Complaint: The mortgage company, Green Tree Servicing, added " Hazard '' ( insurance ) to my escrow payments. I already have homeowner 's insurance through a reputable company XXXX XXXX XXXX XXXX and was contacted by them when Green Tree decided to start " making my insurance payments ''. I DID NOT authorize any changes to my account and will continue paying my premiums directly to XXXX XXXX. I do not want Green Tree 's " insurance ''. I also told my XXXX XXXX agent that I did not authorize any changes to my insurance policy or method of payment.

Complaint: XXXX XXXX sold our XXXX Mortgage to Green Tree Servicing LLC a few years back. I 've been reading about harrasing calls for collecting payments and we most definately agree, they were so rude and demanding. Their calls would always start out " could I speak to XYZ '' and you respond " this is '' and the next sentence would be " do you want to keep your home at XYZ '' ). Really, what a very offensive comment on your XXXX call requesting payment information. I recall many times I commented that they put their efforts towards collecting from true " past due '' customers and not us when we did n't miss a payment in a 30 day window ). They would go so far as calling on the due date if it did n't arrive and ask where 's your payment, what 's the check number, why did n't you mail it in time. XXXX conversation we specifically remember that was so wrong on their behalf.. I questioned them as to why they continue to call every month without allowing us the 14 day grace period before it 's past due. I was told Green Tree is a collection agenecy not a mortgage company so no grace period is allowed, which I found to be very concerning as my loan was definately connected to my home mortgage for colateral. Last year, XXXX sold our primary mortgage to Green Tree as well so I 'm concerned what the future may hold for us if our payment does not arrive on or before the " due date '' and no grace period allowed ( according to GreenTree representatives ). I do have to say for a professional lending company, they have no professionalism in their business tactics. We just recently paid our XXXX mortgage in full with GreenTree so we could have the harrassing stop every single month, no matter what the date was and we did not feel they deserved XXXX in interest to support wages for that kind of customer service. If I had the finances I would pay my primary mortgage in full as well so GreenTree receives no interest from us ( but we currently do not have the resources to pay it in full ).

Complaint: To Whom It May Concern : I have lived in the XXXX County area for 24 years and want to spend my retirement years in my XXXX XXXX XXXX. I have always been heavily involved in community service, the last time being when I helped XXXX Link ( a non-profit organization ) market to people with XXXX that need help. I worked for XXXX XXXX for 10 years and then transitioned into marketing in XXXX. I was doing fine until my hardship hit in XXXX. My XXXX began to fail prior to XXXX, and after struggling for quite a while on the job I was finally forced to retire after my first XXXX in XXXX. After XXXX more XXXX ( the last in XXXX of this year ), I am now considered XXXX and on permanent XXXX. And on top of the fact that I could n't work anymore, I also had the cost of my prescriptions skyrocket as well. All of this caused me to fall behind on my mortgage payments. Unfortunately, I may be forced out of my home by my current lender ( Greentree XXXX since lately they have not been willing to work with me to retain my home. The only communication I have had with them is how much I owe on my mortgage and how to pay them. They have no interest in helping me and it appears as though they just want to take my home away via foreclosure. I have tried to obtain an affordable loan payment, but the assistance I have been offered has been minimal. Since XXXX, I 've been trying to get Greentree to modify my loan. I even tried with the help of other agencies including the XXXX. After dealing with Greentree on my behalf, all of these agencies trying to help me said it was " ridiculous '' how poorly Greentree was treating me. Every call made to Greentree resulted in having to leave a message that was never returned. When we did reach someone, we were told to submit paperwork -- -then literally the next day, I got a denial letter in the mail and/or that person was transferred to another department. When Greentree finally acknowledged my need to modify my loan, they came back with an offer that significantly raised my monthly payment!! Is n't it obvious with my hardship that I need a modification that makes it easier to make payments, not one that eats up over half of my fixed income? I know they have guidelines to follow when it comes to how much of a borrower 's income should go towards their mortgage payment ... .why would they make such an unreasonable offer? It sure seems like they are just going through the motions so they can put it on me that I did n't accept their offer of help, justifying their foreclosure on my house. Furthermore, my property value has severely declined as well. But I still want to keep my home!! I 'm not looking for a handout. I want to get back to normal and not be facing imminent foreclosure. It 's stressful not only emotionally, but physically as well. I just need someone to assist me in getting Greentree to use some common sense to solve this problem. I would be forever grateful for any assistance that can be provided towards that goal.

Complaint: I had a house ( bought in XX/XX/XXXX ) put {$65000.00} of my own money into. I could n't make the payments on without a loan modification. At the time the mortgage was held by XXXX XXXX. We were working on a loan mod. I was making all payments and complied with all requests to get the loan mod. Suddenly my mortgage was sold to GREEN TREE. At first they did n't want to honor the deal I had going with XXXX XXXX, but finally relented. We worked out a 6 month deal that if I made my new amount of payment for 6 months we couls work out a loan mod. I did. The deal they offered me was the amount I owed on the house plus the amount of missed payments and they were going to work out a kind of vraiable interest rate. something like 3 % first 3 years 4 % next 3 years and then I think is was XXXX the rest of the loan. Totaling somewhere around $ 250,000+ for a house worth around {$160000.00}. I counter offered at {$170000.00} 5 %. They immediately said No my house was foreclosed on in a couple of months and sold at auction for {$110000.00}. I wanted to short sale, they said If I could get it done before the foreclosure date which was less then 60 days away. I let the house go. I was beside myself and felt so betrayed.I finally lost the house in XX/XX/XXXX. I just saw that GREEN TREE settled a lawsuit from you with similar cicumstances. I still owe {$49000.00} of the {$65000.00} I put into that house. Can you help me?

Complaint: Escrow payment went up and I made a payment for the old amount ( accidentally ). I realized the error of my ways and paid the added escrow amount. During the time I made the XXXX payment and the XXXX for the escrow account, the bank did not apply the payment to the mortgage. I called to register a complaint about this practice and the agent put me on hold as he tried to figure out the issue, though I already explained to home what happened. Once he called someone to figure out what I explained, he tried to explain to me what happened, which was not accurate. He said they did not hold on to my payment and not apply. Then he realized the error and explained it correctly. I asked repeatedly to register my complaint and all he wanted to tell me is that is how the process works. I even said I was going to the CFPB and he still would not acknowledge filing my complaint. Throughout all of this he said if a customer makes an overpayment that they will not apply the funds to principal until a full payment is made ( principle and escrow ). Th is not acceptable for a bank to hold on to funds when they should apply to the outstanding balance. It is also not acceptable for someone to have to spend XXXX trying to log a complaint and receive push back from the telephone agent. He made a bad experience worse

Complaint: I wanted to set up automatic payments for my mortgage. I faxed the request and checked with the lender a XXXX later. I was told it had not been received, XXXX days later I got a letter from my mortgage company stating that the request had been received but the voided check had not. I sent a voided check and a new automatic payment request. When the next payment was not taken out of my account, I again called the lender and again was told that they had not received a request for automatic payments. XXXX more time, after receiving a letter that they had the voided check, but not the authorization form, I sent both. When I was again told by customer service that they had n't received the form and voided check, I gave up and mailed a check. The day the check cleared ( XXXX XXXX, 2015, ) I got a letter from the mortgage company stating that the automatic payment of {$1300.00} would start on XXXX XXXX, 2015. I called the mortgage company on XXXX/XXXX/15 and told them to stop the XXXX/XXXX/15 payment as they had already cashed the check. That same day I placed a stop payment on the {$1200.00} at my bank. On XXXX/XXXX/15 the mortgage company withdrew {$1000.00}?? After a faxed request and numerous phone calls the funds have not returned. The customer service department has refused to provide access to a supervisor, once transferring me to " the person who handles your account '' after I told her to transfer me to a supervisor. The person who transferred the telephone call identified herself as " XXXX '' and refused to provide me with a phone number at their corporate offices.

Complaint: My wife and I received a Green Tree Servicing letter stating that my home equity account was forgiven as part of the XXXX XXXX XXXX XXXX settlement. On page XXXX of the letter the last paragraph states, " we will report to the major credit bureaus that your account was paid and closed. '' The forgiveness has been processed. However I have spoken to Green Tree Servicing several times because they will not provide a letter that it has processed and they are saying they will not report that language to the credit agencies. They stated it in black and white on their own letter I didnt negotiate this language and now they need to honor what they stated.

Attempted to contact Green Tree/Lender by phone and email on several occasions, leaving messages each time and have never heard back from them other than to send a letter stating they denied my application. There is additional information concerning the application that I have been unable to convey to them due to their lack of communication concerning the application. Now a " Notice of Trustee 's Sale '' on date XXXX/XXXX/15 has arrived on my front door. Green Tree/Lender does n't appear to be interested in anything but foreclosure. Complaint: Dear XXXX ; Complete failure again by your company leaves me both powerless and victimized. This note is to inform you that yet again Green Tree fails to keep good accounting records and provides zero customer service. I have no faith in your ability to carry out basic business practices and repeat my request to please sell my mortgage to another company that may value me more as a customer. For anyone unaware of what has happened and continue to happen. You need only to look at statements dated XXXX/XXXX/2015 & XXXX/XXXX/2015 where the principal balance remains exactly the same. Please note the amount due in both statements are vastly different. This is a clear action by the company to withhold my payment to gain more interest. How is the evident? The company gets automatic payments twice a month from my bank account and has for many years. It should be impossible for there to be a late payment or for the principal balance to remain the same from XXXX statement to the next. I 'm making XXXX payments within a billing cycle and Green Tree withholds the payment for financial gain. That is theft. Most recently I contacted your customer service phone line where a representative could not explain the error in statements. She claimed a corrected statement would be sent to me within 3-business days and that would have been XXXX XXXX, 2015. It has yet to arrive. When asked how I could trust the value on the pending statement to be accurate since the last one was not, she could not provide an answer. Upon my request she transferred me to a supervisor and that line never led to a human answering the line. A copy of this note is being sent both the Federal Trade Commission & the Consumer Financial Protection Bureau. It is important to note I will also reach out to various lawmakers to seek some kind of solution that prevents this powerless situation where a customer is held hostage by a bad company.
