Complaint: Client came to a HUD agency ( XXXX research, XXXX, De ) for assistance. Housing counselor submitted required documents to lender back in XX/XX/XXXX. Have not heard from lender since submission stating if there is anything additional needed. Client gives Housing counselor a call for follow up and the agency has not heard from lender as well. We also requested payment history of the loan before loan was serviced released to Green Tree Servicing LLC from XXXX. We did not receive any history. XX/XX/XXXX lender called client to request status on second mortgage which also is with Green Tree Mortgage. Mortgage has a XXXX and XXXX with Green Tree. Mortgage is also not reporting on credit report since loan was originated back in XX/XX/XXXX. We have been trying to get answer from lender but have been unsuccessful in getting a response.

Complaint: I missed last XXXX month payments on my loan due to a divorce process. I contact Green tree llc. to modify my loan. But they deny the loan modification. I tried to a payment arrangement with them but they refuse to work any plan. So i finally able to come up with the full past due amount and schedule to make payment on XXXX XXXX. I spoke with XXXX ( supervisor ) and want her to give me assurance that they will not foreclose my property. She told me she can not do that. She did n't want me send any document that i made the payment arrangement. I am unable to get any email from them to show that i made the payment arrangement. I am afraid that i will pay the full pass due amount and they will still do the foreclose procedure and i will lose my house. Please help me to figure out how to save my house.

Complaint: a mortgage co bought out my mortgage and kept putting partial payments in an account they called " unapplied funds '' even though I told them it was extra principle over and over again. when they finally applied the funds correctly, they cheated by not applying them to the correct month. as a result the discrepancy continues growing each month despite my constant complaints

Complaint: I obtained a HAMP modification on my XXXX mortgage. I submitted a loan modification request on the junior lien Green Tree Servicing holds on my property and we requested it be evaluated under 2MP. Afterward, I spoke to XXXX, a Green Tree representative on XXXX XXXX, 2015 to discuss status of a modification application I submitted. According to the representative, while she admitted I was eligible for 2MP, I was denied loan modification.
The loan servicer participates in 2MP, a federal program, and my loan is eligible for modification pursuant to Federal guidelines. Green Tree refuses to participate in good faith in this program. I am living proof..

Complaint: We are the poster children for the real estate crash -- we purchased in XXXX at the top of the market, put 25 % down ( {$150000.00} ) and our rate on the 1st mortgage was 5.875 % ( 6 month Libor ARM with XXXX XXXX ). XXXX would not allow a short sale nor would they reduce the rate on our Libor ARM ( imagine the profit over 10 years -- Libor Index under 1 % and we were paying almost 6 % ).
In XXXX we needed to make repairs to the house. I was unemployed at the time so my husband obtained a HELOC from XXXX in his name only ( I was only on the title ). Servicing was later transferred to XXXX. We struggled for years to make the payments and in XXXX attempted to short sale our home ( due to large reduction in both our incomes ). The 1st mortgage was with XXXX XXXX ( but investor was also XXXX ). We were declined for short sale ( investor XXXX would not approve ). Ironically we had no trouble getting an offer on the HELOC to settle for {$7500.00} -- but only if the first mortgage holder would agree -- also XXXX. We could not afford to keep making payments on HELOC and the 1st so we stopped payment making the payment on the HELOC in XXXX. The HELOC was charged off by XXXX about 6 months later.
In XXXX XXXX with another 24 months in payments and the increase in real estate values we again listed our home for sale in the hopes of paying off the first with XXXX and settling with XXXX on the HELOC. Right after we listed for sale, we got notification that the charged off loan had been transferred again -- now to Green Tree. We had over XXXX showings and a series of price reductions before we finally secured a buyer. With a sales price of {$420000.00} it would pay in full our balance on the 1st and pay approx. {$9500.00} on the {$72000.00} HELOC balance.
Green Tree refused to release the lien unless we came up with an additional {$5000.00} ( which I took out a XXXX loan ). They refused to release my husband for the liability. We were forced to submit tax returns and all asset statements. Our only assets are in our retirement accounts. Our credit scores are high as we have been diligent about trying to reduce debt to prepare for retirement. We are half-way through with putting our XXXX daughter through college and money continues to be tight. The charge off from XXXX dropped off my husband 's credit report in XXXX XXXX and there was never any Green Tree account listed. We closed escrow on the sale of our home XXXX XXXX, XXXX.
Beginning in XXXX XXXX the phone calls started. Three and four times a day to my husband 's office, cell, my cell and office. I explained to them that we had nothing else to pay them and we are close to retirement age ( XXXX and XXXX ). Our only assets are in our retirement accounts. We sent ( registered mail ) two separate do not call letters. I also explained that I was not on the note -- only my husband was.
On XXXX XXXX, XXXX we received a letter ( forwarded from our old address ) from XXXX XXXX XXXX. Cover letter was from Green Tree Servicing dated XXXX/XXXX/XXXX that " Our records indicate this loan has been settled in full to Green Tree Servicing LLC.
Attached was the original HELOC Revolving Loan Agreement -- only in my husband 's name and only his signature.
Today ( XXXX XXXX, XXXX ) I checked our credit reports and was stunned to find a new entry on both our reports ( XXXX XXXX only ) listing past due {$58000.00} Charged Off as Bad Debt and Profit and Loss Write Off.
Green Tree purchased this note for XXXX from XXXX, they received a 20 % pay day on their investment. We ca n't pay them any more and I need assistance in getting this handled once and for all. We do n't want to be forced into bankruptcy over this debt. I need assistance in removing this from our credit reports and ending this issue once and for all.

Complaint: Green Tree financing has had an equity line of credit on my property in Ohio. In XXXX XXXX, they bought the primary mortgage from XXXX. Green Tree doubled the payment on the equity loan in XXXX XXXX. I filed for loan modifications on both loans, the equity interest rate was dropped, but the primary loan was offered to extend back out to a 30 year mortgage at 6.875 %. I did not take this and asked for the amount to bring the mortgage current. I did a pay by phone payment on XXXX XXXX XXXX for {$4600.00}. This was to bring the mortgage current through XXXX XXXX.
Green Tree did not credit the amounts to the account. I have made several calls to clear up the matter, but am being told that they have no record of a {$4600.00} amount. I was told I did n't send in a XXXX payment, but when I produced a receipt, they asked for a couple of weeks to clear their records. Green Tree also said I would continue to accumulate late fees and I should be fine to pay them.
I did get letters dated XXXX stating that both loans were in good standing and were current. Today I received a loan modification packet stating I am 30 days past due.
During one of the conversations, XXXX from Green Tree said " I needed to understand that her investors did n't care about the equity loan and just wanted to foreclose on the property because they could make money ''.
I would refinance to get away from Green Tree, but the value of the home is still less than the combined mortgages.

Complaint: Green Tree again has and continues to violate certain RESPA laws surrounding the servicing and collections practices of my particuliar loan with them and maybe others. I am disputing the response they gave to my compliant below last year. As i have a doucumented letter stating and showing from my understanding to be A ERROR RESOULTON AND iNFORMATION REQUEST PROVISION OF THE MORTGAGE SERVICING RULES. ( 1024.359 ( a ) and ( 1024.369 ( a ) the letter indicates a unpaid principle balance error, amount paid to principal errors, amount paid to interest, amount paid to principal and interest errors, AMOUNT PAID TO ESCROW AND DISBURSED FROM ESCROW ERRORS. The letter shows payment reversals of XXXX principale and interest payments and XXXX other payments made to the account all dated XXXX, the letter also shows payment reversals dated XXXX and XXXX,. i spoke with my representative and she nor her supervisor or any one i spoke to could make sense of this. The peculiar reality about the math or speculative voodo math used is that while it may be performed without the intetion of being appied, the rigorous deductive resoning is abandoned, degraded and disreaged, or forgotten, resulting in only a mind numbering erntertainment excerise. I have attached the for proof of my compliant the letter sent to me on XXXX to dispute their response to my 1st compliant submitted XXXX XXXX. Green Tree has in my research and understanding of the CFPB rules and regulations has violated certain RESPA laws surrounding the servicing and collections practices. The Act of Interplay between the servicing rules, bankruptcy code, and the Fair Debt collection Practices ) : Communications with me as the Borrower under the Early Intervention Rule.the interplay between certain of the XX/XX/XXXX RESPA and TILA Servicing Final Rules and the Fair Debt Collection Practices Act. Error Resolution, Information Requests, and Loss Mitigation RulesXXXX. I have attached documentation from XXXX whom i started my loan modification with and was approved and while making and completing my trail period payments my loan was transferred to Green tree which they do n't seem to want to adhere to the disclosed approved loan mod they gave after 6 months of waiting for them to approve it. During this time the communication regarding the set monthly payment amount by XXXX was challenged by Green tree as they did not want to honor the agreed amount set by XXXX. From this point i have been in a constant battle with them to do the right thing by keep the agreed loan modification agreement sent and approved by both XXXX and Green Tree, dated as of XXXX XXXX XXXX i am now receiving threatening letters of notice of Default when my loan was current. Per the agreement in the summary it summarizes the New Principal Balance, any past due amounts including escrows will be added to the balance, INTEREST RATE, DEFERRAL OF PRINCIPAL, PRINCIPAL FORGIVENESS, ESCROW SHORTAGE, PAYMENT SCHEDULE, AND FEES. In conclusion, Green tree states that i owe a balance due to fees which the agreement states their are no fee or other charges for this modification, thee escrow shortage clause states that at the time they were aware of a shortage and that the shortage may be paid over a 5 year period and payment has been include in the monthly escrow as of the date of the agreement XX/XX/XXXX.

Complaint: Our mortgage was transferred to GreenTree Servicing in XX/XX/XXXX/XX/XX/XXXX. There were confusing documentation sent from both XXXX and Greentree in regard to who and where payments were to be sent. I never rec 'd a payment booklet nor an actual statement. I waited and sent a payment in XX/XX/XXXX. The item I did receive from GreenTree said " Informational Statement '' an " This is not a bill '' ... .I paid in XXXX, XXXX, XXXX ( which they held the check long enough to charge a late fee to my account ). But in XXXX, they ret 'd my check and refused the payment that was above the amount of my house payment. SInce transferring my mortgage to GreenTree, it has been a constant complication. I have tried to deal with them but even completed a " loss mitigation/modification pkt '' in order to settle this issue. I have not been informed of the result, p/there statement but instead rec 'd a letter from a lawyer informing me my house would be up for foreclosure on XX/XX/XXXX. Essentially, we never had a prob prior to Green Tree and I have offered and tried to make payments but they have refused to take them making me further behind and adding ridiculous charges/fees. I need help to deal with these people or advice on how to do so.
