Complaint: My complaint is against the following Company : Green Tree Servicing - XXXX XXXX XXXX # XXXX XXXX XXXX, CA XXXX ( XXXX ) XXXX www.XXXXcomThis company illegally placed " attorney fees '' on my mortgage without my approval and i have no idea why. They said it was attorney fees that they placed on my monthly mortgage and did not mention or give me any written explantion of these fees. I had to pay them so my monthly payments would not default or be late. I demand these fees be returned to me in a timely manner.

Complaint: My mortgage company went from XXXX to XXXX XXXX XXXX to Green tree and has been nothing but Inconsistent communication. As I have tried to establish some form of reasonable payment I have been tossed around like trash. If I was given different deadlines and always tried to reach them, leaving messages asked for a return call. It never happened. My payments were anywhere from XXXX down to XXXX and XXXX with ARM of XXXX % interest. This has been all over the place from the start, My home has been underwater for some time now, My husband and I have even walked from the home after filling Bankrupsy back in XXXX and returned after a year and half when given false hope the bank would work with us, not to mention the company that they had monitoring our home when we left, appeared to have taken all the copper piping. When Green Tree sends you paperwork, often you will recieve several copies from basic mail, XXXX, Certified. With messages to call, or will have unidentified people walking around your house snapping pictures and leaving notes on your door to URGENT! call Green Tree, and when you do, end up leaving messages with no return. I do n't want to loose my home, but this company is not really there to help. This process has taken my trust, my money, my serenity, with no desire to help ones that need it most.

Complaint: I submitted a settlement check that was the result of a judgment from an insurance company. The check was required to have the name of the current mortgagee and myself. I informed Green Tree the background history prior to submitting the check. The initial person I spoke to gave me what they thought the requirements would be for disbursement. Unfortunately, once they got the check all of that changed even the department handling the situation changed. They kept stating it was a claim for damages even after receiving copies of the court papers, affidavit from the original contractor, and a statement from the insurance company. Green Tree just refuses to give me my money. According to the reviews and statements from former homeowners this is their practice. They hold all the checks in escrow and profit off the interest. They have been in possession of the check since XXXX 2014. They are now proceeding to foreclose on my home, because of delinquent payments and still refuse to give me my money. I offered to pay for an licensed inspector to prove that the work had been done years ago, before they took over the mortgage. They said it would not make a difference. I sent a notarized statement offering to bring mortgage current and take the difference. No response from Green Tree. They are withholding a {$26000.00} judgment settlement check that would help me get my financial stability. Please help end this XXXX, and save my home.

Complaint: I temporarily became over 60 days late on my Greentree mortgatge for a rental property. Greentree sent and charged me for an inspector to visit the tenant occupied property. The inspector told my tenant I was in " forclosure! '' My tenant immediately called me asking many questions. I wrote Greentree 's customer service deptartment asking for the name of the inspector they sent because I wanted to file a complaint for releasing my private credit info to another person? I have not received any response from Greentree what so ever!

Complaint: Green Tree improperly raised the interest rate on my mortgage. The terms of my mortgage contract state that the index is the weekly average yield on the United States Treasury Securities, adjusted to a constant maturity of one year, as made available by the Federal Reserve Board. It also states the most recent index figure available as of the date 45 days before each change date, is the index that will be used to determine the change. The new interest rate will be calculated by adding 2.75 % to the current index and then rounded to the nearest one eight of one percent ( 0.125 % ). The rate will never increase or decrease on any single change date by more than two percent. ( Prior to the reset my interest rate was XXXX. They added 2 % to the 2.875 % and it is now 4.875 %. They did not adjust according to the contract and use the proper index ). Forty five days before XXXX XXXX, 2015 is XXXX XXXX, 2015. On XXXX XXXX, 2015 the index was XXXX adding the margin of 2.75 % my new interest rate should have adjusted to 2.97 % with a new payment of {$900.00}. Not {$1000.00} In addition my escrow account shows that a payment for my hazard insurance will be made on XXXX XXXX, 2015. I have never had an escrow account for insurance or taxes, I pay them myself. On XXXX XXXX, 2015 I called and inquired about this. I was transferred to 4 different representatives, each time having to give my account number and social again. no one was interested in helping me answer my question. They were rude and wanted to know when this months payment would be made. The final person I talked to told me to send a fax to customer service general correspondence, stating I was disputing the change in the rate, which I did on XXXX XXXX, 2015. I also have written a QWR ( RESPA ) letter which will be mailed certified tomorrow XXXX/XXXX/2015.

Complaint: After losing my job in XXXX, I got behind on my $ XXXX/month mortgage payment. By XXXX, XXXX, I was three months delinquent. Around XXXX, XXXX, I commenced a temporary workout package with XXXX. For the next seven months I paid {$1.00} per month. On XXXX XXXX, XXXX, I called XXXX in response to a written notice and was informed on the phone that if I made payments on time for the upcoming three months ( the payments were about 90 % of a full month 's payment ), I would be eligible for a refinance and possibly having XXXX funds cover the arrears. During that XXXX/XXXX/XXXX phone call I made an electronic payment of {$2300.00} as the payment for the month of XXXX, XXXX, i. e., the first of the three trial months payments. About that time, Green Tree Servicing LLC became the loan servicer in place of XXXX, but I was unaware of it. On or about XXXX/XXXX/XXXX, at XXXX I called XXXX at XXXX XXXX XXXX XXXX to make the XXXX of the XXXX 90 % monthly payments. I was told by their representative that he could not talk to me about the loan because Green Tree had taken it over. The call lasted XXXX minutes. On XXXX/XXXX/XXXX, at XXXX p.m., I called Green Tree to make my XXXX of the XXXX monthly payments. I spoke with XXXX XXXX, and told her I wanted to pay the {$2300.00} over the phone. She said I could not and instead demanded aggressively that I pay the full arrears of about {$31000.00}. She would not let me explain that I had an agreement with XXXX. Finally she started asking me about my financial situation and my income. I asked her why and she said she had to fill out an application for me before she would know if I qualified for the same workout package that XXXX had given me. After taking my information, she said it looked as if I might have a chance to qualify for starting a new trial period that would last for XXXX 4 months. Then she said she would mail me the workout application package for me to complete. She told me I needed to get it back to them in about 3 weeks, and gave me a fax number to submit it to. She said it would be best to get it in by XXXX/XXXX/XXXX. This call lasted XXXX minutes. I did not submit the form. According to Green Tree 's monthly statements, the arrears are up to {$46000.00} as XXXX XXXX, XXXX. I have been setting aside the monthly payments in my bank account since Green Tree refused my XXXX/XXXX/XXXX payment. On XXXX XXXX, XXXX, I received a call from a Green Tree representative in XXXX, AZ. She asked if I had received the certified mail they had recently sent. I had not, I told her, so she explained that I had 30 days from the date on the letter, which she claimed was XXXX/XXXX/XXXX, to correct to the default by paying {$41000.00} within 30 days of the date of the letter. Or I had the opportunity to cure the default by making a workout agreement. If I did not cure the default within the 30 days, they might begin foreclosure thereafter.

Complaint: I received a letter from Greentree servicing LLC that my Hurricane insurance had not been paid and they were going to place their own expensive insuranceon my bill. I checked with the insurance company XXXX and XXXX and they both said it had been paid and it was current. I called Greentree several times and wrote them letters as to who they could contact to confirm this. They were uncooperative. They just sent me a letter stating that the evidence now shows that the insurance was reinstated. It was never cancelled. This was an attempt by them to extort money from me. XXXX could n't understand why they did n't contact them.

Complaint: Due to medical I got a second mortgage on my home in 2006 with XXXX dba as DItech. Because of the low equity, and the amount of time I was in the home I did not qualify for any other loans. Although I did non need XXXX XXXX would only due the loan if I would let them pay off my car loans and all revolving credit balances which was around XXXX. Because it was an 125 % LTV loan I had to pay 12.25 % interest rate. I was assured by the XXXX rep that I would by able to refinance in a couple of years to a traditional loan with a lower rate after my home had built some equity. Over the next few years the housing market went down, our medical issue 's got worse, my wife lost her job and we lost our health insurance. We were unable to get other health insurance to to " pre-existing conditions '' and the cost. During that time XXXX sold our loan to GREEN TREE SERVICING. After the toke over the loan it turned into a nightmare. When I reached out to them numerous times for help. I was told so many different stories and lies by the company I ca n't even come close to remembering them all. I was told there were no government programs for my loan, I was told it was illegal for them to modify the loan, I was told that GTS now owns this loan and not XXXX and they would not modify the loan or even subordinate it so I could get a lower rate on my first mortgage. THey called my multiple times daily, even if I was late or not. Me and my wife both had to have our phones disconnected to stop the harassment. The called my employer, my wife 's employer and my former employer multiple times a day. Day after day. Even when I told them I had taken a second job at night and slept late they would call me at XXXX and XXXX and not ever say anything, just breath or giggle over the phone. To make things worse I received a letter telling me my first loan was going to be " serviced '' by GTS now. I received the same type of treatment after GTS took over my first loan. They tried to change my due date. Charge all kind of service fee 's. To " see if the home was still occupied '' along with quick pay fees for paying my bill. If i set up a online payment through my bank the would not accept an ach payment so my bank would have to cut a actual check that would take 6-8 days to clear. Just last month they tried to force my into buying insurance for my second loan when I know i was n't required to. After running out of options on how to deal with this company I wrote a complaint to the better business bureau the sent me a packet with a contact number and extension for a person that in the letter I could speak to about help. When I called GTS that person did not work for the company and no one had ever heard of them and the extension was dead. I was handed over to " XXXX '' who I was told was my account rep. XXXX told me I would be given a lower rate and they would never ever subordinate this loan and If i had a problem with that just let the house go into foreclosure. He then hung up on me and told me it was in my best interest never to call back.

Complaint: XXXX/XXXX/XXXX I am writing this letter on behalf of the lack of concern, underhanded tactics, a total disregard and disrespect of customers, conduct unbecoming of professionals whose job is to deal fairly and justly with customers facing financial hardships, regardless of the cause of the hardship. On XXXX/XXXX/XXXX, I filed a Chapter XXXX bankruptcy in an attempt to get a handle on my debt. I received a letter from Green Tree Servicing LLC, informing me that my loan was being transferred from XXXX XXXX to their company and would be in effect on XXXX/XXXX/XXXX along with my new account number and the mailing address. The bankruptcy was discharged on XXXX/XXXX/XXXX, but I kept receiving monthly billing statements and was paying them because I was told that I still had to pay because this was owed and if I did n't, I could very well lose my home. On XXXX/XXXX/XXXX, I made a decision to see a credit counselor to try and clean up my credit. When I received a copy of my credit report, both Green Tree Servicing LLC and XXXX XXXX XXXX appeared with the same outstanding balance of {$25000.00}. I requested that XXXX investigate and correct the account. I made payments to Green Tree Servicing LLC from XXXX/XXXX/XXXX until XXXX/XXXX/XXXX in the amount of {$3900.00} ( USA Dollars ). Complaint: Subject : Greentree Servicing extending processing, not evaluating documents properly. Homeowner submitted RMA requesting modification result from medical hardship and filing bankruptcy. Homeowner was denied a MHA loan modification. Homeowner filed all required court documents and to pay mortgage payment separately. Homeowner has a current medical hardship with spouse. Homeowner has an aggravated medical hardship with a family member with XXXX. Greentree failed to take the medical hardships into account. Greentree has begun a double tracking and set the date of foreclosure sale, for XX/XX/XXXX. Greentree is in violation of the DOJ Department of Justice/ XXXX States Attorney Generals Settlement Agreement. Homeowner is being discriminated against in a form of reverse discrimination because of age, race and medical hardships '. This homeowner, feels that his case has been unfairly treated for the following reasons:1. No active single point of contact, constantly changing, when calls made to the single point of contact, routine routed to the collection department, never the same contact person. 2. No single point of contact has been assigned. 3. Homeowner thought that the mortgage payment was included in the trustee payment. 4. Greentree did not inform the homeowner of his modification options under the MHA Making Home Affordable guidelines. 5. Homeowner and Authorized 3rd Party has made numerous calls ( XXXX ) inquiring on status of his loan modification application, calls were routed to next available agent, comments were : A ) wrongfully advised that documents were not submitted, or lostB ) documents were submitted by homeowner but not located in the data base, orC ) resubmit your documents again. D ) the foreclosure date is set and homeowner is responsible for not providing the requested documents : these XXXX points are causing a state of confusion and terror to the homeowners household. XXXX. Greentree started the double tracking procedure with XXXX XXXX XXXX XXXX on XX/XX/XXXX. Greentree was aware of the loan modification in process, and moved forward with the double tracking anyway. This is a clear violation under the National Mortgage Settlement Agreement ; specifically double tracking while homeowner provided all documents under good faith to protect their home from foreclosure. Homeowner is claiming mortgage processing discrimination in delaying processing : by overloading Greentree processing agents with a case work load of XXXX+ cases as per one agent 's statement. These overload cases are causing a form of mortgage discrimination against homeowners, thus losing their homes to an inability of the Loss Mitigation department to properly manage the existing case load. Alleged violations, included, but are not limited to, the following : a ) Failing to perform proper loan modification processing ; b ) Failing to manage processing agents and special points of contacts, therefore causing a processing center unable to handle homeowners case loads, a form of mortgage discrimination against homeowners.

Complaint: Our Mortgage was originated by XXXX Mortgage, they sold our loan to Green Tree Servicing. It has been 6 months and there we have had several issues. They applied our payment to an incorrect account, I have been unable to call and make a payment ( although normally after the XXXX ), I can not get a rep. on the phone to assist. They add the next months payment to the statement on the XXXX of the month and then charge a late fee of XXXX if it is not paid on the XXXX of the following month. This is not a reputable bank. I wish I was given a choice. I am sure many other struggling families are frustrated. Please help.

Complaint: To whom it may concern, Within the last 3 years I have lost XXXX parents, suffered a XXXX and received XXXX XXXX XXXX. By GODs grace I have been in recovery and working again. About a month ago, my bank/servicer XXXX sold my loan to Greentree Servicing. I received no documentation. When I contacted Greentree, they told me to bring the note current because I do not qualify for any type of modification. I contacted MHA ( Making Home Affordable ) Help Hotline. I was told because I never received a modification, that I am eligible. We prepared all the documents and sent them to Greentree. They have refused to confirm my documents and have posted my home for Foreclosure on Tuesday, XX/XX/XXXX. I have recently received an inheritance from the sale of my parents home. I have also tried to request an accurate pay-off but Greentree keeps telling me that it is too late to do anything except to contact their Foreclosure Attorney. Please help me save my home. Complaint: I had a Heloc with Greentree. That loan was paid off in XXXX of 2010 when I financed my home. I am the process of refinancing again and in the process found a lien on the property. There was never a release filed after the closing by Greentree. I have made many calls, as well as the closing attorney, handling my refinance, to Greentree attempting to get a release since the beginning of XXXX and still have not received a release. As I understand it that release notification was to be done within 2 months of the payoff of the loan and here it is 4.5 years later and nothing has been done and I am getting no satisfaction from Greentree. I have talked to many people at Greentree and I never get a straight answer from them. I asked for them to email or fax a copy of the release and they tell me they ca n't because it is in the documents dept and they take 30-45 days to process. So here we are past that time frame and still nothing has been done. This is the most unprofessional organization I have ever dealt with.
