Complaint: Had a trial loan modification with Greentree in which payments were made. On XXXX/XXXX/15, Greentree sent Permanent Loan Modification document, which was due back by XXXX/XXXX/15. There was no mentioning that this document needed to be notarized. The only instructions were " To accept this offer and take advantage of this opportunity, you must sign and return the enclosed Agreement by XXXX/XXXX/15. '' The agreement was signed on XXXX/XXXX/15 and sent via regular mail to Greentree 's address at XXXX XXXX XXXX, XXXX, AZ. After sending back the signed modification, borrowers made a phone payment of the permanent loan modification amount on XXXX/XXXX/15 in the amount of {$1200.00}. The confirmation number was XXXX. Borrowers called back on XXXX/XXXX/15 to make the XXXX payment and Greentree said the loan was in foreclosure because the final loan modification documents were never received. Greentree has instructed the borrowers that they need to start the loan modification process all over. This is an abuse and we need help from the Consumer Financial Protection Bureau to enforce the permanent loan modification that we worked very hard to obtain.

Complaint: Hello, I am so frustrated and angry and stressed that I might lose my home that I have worked so hard to keep. I filed for bankruptcy back in XXXX of XXXX. Right at that time XXXX XXXX XXXX also sold my mortgage to Green Tree. I kept my home under the chapter XXXX. In the bankruptcy, there were XXXX payments of around {$480.00}, and what they claimed to be legal and other fees for a total of {$1500.00} in arrears. Another year goes by, and due to some illness and struggles to find work, I started to fall behind again. Last XXXX XXXX they told me I was behind {$2300.00}. ( see spreadsheet titled Green Tree payment spreadsheet XXXX ). They also filed a motion to lift the stay of relief. Which was granted.My trustee said they would still pay, see bankruptcy docs, and I told Green Tree. As you can see I made an extra XXXX payments, and they also missed a payment I feel from back in XXXX of XXXX. I emailed the copy, which they say they never got, I then faxed it and got confirmation it went through, they say they never got it, so I finally mailed, with correspondence, registered return receipt. I then inquired the next several months, which you will see 4 canned responses " we will get back with you in 30 days '' ... they never did. I was trying to find out the status of that missed payment, whether I was paying enough ( you will see extra amounts being paid on my money orders ), and what would happen with the payments that were wrapped into the bankruptcy. Fast forward to a little over a week ago. I get a notice from them that I am in default and that I owe them {$4000.00}. I was of course shocked. They say I am XXXX payments behind and 200+ days behind. It is in no way true. Please find enclosed copies of every payment I have sent since last XXXX, return registered receipt, except for one ( which they do show they got ). they also did not apply a payment I sent in XXXX that I show they got. And, I found out that the payment I sent in XXXX was lost by USPS, and I am in the process of filing a claim with the money order company. However, Green Tree will not let me pay online, so when I am doing everything in my power to make sure they get payments, and USPS loses something, what am I supposed to do? I was not able to get a regular checking account for the last few years because of the bankruptcy so had to send payments by money order. I have now found a bank that will take me and will be opening an account today. So, since I have gotten this notice, I have been on the phone with them several times a day and I keep getting the runaround. Last week they were telling me they could not talk to me because the old attorney ( whom I fired last year ) was still on the account, even though I told Green Tree last year I fired him, so I had to have the attorney fax their release, which they did last Thursday, and have the date and confirmation. As of yesterday Green Tree said they still did not show in their system. I spent over an hour yesterday trying to get answers, was transferred several times, they could not tell me if the arrears was included in the $ XXXX total, they ca n't give me an accurate accounting ( see printout from them only showing a years payments ). I am attaching everything. What they are doing to me is unethical, and their legal action needs to be delayed until they can provide me clear and concise accounting. I just sent another {$500.00} ( I have copies ), and can send another {$600.00} tomorrow. And I will be borrowing money and selling some stuff, which you will then see just leaves the arrears of {$1500.00}. on my spreadsheet. I am filing claim for lost payment sent XXXX/XXXX/XXXX, so add that on too for {$500.00}. Did they give me credit for payment in XXXX XXXX? I have also sent this to a new attorney that I may retain. Also, if they could n't talk to me before they should not have sent those response letters and told me I needed to get my attorney off the account.

Complaint: Back in XXXX I received a letter from Green Tree stating the amount that XXXX XXXX XXXX ( XXXX ) stated I owed. Sometime around XXXX of 2014 I continued going back and forth with XXXX regarding XXXX of my XXXX loan payments that had never appeared to be credited to my account. XXXX continue to acknowledge and send me multitutude of apologies and promises to take care of the situation. In the mist of being behind XXXX sent me XXXX applications to apply for another modification. After being hounded, I applied and received only a letter stating they rec 'd my information and would contact me. All of this was still " under investigation '' and " being worked on '' by XXXX when they sent my loan over to Green Tree. XXXX continuously sent me letters with the same content over and over promising they were tending to my issue. I have included XXXX but have plenty more of the same. I sent the last XXXX which was in XXXX, about XXXX weeks before they told me they were selling my loan. I supplied these letters and a few others to Green Tree. Then Green Tree, even after being told that this was going on, sent the letters XXXX sent me, and I also exercised the FDCPA requesting correction to the amount owed sent in the original notice, they completely ignored the information and sent me Default Notices. They even sent me a notice stating that I was behind my XXXX payment in XXXX? I received a notice to apply for modification, even though XXXX has my application and documents, nothing has been done about the misapplied payment, and in XXXX I made a payment to XXXX prior to my account going to Green Tree that I 've been told is " awaiting processing '' but continuously receiving letters stating they do n't have it and send documentation that they are holding the payment ( which I did -record straight from XXXX ). I continue to send my payments and request communication via email or written documentation ( XXXX ). They tell me they are a debt collector, but completely ignore my side of being able to exercise my FDCPA rights? today I received a letter dated XXXX XXXX, 2015 basically telling me they are preparing to take my home and that they have n't received a response from me ( they have gotten many and I have tracking and fax confirmations ). I show that I owe for XXXX, XXXX 's payment was sent in. They are telling me I owe for XXXX, XXXX, and XX/XX/XXXX- ( they have n't received the XXXX payment since it was just mailed, so I assume it would be XXXX ( which they have ) and XXXX which is a payment that carries on in dispute-not XXXX, but the payment XXXX was supposed to credit my account with. This has been absolutely horrible. Not to mention their calls and XXXX which an extremely rude person told me that it did n't matter XXXX I tried to explain talking loudly only confuses me. They were still yelling when I hung up the phone. I just do n't think it 's fair how XXXX can just ignore their promises and what should have been communicated and Green Tree ignore dealing with it and telling me I 'm not responding. Thank you for any assistance, I am incredibly stressed over this and feel bad that they think XXXX I 'm dumb.

It was a rental property -- we tried so hard to get a loan modification but neither the XXXX or XXXX lender would work with us ( they pretended to but in the end demanded so much paperwork over & over again that we finally realized they truly were not serious ) Because we were retired we could not compromise our savings feeding the alligator on this home. The XXXX was held by Green Tree. They continue to call us night & day demanding payment ( over XXXX years ago it went & sold at sheriff sale ). When we pick up the phone it is a recording. When we call back we think we receive someone speaking outside of the United States. They are truly harassing us!!

It was sold to another lender who is reporting the property as being foreclosed on in late XX/XX/XXXX. It is affecting my ability to obtain credit and pursue the possibility of owning a home again. Complaint: I have had a mortgage with Green Tree financial for well over XXXX years. I have tried numerous times to get them to refinance for a lower interest rate. I have had some ups and downs but over the past XXXX years we have been perfect, but yet they say they do no refinancing on existing loans. I have been paying 13 % on a mortgage that is crazy. I have vehicles and much more that have qualified for 5 %, but yet I ca n't get them to respond. Being bad is XXXX thing but this is really taking advantage of people and really bad business. I just wonder how many people they are really ripping off.

Complaint: I 'm with green tree and recently at XXXX. My last payment for the yr. Was due and payed on time how ever green tree also put XXXX XXXX payment on this statement as well but the math did not add up to, XXXX payments in the amount due box on the paper statement the payment for XX/XX/XXXX was on the statement for XX/XX/XXXX but on the far side of the statement were your eyes do n't look when your use to seeing the same thing all the time. i did not catch this until I received my mortgage bill for XXXX. I was hit with late fee 's and was basically made a fool of over the phone when I was told both my payments XX/XX/XXXX and XX/XX/XXXX were due on XXXX bill. And that basicl " it didnt matter if i missed a payment for XX/XX/XXXX. I have to pay them regardless if i recive a statement our not '' .the information I was told I needed to send for a request of all the info I wanted to inquire about, to resolve the issue I never received any info or a denied response with reason. I payed all dept. Due in full plus The Late fees. I 'm still being charged late fees I 've write on the statements and stated that the billing is wrong and all late fees from the incidents have been payed green tree will not fix there mistakes

Complaint: My issue is with Green Tree when I was having problems paying my mortgage. I have had issues with them repeatedly threatening me regarding my mortgage payments. Call me at all hours of the day, every hour. They took money from my bank account, when not authorized to do so ( I filed fraud charges with the bank and it was corrected ). They have forced me to pay the XXXX processing fee-in order to keep my house, many times over. They have refused to listen to me, or work with me in any way, called me a liar and threatened to evict me. I filed bankruptcy when my loan was still with XXXX XXXX XXXX, and I reaffirmed my mortgage at that time, they refuse to believe that, and have told threatened to evict me if I am 30 days late. They tell me I have to go back to my lawyer or the courts and get new paperwork for them ( it has been 4 yrs since filing ). They refuse to report my payments to the credit bureau, so my credit report shows this account is closed under chapter XXXX-when I am and have been making payments all along.

Complaint: I am entering this complaint because my husband passed away in XXXX 2009, XXXX yrs ago. The loan was in his name, not both names. He left everything to me in his will. The loan he had on the house is with Green Tree Mortgage. I have been trying to get the loan transfered in my name. The Probate papers and death certificate has been sent to them and they still say they ca n't tell me anything or put it in my name. I have given Green Tree permission numerous times for one of my family members to talk to them because I am XXXX and also XXXX and am XXXX yrs. old. I have been keeping the payments up ever since XXXX when he passed away. They will not tell me how much is still owed on the loan, or change the address for mail to come here because I am living with my son and his wife and have been since XX/XX/XXXX. I want to sell the house which and ca n't do that until it is in my name. I ca n't live by myself any longer because my health is declining. I ca n't afford an attorney because I live on a very limited income.
