Complaint: I called the bank again, for the 5th time and asked for their fraud department. After 2 hours of transfers and over seas representatives who argued with me, I got a manager at the US call center that handles issues like this.
Her name is XXXX at XXXX, dept XXXX, ext XXXX I sent her a copy of the letters from Capital One addressing the removal of the item that is not mine off of XXXX who has continued to re-report the item and keep it in dispute way beyond the FCRA 605B rules.
The first letter was sent to me last XXXX by the executive offices in Virginia and I will enclose a copy of that too.
She promised to fax me back a letter of removal confirmation and to make sure this time it is expedited. No reply yet.

Complaint: Capital One failed to follow mastercard policy and the law regarding my dispute with XXXX, aiding XXXX in defrauding me.
I was charged {$99.00} despite having cancelled a service before the billing date. The service was online classes and I did not access any content. There is no way to reach a human being at XXXX so I asked for Capital One to initiate a dispute. They did so but pursued it incorrectly, so I have paid for something I both cancelled and did not receive. I did not receive any notice from XXXX that I was charged, and I discovered it only in my credit card statement.
Capital one asked me to prove that I cancelled. I cancelled online via XXXX 's system, meaning that I rely on them entirely to send or otherwise provide proof. They did not do this, and lied saying it was not cancelled. I believe this is intentional rather than computer error but I don't really know. When I logged into my account, it showed cancelled and asked me to sign up, proving without a doubt that I had cancelled and had not access to the paid content. I told Capital One all of this, but still they chose to assist XXXX in ripping me off. In addition, I discovered that I was getting all emails from XXXX in duplicate, which may mean that they accidentally duplicated something and only one got cancelled. Not sure, but clearly something wrong.
I was forced to pay for something I cancelled, never accessed, and then told I had convince the scamming merchant to admit cancellation or just accept being defrauded.

Complaint: On XX/XX/XXXX. XXXX during the process of buying a house I wrote check # XXXX to XXXX XXXX for {$50.00}. This check was never cashed. I have been showing it outstanding since then. I have been balancing my check book each week due to all of the auto drafts that come out of my account. Since that date I have always had to show this check as outstanding in order to balance.
On XX/XX/XXXX. XXXX, My {$50.00} OUTSTANDING MONEY WAS GONE. I could no longer balance my check book since the money was no longer in my account. If I added it back into my account as an outstanding check I no longer balanced. I was then over {$50.00}.
I called the bank Capitol One customer service on XX/XX/XXXX. XXXX and spoke with some lady for about 30 minutes. She could not understand that the money should still be there and she could not explain to me where my {$50.00} dollars had gone.
I then requested to speak to her supervisor and she switched me over. After about 10 minutes he didn't seem too concerned and he could not tell me where my money was at either. When money comes up missing that is THEFT to me.
