Complaint: A foreclosure notice was issued in the XXXX, AL newspaper about my home. Until then, I had not received any notification from the mortgage holder, Greentree. After approximately five weeks of talking to Greentree representatives and the foreclosure attorney, I submitted the full amount of {$22000.00} to bring the account current. However, the payment was not accepted, and foreclosure proceedings continue. I 'd spoken with XXXX on XXXX/XXXX/15, XXXX/XXXX/15 and XXXX/XXXX/15 and understood that a stay would be issued.
I would like to stop the process and keep my home at XXXX XXXX XXXX in XXXX, AL.

Complaint: XXXX XXXX XXXX were my mortgage company but they turned it over to Greentree Servicing, these are some very rude and uncaring people, they have no training not even the so called Supervisor. If your mortgage payment is XXXX day late, they will try to harasse you into making a payment over the phone which is a XXXX fee then they will tell you that they will waived the XXXX fee but they do n't, after you questions the charge they tell you that their Supervisior forgot to remove it but they never refund you. My mortgage payment was 13 days late I informed the lady that deals with my account that my payment was mailed 5 days ago I asked her to wait until tomorrow but she told me that I should do a short sell because me and my husband were a sad case because we could not pay such a small mortgage payment, she went on and on with many insults and hung up the phone while I was talking. Something must be done about this as a consumer I feel like my hands are tied because this has been going on and on.

I have bank statements to proof it. billing showed a XXXX ( XXXX ) missed payments, even though my bank records showed they had cashed. This company are crooks.

Complaint: I lost my job and fell behind on my mortgage payments in XXXX and XXXX 2014. I have been making payments since XXXX and Greentree rep told me that they would review my account for deferment program since I was only 2 months behind and had been making steady payments. I sent them the requested documents and called 2 weeks later to find out status. They told me they were missing the hardship letter and also that the pay stubs would now need to be more current. I asked if they needed updated bank statements as well and they told me no. I sent updated pay stubs and the hardship letter again.I called a week later and they told me they got the pay stubs but not the hardship letter and that I had to send it again! They also told me that now they also needed bank statements to be updated because in the delay in receiving all the paperwork. I explained that I did not cause the delay and that I had no control over their companies negligence in losing the same document XXXX times!!! I then asked them why I was not getting anything In writing about this entire matter but lots of other notices involving the default etc. they put me on hold and then never got back on the phone to discuss my concerns. I feel that I am being jerked around and the fact that they are not putting anything in writing about this deferment offer seems suspicious. I do not feel comfortable sending any more documents until I have something in writing stating what is needed and the purpose of such documents because for all I know they may be using them for foreclosure purposes and have no intentions of rectifying this matter.

Complaint: Green Tree Servicing LLC recently acquired my mortgage. On the date of transfer, XXXX XXXX, I had not received a mortgage statement, or instructions on how to make a payment. After speaking with a representative, Green Tree insisted that I pay a {$12.00} fee for making a payment over the phone or through their website. My previous mortgage company XXXX Bank allowed automatic payments through their website for free.
Green Tree was unprepared to collect payment as of the loan transfer date. Green Tree has made no effort to contact me in regards to how to make payments. The only correspondence I have received in this matter is from my previous servicer. I have wasted 2 hours dealing with them today.

Complaint: My husband and I refinanced our home in XXXX, 2015. The former mortgage company was Green Tree. Since then we 've gotten several letters and phones calls from them regarding different things from insurance nonpayments to today 's call saying that we owe the XXXX payment plus other charges that were n't named. On their own website it shows that we have a balance of XXXX but they state that 's inconsequential and incorrect. The conversations have become increasingly rude. I 've had my mortgage broker call on my behalf but they tell him one thing me something then my husband something different again.
Previously, they failed to accept the cancellation of my homeowners policy so they paid XXXX policies for a year and a half leaving my escrow several thousand in the negative. I had to deal with that myself with no help from them. Next, they are hounding me for XXXX 's payment that I do not owe and are being rude. Why would they tell us an incorrect amount for payout? Now they are threatening to make the escrow balance even less and therefore me owe them more by paying the taxes that are due even though we have paid off the account. UGH! The woman on the phone seemed to think she was being tough or threatening by stating that the account was still open and we still owed money. Please help! THESE PEOPLE ARE HORRIBLE! THE ONLY GOOD NEWS HERE IS THAT WE HAVE MOVED ON TO ANOTHER COMPANY!!!!!

Complaint: My name is XXXX XXXX I purchased the property from XXXX XXXX. I was set for failure from the get go, when I was placed on an adjustable ARM at 9 % increased to 11 %. I wasnave and the lack of Real estate knowledge and being that my XXXX is XXXX. I felt I was pushed and wronglyadvised by myBroker, to accept these terms. She stressed that I canlaterrefinance XXXX fixed rate.I laterlearned, at the time that XXXXXXXX XXXX, increased the value of thepropertyto cover the closing cost.
When the recession hit, my hours were cut and my wife lost her job also, we were negatively impacted financially andin result had marital problems that almost caused us our marriage.. Wereachedout toXXXX for assistance on my mortgage. I went through the loss mitigation process and XXXX early fromXX/XX/2013.I 'm sure you are aware of the devious practices ; theykept losing the paperwork, and closed my file XXXX times. I tried calledlooking for answers, andwas told bythe lender representativesto keep sending the paperwork.
Theproblem? Icould n't refinance my mortgage ; the property was now upside down it plummet form {$84000.00} to {$54.00}, XXXX. Unable to REFINANCE the adjustable rate to a fixed rate.The loan had transferred from XXXX TO XXXX XXXX XXXX.
I received a point of contact ; an application was mailed out to my residence. I complied but the tedious, repetitive and the lender constantly losing paperwork, lack of communication well turned into a nightmare, I was asked again to resubmit thefile. XXXXXXXX XXXX never assigned single point of contact with Greentree.
I want this nonsense to stop and for GREENTREE to review my present situation lower my rate, andbehave like a professional organization. It 's up to GREENTREE step in andfixthe problemthatinitiallytheir COUNTERPART ( XXXX ) set me up for failure offering me the option ARM.
! I called into your Customer Service Department and could not get a straight answer. I began working with a non-profit organizationthatsent over documents.
Thesituationremainsthesame, I 'm on the phone constantly withGreentree to fix the problem, but you could n't get it right due to communication issues andtheirinflexible process. Things became progressively worse as the agents proved they are utterly incapable of correcting the simpleproblemXXXX/XXXX XXXX XXXX AND NOW GREENTREE created, they clearly do not understand what a signed contract meansorhow to treat clients with respect, THE OPTION ARM IS DECEITFUL AND JUST PLAIN IMMORAL.
A further step down into the abyss occurred whenXXXX XXXX XXXX XXXX XXXX raised my mortgage paymentas explainedearlier XXXX dollars. Nowtheissues to contend with and I could never get a straight answer and the gap between me and GREENTREE began to widen further.
The bottom line is that I Now have an agreement with GREENTREE regarding my mortgage payments and GREENTREE has created a huge mess which continues to snowball.Despite the cry for help, and theirlies, inconsistencies and inability to provide me with answers to my concerns. Complaint: My wife and I came on some hard financial times right at the start of 2010 when she got XXXX. I work from home as a XXXX. We were able to keep both the XXXX and XXXX mortgage payments up while she was collecting unemployment. Once the unemployment ran out we started having serious trouble making XXXX the XXXX and XXXX mortgage payments and fell behind.
We turned to the North Carolina Foreclosure Prevention Fund and were approved for their program. The NCFPF then made good our back payments for both mortgages and continued to make payments for a little over a year until our maximum had been reached.
By the time the NCFPF ran out my wife got XXXX, and while they are a true blessing it did n't help improve our continuing financial issues.
We again got behind on both the XXXX and XXXX mortgages. By this time wife has found gainful employment full time ( 30 hours a week ) with a local bookkeeper. However it took all of our income just to keep the lights on, heat, groceries, car insurance and all the other necessities of daily life and left little to no extra money for the mortgages.
We then turned to our local HUD approved agency for assistance with a HAMP modification. The HUD agency is the XXXX XXXX XXXX XXXX XXXX. We also sought the assistance of another legal agency, the XXXX XXXX XXXX XXXX that provides us with a free attorney.
The attorney proved to be very helpful since the XXXX mortgage company has been trying to foreclose on our home for almost a year and we have been to court more than XXXX times, each time resulting in a postponement while we were working through the HAMP process with XXXX.
We successfully completed the HAMP process with our XXXX mortgage company and are over XXXX payments into that modification with them. And this is where we start to have an issue.
We were told throughout this entire process by our XXXX mortgage company and our HUD rep that once we were approved for the HAMP with our XXXX mortgage company we would automatically be approved for a 2MP with our XXXX mortgage company. The loss mitigation rep at my XXXX mortgage company called late last week and informed us that after their " in house '' review for mortgage modification that we did not qualify.
Needless to say I was perplexed as to why this was in " in house '' review and not under the HAMP law. He did n't really have a good answer as to why we were not eligible under HAMP just that we did n't qualify for HAMP with them, even though all along were led to believe that a XXXX was automatic once the XXXX mortgage company approved us for HAMP.
After calling my HUD rep at XXXX she was able to find out that because our HAMP mod with the XXXX was an FHA HAMP we did n't qualify for an automatic XXXX approval. This is something that my HUD rep was also not aware of for this entire process.
So now I am filing this complaint on the advice of my HUD rep hoping that I can get some kind of positive resolution to this XXXX mortgage modification issue. This matter is further complicated due to the fact that we have another court date scheduled for XXXX XXXX and the court has a sale date for my property already on the books.

Complaint: My mortgage with GreenTree Servicing LLC was {$620.00} for a year when it was modified and transferred from XXXX XXXX XXXX. XXXX XXXX, XXXX, I received an Escrow Account Disclosure Statement stating my mortgage will increase to {$680.00} for the following year. Then I received another Escrow Account Disclosure Statement XX/XX/XXXX stating my mortgage will increase to {$830.00} for the new year. The explanation I was given for these increases were there was a delinquency or deficiency escrow balance of {$6000.00} or more from my previous servicer- XXXX. I therefore requested, in writing on XX/XX/XXXX, that Greetree Servicing provide me with evidence of this delinquency or deficiency escrow balance from my previous servicer- XXXX. I have received several form letters from Greetree Servicing saying they are working on it with delivery dates of resolution that have not been kept. This will be my XXXX month paying the {$830.00} mortgage payment with no evidence to support the delinquency or deficiency escrow balance from my previous servicer- XXXX.
Furthermore, my mortgage is HAMP loan and I have been with Greetree Servicing for a year. According to my HAMP loan agreement I am supposed to receive an incentive payment of {$1000.00} to my principle balance once a year after the anniversary date. I wrote a letter on asking for a written explanation of why I have not receive this incentive payment according to the Actuarial Payment History Greetree Servicing sent me on XX/XX/XXXX. I made my inquiry in writing on XX/XX/XXXX. I have not received an answer for either of these concerns as of yet.

Complaint: My husband and I got behind on our mortgage when my husband had XXXX XXXX. Green Tree sent us notification they were going to foreclose on our home. We finally got the money to catch the payments up and paid it. Thinking we were good we recieved a letter in the mail stating they were taking the necessary steps required by law to gain possession of the creditor 's collateral. It also states they 've sent us a " Notice of Default and right to cure Default '' notice. The notice is still in effect and they will proceed as outlined in the notice unless they receive {$400.00} in late fees. My husband went in person to pay the missed payments and was told we were current. No one said anything about late fees or that they could still foreclose on our home over late fees. They also charge every time you make a payment and with draw money out of our bank account even when we 've not authorized them to do so causing NSF charges at our bank. This company needs to be closed.

Complaint: Greentree removes my tax money and does n't pay my taxes until a month later. This time they decided to raise my monthly impound to cover this, by {$1200.00} a year, saying there is a {$970.00} shortfall. There is no shortfall, they just remove $ 4K+ from my account a month early.
I have proof of the withdrawal and the fact that my taxes remain unpaid. They did this in XXXX of last year as well. I opened a case up then as well.
I have since requested that impounds be removed for all but the mortgage insurance.
