Complaint: XXXX sold my mortgage to Carrington Mortgage LLC in XXXX 2015. In XX/XX/XXXX, I paid XXXX {$310.00} to cover an escrow shortage. Carrington 's commumincations advised that I had a {$1600.00} shortfall. When I called to discuss this change, they advised that they are allowed by law to hold a 2 month cushion, which I understand. However, when I did an escrow analysis, I determined that they were overstating the shortfall by over {$500.00} because they were *paying* my homeowners insurance, town and school taxes one month before they are due, resulting in over {$500.00} of the shortage. I called and asked how they could pay the bills before they are even sent out, and they replied that the wanted to " make sure the homeowner was not late with a payment ''. While this sounds wonderful, it allows them to hold {$540.00} of my money in escrow in addition to the {$1100.00} cushion, which is {$540.00} that is not available to earn money for me. For example, my homeowners insurance premium is not due until XX/XX/XXXX, but the escrow statement notes that the payment is sent in XX/XX/XXXX. If Carrington does this for only XXXX mortgages, that 's XXXX XXXX in their bank account instead of the home owner 's account. XXXX recently sold XXXX mortgages to this company. If they hold just {$250.00} from each of those customers, that equates to XXXX in funds that have been collected early, and earning money for Carrington. Understanding that the law allows them to hold a 2 month cushion - {$1100.00} ( in my case ) x XXXX = XXXX in Carrington 's account instead of the home owner 's bank.
I have owned my home for 16 years and never had any issue with XXXX or XXXX. I am astounded and appalled to know that this company is allowed to practice in a way that causes the consumer to remit funds that are not due for up to 60 days.
I am in the process of refinancing, but after speaking with Carrington 's customer servcie department, have zero confidence that the funds in my escrow account will be returned to me in a timely manner. Reading the consumer affairs reports about Carrington lowers my confidence level even further. By the time the refinance is complete, Carrington will have over {$2500.00} of my money held hostage in escrow. I would like to know if there are guidelines regarding the process to return money in the event of a refinance, so that I have some ammunition when speaking with the Carrington customer service department.

Complaint: I purchased a my home in XXXX, Arizona in XXXX XXXX through XXXX, XXXX XXXX XXXX making weekly payments with no payments missed. Around XXXX XXXX, I started to receive checks from XXXX XXXX XXXX, when I called them to question these refund checks, they then stated that they bought my loan XXXX. I asked them why the did n't assume my loan, they stated that I was not in their system and that my payments were being posted in an escrow account. B of A stated that because they could not assume my loan that I would have to reapply with them and so I did, with one request, reduce my interest rate to something more reasonable. Every month since then, I have refiled as they claimed that they needed either new documentation and or they lost some part of it. In XXXX of XXXX, I discovered that Carrington Mortage now has my loan. I discussed the past problem with a XXXX XXXX XXXX, the gentlemen who called me and he stated that based on the information that he reviewed, he did n't see a problem getting this loan processed. It is now XXXX XXXX, now they claim that there is an issue with my XXXX issuance letter, they are requesting an updated letter for XXXX. I explained to them that I am a XXXX XXXX for life, the original letter is all I have.
Since this process started with XXXX XXXX XXXX and the fact that they would n't accept payment for my loan, has my credit tied up with this " single '' mark against me. They have tried to Foreclose on my property XXXX times, all of which they withdrew on the date of sale.
This is my retirement home, I make good money, have always been employed and have set aside a years worth of money to clearly prove that I can afford my home. I even gave them a written offer to which they refused. ( very reasonable, I offered them more than the house was [email protected] %, 30 year fixed - they ignored it ) I am not sure what else to do and I need help finding resolve to re-establish my loan and have my credit repaired.

Complaint: Hello my name is XXXX XXXX and im trying to obtain a loan modification to save my house. In this process has made me very confused and feel mislead.Trying to obtain a loan modification threw Carrington Mortgage Services seems impossible. I do n't even know which bank or mortgage company im even dealing with .The statements that are being sent out says XXXX XXXX XXXX and other statements says Carrington Mortgage services.When your also dealing with XXXX different people who is asking to submit information that you already submitted in which I mailed faxed and emailed 5 different occasions it makes you wonder what is going on with this company. My account was assigned a representive from there company but never could get a hold of her and she also said was n't receiving certain documents that I faxed 6 times to there company. I believe and will be proven that there conduct is not only unproffesional but unfair as well. Each and every time I submitted a loan modification packet I was told I did not meet the time requirements as far as them receiving information they needed from me on time and it was always pass the deadline they gave me to that they said they received my paper work. So I was told and letters being sent out to me stating that I was not approved for a loan modification twice because they said they never received my 30 day profit and loss statement but I faxed it to them 4 times well before the deadline they gave me. I was never told I did n't qualify. I just would like to save my home for me and my children, a string of un fortunate events lead me to this position that im in and I just want to save my home for forclosure which is scheduled for sale on XXXX/XXXX/2015. Which gives me very little time to figure this out. I believe threw there unproffesional and misconduct and tactics on acting like there not receiving certain information is a direct attempt to discourage me and in there actions directly cause me to lose my home instead of doing a loan modification in a honest way which would help me save my home. Im getting different info from Different companies for instance Carrington Mortgage Services sends me current mortgage bills, XXXX XXXX XXXX sends me current Mortgage debt as well. This whole ordeal has me lost and confused. If you could help me out in anyway in this matter I would truly appreciate it and would be thankful if you could help me get some honest results in this matter. Im actually working with a company called XXXX to also try and help me in this serious time sensitive matter. So with combined efforts I hope something can be done for me and my children so we can stay in our home and live the AMERICAN DREAM .Thank you for taking the time to read this letter. Complaint: I authorized a Post -dated check to run on XXXX/XXXX/15 for {$940.00} using my savings account. I noticed that this payment never was processed thru my bank account. I was told by my bank that if the account is coded checking account and not saving account that the payment will not process. So the payment of {$940.00} was not coded savings. So since I did n't see the payment go thru, I transferred the money from my savings account to my checking account and did a payment via your website for {$920.00} on XXXX/XXXX/15 confirmation # XXXX that is the amount your website was showing was due. I just received a letter dated XXXX/XXXX/15 stating that the payment I originally gave for {$940.00} dated XXXX was returned. That is incorrect. That payment was made on XXXX/XXXX/15. This was clearly a coding issue not me not being able to make the payment. You have now reported my being 30 days past due. The payment was scheduled on the XXXX day which my credit report should n't have been hit with a 30 day late. I filed a dispute with the mortgage company who said that they will not remove the 30 day because I would have to replace the payment in the same month. This was a coding issue, and the payment was made on the XXXX. I had no knowledge that this was going to happen. How could I have replaced it. I have also attached a letter from my Bank stating the fact. Also Carrington has n't updated my credit report since XXXX and this is affecting my credit rating. I have attached my credit report as well. Also they have stated in there letter that " If a payment is reversed for non sufficient funds ( NFS ) and the replacement is not made in the month that the payment was due, the payment may be reported negativity. I do n't show that anywhere or have I ever in my years in banking known that the payment has to be made in the same month.

Complaint: Carrington Mortgage Services is trying to raise my mortgage payment $ XXXX/mo stating that there is an escrow deficiency. There are many similar stories online after CMS takes over a loan that they have purchased. This creates a hardship and seems predatory. My loan is current and for the last XXXX years ( with XXXX XXXX XXXX ) has always been $ XXXX/mo, now they want {$1700.00}. Complaint: XXXX XXXX XXXX XXXX XXXX transfered our mortgage to CARRINGTON MORTGAGE SERVICES LLC at XXXX XXXX, XXXX CA XXXXXXXXand since then XX/XX/XXXX/XX/XX/XXXX, our numbers do not coincide with what the new CARRINGTON XXXX claims. which is leading to larger monthly payment. We do not receive monthly notices nor any other updates and seem to have to pay approx {$300.00} more monthly on a house we have been paying on since XX/XX/XXXX.

Complaint: Our mortgage was sold to Carrington Mortgage Services in XXXX. After we sent in our XXXX payment, Carrington lost {$100.00} of the payment. They could not account for it, and they did not know where it went. After numerous phone calls, they finally agreed to look into it. It took Carrington more than XXXX weeks to correct it, and they still offered me no explanation as to what happened.
This is when it gets fun! To correct the problem, Carrington deducted a whole additional payment ( {$1200.00} ) from my checking account Without notification or my permission. They were able to do this because they made an electronic-funds-transfer from my original check, and then they also deposited the actual paper check ( same check number too! ). Needless to say, XXXX mortgage payments withdrawn in 32 days overdrew my account. After racking up NSF bank fees for three days, Carrington quietly deposited the money back in my checking account with the notation " check pymt PCF ''. They did n't even attach their name to the transfer. I called Carrington as soon as I found out about this, and all they had to say was " They could n't understand why I made a payment in the middle of the month? '' They could see the extra money, but " there 's no way that they initiated the transfer ''. The woman said that there was nothing they could do. She suggested that I send Carrington " All my bank statements, dating back to XXXX '' XXXX? Are you kidding me? You want some DNA too? Maybe my ATM PIN? I spoke with her supervisor, XXXX, and he said the same thing. I told XXXX that I wanted to Opt-Out of electronic-funds-transfer on my mortgage, and he said that I agreed to that by having my mortgage with Carrington. I told him that he had to abide by my original loan terms, and asked why my monthly statement from Carrington included HIS phone number if I wanted to opt-out of EFT?
Bottom line : Carrington Mortgage is a bunch of loan-shark, scam artists that ca n't even read the information they publish on their own website. They must be used to dealing with lots of delinquent debtors that they can silently exploit as second-class citizens.

Complaint: My mortgage was bought out from XXXX by carrington. My family had a few bad financial months, and fell behind on our mortgage. I kept in touch with them and tried to make numerous XXXX payments in which they did not put towards my account, it went into a " holding '' account ( which I did not know ) when I called to make another payment they would not accept unless it was the full balance owed. I started saving money and calling weekly to make sure it would not be foreclosed on so I could pay the full balance. I finally had the total amount due and called to make a payment for my delinquent months. ( I had just spoken to a rep XXXX days prior ). They informed me that my home had already been sent to a foreclosure attorney a week prior. I explained that this could be true because I had just spoken to a rep XXXX days ago and I could make the payment. Long story short after the supervisor listening to her employee tell me all of the wrong information and that I had a few more days to pay and even saying wait till the XXXX month and pay that also -- that I would not be in threat of foreclosure she assured me that her employee did need more training and made a mistake but it would not change the fact that my home was in foreclosure. So now they will not take my payments and I have to pay reinstatement fees even though admitting her employee was wrong and gave false information. Now I am in fear of losing my home all because I relied on the workers to give me accurate information.

Complaint: My alleged loan is currently serviced by Carrington Mortgage Services ( CMS ). My alleged loan is originated with XXXX, XXXX XXXX XXXX and riddled with fraud and contains forgeries, etc. I previously had XXXX XXXX XXXX who posted many of my mortgage payments to foreclosure fees instead of to my payment account. Money was embezzled from our escrow and payment account and we have complained with XXXX XXXX XXXX and now with Carrington about the inaccurate fraudulent debt to no avail. They continue trying to collect an amount that is not correct. They also continue to report it on my credit even after numerous disputes. Recently, I requested from Carrington proof of claim under U.C.C. Code Article 3 -3-501 ( b ) 2 ( 1 ) to visually inspect the alleged wet ink Note. Carrington response was that they decline because the Note is secured and not available for release until debt is consolidated. They also continue to state that they will no longer respond to my requests and that my loan is in foreclosure even though there is not yet a foreclosure date ( I live in Florida, a judicial state ). They assert that they are the holder/investor/owner/servicer and in other letters they have alleged that they are also the trustee. Nonetheless, there are numerous contradictions in all responses I have received. This foreclosure mill/debt collector ( Carrington ) is threatening with foreclosure and expect that they will continue this fraud without showing us proof that they are truly the holder in due course or that the " original '' wet ink Note actually exists. All they have sent us is a copy of the alleged Note and a Possession Certificate under Florida Statutes by XXXX XXXX XXXX, not from them. I can also confirm that the copy of the alleged original endorsed Note is indeed fraudulent but I will not give details now because I will save it for trial. This alleged loan was " criminally '' created and serviced from the inception. My family and I have been suffering monetary, physical and emotional damages for years. This specific complaint is about Carrington Mortgage Services who has been servicing this alleged loan since XXXX 2014 because they have failed to comply with our debt disputes, QWR 's and now with our request to visually inspect the Note which we have a legal right to do so. I have all documentation to substantiate my claims against CMS.

Complaint: My loan was sold to Carrington Mortgage Services by XXXX XXXX XXXX effective XXXX XXXX, 2015. Prior to the sale of my loan, I was provided with my yearly escrow analysis which explained that my mortage payment would increase by approximately {$30.00} per month. This seemed like a large increase, so I did my research and found out that my taxes and insurance did increase so the increased escrow payment was justified. Fast forward to XXXX 2015. I am now an unwilling customer of Carrington Mortgage Services. I received a new escrow analysis from Carrington stating that my mortgage payment would increase {$120.00} per month OVER the increase that XXXX XXXX XXXX had already implemented. I lookled up my taxes, insurance, principal and interest amounts for each month and came up with exactly what XXXX XXXX XXXX was going to raise my payment to. {$1200.00} per month. I called Carrinton XXXX and was on hold for XXXX+ minutes each time. And while both employees were courteous, I was eventually told that they could " cushion '' my escrow however much they want and I have no recourse. So my payment is now {$1300.00}. This is unacceptable. I did not agree to these terms and will not pay this. It is appalling that I now have to deal with a company that I did not choose and who can change the terms that I legally agreed to with XXXX XXXX XXXX.

Complaint: Loan sold from XXXX XXXX XXXX to " Carrington. '' Within 2 months of sale, escrow payment skyrockets. As apparently as it was explained to me by " Carrington '' XXXX XXXX XXXX did not require a " 2 month cushion '' in my escrow, but " Carrington '' does. Therefore, my escrow skyrocketed. I had no say in this, no warning, no nothing. But a {$140.00} increase in my monthly payment 2 months after being sold to " Carrington ''. They waited 2 months to hit me with the bad news. They say to pay off my " 2 month cushion '', I need to pay them nearly {$3000.00}. What " Carrington '' has done is INCREASE MY MONTHLY PAYMENT FOREVER by adding " their own '' requirement that has nothing to do with my loan. Complaint: I purchased my home XX/XX/XXXX. Since my purchase, my loan has been sold twice, first to XXXX XXXX XXXX & this last time to Carrrington Mortgage. Looking through the paperwork that I received in regards to the sale I think Carrington Mortgage purchased my loan XX/XX/XXXX but my first letter of contact from them was XX/XX/XXXX. While XXXX owned my loan they pulled my mortgage payment from my checking account twice a month, the XXXX & XXXX for the amount of {$1300.00}. My last payment made was XX/XX/XXXX made to XXXX. I assumed that Carrington would continue to honor the payment arrangements. When next payment came up on XXXX XXXX no payment was removed. I waited a few days assuming that things might be a slow because of the sale. I finally called Carrington regarding the payment not being pulled & was informed that I need to re-apply for this service and that because I was behind on the mortgage they would not consider me until I was caught up. When I inquired about being behind they told me that because they had yet to receive the XXXX XXXX payment I was now overdue ( XXXX pulled this payment on XXXX XXXX and Carrington took over loan on XXXX XXXX ). I was also informed that I had an escrow shortage and that my payment was going to increase. As of XXXX XXXX I will be a little over $ XXXX late on my mortgage. I have cashiers checks for XXXX XXXX, XXXX XXXX & XXXX, XXXX XXXX but I 'm not allowed to make these payments because Carrington does not accept partial payments ( XXXX XXXX is still missing according to their records ). We are risking our credit and losing our home, but would like to see Carrington continue to honor the same terms of our loan that was established with XXXX. We would also like to see them take the partial payment XXXX pulled and apply it to XX/XX/XXXX. When that payment is applied we could then catch up on our loan with the cashiers checks that we have.

Complaint: Carrington Mortgage bought my loan about 3 mo ago from XXXX XXXX XXXX. It is a XXXX property. With escrow etc it comes out to XXXX monthly. I found out my insurance company had increased my policy by 3 times the amount in XX/XX/XXXX. This brought my escrow account to XXXX negative. I cancelled that policy effective XXXX XXXX. And started another policy that is 3 time less. With no warning or chance to pay the negative escrow Carrington just sends me a bill for my new payment of XXXX mo. On a XXXX property that only has XXXX yr taxes. They want and escrowed amount of XXXX mo. I have called them twice and now emailed them in reference to this. Their agents tell me it is an escrow cushion. They are asking for XXXX year escrow and my property taxes are XXXX and my insurance is XXXX yr. I told them I wish to pay the negative escrow not to raise the payment. Even with the old insurance amount, negative escrow, and taxes they are still asking for an additional XXXX in my escrow account. I sure can not afford to have my monthly payment increase by XXXX just like that!!!
