Complaint: XXXX thinks I am lying about what I am complaining about. Well, Here 's some proof enclosed that I have, including XXXX help DMs from XXXX, XXXX, XXXX, and XXXX. XXXX said that you weren't going after me, Then how come the note from your Lawyers says " This is a attempt to collect a debt ''? They say different. I may have attempted to drop XXXX a note with my verified info in the mail, because I knew from previous exchanges that is what you always want. I never ever saw that note you sent me. I was trying to act like I knew her so she would respond to me, because getting any kind of customer service from you is like talking to a brick wall. It is impossible. I honestly thought since she didn't respond to my emails writing her would get her to listen. I had no idea that note from her existed. I was attempting to get ANYONE on your side to help me and listen. Then when you do finally I don't get notice of it. Thanks. This fight would have never occurred if you just would have notified me of that note. I had no idea she wrote back offering help. Your poor communication is not my fault. I should not be restricted to only talking to you on the phone in order to get something done. I have told you over and over again that I can't do that. This is all revenge on your part for me complaining too much. I wanted this remedied long before now and you have always refused everything I offer. You're demolishing my life, your demolishing my future. You couldn't care less. Since you've gone so low to essentially call me a liar now, I have a feeling even though I have sent proof you will still call me a liar. I know you don't listen to me at all because in XXXX 's letter she said I was to send the pictures of the front and back of the checks that were refused and sent back because they didn't have any record of them. I did send pictures of the checks along with the first complaint in XXXX. She didn't even bother to look at the proof I sent. You don't care, you don't listen. You would rather see me in trouble then try to remedy anything. You have blamed me for everything and I truly believe this is revenge for complaining so much. If you would have just helped me back in XXXX and solved this then, we would both be happy. I had told her I wanted the debt cleared and off my credit report because of the letter I got from XXXX XXXX XXXX. She didn't acknowledge anything and just said " all the info is correct ''. Not what I asked, and she knew it. No one listens. Don't acknowledge=does n't exist. That is how Capital One works. Also, blame the customer NO MATTER WHAT. I always wanted a settlement but since I hadn't heard from you at all I was attempting to negotiate ANYTHING so it would be on the books. Not fair that you are turning it around to blame me. This is all revenge because I complained too much. You've drug this on for nearly a year. It's enough. Fix this. You've kept me in the dark on purpose. All of this was unnecessary. I have already sent a note to the FIRM and a note to your address in XXXX XXXX XXXX. Do not contact me by phone.

Complaint: This company, claiming to be a credit card company, claims I opened an account with them, a credit card, and are claiming I charged over {$600.00}. I didn't know this until I looked at my credit report. I have never heard of this company, apart from commercials. I have never opened an account with this organization or any of its affiliates. I only possess debit cards from my bank and do not own any credit cards. I have never opened an account, line of credit, loan, et cetera, without my sealing the contract with my wet signature. I never have and never will " sign up '' for anything electronically or online. I have already demanded via email to be shown the contract this entity says I agreed to, opened, initiated. They have yet to show me a contract with my signature thereon to prove this. And again, I have never contracted with this organization in any way. This derogatory entry on my credit report has damaged me. I demand it be pulled immediately, as it does not belong to me.

Complaint: This is regarding my loan with Capital One Bank for my auto loan payment. In XX/XX/2017 my bank did not complete the auto pay and I was out of town. I contacted the bank and they said that if I made the payment via phone ACH that it would not record late. I have made every single payment on time my whole life and they ended up reporting my payment as late XX/XX/2017 My credit report has this blemish and I have no other derogatory auto payment ever reported.

Complaint: On or about XX/XX/XXXX this year I received a letter from XXXX XXXX XXXX, XXXX demanding payment on a debt that is not mine. On XX/XX/XXXX I informed XXXX XXXX XXXX that the debt was not mine and requested that they provide me with all of the documentation that made them believe that it is mine. On XX/XX/XXXX I received the response from XXXX XXXX XXXX rejecting my dispute and insisting upon full payment. It included a copy of a letter from the original owner of the debt CapitalOne Bank to the real debtor and a summary page with the past due amount. Incidentally, all of the bank correspondence to the debtor was sent to an address in Florida. At this point I thought it best to hire an attorney. On XX/XX/XXXX my attorney sent a letter to XXXX XXXX XXXX requesting further information. He specifically asked for a complete executed copy of any agreement between CapitalOne and myself. On XX/XX/XXXX XXXX XXXX XXXX again responded but did not send the information he specifically requested. All he received were more summary credit card statements. The reason that XXXX XXXX XXXX can not provide any proof that it is my debt - is because it simply does not exist. And yet, on XX/XX/XXXX and again on XX/XX/2019 XXXX XXXX XXXX informed the credit reporting company XXXX that this account was in collection under my name. The facts are : 1 ) all correspondence from CapitalOne to the real debtor were sent to XXXX XXXX, XXXX XXXX XXXX CT XXXX, FL XXXX. I have never lived in or even visited Florida. Tax and real estate records will prove this. XXXX own dispute report # XXXX dated XX/XX/2019 validates this. 2 ) I have a history of paying the balance on my credit cards every month and have done so for at least 20 years. I do not let credit card debt accumulate nor do I make late payments. A simple review of our credit history would have verified this. XXXX own dispute report # XXXX dated XX/XX/2019 validates this also. I believe that XXXX XXXX XXXX is in violation of The Fair Credit Reporting Act ( FCRA ) Section 623 by reporting this disputed account to credit reporting agencies after being informed ( multiple times ) that the information is inaccurate. In addition to what I told XXXX XXXX XXXX multiple times, they also have access to my credit history and dealings. Together they would cause a reasonable person to have substantial doubts about the the accuracy of their information. XXXX XXXX XXXX can not provide me with any substantive documentation regarding this account such as the original consumer contract that my attorney asked for three months ago. Once again, on XX/XX/2019 I demanded to see all verifiable proof ( an original Consumer Contract with my signature on it ) that they have on file for this account. Since XXXX XXXX XXXX falsely and maliciously informed XXXX that this debt is mine my credit score and rating have dropped substantially, damaging my reputation and impacting my ability to get future credit. This has caused me great pain and mental anguish. Because of this I have filed a complaint with the Texas Attorney Generals Office ( complaint number is XXXX ) and now with the FTCs Consumer Financial Protection Bureau. I am also now looking to retain a legal firm specializing in consumer protection matters. I will incur further cost to correct XXXX XXXX XXXX ' errors.

Complaint: There is a charge of {$31.00} on my GM MasterCard that happened on XX/XX/2018. I claim that two billing cycles went by after that {$31.00} charge where I received NO paper bill per my account settings. When I noticed an email notification that the account had been frozen I immediately called and paid the account, and requested a review of the paper billing process. I also requested that CapitalOne remove the derogatory information from my credit report, as I feel that either the mail, or the CapitalOne billing system failed to deliver a bill to me. Please note that the delinquent amount reported was for this one {$31.00} charge plus a couple of late fees. There is hardly any reason to assume financial hardship on my part as a reason for the late pay, and furthermore my credit score at the time was better than 800 I've never missed payments in the past. I will attach two rounds of recent communication w/CapitalOne where I once again ( recently ) requested that they remove the derogatory information from my report. The first letter from me is rather lengthy, as I wanted to address the things that CapitalOne representatives told me by phone when I initially tried to resolve the issue late last year by phone. Aside from addressing those phone calls, the essence of request # 1 is " I didn't receive a paper bill, can you please remove this information from my report? ". Their response was to recite a fact that is not being contested, ie " the payment posted late ''. Yes, the payment posted late because I was not billed. The second letter from me is quite brief. I ask CapitalOne directly what is their policy when a customer claims to have not received a bill in accordance with the account settings ( in this case, a paper bill delivered by U.S. mail )? Their reply is quite stunning, as it totally avoids the question that I asked, and simply restates the non-contested information " the payment posted late ''. I do not feel like the responses from CapitalOne lives up to the standards of proper consumer interaction, nor is it consistent with fairness in credit reporting. I am requesting that CapitalOne directly answer my letter # 2 questions and/or remove the derogatory information from my credit report. Thanks for your attention to this matter. Sincerely ...

Complaint: Good Day, XXXX XXXX, XXXX negotiated a settlement on my Capital One Credit Card account dated XX/XX/XXXX for an amount of {$3000.00}. The first 24 payments were to be {$120.00} and the final payment due XX/XX/XXXX is {$120.00}. For some reason, in XX/XX/XXXX Capital one sent me a refund check for the amount of the XX/XX/XXXX indicating " no open account found ''. The first 3 payments in XX/XX/XXXX ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ) were paid on my behalf by the law firm and then I continued payments, always on time for the amount shown via my bank bill pay function. Documents to support proper, complete payments attached to this complaint. When the refund check was received in late XX/XX/XXXX, I sent a letter via certified mail to the Debt Settlement Negotiator of Capital One, XXXX XXXX on XX/XX/XXXX via certified mail ( copy attached to this complaint ). Enclosed with this letter was the Capital One refund check. To date, no written response has been received from Capital One ; however, Capital One is now negatively reporting this account on my credit reports. Please help. I want to pay the remaining payments as agreed to this creditor. Many thanks!

Complaint: In XX/XX/XXXX, my primary bank account where the payments to my Capital One credit card came from was compromised in a fraud attack so the bank transferred my money to a new account. At that time the credit card payment day ( Capital One ) was made and the payment was declined. After 3 days from the new bank account I paid the entire credit card statement. I have always paid the full amount of the card statement. I understand that for that specific month the have to charge me interest and it is ok ; but now Capital One continues to charge me interest on the monthly amounts of my card without my balances having more than 30 days which is unfair if I do not charge balances without paying from one month to another. Today, XX/XX/XXXX, I called to be explained and the supervisor XXXX XXXX tells me that they would continue to charge me for the next 2 cycles for the XX/XX/XXXX delay problem. I told him that it was unfair because if they had told me that I would not have used the card in the coming months. In addition, it is not fair that they charge me interest for amounts that do not take more than 30 days. She told me that on page 2 of the card statement it said that and that is LIE! I read her what she said and that is never mentioned, so she answered that even though it doesn't say it textually there in writing, that's how they execute it. This is totally unfair. I should not pay interest for money that I don't owe them.

Complaint: XXXX sent a cheap battery in place of the real bicycle battery I ordered and tried to say they sent the right one. They even sent Capital One Bank a picture of the right battery!! Capital One first credited my account for the money, but then recharged it. When I sent them all the pictures that they requested and all of documentation, it seemed it just wasnt never enough. Every time I sent them documentation, Capital One would request more or state that it was wrong. I spoke with them and they insisted that it had to be on letterhead, but the letterhead that the XXXX and XXXX XXXX provided was what they used and it wasnt regulation letterhead so it wasnt good enough for Capital One. I tried to explain to Capital One that not everyone has printed letterhead, but no one listened. A lot of shops print their letterhead on their printers. Needless to say, my dispute case was dismissed!! This is the water downed version of what happened. Each month, Capital One requested something different. But no matter how many hoops I jumped through, it was never enough.

Complaint: Capital One Bank offers overdraft protection. The line of credit account is listed along with the checking accounts. The full-service access online and the mobile app allow the transfer of funds between all accounts entrusted to Capital One. Over the last two payment cycles, the online ability to transfer money and pay off the line of credit has not been functioning. You can choose the " account from '' to begin the transfer process but the " account to '' does not include the line of credit account. I called and alerted Capital One. They informed me that Capital One is having issues with the feature, which allows customers to transfer money and pay down their line of credit. After I paid the balance over the phone, I registered a complaint with the Capital One customer service representative. I informed them that the inability for customers to complete the transaction online is suspect and that " it was convenient for Capital One to sit on this money and draw interest. '' The representative said that there was a way to pay by calling customer service. I responded by informing the customer service agent : 1. At no time was I informed that Capital One was having issues with the online feature, which allowed me to pay down my line of credit through the online transfer of funds option. 2. At no time was I informed via email or some other mechanisms while in the act of transferring funds online that the feature was not working and to call customer service. Capital One is not informing their customers about issues with the online transfer of funds and causing unsuspecting consumers to become delinquent. In addition, I feel I have the right to pay off the balance of my line of credit, and if there are technical issues with the ability to do so, Capital One should inform their customer immediately as to how to proceed.

Complaint: On Thursday, XX/XX/2019, I received an email saying that my email and home address had been changed on my two credit card accounts. I contact the credit card company immediately and spent an hour on the phone with them. They assured me everything was changed back and a restriction was put on my account. I asked specifically since I was on the phone right away that these cards would NOT be sent out. She assured me we caught it on time. I made sure BOTH the accounts were fixed and she said yes. Now 14 hours later I get another email from them stating that my cards were XXXX XXXX XXXX to the fraud address in Florida AND they charged my account a rush fee, {$16.00} each, for both cards on my account. I contacted them and told them and they act like they have no idea what is going on. I called XXXX XXXX and they said the only person that can stop the delivery is Capital One, yet they act like they don't know who to call XXXX XXXX to stop this delivery. I did my due diligence to try to protect my identify and they did nothing. I have been on the phone twice with them and they did nothing. I begged them to call XXXX XXXX to have this delivery canceled and they refused. They acted like they had no idea how to reroute a package when XXXX XXXX told me all they had to do was call and stop the shipment.
