Complaint: I have Power of Attorney for owner of the property in XXXX XXXX, FL. As the XXXX representing the owner, I listed his property on XXXX in XX/XX/XXXX. Since that time I have tried to negotiate with Green Tree the payoff amount, at XXXX by phone and later by fax beginning XXXX XXXX. They promised to review the amount and respond to me within XXXX business days. I did not receive any reply. I continued to phone, fax, and mail them without any response. I received a XXXX letter XX/XX/XXXX and a XXXX letter XXXX XXXX again saying the same thing : " We are going to response .... '' The main thing about that is I have a buyer ready to close this purchase on XXXX XXXX. It is not right that the owner suffered these additional expenses due to Green Tree delays in response to my faxes, letters, and phone calls. My client is XXXX and XXXX. My client does n't have any condition to defend himself.

Complaint: Due to severe financial difficulties, I was in a loan modification process with Green Tree for 9 months ( XX/XX/XXXX - XX/XX/XXXX ) after completing numerous " Uniform Borrower Assistance Forms '' and was continuously rejected. The reason was always that documents were missing, which was not true and I have the documents to prove it. I should have qualified for a loan modification based on my income and financial circumstances. On XXXX XXXX, XXXX, after I received another rejection from Green Tree for a loan modification, I called Green Tree for a reinstatement amount since I was worried about loosing my home. I forwarded a cashier 's check in the amount quoted by Green Tree over the phone on XXXX XXXX, XXXX ( only 19 days after receiving the written rejection for a loan modification ) and have since then paid my " Regular Monthly Payment '' in accordance with Green Tree 's monthly billing statement. Despite these facts, Green Tree filed for foreclosure proceedings on XXXX XXXX, XXXX ( please note that the date is after the reinstatement amount was paid in full ) and added all kind of legal fees to my account without any kind of written statement, letter nor invoice. The mortgage document requires all notices to be in writing, which Green Tree did not do. I have even been accepted by XXXX XXXX XXXX XXXX on a pro bono basis since these actions by Green Tree are not legal, however, they are refusing to remove the charges from my account and are now threatening foreclosure again. I have an entire folder of correspondences between Green Tree and myself over this entire period and we seem to be going in circles at this time. It is very frustrating since Green Tree is a debt collector and not a mortgage company and it seems impossible to deal with them in a professional manner.

There is no Florida Statue that state that XXXX or Green Tree Servicing LLC can create an alleged XXXX mortgage out of thin air. Then hold my XXXX mortgage hostage from being refinanced by another entity. However, there is a Florida XXXX XXXX XXXX, Statue Of Frauds, Fraudulent transfer ch. XXXX. Thus, this is not only Florida XXXX it is a XXXX XXXX. Because, You are trying to extort {$93000.00} across State lines from me. Thus, I demand you release my XXXX mortgage to be refinanced immediately. XXXX days from this memorandum -- I will turn this case over to the Attorney General Of The State of Florida and the FBI.

Complaint: This is from Green Tree about a double wide that was gave back to them, they sold it for just XXXX dollars and told us that we own XXXX to them. We set up a payment plan of XXXX a month and then they called back after a year and we have to started making XXXX dollars a month. Each month we have been faithful in paying what we set up with them and they have been cashing the checks every month. We received a letter from them stating that we own XXXX and they wanted it in full by the XX/XX/XXXX. I called and got XXXX and she was telling me we did not set up a payment with them. And that every 6 months we need to re-set it up. My problem is this is the first letter that we have gotten in about 4 years from them. She was telling me that we need to fill out a financial statement and mail it back to the company, she is suppose to be mailing one out. She basely threaten us that if we did not mail it back. We have to pay it in full by XX/XX/XXXX. My question is this if this was true then why have they not call us or quit cashing our checks. We have proably been paying on this debt for about 9 years and now they are threatening us. We are doing the best we can do and we are trying to pay for this double wide that they sold for nothing.

Complaint: On XXXX XXXX, XXXX, I refinanced a loan originally held by Green Tree Servicing LLC., with XXXX. XXXX sent XXXX separate payoffs checks to Green Tree. XXXX was on XXXX XXXX and XXXX was on XXXX XXXX, XXXX. The loan was never processed by Green Tree and I continued to receive bills. I contacted Greentree on XXXX XXXX, and advised them of the issue through a three way call with a XXXX rep. The rep for Green Tree ( XXXX ) was provided the routing and bank information where the disbursement was sent to. Ironically, I settled XXXX additional loans through XXXX with Green Tree and there were no issues. XXXX indicated the funds were there but had to be verified. By XX/XX/XXXX the issue had not been resolved. I contacted Green Tree several more times and no one was willing/able to help me. I also spoke with XXXX ( manager ) who indicated the disbursement was allocated to a different loan and would have to be transferred to the loan in question. Of course, nothing was done and on XXXX XXXX, I spoke with a rep for Green Tree who was actually helpful. She indicated I had a suspended credit disbursement, but the payoff still did n't appear. She attempted to reach XXXX, but to no avail. Today, XXXX XXXX, I received XXXX identical letters from Green Tree indicating that they were looking into the issue. Technically, I have XXXX loans for XXXX home and am still being contacted by Greentree for payment. An additional concern is whether my credit will be affected. According to XXXX, the disbursement checks were cashed by Green Tree on or about XXXX XXXX. Green Tree is a terrible company who has poor customer sevice. They make ridiculous mistakes and do nothing to rectify the situation. At this point, I believe they are intentionally affecting this process. Thank you.

Complaint: Greentree Mortgage has denied me a loan modification reducing my interest rate, without going thru the proper review process. I submitted their form on XXXX XXXX, theuY denied the modification with a letter dated XXXX XXXX, never asking for any documentation. The letter sent to me on XXXX XXXX stated that all documentation was complete! This is a loan shark operation, my mortgage was sold to them by XXXX XXXX XXXX 2 years ago. I have been modified on other loans based on reduced income, I just think Grrentree operates on a shady mode!

After filing my complaint XXXX did file a Motion to Vacate the Final Judgment, Certificate of TItle, Cancel the Foreclosure Sale, Dismiss the action and Release the Lis Pendens, Order dated XXXX XXXX, XXXX. XXXX county CIrcuit court Case Number XXXX. XXXX XXXX, Specialty Servicing Advocate II Social Media Team Office of the CEO and President of XXXX XXXX XXXX XXXX XXXX, Phone XXXX, extension XXXX had told me that XXXX would help me giving me with a Loan Modification, he asked for my husband, XXXX XXXX, who died on XXXX XXXX, XXXX, death certificate along with any income I may have. He kept informing me with weekly calls that ( I have all recordings ) telling me do n't worry XXXX wanted to help. After sending the death certificate, along with my income they wanted me to sign a Assumption of Mortgage. On the original Note, My deceased husband was the only one who signed the Note, the Deed/ title was in both my name and my late husband. He did not leave a Will, there was no Estate filed, he did not have life insurance. XXXX XXXX XXXX Loan # XXXX, under Florida Law the title should be in my name since the Deed was in both our names and it was homestead property. I did not sign the Assumption of Mortgage because the title should be in my name, I do not owe XXXX anything because the Note was not signed by me, it was signed by my late husband. Before my husband 's death, there was a Trial Loan Modification for XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX which the payments were made, the representative who handled it was XXXX XXXX, Customer Relationship Manager, XXXX with XXXX, XXXX XXXX, XXXX all the income information was faxed to him, he handled it from there with the payments for the Trial period. XXXX, XXXX the representative told us we were approve for the modification, she said do n't worry the foreclosure hearing will not go through on XXXX XXXX, XXXX, underwriting for XXXX said we would receive our payment booklet at the end of XXXX, XXXX, payments were approximately {$1200.00} monthly. Unfortunately, my husband, XXXX XXXX died unexpectedly on XXXX XXXX, XXXX, XXXX days before the hearing, I was devastated, and under duress we were married for thirty years. We have a daughter who is XXXX I have to take care of she has XXXX. This is my homestead, the title should be in my name, right of survivorship. XXXX XXXX, XXXX XXXX sold the mortgage to Green Tree, Account Number XXXX, when I called them and explained everything they said they could not talk to me because my name was no where to be found. XXXX failed to let them know that I am on the deed, XXXX never sent them the death certificate or told them about the Loan Modification in XX/XX/XXXX. We had a bad storm which took off some of the roof of the house, XXXX was suppose to have insurance on the home. Green Tree sent a letter to my late husband stating that there was no coverage on the home at the time of the storm. Now they are sending billing statements, XXXX can not get away with this FRAUD the Government has to do something to help me get the TItle back in my name, please research this for me I have asked XXXX for months to refund the money for the Trial Periods we paid to them in XX/XX/XXXX, but they keep ignoring me, they are taking advantage of me, Please have President Obama read this I need help to get my homestead back I have been living here since XX/XX/XXXX. Complaint: Green Tree Servicing LLC took an extra {$380.00} out of our checking account for the month of XXXX, 2015. Our normal payment is {$1700.00}, Green Tree upped the payment to {$2000.00}. We called and found out that a person with the same first and last name and a different middle name, home owners insurance was paid out of our escrow account. There was {$3000.00} taken out of our escrow and our mortgage payments were re-figured to cover the cost of the {$3000.00}. Green Tree told us we had to pay the extra {$380.00} to cover the amount taken out of the escrow even though it was their mistake. We canceled our automatic payments hoping this would be resolved by XXXX XXXX, 2015. Green Tree had n't collect the money from the other person by XXXX/XXXX/15 so we were required to pay another {$2000.00}. We sent a message to Green Tree on XXXX/XXXX/15. On XXXX/XXXX/15 {$3000.00} was put back into our escrow account. But Green Tree still owes us for the extra we paid in XXXX and XXXX. We were contacted by mail saying that they were looking into the matter and would get back to us in 30 days from the message we sent. We have never been able to talk to anyone other than customer service. Same with our attorney. The attorney called today and Green Tree stated that the money they owe us was taken care of when they deposited the {$3000.00}. back into our escrow account. This is the message we sent to Customer Service on XXXX/XXXX/2015. I just made another mortgage payment of {$2000.00} for XXXX mortgage payment. I also paid {$2000.00} in XXXX. The normal mortgage payment is {$1700.00}. This mortgage payment was increased because you paid for the other persons home insurance {$3000.00} out of my escrow account. When I look at our escrow account online, it does n't show any of the updated changes. I would like a detailed statement showing the changes. I would also like a check for the amount {$770.00} ( {$380.00} for XXXX and {$380.00} for XXXX ), to be refunded to me to cover the amount taken out of my checking account to cover your mistake. I am paying out of my pocket, for your mistake. This is n't right or just. I have hired an attorney and letters have been mailed and faxed. I have been told that the escrow account ca n't be adjusted until you receive the funds from the other persons account. Please have someone other than a customer service representative contact me.
