Complaint: I requested a loan modification in XXXX due to financial constraints and have provided numerous documents to the 3rd party representative as requested. This company failed to make any determination about the modification request for greater than 12 months. I was offered as a deed in lieu option with a payout " cash for keys '' in XXXX XXXX. I completed the form and faxed to the mortgage company in early XXXX XXXX under the assumption if this was being offered to me it must be valid. Upon returning from viewing colleges with my son I received notice that my home was being foreclosed upon with a sale date of XXXX/XXXX/XXXX.

They continued the foreclosure process ( dual tracking ) as they were working on my loan modification. Complaint: working with Caliber Home Loans was the most XXXX and horrendous process that I have ever dealt with for one of my clients. As a XXXX, we deal with many lenders on a weekly basis and I will NEVER recommend Caliber to another client. In fact, I will strongly discourage any client, friend or family member to do business with Caliber based on the service that was provided on this transaction. XXXX XXXX, who is the branch manager in the XXXX XXXX office, needs to be instructed on professional courtesy and also needs to better informed when pre-approving a buyer and misleading them with false information upon initial contact. He was very unprofessional not only with my client but also hung up on me and was extremely rude to me on several occasions. He and the others who worked on this file missed several deadlines and also encouraged my buyer to break rules on a HUD contact. They incorrectly scheduled the appraisal and then informed my client that he would be responsible for the additional fee for an appraiser to go out there and re-do the appraisal based on misinformation that was given by Caliber even though we gave very specific instructions that the home was being sold as-is. On top of the issues throughout the process, we got to the final week of close and my buyer was informed that they had incorrectly calculated his DTI in the beginning and that he actually was not approved for the loan. Nothing had changed in my buyers debt or income, only the calculations by the mortgage officer were incorrect. We were able to resolve the issue ; however, it still took Caliber a week to prepare the closing docs and we missed the HUD contract deadline due to this delay. Once finally done, the docs were sent with incorrect data TWICE and had to be corrected. After all of this, when the loan funded, the closing agent LIED to the title company about having processed the wires when in fact, they had not worked the file. In the end, Caliber scrambled to get the funding over prior to close on Friday and, in their haste, sent the funds to the wrong title company. We are still waiting for this issue to be resolved. The practices throughout the entire process were misleading, untrustworthy and the absolute worst service I have ever seen from any lender I have ever worked with. They caused much undue stress on my XXXX-year-old client, the title company and myself. I am happy to give more details on this situation if necessary. I would love to see some sort of compensation for my buyer although I am unsure what could be done to make up for the nightmare that he was put through during this transaction.

Complaint: MORTGAGE MODIFICATION : On XX/XX/2016, I submitted an application for a mortgage loan modification with my new mortgage company, Calilber Home Loans, who had recently purchased our mortgage from XXXX XXXX. XXXX sent a letter to our bankruptcy attorney ( Chapt. XXXX ) indicating we should apply for a modification. For 2 months and 3 weeks, I have submitted and resubmitted document after document, specifically, Transaction Summaries, among other things, regarding my husband 's Social Security XXXX credit and debits on the SSA issued XXXX XXXX Debit Card. I have been submitting, at Caliber 's request, updated Transaction Summaries numerous times and have explained, to Caliber 's satisfaction, I thought, that I did not have access to a " bank statement ''. I can only print Transaction Summaries from the account on the XXXX website. My application for modification becomes null and void on XX/XX/2016. It appears that Caliber 's convoluted, unorganized and cavalier approach to applications for loan modification are designed to frustrate the applicant at every opportunity and to stall the process until the application is null and void. Applicants can not speak directly to loan modification officers, only a " single point of contact '' individual who is the " middle man '' and who can do little to nothing to actually assist the process. They can only pass along what they read on the computer or are told, while the applicant is put on hold, what " they '' said. My bankruptcy attorney told me this process would be " difficult '' because mortgage companies really did not want to modify loans. I had no idea just how difficult and frustrating this process would be! Last week I was told by Caliber that I needed to resubmit the XX/XX/XXXX and XX/XX/2016 " bank statements '' for the XXXX debit card, which I did. I explained, once again that I could not access a " bank statement '' only a Transaction Summary. I was told that the submission would be forwarded to a supervisor for review and to call back in several days. I called today and was told that the Transaction Summaries were not acceptable and that I had to submit a bank statement. My submission is once again going to be submitted to a supervisor, because I apparently convinced him that every transaction on the debit card was recorded by date and amount on the Transaction Summary. I inquired as to why, after almost 3 months of submitting Transaction Summaries, I was being told, a week away from the deadline, that Transaction Summaries would not be accepted. Even if I could get a " bank statement '' I do not have time to obtain them before the XX/XX/XXXX deadline. It appears that Caliber deliberately waited until the last minute to tell me Transaction Summaries were categorically not acceptable in an attempt to have the time run out on my application which expires on XX/XX/2016 - eight days from now. Caliber had ample opportunity to advise me that they would not accept the Transaction Summaries in order to give me an opportunity to try to get them, if possible, and submit them in a timely manner.

Complaint: I submitted a 1st mortgage loan application online with Caliber Homes on Friday, XX/XX/2016. Prior to submitting the online application I contacted Loan Consultant XXXX XXXX with Caliber Homes at the XXXX XXXX branch. I told XXXX what my request was and she told me to submit my application online and put her name on the application so that it would be forwarded to her. I did not hear back from XXXX, so I called her two business days later, on XX/XX/XXXX, and left a voice mail. XXXX returned my call that evening. She did n't really understand my request and pretty much told me that she did n't think I should proceed with my loan request. Quite frankly she did n't even know what product I was looking for. So I told her what loan product I was considering and that Caliber Homes does offer the loan product, which is an FHA XXXX She then told me that another loan consultant handled these transactions. I told her that I would like him to call me. I never heard from him, or XXXX again. In addition, I NEVER received my early disclosures. I also never received any documentation from the mortgage company if my loan was declined or conditionally approved. The mortgage company never processed my " COMPLETE '' application.

Complaint: We are an attorney 's office who represented a client seeking mortgage assistance. She received a modification trial offer and has made all her payments on time. I have been following up with the lender for over a month for final documents and was told on XXXX XXXX, 2016 that they had no authorization for me ( despite working with me to get the mod ). I sent updated authorization and had to wait for them to apply it to the account. Now they tell me that the final documents went to our old address the day after I called in and was told we had no authorization on file, and the deadline to return the documents was on XXXX XXXX. I told them that the docs were not received, and they will only give me until XXXX XXXX, 2016 to return the documents ( that I STILL have not received ) back to them, or they will pull my client 's modification and make her reapply. I specifically asked for a supervisor 5 times in a 45 minute conversation and was refused XXXX.

Caliber Homes charged us {$10000.00} in order to keep our home from being foreclosed, yet we had made the payments ( receipts are attached ). XX/XX/XXXX I mistakenly paid {$87.00} short for a total of 3 months for a total of {$260.00}, yet I was forced to pay {$1900.00} in order to keep our home from going to foreclosure. I did receive one response from Caliber after submitting one complaint with you, they state that I was behind XX/XX/XXXX and therefore needed to pay {$10000.00} to keep my home ( see receipts & statements that I have ). There were many discrepancies at the time for the amount we owed, and that has not been explained ; different amounts are {$17000.00}, {$8600.00}, {$8500.00}, {$8100.00} depending on who you talk to or what correspondence you receive and they have not been addressed. Please address concerns and apply additional monies that I am sure I have paid towards my loan to the principal balance. Thanks in advance for your help with this matter.

Complaint: Your companies " proprietary '' loan modification packages, combined with company procedures, are predatory, misleading, and deceiving, these practices cause, consumers to sign, certain rights away, under distress ; this extortion, causes the consumer to be locked into fess, inflated in many cases by, Pyramiding, Water Falling, and Cascading, causing improper default, and wrongful foreclosure ( s ). I ) Your company states that it sent out a pre- approved loan modification on XXXX XXXX, XXXX, followed by foreclosure proceedings being initiated on XXXX XXXX, then followed by completely different loan modification, being sent out XXXX XXXX, XXXX, being replaced by another on XXXX XXXX, XXXX, because of an error, according to your companies response to case number XXXX. Please explain in detail, as to why your company filed foreclosure proceeding 's before I had time to receive mailed, pre- approved loan modification, or even time to respond ; and the reason your company replaced modification, with one that contained errors, within ( 4 ) days of mailing the first. Also, give the reason your company lied to the CFPB about the date, in which your company initiated foreclosure proceeding, stating XXXX XXXX, XXXX ( I have recorded documentation, from XXXX, dated XXXX XXXX, XXXX, confirming the firm was not contacted until XXXX XXXX, XXXX, to initiate foreclosure proceedings, first notice of default being dated XXXX XXXX, XXXX. ). This is not the only contradicting response, your company has given, in association to this account. II ) My wife made an electronic payment, through her bank, on XXXX XXXX, XXXX, in the amount of {$120.00}, that should have been combined with a unapplied fund balance, to make a whole payment, that was sent back, by your company on XXXX XXXX, XXXX, after your company held payment, for a number of days. Why did your company lie about the date it received these funds? Why did n't your company apply funds, to the date of receipt? Why did your company reject payment, before account was 120 days late? III ) I called your company on XXXX XXXX, XXXX, and spoke with employee number, XXXX to initially make a payment. I was informed the only payment she could accept, was the entire balance of the loan in full, which was well over {$100000.00}, because account was in default, she could not even accept, a payment of {$2500.00}, which according to itemized mortgage statement would bring account current. I then tried to address errors within account, in which her response was, lets get you into this loan modification, after process is complete, only then we can address errors within loan, using pressure tactics, and threats of foreclosure, that would result in the loss of my home, in the attempts to delay correction of errors, only to lock me into errors, by means of " proprietary '' loan mod. I told her then, in that conversation, I felt forced, into signing, and at the time it seemed like my only option, even when I informed her, of the Hardest Hit Modification, application on file, with the state of Alabama, that I turned in, XXXX XXXX. Your company twice run notice ( s ) of default, in local publications, while I was awaiting decision, from the State of Alabama, on complete, Hardest Hit Applications. Why? Your companies policies and procedure 's, I believe, cause this employee to be deceitful, in efforts to cause extortion, and justify a wrongful foreclosure. Please provide recording of entire phone call/ conversation, including all notes, and documentation, relating to call, and issues addressed or brought up during call.
