Complaint: My wife and I moved into a Family 's home that was larger. We rented out my home at XXXX XXXX XXXX, XXXX XXXX Ga. XXXX. The rental tenant skipped out and trashed the home. We tried to short sale the property and the bank declined the offers. I tried to do a deed in lieu and they did not do that. They started the foreclosure property 3 years ago. They even changed the lock and winterized the home. Two years went buy and they never foreclosed. I filed bankruptcy on this last year. They still have not foreclosed. They have been paying the property taxes and insurance yet the home is still in my name. I called FHA resources and he stated their is no claim on my XXXX report of where Bankruptcy was started therefore they illegally changed the locks on the home since it is not in Bankruptcy and still in my name. I do not want the home back, I want them to foreclose on it like we agreed 3 years ago so I can re establish credit and buy again in the future. Furthermore this home is getting vandalized and people are doing drugs in it. I contacted the police as I see it unsafe for the neighbors and children out playing, he stated that they have contacted the bank regarding theses issues at the property as well and they do not bother to board the home up or do anything to prevent this from occurring. I feel it is unfair they have changed the locks and started the bankruptcy process over 3 years ago yet have not reported it to FHA so it can begin to give me a clear XXXX report. Complaint: I filed a Chapter XXXX bankruptcy in XXXX. In XXXX XXXX I converted to a Chapter XXXX and Carrington Mortgage Account # XXXX was included in that Chapter XXXX and was successfully discharged in XXXX XXXX. I have been fighting with this company ever since. They continue to contact me and send statements saying I owe this debt and I DO NOT. They continue to report to the credit bureaus that it 's an open account with 180 days late with past due balance and I 've had to get this corrected 3 times and just when I get it corrected to report as included in bankruptcy they have reported it back again to the credit bureaus as open past due and this account is CLOSED discharged through Chapter XXXX bankruptcy as of XXXX XXXX. Also they have yet to take ownership over the mortgage and I still have the County sending me property tax statements and I explained to them that I DO NOT own this house anymore that it was included in my Chapter XXXX bankruptcy and they informed me that the mortgage company has not taken it out of my name yet. What they are doing is illegal and before I hire a lawyer to sue them, I would like for your company to step in and make this right.

Complaint: on XXXX/XXXX/XXXX I applied for a loan modification of my house with XXXX after 8 months of negotiation and when they have all documents to make a decision, XXXX on XXXX/XXXX/XXXX transferred the loan to XXXX on XXXX/XXXX/XXXX I have submitted a complete loan modification package and keep constant communication on XXXX/XXXX/XXXX XXXX XXXX from Carrington Mortgage has requested recorded divorce decree and quitclaim deed.XX/XX/XXXX XXXX XXXX has requested aditional info. on XXXX/XXXX/XXXX XXXX XXXX told me that foreclosure is on hold while they review the loan modification package XXXX/XXXX/XXXX XXXX XXXX asked me to resubmit the complete package. on XXXX/XXXX/XXXX I calle dXXXX and he told me that on XXXX/XXXX/XXXX the foreclosure was executed because there was not enough time to work out the loan modification. This is an abuse, they lied to me now I 'm going to be homeless because XXXX and Carrington Mortgage Services LLC are so irresponsible. Thank you in advance for all the help that you can give me.

Complaint: My 2nd lien mortgage is very delinquent due to a BK and payments not being paid to the creditor during the BK. I have tried everything in my power to work with this company. As I am now able to make the payments and keep the loan current. I sent a check for XXXX payment {$19000.00}. The check was not cashed or returned. This would cover all the PITI. leaving only fees and forced placed flood insurance ( my hone is not in a flood zone I paid the {$500.00} to have a the home re-survey and the letter needed for XXXX to remove it ) Not sure why the 2nd forced placed insurance and my first lien did not. I attempted to call and e-mail their advocacy group and was told they can not talk to me due to a cease and desist order. I exampled that was put in place due to the BK and that only means they can not contact me but if I 'm seeking out help they can talk to me. The rep refused to give me any additional information as to where my {$19000.00} went and why it was not accepted. The loan has not been breached and is not in XXXX they send me a monthly statement. They have no right to refuse payment. They have in no way issued a demand letter demanding payment in full. I tried to send them the full XXXX payments I am behind in XXXX payment and like I said above not sure what happened the check has not been cashed or returned and they wont talk to me. The chpt XXXX BK was completed XXXX 2015 all payments were paid on time.

Complaint: Carrington has incorrect and misleading information on their consumer webpage. My loan was transferred from XXXX in XXXX XXXX and apparently, my ACH payment was successfully transferred unchanged. Unfortunately, the timing of my ACH payment did, in fact change. When I log into my account, my payment shows in my payment history as executing on XXXX XXXX. In small letters at the bottom of the page, the words " updated XXXX XXXX '' appear. On the main page, the words " previous payment received XXXX XXXX '' appear. In fact the draft failed to process on XXXX XXXX. Contrary to what is specifically stated in their faq at http : //carringtonms.comXXXX which states " How current is my loan information? All loan information is displayed on our website in real time. When we enter your payment in our system, the information on the Loan Servicing Website is also updated. '' This is clearly untrue. I did not realize that the ACH failed, and was in no way contacted by Carrington. On XXXX XXXX, after finally realizing that the payment had not processed, I called carrington 's phone number to make a phone payment. The Carrington service representative refused to process my payment by phone. The website also would not allow payment of any kind. I was informed on XXXX/XXXX/16 that I would have to pay with " certified funds '' and was directed to XXXX XXXX. Returning to the Carrington faq. I attempted to follow the instructions listed for making a payment via XXXX XXXX, only to find that Carrington Mortgage, LLC is NOT listed among the mortgage companies that can be payed in this manner. I called Carrington back and requested that whatever blocks were being placed on my ability to make a payment online or by phone be released. I was told that this is impossible. I in good faith was attempting to pay my mortgage payment, and prevent a " 30 days past due '' mark on my credit reports. Carrington has failed to accept my good faith attempts to pay, and has unfairly restricted how I may pay. Carrington refuses to remove these hindrances. As of today I have mailed them a cashiers check for both XXXX and XXXX of 2016, along with more than {$100.00} excess so that some unmentioned fee does not prevent the cashiers check from meeting the total due. Had Carrington 's website not been misleading in critical areas, and absolutely incorrect in others, this would never have happened. The fact that no one that I talked to by phone could explain when exactly I had agreed to the terms of payment they now require bears further examination and scrutiny, as does the fraudulent and misleading conduct of this company. I have asked that any derogatory credit reporting that has happened as a consequence of their error, their misrepresentation of the status of my account, or their unwillingness to accept payment by phone, be removed and expunged from any/all credit reporting bureaus. Further, I have a recording of my interaction with customer service, screen captures of their website and of my personal account that clearly prove their inaccuracy and unwillingness to accept payment. If this issue is not resolved immediately and to my satisfaction, I will pursue legal action in the State of Texas.

Complaint: I am in need of immediate assistance with my mortgage company, Carrington Mortgage Services. I am behind on my mortgage and faced foreclosure which is a final judgment made. I went to a realtor and was attempting to do a short sale on my home as I thought that was the only alternative. Carrington said that since I have an FHA mortgage I had to go through a modification first. I contacted them and they sent me a packet that was to be returned on XXXX XXXX. I did that. I also sat with a HUD counseling agency, XXXX, and we both put all the paperwork together that was to be submitted by XXXX XXXX. When I sent the packet, I followed up and Carrington rep confirmed receipt of all my documents. During the gathering of the documents, a sheriff 's sale notice was taped on my front door. I contact the the sheriff 's office in XXXX, NJ and was advised to come in and apply for XXXX ( XXXX ) of XXXX ( XXXX ) adjournments. I did that on XXXX XXXX and continued to gather the documents to be sent to the mortgage company for the modification. On XXXX XXXX, I contact them and was told that they would not be reviewing my packet because it had to be in by 37 days prior to a scheduled sheriff 's sale which according to their records, is XXXX XXXX, 2016. I explained to the rep that I got an adjournment until XXXX XXXX. She told me to submit additional paperwork along with the sheriff 's sale notice of adjournment by XXXX. I did that. I then called on Friday, XXXX XXXX and was told that they still will not be accepting my application because it was too late and I did n't get the information in on time. I asked to speak with a supervisor and was transferred to XXXX. He told me to resubmit ( reapply ) my information and include ( again ) the sheriff 's sale notice regarding the adjournment. I did so after speaking with him. I also expressed my dismay and confusion as to why he 's asking me to do this XXXX by coming back and saying they wo n't review my information because I am too late and not within the time frame of 27 days before a scheduled sale. I tried to explain to him that the sale was postponed and they have that information in the packet I had to send on XXXX XXXX by XXXX. I even told him what page number it was on in the pdf file that was sent. He said nothing as if he was n't even looking at my documents. After getting off the phone, I cried. I then contacted the HOPE hotline and was referred to the HUD National Servicing Center to file a complaint. A woman left me a message from HUD today to tell me that she spoke with Carrington and they will not review my paperwork and are proceeding with the sheriff sale of XXXX XXXX. Someone please help. Carrington is n't even looking at my paperwork. I do n't know if they can proceed with the sale tomorrow given that I have an adjournment or not. I do n't know what to do at this point. I want to try to keep my home and realize I am going to struggle to do so, but where do I go from here? I need someone to really listen and help me. The rep from XXXX suggested I submit this complaint to your office so that you may be either able to help me or at least monitor what is going on. Complaint: Carrington Mortgage Services ( carringtonms.com ) is defrauding consumers by not allowing any additional principal or escrow payments on my mortgage account. I contacted them via phone twice ( once in XXXX XXXX and once in XXXX XXXX ) and was given differing stories about why I could not pay additional principal-I was told once that there was an issue with the website and once that because my mortgage was newly purchased from XXXX that processing was still taking place and that I would be able to make additiol payments the following month ( XXXX XXXX XXXX. This did not happen. I sent and email on XXXX XXXX, XXXX and lo and behold I was able to pay additional principal in XXXX XXXX. In XXXX, it went back to no additional payments and again in XXXX, and now for my XXXX payment again. I know that additional principal payments decreases the amount of profit for the company for the mortgage and this is fraud.

Complaint: To whom this may concern, my name is XXXX XXXX. My husband, XXXX XXXX, my XXXX children, ages XXXX & XXXX and myself live in XXXX, TN. We are devastated and terrified that our mortgage co., Carrington Mortgage has deliberately and methodically steered our mortgage into foreclosure for their own monetary gain without any concern for our family or well being for us & our young children. They have now issued a sale date for XXXX XXXX, XXXX. Our hardship began in XXXX when I was injured in a car accident that was not my fault. I was unable to work for some time because of the injuries sustained. I continue to be under doctor 's care but I have recently taken a job for far less than I used to make just to try and make ends meet. I still have to take pain meds daily although I want to discontinue them as soon as possible. When we first reached out to Carrington to let them know of our hardship they said they would send us a package in the mail to fill out and we should n't worry because there were programs that could put us back on track and possibly even lower our monthly payment. We told them that we had a modification prior to but the person told us as long as we had a new hardship than it should n't be a problem getting a new one. That is really when our nightmare began with them. We began the process of submitting the modification package to them and we began to experience continuous runarounds when we would follow-up to see if they had received what we had sent. Violation of The Real Estate Settlement Procedures Act ( Regulation X ) 1024.41 Loss mitigation procedures. The Consumer Financial Protection Bureau established rules to " protect mortgage borrowers from costly surprises and runarounds by their servicers. '' It almost appeared, in time, that they were purposely losing documents or pretending to lose documents to stall the process of attempting to get a modification. Something was going on with our file because the hurdles and roadblocks seemed to increase although we continued to give them the documentation they kept asking for repeatedly. 1024.41 ( b ) Receipt of Loss Mitigation application - " A servicer shall exercise reasonable diligence in obtaining documents and information to complete a loss mitigation application. '' 1024.41 ( b ) ( 2 ) ( B ) " Notify the borrower in writing within 5 days after receiving the loss mitigation application that the servicer acknowledges receipt of the loss mitigation application and that the servicer has determined that the loss mitigation application is either complete or incomplete. '' Month after month we continued to endure phone calls & emails not being returned. When we would get through to someone, we would be assigned a new account mgr. and would have to explain our situation all over again and that person would want updated pay stubs and bank statements. 1024.40 Continuity of contact - " Servicers are required to maintain reasonable policies and procedures with respect to providing delinquent borrowers with access to personnel to assist them with loss mitigation options ''. Why were n't we assigned a single point of contact to assist us in saving our home? The next thing we knew, we were in active foreclosure and soon after that a sale date of XXXX XXXX, XXXX was issued. How is that possible when we were still trying to get a modification? 1024.41 ( g ) Dual Tracking is prohibited. " Servicers can not start a foreclosure proceeding if a borrower has already submitted a complete application for a loan modification or other alternative to foreclosure. We desperately need someone to intervene and contact Carrington Mortgage and postpone the sale date while someone reviews a new financial package that we just submitted. We ca n't lose our home, we would have nowhere to go. Please help us!!! XXXX & XXXX XXXX

Complaint: I was supposed to receive an escrow check from this company. I sold my house on XX/XX/XXXX. XX/XX/XXXX and I still had not seen a check. I called them on XX/XX/XXXX and they told me it was mailed out on XX/XX/XXXX. I have received all kinds of mail form them but no check. On the XXXX a gentleman told me that he would stop payment on the old check and have them issue a new check, to wait 5 days. If I did not see a check by Saturday XX/XX/XXXX then to call back. I called back on XX/XX/XXXX and the lady told me that the gentleman had mad a mistake and put the check back in escrow! After a long conversation with her she said that her supervisor agreed to have the check sent next day air to my address. She also said to call back on XX/XX/XXXX and they would have a tracking number. I called back on XX/XX/XXXX and the new lady said the check was still in process of being issued and that it would take about 2 weeks for me receive this check. I settle on my new house on XX/XX/XXXX and this is money I was going to use for the down payment! Now I may lose the new house and all they can do is say sorry for the inconvenience. They flat out lied to me from the 1st phone call, I asked to speak to a supervisor and they kept transferring me to different departments. This company dose not know the 1st thing about customer service!

Complaint: Carrington Mortgage Services sent me a notice of intent of foreclosure. I am up to date on all of my payments, they have no reason to foreclose on my house. I have all my bank statements to prove every payment has been withdrawn from my account. Even on their website my account shows every payment made. I first had issues in XX/XX/XXXX, they told me they never received my payment even though the funds had already been withdrawn from my account. They finally applied the XX/XX/XXXX payment I made on XX/XX/XXXX to my account on XX/XX/XXXX. I then made my XX/XX/XXXX payment on XX/XX/XXXX and they are telling me that was for my XX/XX/XXXX Payment. I have proof of every payment for the entire time my loan has been through them. They also increased my escrow account due to a " deficit ''. I did the math, there was no deficit and they are charging me double for my escrow. My property taxes and homeowners insurance do not add up to amount of escrow they are charging me.

Complaint: Company increased my mortgage payment for escrow shortage. Claim they sent a notice although I did not receive it. My auto-bill payment account completed an on-time payment using the old amount ( {$55.00} short of new payment ), after which i received a letter stating no payment was received. I was charged a {$25.00} late fee that the company would not reverse. At present, the company is still holding my payment without applying to my account, stating they can not apply until full payment is received. This does not seem like proper accounting practice.
