Complaint: Carrington Mortgage Services , LLC is committing mail fraud by posting false address of us in the website addressed as : XXXX XXXX XXXX Anyone creating a free account of the website and logs in can search by the property address of XXXX XXXX XXXX, XXXX, TX XXXX, will see the fraudulent page that would display our fraudulent information. Our address has been posted to be : XXXX XXXX XXXX, XXXX, TX XXXX. They are using this mailing address to post their auction for our property. This has been done to fraudulently access the mails of interested buyer who would be willing to buy our property and communicates with us. Also Carrington, in the site, has posted the straw borrower 's information and the flipped mortgage loan information to increase the foreclosure bid higher for the house. This is an example of how low can a mortgage servicer/lender can stoop down to in committing mortgage fraud. This act qualifies for both fraud for money and fraud for property.

Complaint: My loan to value ( XXXX ) is currently at 75 %. I contacted this company to remove my private mortgage insurance since I am still paying when I no loner required to do so. I previously requested removal of PMI which has not occurred. As a result, I would like it immediately removed and reimbursement of the all PMI since XX/XX/2018 ( when my loan was transferred ). This company continue to state that it takes time or they haven't received my correspondence.

Complaint: My complaint is with my current mortgage lender Carrington Mortgage. I have tried to work out a payment arrangement because I am not eligible for Loss Mitigation Request. My original loss mitigation request was granted last year in XX/XX/XXXX. I was on a trial payment for 4 months and the Loss Mitigation was granted XX/XX/XXXX. Unfortunately, I became ill from a chronic illness that I have been battling with. I was hospitalized and had to go for treatment on an outpatient basis. During this time, I was upside down with online pay advance lenders and the lenders were deducting their fees from my paycheck. Carrington Mortgage had a representative come to my home in XX/XX/XXXX to advise me to apply for another Loss Mitigation request so I could catch up with my mortgage payments. The first application I submitted was in XX/XX/XXXX, it was denied because I was missing information that was needed for the underwriters to review. I applied again, submitted my papers in XX/XX/XXXX. This time I included both of my sons on the application to show that we were able to make the back mortgage payments within a reasonable time period. XX/XX/XXXX, I had emergency XXXX and was hospitalized for a few days, during that time under heavy medication, I received a call from the Loss Mitigation Department.. a few hours after I was out of recovery and was told that Carrington could not use my youngest sons information because he did not have any bank statements, even though he is paid every week by check. I was giving a deadline of XX/XX/XXXX to provide proof that the {$200.00} he was paying me once a month was deposited into my account. I was released from the hospital and out of work for 5 weeks. I contacted Carrington Mortgage and was told that it would be better that I removed my youngest son as an additional applicant so the application could be processed. I was seeking a payment plan to pay the arrearage and current mortgage. The Loss Mitigation Department denied my request because of my oldest son and my debt to income ratio that included my student loans, medical bills and car payment. I submitted my younger sons paystubs and it was never processed. I was told by the representative that the paperwork was not received by the deadline. I disputed this over the phone and another representative located the paperwork that was emailed 1 day before the deadline. XX/XX/XXXX, I asked that the decision be appealed because the debt to income and payment of arrearage mortgage and current mortgage could have been paid within 6 months if my youngest son 's income was included. I was told that I had to complete another application and in XXXX we were denied again because Carrington Mortgage stated that FHA guidelines would only allow us to catch up 6 months of back and current mortgage. I explained that I could make payments arrangements with my student loan which appeared to be the largest debt. Again I appealed this decision XX/XX/XXXX and was denied. I applied again XX/XX/XXXX and was asked for additional information for both of my sons, this time I provided them with my youngest son 's XXXX account. Additional information was requested and sent on XX/XX/XXXX. Then on XX/XX/XXXX, I was involved in a serious car accident, hit by a driver who was under the influence driving a company 's truck, the other worker who was the passenger died at the scene of this accident. I contacted Carrington Mortgage on XX/XX/XXXX and was told to provide a copy of my insurance who totaled the vehicle out. I also provided information regarding my GAP insurance. I was denied again because now it is nearly impossible to pay the back mortgage and current mortgage within the 6 month time frame that according to Carrington Mortgage FHA will only allow us to pay back mortgage and the current mortgage within a 6 month time frame. I applied for Loss Mitigation again XX/XX/XXXX, explaining my debt to income ratio no longer includes a car payment. Also as a XXXX worker, I can pay a discounted monthly rate towards my student loan. and again explaining that my online loans were settled. and again I was denied for a payment plan. I have lived in my home since XX/XX/XXXX and my family and I do not have anywhere to go! As stated with all of my appeals and refilling for Loss Mitigation assistance if Carrington Mortgage processed my youngest sons income back in XXXX, we would have been able to pay the back mortgage and current mortgage within the 6 month time frame. Instead we are being penalized because the paperwork was not processed nor were we advised properly as to include my youngest son as an additional applicant in XX/XX/XXXX. I understand that I am the one who fell behind in with my mortgage and it is my fault however I want to be able to keep my home and I understand that I am responsible for all outstanding mortgage payments. I filed Bankruptcy in XXXX and decided to keep my home so I do understand my obligation. Please let me know what I can do to save my home.

Complaint: In 2014, my now ex husband and I purchased a home in Arkansas with the knowledge of foundation work being done prior to us moving in and with the knowledge of there being a warranty. I found out that the warranty expired in XXXX of this year. The home is now sinking. We have multiple cracks, some wider than others. One end of the house has dropped almost 3 inches. The other end inside the garage has started to split in multiple places and also inside our laundry room located on that end as well. We have contacted multiple companies and received estimates on how much it would cost to repair and the amounts are in the thousands which we do not have. I have contacted my mortgage company to file for a lien release so we can give the home back and just move out but was told that they could not do that due to the company not wanting to take the loss. The damage to the home is slowly getting worse and the mortgage company doesnt care. My complaint is the mortgage company is refusing to work with us on this issue and as stated above its getting worse and my husband and I do not make enough to cover it

Complaint: Carrington Mortgage is in violation of federal RESPA regulations. All information is being tracked for possible litigation. At issue is a conversation with Carrington Mortgage on XX/XX/XXXX whereby Carrington stated they had up to 30 days to process documents. This is a blatant violation of RESPA which only allows for 5 days. These documents are being submitted today if and everything is not processed within the required time frame a NOE letter will follow for litigation, fines, penalties and attorney 's fees to be paid by Carrington. Maximum fees will be collected. Every time I call, they give me a further out date when it will be removed, when that date approaches and it is not remove I call again and they give me a new date of removal. Complaint: On XX/XX/XXXX, I received a letter from the law offices of XXXX XXXX XXXX XXXX XXXX which is the law firm representing Carrington Mortgage Services (CMS). The letter is dated XX/XX/XXXX and the date stamped on the envelope is XX/XX/XXXX. This letter has an address of XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, GA XXXX. This letter states that a breach was made on the loan number XXXX and their law firm was employed to take action against myself and the property if necessary. It states that I have 30 days to dispute the validity of this debt, or any portion thereof, or the debt will be assumed to be valid. Also, it states the amount of debt is $XXXX and is accelerated and the entire amount of the outstanding balance of principal and interest is declared immediately due and payable. On XX/XX/XXXX, I received a letter dated XX/XX/XXXX from CMS with loss mitigation options and began gathering my documents to submit yet another mortgage assistance application. On XX/XX/XXXX, I received a second letter from the same law firm above stating that a notice of sale was submitted to XXXX XXXX in which a sale of my home will be conducted on XX/XX/XXXX at XXXX XXXX at XXXX County Courthouse. I submitted my latest mortgage assistance application on XX/XX/XXXX via email. Previously, I began submitting request for mortgage assistance applications all the way back in XX/XX/XXXX to present. CMS would either say the application was incomplete and would close it out, that I did not qualify, or some other bogus reason to take my home. When CMS finally said that my application was complete and they would send it to their home retention department, they then claimed the documents were fraud as I was forced to put my elderly sick parents on the application. They told me to appeal if this was not true. I appealed and was told to wait 30 days for their research department to review. I called regularly to obtain status and was told various conflicting information. Finally when the 30 days were up, I called again and was told that there was no such thing as a research department even when I gave them the name and ID number for the representative that stated she was handling the appeal. I have received ill advice and contradictory statements from different employees within the same departments. I exhausted all options that I could possibly think of to rectify the situation with no avail which led me to believe that they were just determined to take this home from me regardless of my efforts. I have countless documentation for over a year now with the various conflicting information I received from different representatives at CMS. I purchased this predatory loan back in XX/XX/XXXX in which the sale price was $XXXX. It has been over 14 years now and I owe just as much now as when I first bought this home. It is very difficult to talk to CMS. Most of the representatives I have encountered have been very aggressive and forceful with their words. I become mentally and physically sick when having to deal with them. I would like nothing more than to rectify this situation. So, I can keep my home but please note that the information the law firm and CMS has as original borrower and owner of record is inaccurate. The personal identifying information provided is not mine. If you need any additional documents, please let me know as I have documents dated back to XX/XX/XXXX when I first began this process and I also have documented phone calls received and made to and from CMS. Complaint: I applied for a VA loan with XXXX and was issued a prequalification letter. I contacted my realtor and went under contract for a house on XX/XX/XXXX. I was currently in a rental and had to be out byXX/XX/XXXX so that the owners could put the house on the market. We asked for buyer possession and we along with my realtor kept asking was everything moving smoothly with the loan along the way and we were told yes. Everything they asked me or my realtor for they received immediately. My realtor contacted XXXX XXXX on XX/XX/XXXX because we were scheduled to take possession on the XXXX and she was told that it was in underwriting and we should here something that day or the following day. I then called and spoke to XXXX XXXX and was told everything was moving smoothly and we should not have any problems. I still didn't feel comfortable so I still waited to the following week to start moving items in the house and had my movers scheduled to come on Friday XX/XX/XXXX with my bigger items. My realtor contacted them again on XX/XX/XXXX because no one has yet to confirm that we had final loan approval and were scheduled to close in a few days on the XX/XX/XXXX and XXXX emailed her back and said my file was still in underwriting and we should have final loan approval today. I then called him later that day to check on the status and I was told that the underwriter did not feel comfortable approving my loan so it was denied. Imagine my shock because now I am homeless and do not know what we are going to do. My realtor gave me the number to 2 local mortgage companies to see if they could help and they both said just solely based on pulling my credit that I should have never been issued a pre-qualification letter. I feel like this company mislead me and had me spend thousands of dollars on moving and inspection expenses by leading me to believe I was qualified to purchase a home. I am a military veteran that served this country and this is the thanks that I get? If they would have been honest with me, I would have just found another rental and fixed me credit and purchased when I was qualified. We have all emails and my realtor also have email transactions from them as well as proof. They left me homeless and ruined my life and will not return any of my calls or calls from my realtor to try to fix the mess that they made.

Complaint: Carrington Mortgage Services , LLC opened fraudulent mortgage loan using our property information and my identity information on the XX/XX/XXXXof XX/XX/XXXXof XX/XX/XXXX. They did not report this loan to my credit history until XX/XX/XXXX. Recently when I found that this loan was opened by my stolen identity information in XX/XX/XXXXand not by any legal business process, I reported a complain to FTC. As a result, Carrington closed the loan for few days. Recently they again opened the loan account and sent me a foreclosure notice for non-payment on this loan. I have made it clear to Carrington Mortgage Service that unless and until they prove that this loan has been opened in XX/XX/XXXXlegally, I would not be paying them any money. Carrington did not provide me any proof of the legality of the loan. Moreover, they changed my property title by executing two forged mortgage deeds. Carrington issued two other fraudulent mortgage loan notes on our property. One was on the XX/XX/XXXXof XX/XX/XXXXof XX/XX/XXXXand the other on the XX/XX/XXXXof XX/XX/XXXXof XX/XX/XXXX. They serviced the loan in XX/XX/XXXX, when they were not even servicer of our mortgage loan. The other loan they are currently servicing since XX/XX/XXXX. Both these loans have been documented in Mers and the forged deeds are also recorded in the XXXX XXXX of Texas.

Complaint: I am writing on behalf of my father who I am the POA for him. On XX/XX/2010, he ( we ) closed on our home. For approximately 2 and 1/2 years we paid our mortgage diligently and on time. Which was around $ XXXX. About 2 years and some, we received a letter from XXXX XXXX XXXX ( became our lender after XXXX XXXX who was the original owner of the loan ) stating that we had to come up with an additional $ XXXX. As our home magically grew legs and positioned itself in a flood zone. There was no way we had that extra money and it was fraudulent placed on us as we continually complain to them that we were not and had never been in a flood zone. We continued to make our regular mortgage payments of {$2500.00} monthly in which they would say they were holding on to it because it was not the complete mortgage amount which they insisted was now approx. $ XXXX. They would continually send us the same paperwork noting the above and at some point they started to send us back our mortgage payments and were told that they weren't going to accept any other payments then what they stated was {$2900.00} with the additional flood insurance cost they were billing us. I researched and got in touch with as many agencies that could assist me in getting to the bottom issue of flood insurance forcibly placed on us. I contacted HUD and complained about the situation we were going through. They went so far as to file a complaint with XXXX and sent me copies of Maps outlining the home proving that we were NOT in a flood zone. At one point we hired XXXX XXXX XXXX who drafted letters to XXXX explaining the above and expressing to them that we would not file legal resources in this matteras we were only asking for the mortgage amount that it was supposed to be minus all their interest and fees and for the original arrears to be added to the end of the mortgage loan. They refused to even contact the attorney back. During this time my father was diagnosed with XXXX that I know was exacerbated because of his fear of loosing the home. During this mess I was diagnosed with XXXX and going through XXXX and XXXX which all put additional strains on us. At one point the bank finally admitted to their error however worded as Congratulations you are no longer in a flood zone! I wanted to scream and yell at them that we NEVER were. They refused to approve any loan modifications always with different excuses that they were missing this or that or that we had to initiate the process again. Then we received what I like to call XXXX 's promise. We received a notification from an attorneys office stating that XXXX had to pay over XXXX XXXX dollars on a class action suit involving the same situation they put us through. Once this was received by XXXX my loan all of sudden now belonged to XXXX mortgage where we had to begin the entire process over despite them having letters from doctors informing them the strain they were putting on us and how negatively it was affecting our health. Then I found out the the " new '' mortgage holder was a subsidiary of XXXX XXXX XXXX. They caused this situation of us being so arrears in our mortgage and we are now being foreclosed on by the lender. I would love to find an attorney in MA who would be willing to help me file a class action suit here in Massachusetts. We are begging and pleading for help to be able to keep our home. They illegally forced this burden on us and are refusing any modification or compensation of any kind.
