Complaint: I am the owner of a home at XXXX XXXX XXXX, XXXX XXXX, VA XXXX. On or about XXXX/XXXX/XXXX, a Veteran 's Administration loan was closed with XXXX as both the " nominee '' and the " beneficiary, '' and XXXX XXXX XXXX XXXX ( XXXX ) as the " lender. '' They appointed attorney XXXX XXXX as trustee ( in a conversation with XXXX XXXX that I had appx a year ago, she said she had no recollection of ever being a trustee ). XX/XX/XXXX, XXXX was raided and shut down by the FBI for massive fraud. XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, and Reconstrust were all involved with the property for the next few years, and, then, around XXXX of XXXX, XXXX and XXXX changed the trustee to XXXX XXXX XXXX ( XXXX ). One problem : # XXXX of the Deed of Trust states only the LENDER can change trustees, and neither XXXX nor XXXX were the lender on the alleged loan-XXXX was, and they went out of business in XX/XX/XXXX. All subsequent appointments and actions of XXXX were therefore fraudulent. Carrington Mortgage Services took over around XX/XX/XXXX, and promptly threatened to accelerate the loan. I am the owner of record in XXXX County and sent them a debt validation letter to them upon receipt of their letter, which they never validated. Since then, they have, together with XXXX, twice tried to foreclose, each time being an FDCPA violation, not to mention violations of the Hobbs Act, codified at 18 U.S.C. 1951 ( a U.S. federal law that prohibits actual or attempted robbery or extortion affecting interstate or foreign commerce-I live in Nevada ). It also a violation of XXXX XXXX, deceptive trade practices vs an older person. In XXXX XXXX, I sent a rescission letter to Carrington, which they " rejected. '' However, since the XXXX Supreme Court decision in XXXX v XXXX in XXXX XXXX, XXXX made it clear that a rescission, right or wrong, is effective from the moment it is mailed, and that a lender/servicer must bring suit within 20 days of receipt to overturn the rescission. Carrington did not bring any suit, so they are forever barred from bringing any defenses. They have harassed my tenants and thus are threatening my income, not to mention are intentionally inflicting emotional distress upon me, as I will soon be seeing a psychiatrist. Finally, they have called me twice, with an autodialer on my cell phone in the last months, which is a TCPA violation as well as another FDCPA violation. Also, Carrington ( along with XXXX XXXX ) was fined XXXX XX/XX/XXXX for fraudulent assignments-exactly what they tried to pull here, and XXXX has no license to collect debts in Nevada, which is a requirement here. The " Release '' clause in the DOT, # XXXX, says when the Lender is paid off, the property is supposed to be reconveyed ( DOT is attached, the first XXXX pages of the " XXXX '' file ). Needless to say, several parties have been paid off ( in addition to XXXX ) and no reconveyance has occurred, more fraud. Carrington Mortgage has ignored ignored a QWR letter and a UCC-9-210, which gave them 14 days to dispute my contention that there was no loan amount due. Carrington is XXXX and deserves an even larger fine than they got last year.

Complaint: Carrington Mortgage Services, LLC ( XXXX, CA ) recently bought our mortgage from XXXX XXXX XXXX. I have not recieved a notice or letter from my new service, Carrington Mortgage Services , LLC . It has now reached the 15 days time frame I should have received a notice, as mentioned in my rights from the notice from my previous server, XXXX XXXX XXXX.
When I called Carrington Mortgage, they refused to take a payment by phone or online. I am not current on my loan and need to make payments but it seems they are trying to make it " difficult '' to get a payment to the company. Not sharing important information of where to send the payment, not giving me my new loan number and refusing to set up payments. However when I agreed to send a XXXX XXXX they stated " I better call because they may " flag '' my loan as foreclosure. However I have not received 'Any ' information from them. I am really upset and disappointed with the company and when I asked about setting up automatic withdraw payments after the XXXX is paid and the account is current, they statement reply was - I would not be able to set up automatic withdraw payments for six months of paying current. I feel this is discrimination also due to the fact that I had a financial hardship while being laid off XXXX. Why would a creditor not want automatic bank payments??????? Straight from you account ... The answer I feel is they are trying to set me up for failure to loose my home. The law states this should not happen. I am wanting to make my payments. Please Help!

Complaint: I have been making additional principal payments on my mortgage. I send XXXX separate checks each month, because I do n't trust them. I noticed on my statement that instead of crediting me {$300.00}, they credited {$290.00}. I called them and asked about it. They noticed it on the previous month as well. They refused to accept copies of bank statements and insisted that I go to my bank and get check copies, front and back. I am sure they hoped I would just drop it. I am sure they are during this to many, if not all of their customers, which could total into XXXX dollars over time, which is why I am continuing to pursue this.

I received a modification with Carrington Mortgage. It was confusing because first i was denied then I received one, then I was trying to make the payment on XXXX XXXX and I called the number on the modification and I was not able to make it. We called Carrington and spoke with XXXX in foreclosure department and he advised that someone would call me. I never received a call. I kept calling the bank to no avail. We called again today and finally spoke with XXXX in the Home Retention Department and I was advised that I had to reapply. I offered to make both the XX/XX/XXXX payment and the XX/XX/XXXX payment, but she said she could not take my payments. This has been a very stressful situation and I am at my wits end. Now XXXX advised that I have until Thursday XX/XX/XXXX to submit ALL of the documentation all over again. Please assist me in not losing my home, as I waited over 5 years to finally receive one and when I was going to pay they are not taking my payments. Another thing that they did, is that we kept having people trespass onto our property because all along they had the property on Auction.com while we were in the modification status, so how can we believe that even making the payment the house would not have been foreclosed, seems they have been dual tracking all along. The people stated that we were going to auction because we were losing our home! Can you imagine how one feels when we are trying to make payments and we hear this? Complaint: Good morning, on XXXX XXXX after attempting for countless months to get a loan modification with XXXX XXXX XXXX I receive a foreclosure notice from XXXX XXXX XXXX giving me less than 20 days to appeal. I file for Chapter XXXX and the rear payment was included, since then I was making the regular Mortgage payment to ( XXXX ) and the past due balance was being made by the Trustee. On XXXX of XXXX ( XXXX ) sold my contract to Carrington mortgage. Upon receipt of the notice I contacted Carrington to start making the payment to them, I was told that I would have to continue sending my payment to XXXX since they have not loaded all the accounts yet into their system. My first payment to Carrington Mortgage was XXXX XXXX and the months after up to XXXX XXXX. On XXXX XXXX XXXX I receive a notice address just to me stated my escrow was in the negative due to insurance and taxes increase, I pay the negative balance in full. I have attempted every day after up to the XXXX and was told that I 'm behind by 5 months that the minimum they can accept is 3 months. I ask them where did they applied the previous payment dated from XXXX XXXX and was told that someone would get back with me. I have waited until the next month when I have tried to pay yet again XXXX and XXXX was told the same story. My Bankruptcy lawyer have also contacted them to provide a payment history since XXXX have yet to get a reply to their notice. As of XXXX of XXXX I have all payments dated back from XXXX of this year waiting to be issue to Carrington. Every day I have XXXX my property to look for any foreclosing notice on my house. Recently we had a storm that had damage my roof and now the roof is leaking right in the middle of my bed when I contacted my home owner insurance was told that I could not file a claim due to my delinquency on my account. My home owner, property insurance is pay with my mortgage via escrow. I have made my last payment to the Trustee last month I 'm afraid that now I 'm no longer cover under Chapter XXXX they might take this opportunity to foreclose on me since the housing market is going up and I 'm no longer upside-down.
Please help me save my house my Husband XXXX Veteran with XXXX his having more XXXX than usual because he 's afraid that we might be homeless any day. We are not qualify to purchase or renting other property since we just recently got out of bankruptcy.

Complaint: Mortgage servicer Carrington Mortgages LLC claims that I mistyped my account number when attempting to make payment via their payment website on my mortgage for XX/XX/XXXX. I have requested in writing via certified mail that they show me evidence that such a mistype had occurred. I am currently awaiting for their investigations to complete to be advised. In the meantime I received a phone call stating that my account has now been " flagged '' and that I need to call them up ASAP. I am not in arrears. Hopefully they will post my XX/XX/XXXX mortgage payment that I submitted for mortgage payment XX/XX/XXXX.
Prior to the above, they increased my escrow account cushion since they claim they require 60 days cushion whereas previous servicer XXXX XXXX XXXX did not, then they hard push for me to refinance with them.
I would like to know what financial benefits or interests this organization has for being a mortgage servicer. As I feel that there is none whatsoever except for recovering late fees and foreclosing on individuals which have never been late prior to Carrington Mortgages LLC becoming their servicer.

Complaint: I completed an application for a modification with Carrington Mortgage Services XXXX XXXX. I received a call last week stating that they could not assist me because they did not find a hardship. The total loan amount on my mortgage is {$100000.00}. The value according to the comps in my area are {$40000.00} and XXXX has the value as {$62.00}, XXXX. This is indeed a hardship to be paying more for a house than it is worth. I have a conventional loan therefore I am ineligible for the HARP and I originally purchased the home after XXXX XXXX, XXXX. I purchased the home XXXX XXXX, XXXX. I have not missed a payment because I do not want to hurt my credit. I get the feeling that they want me to miss a payment to qualify for their program but I do n't want to hurt my credit. I want them to see the situation that I am in for what it is and provide a solution. I suggested that they lower the principal or at least give me a lower interest rate. Right now I am paying 5.5 % when FHA is between 2.75 and 3.65 % today.

Complaint: I am a XXXX in Maryland. I listed a XXXX home from Carrington MORTGAGE services. I signed a form with Carrington REAL ESTATE services agreeing to pay 35 % referral fee. The listing agreement with Carrington MORTGAGE services had me paying a 1.5 % referral fee to Carrington PROPERTY services. The agreement also stated that the max referral fee would be 1.5 % I assumed I was only paying a 1.5 % referral fee to Carrington. I never noticed they were all different companies they all had the same logos. They never disclosed that they were all different. All you see on there forms is the Carrington logo then in small letters either MORTGAGE PROPERTY REAL ESTATE services depending on who your paying. I think this XXXX a RESPA violation. How many other Realtors work hard for there commission only to find out at the settlement Carrington and all there partnership are getting there money they worked hard for.

Complaint: XX/XX/XXXX our mortgage was transferred from XXXX XXXX to Carrington Mortgage. We started to get all the paperwork regarding the transfer and on XXXX XXXX we got some more information. On the XXXX XXXX at XXXX I called XXXX. The call lasted 6 minutes and 37 seconds. I will be attaching a screenshot of that phone call log that I took on my phone. What I was calling to ask about was how this works as I have never had a mortgage change financial institutions before and there was some verbiage in there about 60 days and I needed to know what that meant. When I asked about this letter and what the numbers meant I was told i had 60 days to make a payment. Which would make it XXXX XXXX my first payment was due. The lady on the phone confirmed and repeated that. So I took that as i did not have to make my first payment until XXXX XXXX. Fast forward to Some time in XXXX and I get a letter that we are past due on our first payment. I then called in to ask about this letter and I explain to this person that I called back in XXXX and was told my first payment was not due until XXXX XXXX. They said that was incorrect and that it is due now. The person on the phone said they would start an investigation into this. I did not hear back for a month. I called back and they said they never found that call on my account. I had to gather all my evidence and send it to XXXX XXXX fax ) which was their research team. I got on XXXX XXXX from their research team that they received my request. It also mentioned that we owed XXXX Soon after I got a letter from their research team saying they can not find my call. We then agreed that i would make payments to catch up and it would go into an unapplied balance and when that unapplied balance reached the amount due it would be used to pay that. So now fast forward to XXXX and me and my wife are trying to buy a car for her that gets better mileage as she will be driving to school a couple times a week. We get our credit report and our score is very low. Turns outs Carrington Mortgage has reported us 3-4 times for being late on payment even though they agreed that would n't be the case as long as i made these payments. This in turn has killed our credit and is stopping the ability for us to get a good loan for a car for my wife to go to school in. I had to borrow money to pay off the rest of the loan now that I know that they will keep reporting me. Carrington Mortgage has lied to me to many times and they are not trustworthy. I do n't believe they have my best interest and hope to get out as soon as I can.

Complaint: I have been unable to get in contact with Carrington Mortgage LLC, services of my mortgage loan. I used to have XXXX, and XXXX sold loan to Carrington Mortgage. I googled Carrington and they have over XXXX complaints, worst customer service ever. Here is my issue. On XXXX/XXXX/16 I cancelled the remaining portion 1/2 payment mortgage check for XX/XX/XXXX. I cancelled that check and reissued another in {$880.00} amount through XXXX bill pay. The check was sent on XX/XX/XXXX and I know Carrignton Mortgage received it XXXX. XXXX gives it a deliver by date of XX/XX/XXXX. The check still has n't cleared my account as of XX/XX/XXXX and it usually does immediately within 1 day. I want to make sure that Carrington Mortgage does NOT say my check is 30 days late and report to credit bureaus. Full mortgage was received by them within the 30 day allotted time allowance. I 've searched and saw where Carrington Mortgage will falsely indicate 30 day late on credit report and I CAN NOT HAVE THAT. So I 'm trying to prevent this.
