emailed and uploaded online two separate documents that showed my entire income for the entire YEAR, as stated in my Letter of XXXX XXXX, XXXX : " My income and ONLY MY INCOME, is only {$2600.00} thru XXXX XXXX, which averages to {$260.00} per month for the past ten months. I have only had part-time income through XXXX or misc part-time, short term employment. ''

Complaint: I recently was reviewing my credit report and have realized that since my bankruptcy was finalized in XXXX of 2011, my monthly mortgage payments are not reported on my credit report. I have been on time with every monthly payment but none of the payment are represented on my credit reports, which has dramatically effected my credit score. I have contact my mortgage company in regards to all my payments not showing up on my credit report and they have reported there is nothing that can be done on their part to fix this issue. Since, 2011 my mortgage company has changed ownership several times which I 'm sure has something to do with this issue. Since, mortgage payments have the largest effect on your credit report, this makes it extremely difficult to repair my credit score. Thanks for your help!

Complaint: At first, it would seemed that the respondent collection agency, Ditech Financial LLC ( Ditech ), was consistent in saying that the Substitution of Trustee and Full Reconveyance executed by XXXX XXXX, in the amount of {$75000.00}, recorded by the XXXX XXXX County Recorders Office on XXXX XXXX, XXXX, is totally different from the loan of {$87000.00} that Ditech took-over from another collection agency, Green Tree Servicing LLC ( Green Tree ), on XXXX XXXX, XXXX. However, based on Green Trees letter to the undersigned dated XXXX XXXX, XXXX, which Ditech provided me, it clearly stated that Green Tree took-over my second loan mortgage from XXXX XXXX XXXX ( XXXX XXXX ) only last XXXX XXXX, XXXX and not on XXXX XXXX, XXXX as claimed. Therefore, despite all of these inconsistencies, the fact still remains that my second loan mortgage was originally {$75000.00}, but went up to {$87000.00} because of high interest rates and several add-ons, etc. In other words, both amounts pertains to only one loan which is actually my second loan mortgage which originated from XXXX XXXX. The contention of Ditech that I requested their assistance in the past with regards to my second loan mortgage is also true. This was because I was not sure whether my second loan mortgage was included in the approval of my HAMP Loan Modification, although I made it clear to HAMP at the onset of my application that I want this to be included so I will pay only one mortgage payment every month. I was told that this is basically the objective of the HAMP Modification Program wherein all your mortgages are lumpsum into one, to make it more affordable for homeowners who are financially in distress. I tried confirming this with Green Tree and later with Ditech, but both denied that they were paid off by my HAMP Loan Modification and neither do they know whether XXXX was actually paid-off. It was only on XXXX XXXX, XXXX when I contacted the XXXX XXXX County Recorders Office that I found-out that there was indeed a Substitution of Trustee and Full Reconveyance executed by XXXX XXXX, that was recorded on XXXX XXXX, XXXX. Upon inquiry, I was told that it was actually conveyed back to its previous Owner, XXXX XXXX XXXX. Apparently, what happened here was that my first and second loan mortgages were bundled together and were actually included in the HAMP Loan Modification that was approved. This was the reason why XXXX XXXX had to execute and record such a legal document from the XXXX XXXX County Recorders Office. The only problem here was that I was never given a copy by XXXX XXXX about this Reconveyance which explains why I was kept in the dark all these years, despite the fact that it clearly states on top of the said document thatAfter Recording Mail To : XXXX XXXX As to why I was never given a copy nor was I never informed about this Reconveyance by XXXX XXXX, AND why was this second loan mortgage in question passed on to Green Tree and later to Ditech for collection, despite the fact that this was already included in my HAMP Loan Modification, I have no clue at all. All I know is that the above facts are the actual sequence of events that transpired, based on their actual date of transactions. The other interesting fact to note here, which we also have to ask Ditech Financial LLC, is how come in my credit report dated XXXX XXXX, XXXX, a copy of which is hereto attached, it clearly states there that my second loan mortgage was actually : Account charged off ; {$86000.00} written off ; {$86000.00} past due as of XXXX XXXX And yet as of this writing, Ditech still wants to collect the same amount from me? Does this mean that Ditech had already reported this amount of {$86000.00} to the Internal Revenue Service ( IRS ) in their Income Tax Return and still wants to collect the same amount from me? Based on these compelling facts that I have presented here, I am requesting the CFPB to investigate this matter to the fullest with Ditech until we have finally resolved this case to our mutual satisfaction.

Complaint: My mortgage company paid my property taxes and my home owners insurance even though I do not have an escrow account through them. Meanwhile i paid my property taxes and home owners insurance too. Now my mortgage company will not accept my mortgage payments unless I pay them back for the taxes and home owners insurance. I have not received a refund for any overpayment from taxes. I am not nor have I ever been late on my property taxes. This amounts to {$4900.00} and if I do n't pay this amount I will be in default and may lose my home. I have called and discussed this with customer service who admit they do n't understand how this happened. They told me to go ahead and make my regular payments and if and when I receive refund for taxes to send it to them. They then transfer me to payments who will not accept my payments for anything less than {$4900.00}.

Complaint: We received our annual escrow account statement dated XX/XX/XXXX from Ditech. It showed a {$930.00} surplus. It said we would receive our check as long as the account was current. We called after 30 days, told it was " under review '' and to call back in another 30 days and we were told the same thing. We were told that we were " contractually current '' and just waiting for them to disburse the check. Now, today, they said the escrow department had put a note on our account saying " a bankruptcy credit '' had caused the surplus to be reported erroneously and that as of now there is a {$1400.00} negative balance in our escrow account. When I asked XXXX, a supervisor, why we had n't been notified about this occurrence, he could n't give me an answer. We had reduced our insurance premium and coverage with our homeowner 's insurance at the beginning of the year and that reduced our payment and the insurance in the escrow account. When I asked XXXX, supervisor, employee # XXXX, about this, again he could not give me a definitive response. We talked to XXXX, empl # XXXX, on XX/XX/XXXX ; XXXX on XX/XX/XXXX ; XXXX XXXX XXXX ; XXXX, empl # XXXX on XX/XX/XXXX and XXXX, a supervisor, on XX/XX/XXXX as well as XXXX, a supervisor, empl # XXXX, today, XX/XX/XXXX. At minimum, if there is no surplus check due us, I will need an updated letter of explanation as to what this " bankruptcy credit '' is and how that affected our escrow balances for my bankruptcy lawyer. I think Ditech engages in deceptive, predatory practices.

Complaint: I am very behind in my payments to my mortgage holder, Ditech Financial. Three weeks ago I spoke to my Account Representative who said she was sending me a modification package. She added that I could always reach her by using her extension. I called the next day, and she no longer works in that capacity. Now I have a new Rep who, after calling and asking to speak to him, does n't return calls. And I have not received the modification package, though I 've called several times to demand it. Ditech sent me a Notice of Default and Intent to Accelerate on XXXX, and I believe they 're stalling so they can foreclose on my. I have gone to friends for a loan to cover the huge arrears ( {$33000.00} ) and I 'll have it by the end of XXXX. Ditech in any case would love to declare a foreclosure because then their lawyers, with the push of a button, charge several XXXX dollars to the paperwork, which is all boilerplate. Please help. I 'm attached everything I think you would need to approach them for a dispensation on the foreclosure.

Complaint: I received a letter/statement dated XX/XX/XXXX from a company called Ditech. It did not contain any alleged amount due, or on whose behalf they were collecting for. i called them on XX/XX/XXXX and talked to one of their agents. He said this was an old XXXX XXXX XXXX ( XXXX ) debt that they were acting as a collection agent for. It was either a 2nd or 3rd mortgage. I told him that my house had been foreclosed on in XXXX. I received another letter dated XX/XX/XXXX, which I have attached, that is identical to the first one received. I received a settlement opportunity letter dated XX/XX/XXXX, stating that the amount I owed to them was {$37000.00}, but if I paid by XX/XX/XXXX, I could settle my account by paying half of that amount, which is {$18000.00}. On XX/XX/XXXX I received a phone call from Ditech. I informed the agent that my house had been foreclosed on in XXXX, and that the Statute of Limitations in Michigan to collect on such a debt was 6 years. She indicated that Ditech or XXXX had received a payment from me in XX/XX/XXXX, which meant that the statute would still be valid until the middle of XXXX. I said that was impossible, because why would I have continued sending money on a house I no longer owned. She said that even if the statute had run out, I still owed the debt. I said that they no longer had a right to pursue collection after 6 years. I have enclosed 2 XXXX statements, dated XX/XX/XXXX, and XX/XX/XXXX. The first statement was the last one I could find in my records before I found the last and second statement. The last payment of {$510.00} was made to XXXX, check # XXXX, dated XX/XX/XXXX from XXXX XXXX XXXX. It was cashed by XXXX on XX/XX/XXXX. I have attached my carbon copy of the check, and my statement of account from XXXX. As you can see by the XXXX statement dated XX/XX/XXXX, the amount past due was {$4000.00}. Since my last payment was made XX/XX/XXXX, if you go forward 8 months to the XX/XX/XXXX statement, figuring a monthly amount due of {$510.00}, that would approximately equal the {$4000.00} that I would have been behind. I have no idea how or why Ditech says they got a payment from me in XX/XX/XXXX. Why were n't they pursuing what they say I owed years ago.
